VLP trains attorneys to take on child support cases to help low-income Brooklynites By Rob Abruzzese The Record
Many low-income Brooklynites dealing with child support issues will be able to get help from the Brooklyn Bar Association Volunteer Lawyers Project (VLP). The VLP held a continuing legal education training session on the subject at the Brooklyn Bar Association on Monday, April 8, that was free for attorneys if they agreed to take on a case pro bono. The two-hour lecture was entitled, “Determination and Modification of Orders of Child Support in Family Court,” and featured attorneys Sidney Cherubin, director of legal services for the VLP, Joanne Reece, staff attorney and head of the Family Law Section of the VLP, and attorney Patrick R. Garcia. The training session was open for all attorneys, but was specifically geared toward more inexperienced attorneys, or ones looking to get into new areas of the law. “We assist low-income residents of Brooklyn in various areas including bankruptcy, consumer debt, foreclosure, uncontested divorce, custody visitation, wills, advance directives and child support,” said Anne O’Grady, pro bono director at the VLP. Monday’s speakers took turns going over various aspects of child support cases.

There are three methods, he explained, that the courts use to determine paternity. “One is if the child was born when the parents are married,” Cherubin said. “The second is order affiliation where someone has filed a petition in the court and the court has determined that the father is the actual father of the child. one else. “We see it all the time where acknowledgements are signed by the actual biological father and not the legal father,” Cherubin said. “When we’re dealing with divorce, we explain to people that if someone else signs that acknowledgement of paternity and later on goes to court and says I’m not the father, she was married to someone else when I signed this, that can pose a problem.” In discussing modifications to child support orders, Reece explained that timing is key and that attorneys should file petitions for modification as soon as circumstances change for their clients. “I’ve seen cases where someone was out of work, they lost their job in January, but they don’t file until June because they were optimistic and thought they would find a job sooner than they did,” Reece said. “The court can only give them relief from June even though the change in circumstance might have taken place in January because that’s the date they filed the petition.” The VLP hosts regular CLEs for attorneys free of charge if they agree to take on a case for free. Its next training session will be a naturalization clinic at Borough Hall on April 23 at 5 p.m. Attorneys who attend that event will be trained in the eligibility requirements for naturalization, the standard for a waiver of the filing fee, and how to complete the Application for Naturalization.
Brooklyn Bar Association gives tips for estate planning in the digital age By Rob Abruzzese The Record
Technology has had many intended and unintended consequences over the years and as it takes over more of our lives, trust and estate attorneys are taking more consideration of digital assets and what happens to our online accounts after we die. Dan Antonelli, the vice chair of the Brooklyn Bar Association’s Trust and Estates Section, has certainly taken notice. “From what I see, there is a question as to whether you can get into people’s email accounts or social media accounts after they die, and for what reasons,” Antonelli said. “There is a distinction between digital assets in your iPhone, like photos, and emails, which are more of a communication than an asset. The law isn’t clear on what executors have access to and when.” To help clear up some issues, the Brooklyn Bar Association hosted attorney Robert M. Harper, from the law firm Farrell Fritz, P.C., to give a continuing legal education lecture entitled, “Death
Gets Digital: Your Password Won’t Expire Even When You Do,” at the bar association on Remsen Street on Wednesday. “For attorneys who are drafting wills for clients it’s going to educate them about the best way to fulfill their wishes,” Antonelli said. “Do their clients want other people to read their emails? Maybe there are old love letters in there, or other sensitive materials, so maybe they do, maybe they don’t. If you specify in the will, that is your best chance at accomplishing your clients wishes.” The two-hour lecture was an attempt to answer as many questions as attorneys who attended had and also help them to avoid some of the unanswerable questions. For many attorneys in attendance at the lecture, this is something that went from a hypothetical question just a few years ago to one that comes up often in their practice. Antonelli recalled the first time he was litigating a will and wanted to gain access to a person’s email account to determine
if the person intended something to be a gift left in the will or not. When he contacted Google to try to gain access to the account, he was denied. “There aren’t clear answers for the questions surrounding the topic,” Antonelli admitted. “I’m working on a case against Facebook and Google where we’re trying to get information that we know they’re not going to give to us so we’re looking at potential discovery decisions. I don’t know if I’m going to win, but at least we can make some law and we’ll have an answer one way or another.” Unfortunately, Harper didn’t have clear-cut answers either. A big part of the problem is that these issues haven’t been addressed by the courts before and have largely been completely ignored by both state and federal legislators. “What is a digital asset?” Harper asked rhetorically. “The answer is not clear-cut. There are courts here in New York that describe digital assets as intangible property. That answer, in my view, leaves a lot to
