If there’s one topic guaranteed to raise the temperature on these biting winter days, it’s asking an estate agent or homeowner about the good old Home Information Pack. Almost all of us, it seems, are dying for a HIP replacement. Zoe Dare Hall delves deeper
12 property news
LONDON HOMES & PROPERTY
F
or those who have stayed put for the last two years and haven’t yet encountered the pleasure, HIPs – also known as Hopeless Information Packs by many a bitter vendor were launched in 2007 as a set of documents designed to provide the buyer with key information on the property and to speed up the buying and selling of property. Initially designed for properties with four-plus bedrooms, then three, now every property must have a HIP before it can legally be marketed for sale. Inside are several documents, including an Energy Performance Certificate (the element most routinely disregarded by buyers), a Property Information Questionnaire (PIQ), local authority searches, evidence of title, leasehold information and (if a new-build home) sustainability information, to be compiled by the vendor, an estate agent, solicitor or HIP provider. The idea is to provide all the information a buyer needs at the start of the process, so that fewer sales fall through. So where does it go wrong? And are the HIP’s days already numbered? For many, the big problem is one of unnecessary cost. “HIPs have acted as a mechanism to generate money for the government and for agents and other providers to charge a hefty premium on the service,” says TV presenter Sarah Beeny of this half a billion pound-a-year industry. “I’ve seen HIP providers charge up to £800 when you can get one through Tepilo.com for £186.” One disgruntled vendor, 35-year-old commercial consultant John Weston, thinks his HIP was a pointless expense. “We paid £380, which seemed like a lot of money for searches that will be out of date before the end of the sale purchase and for information that the buyer would have paid for in the past,” says Weston, who has just sold up in Surrey to buy a family home in East Sussex. “Our buyer didn’t use the HIP anyway,” he adds. “They relied upon the information received through searches conducted by their solicitor and the full structural survey they carried out. The surveyor, our own solicitor and the buyer’s solicitors all asked questions that we had already answered in the HIP. And, as buyers, we were amazed how estate agents didn’t actively share the HIPs for properties we viewed. In short, a total waste of time and money.” It certainly seems pointless when much of the information is available to buyers online or through the Land Registry. “And I would still probably get my own buyer’s survey done. In many cases, you’d need to for your mortgage provider anyway,” says Sarah Beeny. The information contained within a HIP isn’t always to be relied on either. “I bought a flat in December 2008 and as an exercise requested a copy of the HIP,” says Penelope Court from Beauchamp Estates. “My solicitor couldn’t use it as it was inaccurate even to the point of lacking the correct lease. And it failed totally to uncover
the fact that works had been carried out without the landlord’s consent, which meant I had to enter into a conditional contract.” Don’t expect energy assessors to be quite up to speed with aesthetics either, says Douglas Kent from the Society for the Protection of Ancient Buildings, who says HIPs may actually be harming our old homes. He recently bought a Grade I listed, 15th century house in Essex and, after an unflattering EPC, was told by the assessor that he could improve the property’s energy rating by adding some new external cladding – despite the property’s elaborate external plasterwork being one of the reasons it is Grade 1 listed. “He even said it would improve the appearance of the building,” says Kent. “In another case where a house had a thatched roof, the energy assessor ignored the thatch as insulation because he said it wasn’t on his software – even though thatch can be one of the best insulators.” So what is the alternative? “An in-depth conveyancing pack which was really ready to go and held some weight with solicitors and mortgage lenders,” suggests buying agent Tracey Kellett from BDI Home Finders, echoing the Tories’ plans. Or something like the Scottish Home Report, says Barbara Pentecost from Smiths Gore chartered surveyors in Berwick-Upon-Tweed. “I see both the Scottish Home Report and the HIP in action and I have to say, NO ONE looks at the HIP,” she says. “At least the Home Report has a single survey element, which gives the buyer a reason to be interested and can be used as a mortgage valuation. Some buyers still get surveys, but not until their offer has been accepted in principle.” Or we could just return to how we used to do it before. It sort of worked after all, with the buyer and vendor each represented by a solicitor who is legally responsible for the advice they give. Amid all the dissent, there is one lone voice in favour of the HIP. “If we scrap HIPs, we are still likely to need the Energy Performance Certificate, so sellers’ costs won’t really be reduced. They will just have less information to give buyers,” says Kate Faulkner, director of the independent advisory Designs on Property, whose First-Time Buyers Pack highlights the benefits of a HIP, particularly for those just entering the property market. “A HIP can help you to budget more precisely, for example gas, water and electricity bills, ground rent or service charges. You can see what might affect your decision to buy the property, such as it’s too expensive to heat or is prone to flooding, and what might affect how long it takes to buy, if the Title isn’t fully registered, for example, or there is missing planning consent,” says Faulkner. “HIPs are being used as a political football,” she adds. “While they are a legal requirement, we should be arguing how to make them effective for the industry and consumers, rather than whether to have them or not.” property news 13