be desired. We have to be mindful of the fact that while the development of digital assets and technology is going full steam ahead, the law is not keeping pace. We’re only now finally getting cases that address digital assets in a trust and estates capacity.” That doesn’t mean that Harper didn’t do his best to explain the current case law that is available and recommend best practices that he thought attorneys should follow to try to prevent issues from arising. He also passed along four “best practice” tips for estate planning in the digital age. His first tip — advise clients to select fiduciaries who are comfortable dealing with digital assets. Second, draft estate planning instruments to address digital assets. Third, instruct clients to back up all data, email and any digital assets they can regularly so that they don’t need to be retrieved by another person after their death. Finally, suggest to clients that they attach digital assets in the names of their corporate entities rather than their own names when possible. The law that shields police records, explained Everything you need to know about 50-a and the campaign to repeal it By Jake Bittle The Record
After years of pressure from activists and government officials, New York’s state legislature this year may finally repeal a law that shields police misconduct records from public view.
But legal organizations and activists argue that the law as written is too vague. In practice, they say, state courts have set a broad precedent that allows the police to conceal nearly all police records from public view, exempting officers from transparency standards applied to other public officials.
Why do they want it repealed? Over the past five years, criminal justice activists have focused not only on acts of violence by individual police officers but also on the willingness of department leadership to forgive, ignore or even cover up officer misconduct.
With a Democratic-controlled state Senate, lawmakers have their best chance in years to revise 50-a or eliminate it altogether. The law, known as 50-a, started to receive greater scrutiny around 2014, when high-profile incidents of police violence forced criminal justice reform into the national conversation. The NYPD has repeatedly cited 50-a in its refusal to disclose the disciplinary history of Daniel Pantaleo, the officer who choked Eric Garner to death on Staten Island. Now that the state Senate has come under Democratic control, lawmakers have their best chance in years to revise the provision or eliminate it altogether. Criminal justice activists and legal groups have long supported repealing the law, as have the families of New Yorkers who have been killed by the police. As reform bills gain steam in the legislature, here’s what you need to know about the campaign to change 50-a.
What is 50-a? 50-a is a section of the New York Civil Rights Law that deems the “personnel records” of police officers, firefighters and corrections officers “confidential and not subject to inspection or review” without the officer’s permission. It was passed in the 1970s both to protect the personal information of officers who testified in court and to prevent “harassment” by criminal defense attorneys.
Who wants it repealed? A coalition of activists and progressive politicians has pursued 50-a reform in earnest since 2014, with more state legislators and city councilmembers announcing their support each year. Bills to repeal 50-a have been championed by police reform organizations, including New York Communities for Change and Make the Road New York, and legal organizations including the New York City Bar Association, Legal Aid and the New York Civil Liberties Union. Mayor Bill de Blasio has also signaled his support for repealing the law. NYPD Commissioner James O’Neill said at the same time that he believed “making information about disciplinary proceedings public will help us build trust with the community.” O’Neill later created an independent panel to study whether the law should be repealed. That panel, comprised of two former prosecutors and a former judge, released a report this February that found “almost a complete lack of transparency and public accountability” around NYPD discipline. In the wake of the report, O’Neill conceded that “the law must change.”
In the case of Eric Garner’s death, for example, the NYPD cited 50-a in refusing to release Pantaleo’s disciplinary history. Pantaleo’s internal NYPD trial began only last year and is ongoing, but a leaked version of his complaint history showed he had several substantiated complaints for abusive stops and searches. A similar debate over public access to misconduct records is unfolding in California, where police unions sued to block a Senate bill that would have made such records public. But beyond the national debates about police accountability, lawyers and activists also contend that New York’s 50-a in particular is egregiously strict. Appellate court decisions over the past decade have expanded the 50-a shield to cover records of on-duty police misconduct, such as an officer assaulting a civilian during a traffic stop. Originally, the law only protected records of offduty misconduct, such as an officer selling prescription pain pills while off the clock. These rulings have made it more difficult for defense lawyers to bring such records into the litigation process through discovery. Only two other states in the country have statutes that exempt police officers from public records law.
Who doesn’t want it repealed? Unsurprisingly, groups representing police and correctional officers have been the loudest voices opposing the repeal of 50-a. These organizations argue that repealing the law outright would endanger police officers by making their personal information too accessible. The Patrolmen’s Benevolent Association, which represents rank-and-file police officers, has been the most vocal defender of 50-a. Earlier this year the PBA said that moves to repeal the law were “designed to once again demonize police officers, seemingly for political gain,” and that legislators who support it “ignored both the serious risks to police officer safety and the reputational harm of publishing false allegations.” In addition, the New York City Correction Officers Benevolent Association filed a suit in 2015 that used an expansive interpretation of 50-a to argue that jail guard records should be hidden from public view. (Last year a judge ruled the records must remain public.)
Despite O’Neill’s concessions, the NYPD has stopped short of accepting a full repeal of the law; instead, as its deputy commissioner Benjamin Tucker argued to the City Council last year, the statute should be amended to allow for the release of only those records that hold “significant public interest.”

Will it get repealed? Unclear. After the Democrats took control of the state Senate this January, progressives were optimistic that long-stalled bills relating to issues such as immigration, abortion and transgender rights would finally pass. At least for the first few months, much of that legislation panned out. But now, after spending months working out the details of the state budget, some senators doubt that they’ll have time to hammer out the details before the current legislative session ends on June 19. (Gov. Andrew Cuomo did not include the issue on his list of legislative priorities this year, and in the past he has said the decision should be left to the NYPD.) The City Council is currently debating a set of bills that would require the NYPD to release some aggregate misconduct data, but the only politicians who have the power to eliminate the 50-a exemption are state legislators. Lawmakers have introduced multiple bills this session in the state Senate and state Assembly to change the law, but the bills in both chambers are stalled in committee. The success or failure of 50-a reform may hinge on the debate between amending the statute and wiping it from the state code altogether. One bill introduced in the Senate by the Bronx’s Sen. Jamaal Bailey and in the Assembly by Manhattan’s Assemblymember Daniel O’Donnell would repeal 50-a outright. State lawmakers said last week that they had made progress toward passing the bill. Another bill, introduced by Brooklyn Sen. Kevin Parker, would narrow the 50-a exemption to cover only records relating to officer performance evaluations and promotions, while a third bill would keep the law as is but add a provision allowing civilian review boards to seek the release of specific records. Most advocates have rallied around an outright repeal, but it remains unclear how pressure from the police unions, which donated more than $1.3 million to state legislators last year, may influence which version of the bill ends up passing. ___________________________________ Jake Bittle is a reporter and researcher who lives in Flatbush. KITCHEN STILL LIFES BY JAN GROOVER
A drop of dark blue appears, its stain spreading over the surface. Tendrils stretch across, their circuits entwining and dispersing, carving lucid pathways in their wake. The deepest blue requires more than just one application, it is a multitude of layers blended into one another, with slightly different circumstances and results each time, as sapphire streams ebb and flow concurrently. The azure currents of time, energy, and memory upwell and merge in union. Lea Thomas applies this aesthetic philosophy in her practice, creating a pool of the deepest blue for her hand-woven textiles. With a lineage harkening back to the traditional use of Japanese indigo in its process and symbolism, Thomas’s work echoes the motion of her predecessors, diving far under the waves of deep time. As the fibers submerge into a vat of natural dye, so does one’s consciousness surge in connection to our environment, our humanity,