Riverside living in the heart of Greenwich London & Regional Properties and King Sturge will shortly be launching Lovell’s Wharf, a low-rise and light-filled development within walking distance of Maritime Greenwich and with exclusive access to the Thames. The completed development consists of 29 spacious apartments, from 1 to 3 bedrooms and including penthouses, Lovell’s provides unique views of the river, high-specification contemporary interior finishes and up-to-date environmental credentials. A village in the City If you’ve been dreaming of a riverfront apartment with stunning panoramic views and a genuine Greenwich address, then you will not be disappointed at Lovell’s. On weekdays, the unique location gives you easy access to Canary Wharf, the City and the West End thanks to DLR, rail and Riverbus connections close by. At the weekend a short walk along the Thames Path brings you to Greenwich Village, its Royal Park, historic buildings, markets, traditional pubs, modern bars and many restaurants. In addition to stunning uninterrupted river views Lovell’s gives the feel of a residence designed for outside living. Tidal gardens, a central square, large balconies and terraces mean residents can live in harmony with their surroundings; and the development’s environmental credentials include green roofs and ground source heat pump heating. Once inside you quickly realize that the apartments are 20 to 30% more spacious than the other developments that have been on the market in the area over the last 3 years. Geoff Springer, Development Director with London and Regional said: “We build homes for people to actually live in so we make sure that they are all substantially more spacious than the average new build flat size. The fantastic outlook over the river from all the apartments, coupled with the facilities on its doorstep such as Greenwich park and the village, will make Lovell’s such a superb place to live that we’d be happy to live there ourselves”. History and heritage Lovell’s is the latest example of the regeneration of former industrial wharves. In the 19th and 20th centuries, the names of Lovell’s, Granite, Badcock’s and Pipers Wharves would have been familiar to river travellers and the residents of Greenwich. However, the line of wharves excluded direct access from the local streets to the river itself. Today Lovell’s opens up the river to its own residents and neighbours in the East Greenwich Conservation Area. An extension to the Thames Path at Lovell’s has been designed to link Greenwich Peninsula (including the O2 entertainment centre) with the historic buildings of the Maritime Greenwich World Heritage Site. • • • •
Bright and spacious 1, 2, and 3 bedroom apartments Stunning 2 and 3 bedroom penthouses High standard of interior finish Excellent eco-homes rating
The apartments are marketed by King Sturge and Max Wilkinson, Partner at their Canary Wharf office, added: “Lovell’s Wharf represents an opportunity to acquire a stunning new home that one can truly enjoy living in. Lovell’s is located on a historic part of the Thames and gives panoramic views of the River Thames and Canary Wharf skyline. Lovell’s is respectful of its location’s heritage, yet built for the future”.

easuring in excess of 1,500 square feet this huge apartment is packed with original warehouse features including large restored windows, exposed ceiling wood beams and
original doors. Senior branch partner, Adam Wolfryd comments; “Warehouse apartments are extremely rare in this part of London. Each apartment within this building has been individually designed giving buyers the chance to acquire a unique home. “Apart from the huge amount of character a warehouse apartment offers, this apartment also has an abundance of space as well as a large terrace perfect for summer entertaining. bespoke interior is finished to the highest of standards and comprises of two large double bedrooms, study, huge kitchen diner and a large living room. Furthermore, there are two secure car parking spaces included within the price.” This property certainly does stand out from the more contemporary developments around The Docklands and buyers looking for something a little different should certainly view this apartment quickly as warehouses of this nature do not usually stay on the market for long. n For more information, please contact the sales team at Felicity J Lord on 020 7987 6776

STATE OF THE MARKET PROPERTY MARKET GROWTH IN 2010?