Jan Groover created her famous Kitchen Still Lifes in 1978 and 1979. Using a large-format camera, she transformed colanders, knives, spatulas and baking pans into objects of beauty that still hold a visual interest that transcends their common use. Her seductively modern color palette of greens, pewter, bronze and brown tonalities permeates the space dissected by kitchen paraphernalia. These take on a new visual meaning as a result of Groover’s juxtaposition of the elements. Although never unrecognizable as everyday objects, these utensils float into an abstract amalgam of planes and shapes. BBQ VEGGIE HASH INGREDIENTS Carrots, rutabagas & parsnips Cajun spice blend Yellow onion & garlic 2-3 leaves collard greens, trimmed Carolina-style barbecue sauce (S)
2 eggs (E) 7 sprigs parsley 1/4 cup heavy cream (D) 2/3 cup grits 1/2 green bell pepper, sides
DIRECTIONS PREP HASH VEGGIES Preheat oven to 425 degrees. Medium dice green bell pepper into about ½-inch pieces. Place in a large bowl. Add carrots, rutabagas, and parsnips. Drizzle with about 1-2 tablespoons cooking oil. Season with salt and pepper. Toss to combine. ROAST HASH VEGGIES Spread veggies out in a single layer on a foil-lined baking sheet. Roast 18 minutes. (See Step 6 to finish.) PREP COLLARDS & ONION Meanwhile, remove center stems from collard greens; discard. Roughly chop leaves into bite-size pieces. Cut ends off yellow onion and remove peel. Medium dice into about ½-inch pieces. Mince garlic. De-stem parsley; roughly chop leaves. COOK COLLARDS & ONION Heat about 1 tablespoon olive oil in a medium pot (with lid) over medium heat. Add onion to hot pot. Cook 2-3 minutes, or until onion begins to soften, stirring occasionally. Add collards and garlic. Lightly season with salt and pepper. Stir. Cook 3-4 minutes, or until collards begin to soften, stirring occasionally. Add Cajun spice blend; stir. ADD GRITS Add 2 ½ cups water to pot with veggies. Season with salt and pepper. Bring to a boil. Slowly add grits to boiling liquid while stirring. Reduce heat to low. Simmer 7-8 minutes, or until grits have thickened and water is absorbed; stirring occasionally. Remove from heat. Add heavy cream; stir. Salt and pepper to taste. Cover to keep warm until plating. FINISH HASH VEGGIES Drizzle 2-3 tablespoons Carolina-style barbecue sauce over baking sheet with veggies (reserve the rest). Stir to coat. Sprinkle with about half of the parsley (reserve the rest). Roast 2-4 more minutes, or until fork tender. FRY EGGS Meanwhile, heat about 1 tablespoon olive oil in a medium nonstick pan over medium heat. Carefully crack eggs into hot pan. Cook 3-4 minutes, or until whites have set (or to desired doneness). Lightly season with salt and pepper. PLATE YOUR DISH Divide barbecue veggie hash between plates. Spoon grits next to hash. Top grits with fried egg and garnish with remaining parsley. Serve remaining barbecue sauce on the side (or drizzle over top). Enjoy!

Judge rules against affordable housing construction in landmarked Crown Heights garden By Lore Croghan INBrooklyn
The city’s need for affordable housing and services for the mentally ill should not influence the fate of landmarked buildings, according to a Brooklyn judge. Those are not among the criteria the Landmarks Preservation Commission is legally mandated to consider when deciding whether to give developers permission to make changes to landmarked properties, Brooklyn Supreme Court Justice Katherine Levine ruled earlier this month. The case concerns the Dean Sage Mansion at 839 St. Marks Ave. in the Crown Heights North Historic District. It focuses on the city Landmarks Preservation Commission’s 2016 approval of a plan by the property’s owner, the Institute for Community Living, to construct a new building that would have occupied more than half of the mansion’s garden. The preservation commission’s decision was “arbitrary and capricious and based upon an error of law,” Levine wrote in an April 2 decision. She overturned the preservation agency’s approval of a plan to develop 70 apartments on the site — a mix of supportive housing for mentally ill adults and affordable units. She
did so by vacating a certificate of appropriateness the Landmarks Preservation Commission had issued. That’s a document property owners must obtain before altering the exteriors of landmarked buildings. The judge also ruled that the commission must hold a new hearing about the Dean Sage Mansion project. She said in her decision that cutting the size of the garden by 60 percent would obscure the eastern facade of the house — so it would no longer look like a stand-alone mansion. Most mansions in the landmarked district were torn down a long time ago, making the Dean Sage Mansion’s contribution to the neighborhood’s historic character especially important, Levine wrote.
WHAT FACTORS ARE WITHIN LANDMARKS’ JURISDICTION?
Levine’s ruling was a victory for community groups and neighborhood residents who’d filed suit against the Landmarks Preservation Commission and the Institute for Community Living. The groups were the St. Marks Avenue Independent Block Association, the Bergen-Kingston Block Association and the Crown Heights North Association. The case is an Article 78 proceeding, which means it was brought against government agencies. In this type of
suit, the plaintiffs are called petitioners. The defendants are called respondents. An important architect, Russell Sturgis, designed the HighVictorian Gothic mansion. Dean Sage, who made his fortune in the lumber industry, constructed it in 1870. The Landmarks Preservation Commission erred in its decision-making by considering factors outside its legally mandated jurisdiction, Levine decided. In her ruling she cited landmarking law, which instructs the commission to consider “the factors of aesthetic, historical and architectural values and significance, architectural style, design, arrangement, texture, material and color” as well as “other pertinent matters.” The phrase “other pertinent matters” should be narrowly interpreted, the judge said in her decision. “It would be absurd and contrary to the raison d’etre of the [landmarks law] to give the [Landmarks Preservation Commission] carte blanche to consider, as pertinent to its determinations, factors that did not enhance and protect and perpetuate these buildings such as the LPC’s finding that it was socially desirable to build more housing for the developmentally challenged and/or the economic and fiscal constraints of developers of such projects,” Levine wrote in her ruling.

A spokesperson for the Institute for Community Living told INBrooklyn it’s “very disappointed” by Levine’s ruling, “which disregards the long-held principle that the Landmarks Preservation Commission is an expert panel whose decisions should be accorded deference.” The Institute is “considering all options for moving forward and remains fully committed to continuing with our mission as a nonprofit to help New Yorkers lead healthier lives,” the spokesperson said. “We went above and beyond to ensure the project was in sync with the historic district requirements and met with various community organizations to take questions and suggestions,” he told INBrooklyn. “We allocated considerable funds to fully restoring the mansion, which will benefit the entire community and enhance the historic district.” The spokesperson said there’s a “great and growing need” in Brooklyn for services the institute provides for people living with mental illness, substance abuse issues and developmental disabilities. “Our plans for the Dean Sage Mansion, where we have provided services since the late 1990s, would not only have allowed us to continue to provide support services to New Yorkers, but also created much-needed affordable housing for many more,” he said.
Preservation experts say Levine’s decision will remind the Landmarks Preservation Commission that its purpose is to preserve sites with historic, social or cultural significance rather than to promote affordable-housing construction. “Landmarks should be adaptively reused, and the Landmarks Preservation Commission’s oversight plays a crucial role in determining how historic buildings can appropriately evolve to be functional in the 21st century,” Kelly Carroll, the Historic Districts Council’s director of advocacy and community outreach, told INBrooklyn. “It is excellent that this ruling serves as an example that preservation, under the Landmarks Law, has nothing to do with [a building’s] use,” she said. “Hopefully this ruling will refocus the lens of preservation and aid in reminding all parties involved that preservation is about buildings, not their uses, however lofty or attractive aspirations might seem.” Carroll provided an expert affidavit to support the petitioners in the Dean Sage Mansion case. If the commission’s approval of the housing development in the mansion’s garden had been allowed to stand, “an unruly precedent would be introduced into Landmarks Preservation Commission proceedings,” Historic Districts Council Executive Director Simeon Bankoff told INBrooklyn. “Regardless if one wants the Landmarks Preservation Commission to have the ability to consider use in their judgments, they do not and this decision rightly doubles down on this determination of authority,” Bankoff said. “To have not done so might open the door to great uncertainty within the regulation of our city’s landmarks and an erosion of their continued existence,” he added.

The city is considering whether to appeal Levine’s decision. “The [Landmarks Preservation] Commission thoroughly reviewed this proposal and determined the proposed changes will not detract from the historic and architectural character of the mansion or the Crown Heights North Historic District,” City Law Department spokesperson Nick Paolucci told INBrooklyn. “The Commission stands by its approvals and is evaluating its legal options, including whether to appeal this court ruling,” he said. Law Department attorneys represented the Landmarks Preservation Commission in the case.