ANGUS EDY OF MOVELLO COMMENTS ON THE RISE OF NEW DEVELOPMENTS IN CANARY WHARF
ALASDAIR CARPENTER OF LOURDES ESTATES COMMENTS ON THE STATE OF THE RESIDENTIAL PROPERTY MARKET
The Canary Wharf property market has started the new decade with a splutter as heavy snow has dampened people’s appetite for getting out and viewing new property both for sale and rental. But with the dire weather behind us we can start to confidently look forward to the year and decade ahead. One of the first events of the Canary Wharf property calendar will be the re-launch of Indescon Court in Canary Quarter by developer Galliard Homes. After successful relaunches at Wharfside and Barking Central, I’m sure the marketing will be along similar lines with big discounts advertised to savvy buyers due to non completion of previous investors. The outlook for property prices in the area looks positive with pent up demand and lack of supply combining to put upward pressure on prices as well as the regeneration benefits on the 2012 Olympics around the corner. My advice to sellers is “don’t wait for the Olympics to sell”. By then it may well be too late. There is a window of opportunity to sell to people hoping to benefit from an uplift in prices due to the Olympics, but the longer you leave it, the less benefit there is to buyers. The regeneration underway for Stratford and surrounding areas will help prices and I think everyone is looking forward to having our own Westfield’s shopping centre on our doorstep! The improvements to transport will also impact on prices. Barratt Homes is also making positive noises, announcing recently that they will be starting work on eight new major developments in London. Rightmove recently announced that property stock levels are at their lowest level for a century. This only adds to the notion that now is the right time to sell if you have been putting it off.
In 2009 the property market began to recover after the devastating 2008. Further gains are expected in 2010 as the Bank of England base rate remains historically low and consumer confidence in the housing market grows. The Docklands property market was particularly affected by the economic downturn due to its reliance on professionals from the financial services industry. Banks have now stopped the wholesale reduction of staff numbers and have in fact started recruiting again in many departments. Several financial institutions have announced the return of bonuses and some at record levels. This can only aid the recovery of the property market. Both transaction levels and prices increased in the second half of last year and this momentum has driven into the New Year. The major obstacle to transaction levels in the Docklands property market over the last six months has been the lack of available property. Buyers in some areas were left with little or no choice restricting the turnover of properties. However, if early indications are anything to go by, the restricted supply of property to the market could be about to change. Potential vendors seem to have finally come to terms with the fact that the sales market has made a considerable recovery since the decimation caused by the credit crunch and subsequent recession. Estate agents have been voicing this message for months and now finally the advice is being taken. Our sales team made more valuation appointments in the first week of January than they did in the six weeks preceding Christmas. Prices should continue to rise in 2010, all be it slowly. There will be more choice for potential buyers and as confidence grows and normality returns we will see the emergence of investors and first time buyers. According to the Council of Mortgage Lenders (CML) this year will also see an increase in the amount of available mortgage finance with lenders actually competing for business for the first time since the end of 2007. Providing the interest rates remain low and funding is available on reasonable terms, property purchases will remain on the agenda for many who have been waiting in the shadows during the last few years.

LONDON HOMES & PROPERTY
FixTuRES or FiTTiNgS
– What is the difference? Rebecca Bozier, partner at Gawor & Co Solicitors looks at the “non” legal matters that can cause the biggest delays and upset in the conveyancing process
W
hen buyers and sellers of a property cannot agree on what should and should not be included in the purchase price and on what basis offers to buy the property were made the exchange of contracts is consequently delayed whilst the wrangling over fridge freezers and the like is resolved. Worse still, on the day of completion the purchasers move in only to discover items that they thought were being taken have been left behind (often because of the pure difficulty of removal) or vice versa. When viewing a property it is not always clear what is to be included and often the first time the matter is addressed is when the fixtures and fittings form completed by the sellers is supplied as part of the conveyancing process. It is only then that the importance of the distinction between a “fixture” and a “fitting” becomes apparent as their classification directly relates to their inclusion or exclusion from the sale and, consequently, the redress if any, available to the aggrieved party. In the absence of express agreement, there are legal presumptions that provide guidance as to the distinction between “fixtures” and “fittings” and this focus on the degree and purpose of annexation. “Fixtures” are generally items which are attached to and form part of the property, i.e. boilers, radiators, fitted units etc unless expressly excluded. Alternatively a “fitting” or “chattel” does not form part of the property, for example carpets and free-standing furniture. Unfortunately in the absence of agreement between the parties, whilst these legal presumptions exist, their application in practice is far from clear cut and case law has been required to settle disputes over items such as kitchen appliances, wood flooring, garden ornaments and greenhouses to name but a few and the cost of resolving an issue relating to 38 market comment
such matters quite often proves more costly than the subject matter of the dispute! Another related issue relates to the apportionment of price between “fixtures” and “fittings” and the contractual purchase price of the property. The sale of fittings does not attract stamp duty land tax and therefore the apportionment issue raises its head when the price of a property is close to one of the current stamp duty thresholds. It has been known for buyers and sellers to produce lists of “fittings “ with part of the purchase price being apportioned to them. It is essential that any such list is representative and not artificially inflated. Any overvaluation of the chattels is a fraud on the revenue and as such ultimately the contract could be rendered void on the grounds of public policy. Once buyers and sellers have agreed the chattels included in a sale, it is important to remember that the contract takes effect as a contract for the sale of goods and as such ownership passes on completion and the items must be transferred in the same condition as they were at exchange i.e. if they were working/undamaged on exchange then they should be working/undamaged on completion. Secondly, that the seller must make good any damage caused to the property following removal of an excluded item. In order to alleviate some of these difficulties a fixtures, fittings and contents form should always be completed and annexed to the contract. This is not a very substantive form and is best completed on an inspection of the property including the garden, rather than from memory, so as to ensure that any additional items are referred to where appropriate. If you are unsure as to whether an item is deemed to be included or excluded then please speak to your solicitor for advice and ensure that the item is accounted for – it will save an awful lot of time, aggravation and cost in the long run. n Gawor & Co Solicitors New Crane Wharf New Crane Place Wapping, London E1W 3TS 020 7481 8888 www.gawor.com

HEARTS & FLOWERS A flutter of romance is in the air as we float our way into February. There’s the usual array of hearts and flowers but Dawn Sandoval encourages you to look a little further and you will find a magical selection of wonderful products to add a subtle twist of romance to our fashionable dwellings
Designer Focus: Barbara Hulanicki After founding influential retail chain Biba in 1964, Barbara Hulanicki has been making an impact on the fashion and interior world ever since. Barbara’s latest project sees her collaborating with Graham & Brown with her first wallpaper ‘capsule’ collection inspired by her passion for Art Deco. The range features five new and exclusive designs – Antoinette, Shoes, Skulls, Baroque and Ophelia – all synonymous with Hulanicki’s dramatic signature style. The collection marks the second wallpaper collaboration with Graham & Brown and Hulanicki, featuring 12 striking colourways including Hollywood cerise, burnt orange, purple grape and petrol tones - mixed with opulent metallic’s, echoing Hulanicki’s high fashion heritage. “I jumped at the opportunity to work with Graham & Brown. They are the best and most fun to work with. This time however I wanted to give traditional flock a distinct modern twist. The old Victorian flocked wallpaper has a fond memory for me from Biba days when wallpaper was a very important product in our household department. Influenced by nostalgia and my home in South Florida, I have created a range which encapsulates humour, style and versatility.” www.grahambrown.com