Community groups took the Dean Sage Mansion case to court to compel Meenakshi Srinivasan, who was then the Landmarks Preservation Commission’s chairperson, to “reassess her priorities in fulfilling the agency’s mission, which is historic preservation, not housing,” Ethel Tyus of the Crown Heights North Association told INBrooklyn. “We felt vindicated for expending the money and time to closely examine what was actually happening within the inner workings of the Landmarks Preservation Commission,” she said. “The former Chair brought the wrong compass with her from her prior positions with the Board of Standards and Appeals and the Department of City Planning.” The community groups want the Dean Sage Mansion to be “preserved and celebrated for its design, its architecturally significant character and its importance to the entire historic district,” Tyus said. Registration ON THE SPOT PLATES Brooklyn Daily Eagle cover from April 25, 1945 ON APRIL 24, 1862, the Brooklyn Daily Eagle reported, “Victor Hugo’s Les Miserables. — A curious interest attaches to this remarkable French novel, which Mr. Carleton of New York has in press from advance foreign sheets. The author’s only other novel, ‘Notre Dame de Paris,’ was accepted by its publisher on condition that he should bring out every succeeding work by that author. ‘Notre Dame’ proved a brilliant success, and made the fortune of — the publisher. Victor Hugo then wrote ‘Les Miserables,’ determining to respect the condition, but to make his own terms with the unscrupulous brain-trafficker. These terms were at once rejected, and the author, unreleased from the old obligation, was obliged to put by his manuscript for a more favorable season. Year after year he renewed his proposals, increasing each year his demand, until at last the publisher died, and, after waiting nearly a quarter of a century, the well-seasoned, if not seasonable, ‘Les Miserables’ is in press.” ON APRIL 25, 1886, the Eagle reported, “Paris, April 24 — A stock company with a large capital has been organized for the purpose of erecting the tallest tower ever seen in the world in time for the International Exposition of 1889. The tower is to have a total height of 984 feet and will be supported on four pillars higher than the steeple of Notre Dame. The whole structure will cost $208,000. It will be surmounted by a group of electric lights, which will illuminate all Paris, and will, it is estimated, be visible at Dijon, 197 miles distant.” ON APRIL 25, 1945, the Eagle reported, “London, April 25 (U.P.) — British Lancasters attacked Hitler’s Berchtesgaden hideout with six-ton earthquake bombs today, and American reconnaissance pilots said fires still were burning close to it more than four hours later. There was no indication whether Hitler was at his mountain retreat when the R.A.F.’s biggest bombers struck at it for the first time, possibly in an attempt on the Fuehrer’s life. Intense antiaircraft fire from the batteries around Berchtesgaden led some observers to speculate that Hitler was there. The Nazis, however, have insisted he is directing the defense of Berlin. There are three primary targets in the Berchtesgaden area: Hitler’s country home; the SS barracks on the grounds, and Hitler’s mountain retreat, about five miles from the country home and called ‘The Eagle’s Nest.’” ON APRIL 26, 1952, the Eagle reported, “’It was at eleven that a delirium of joy and thanksgiving swept over humanity…’ Mrs. Esther Scholnick, mother of 11 children, eight of whom served in World War II, stood silently as the words of the American Legion’s 11 o’clock ritual were spoken last night at the sixth annual ball and entertainment of Maurice G. Jones Post in the Biltmore Ballroom, 2230 Church Ave. Her heart was full. It was one of the happiest moments of her life. From former Deputy Controller Milton Solomon, a past county commander of the Legion, she had just received the ‘Certificate of Merit.’ It was the Legion’s way of honoring Mrs. Scholnick and her husband, Louis, whose ‘eight valiant sons’ are now continuing their service to the community as Legionnaires. All eight were recruited by Post Commander William Panessa and inducted in November. Jones Post is the only one in the country with eight brothers as members. Somewhere in Kansas there’s a Legion post with five brothers. ‘I’m deeply touched, my heart is failing,’ said Mrs. Scholnick as she accepted the award.”