FIXED or TrACKEr: which is the best type of mortgage rate? Ron Radway, Independent Mortgage Consultant at OneCall Financial Advice Centre, brings us up to date with the mortgage market
I
’m often asked this question – and the answer is neither. It’s not a question of which one is better, but rather, which type suits the applicant emotionally. By this I mean that if one is of a cautious nature, they will prefer to know where they stand and would opt for a fixed rate deal. However, if your nature can accommodate the movement that a tracker rate mortgage implies, you could happily choose the lower initial rate that usually comes with a tracker. It isn’t a question of ‘winning the bet’ as advocated by most mortgage pundits. They, typically, are reporting on the current moment in time, with assumptions of future rate movement, when they are patently not clairvoyant. Pundits, like economists, are blessed with 20-20 hindsight and are focussed purely on the figures. And, driven by their own temperament, are unable to factor in human nature. In my own experience, all my clients who took a tracker over the past couple of years think I’m the greatest thing since sliced bread, whilst those on fixed rate mortgage spend their evenings sticking voodoo pins in me. However, the reality is that I did not pick for them, they chose. I merely pointed out the pros and cons of both options, and in the end their own personality made the decision. I do now point out to the ‘Happy Trackers’ that they shouldn’t be so smug, as rates from now on are only going to rise (it’s only a matter of time). And to those on a long term fixed deal – it’s likely that you will have the last laugh! So, in summary, the answer to the question is that as very few of us are able to second guess future market movements, a right or wrong
short term decision has little bearing on a long term commitment - so just do what you are comfortable with.
ASK THE EXPERT
Q: I applied to my bank for mortgage, and was declined on the grounds I was self-employed. Is this right? A: A categorical ‘no’! You either misinterpreted the answer, or were badly advised, both of which are not uncommon, given the source. The reality is that lenders are quite happy to advance to the self-employed, the problem is how they view the earnings. The applicant will, typically, refer to their turnover as earnings, whilst the lender will look at the ‘Net Relevant Earnings’, (i.e. turnover minus business expenses). This is a largely different figure (or it should be if you have a dynamic accountant), which will throw out the lenders’ income to loan ratio drastically. They will also look at turnover and profit historically, and if showing a downward trend may still decline, even if income criteria is met. Company Directors and those employees whose remuneration is bonus or commission biased have similar problems. Not all lenders take the same exact view, or even underwrite consistently, so an applicant in any of these categories will need a nudge in the right direction. n OneCall Financial Advice Centre offers impartial advice on mortgages, loans, insurance, equity release and debt rescue. ON TOP OF THE WORLD A spectacular ceremony in Dubai marked the official opening of the world’s tallest building, the Burj Khalifa, Chelsey Baker reports
46 property news
LONDON HOMES & PROPERTY
T
owering high above the Dubai skyline sits the tallest man-made structure on earth which, after six years in the making, truly stretched the limits of architectural endeavour to recordbreaking levels. The Burj Dubai, as it was formerly known, was renamed the Burj Khalifa at the opening ceremony in honour of the ruler of Abu Dhabi, Sheikh Khalifa who came to Dubai’s rescue during its financial crisis. Measuring a staggering 828 metres (the official height kept quiet until the launch) from its base to the tip of its spire, the Burj Khalifa is home to more than 1,000 apartments, 37 floors of office space and a hotel designed by Georgio Armani which includes a nightclub, two restaurants and a spa. With more than 200 floors, of which 160 are inhabitable, the concrete, steel and glass structure is officially the world’s tallest building, having beaten the previous title holder, Taipei 101 in Taiwan by some 1,000 feet. To put it into perspective, the Burj Khalifa is the height of Taipei 101 plus the Eiffel Tower. The tower was kept shrouded in darkness until his Highness Sheikh Mohammed Bin Rashid Al Maktoum put a new spotlight on the world map. To launch the illumination of the tower skydivers carrying UAE flags landed directly in front of Sheikh Mohammed, who was also celebrating his fourth anniversary of becoming the Ruler of Dubai on that very day. The first act drew prominence to the rare Hymenocalis desert flower, the architect’s inspiration for the design of the tower. After projecting the birth of the flower on to a large 1,000sqm screen, a water show from The Dubai Fountain accelerated the event with water shooting 150 metres into the sky. The second act, ‘Heart Beat,’ captured the construction of the tower in a dynamic light show with an astonishing example of technological innovation; the display recreated the effect of a beating heart and used 320 space canon projectors to generate a shadow effect on the tower reaching 10km into the sky. The finale featuring an impressive show of 10,000 firework effects estimated to be the highest ever, reaching 850m.
Tickets to the ‘At the Top’ Observation deck are now on sale and access to the triumphant tower begins at ground level in the nearby Dubai Mall, the world’s largest shopping centre. Television screens chronicle the history of Dubai and the story of the Burj, whilst high-speed elevators transport tourists to the observation deck on the 124th floor. Skidmore, Owings and Merrill (SOM), the Chicago based architects, have long paved the way for modern glass box skyscrapers. SOM has already designed five of the world’s tallest buildings including the Sears Tower (a previous holder of World’s tallest for over twenty years), a little closer to home they designed the Broadgate Development as well as the master plan for Canary Wharf and many other leading developments in London. Is it possible that there will be a successor to the Burj Khalifa? Of course, in the UAE anything is possible. n www.atthetopburjdubai.com
Towering FacTs •
The amount of steel used for the tower is 31,400 metric tons; laid end to end this would extend over a quarter of the way around the world
•
The cladding contains over 24,000 individually cut glass panels
•
The curtain wall area of the building is equivalent to 17 football fields
•
The concrete used is the equivalent to the weight of 100,000 elephants
•
At the peak of construction 12,000 workers were on site every day
•
It is the tallest building and freestanding structure in the world
•
It has the highest outdoor observation deck in the world
•
The tip of the spire can be seen 95 km away
•
The 160th floor is the highest occupied floor of any building in the world
•
The elevator reaches the observation deck in less than 60 seconds
•
It will take a team of 36 window cleaners three months to wash all the windows

LONDON HOMES & PROPERTY
DESIRABLE LOCATION
AT AN AFFORDABLE PRICE
We are told that location, location, location is always the key and there may be some truth in the old cliché. Of course, in the real world in which most of us have to live, you can substitute at least one location with ‘affordable price’
R
arely do you come across location at the right price – which is a very good reason for giving The Square in Rifle Street, E14 your undivided attention. These great one and two-bedroom top-floor apartments, all with balconies and some with fantastic views of Canary Wharf, are available from just £189,995. Built around a beautifully designed central courtyard, The Square is superbly located less than a five-minute walk to the new Langdon Park DLR station. From here, the world is your oyster with convenient links to the West End via the Tube, The City via DLR or Europe thanks to the nearby City Airport. Canary Wharf is now almost a city in a city, though in truth it’s more urban village than city in its neighbourly feel, with a huge choice of shops, restaurants and other leisure facilities right on your doorstep. Of course, highly desirable though a fantastic location is, your apartment is where you will live (well, it will be once you can drag yourself away
62 market comment
from your favourite restaurant or wine bar) and the apartments at The Square won’t disappoint. The kitchen – which we all know is where we spend most of our time, even if we’re not cooking in it – has Manhattan Latte Gloss units, laminate flooring and a Zanussi stainless steel gas hob with electric oven and extractor hood. The twobedroom apartments have an en-suite shower room as well as a bathroom, while there are BT points to the living room and bedrooms with an additional point providing a home office facility – perfect for those days when, even with such fantastic travel links to work, you just don’t fancy leaving home! The communal gardens (all the pleasure, none of the work) are complemented by a bicycle store so that you can easily explore the nearby calm of the River Lea. Heather Clarke, from Site Sales Marketing, says, “These apartments offer that rare combination of desirable location at an affordable price. You really have got everything you could possibly need in terms of business and pleasure right on your doorstep, yet the prices are incredibly good value for this part of London. Interest is very high and, with only a few apartments remaining, I would urge anyone thinking of buying in this location to contact us for a viewing.” n For further information, please contact Site Sales on 020 8502 5758 or by visiting www.site-sales.co.uk
