Little-known rent reform law is big news for Crown Hts. tenants

When 25-year-old Genna DeSimone moved into her newly renovated apartment in Crown Heights last summer with two roommates, the arrangement felt “good enough,” even though the rent was a steep $3,100 for a three-bedroom and the building, on tree-lined Dean Street, had multiple empty units on each floor.

“We said, ‘This is shady,’” she recalled. “‘We’ll just stay here for a year and find a new place next year.’”

Then this spring, DeSimone learned that her neighbor Flossie Bonaparte, who has lived in the building for more than 20 years, was injured when part of the ceiling in her apartment collapsed. DeSimone overheard some neighbors in the hallway discussing what had happened, and “how they were going to start meeting up.” There was talk of reconvening the tenant union.

Now DeSimone, Bonaparte and dozens of their rent-stabilized neighbors at 1151-1155 Dean St. have filed two suits against their landlord, Renaissance Realty. One alleges that Renaissance illegally inflated rents in renovated units. The other claims that the company has ignored dangerous conditions in unrenovated units.

Together, the tenants are harnessing several new components of a sweeping package of reforms passed in Albany this June that are applicable to about one million New York City tenants. They’re also demonstrating how newly energized tenant organizations can forge multigenerational alliances.

“Because of the tenant association, I became empowered,” Bonaparte told the The Record this fall. “Because all I did was go to work, pay my rent.

I didn’t know that within my apartment I had rights.”

The Unified Court System does not track the fate of overcharge cases. However, at least 18 were diverted back to the DHCR between August 2017 and June 2019 according to a brief submitted to the Court of Appeals this summer. (It’s not yet clear how the new law will impact all of the overcharge cases that were already open when it took effect.)

It takes the DHCR’s Office of Rent Administration an average of two years just to assign an overcharge case to an examiner, according to a recent report by THE CITY. From there, it can take more than six months to process the case. The new rent laws are expected to worsen this backlog, though DHCR spokesperson Brian Butry says the office is implementing them “with thoughtful consideration and care.”

In Supreme Court, housing attorneys and advocates told the Record, tenants have the advantage of automatic pretrial discovery, meaning landlords have to present receipts to back up suspiciously steep rent increases.

“Oftentimes in cases when you bring it in Supreme, you learn that the landlord has misrepresented costs, has misrepresented increases that the landlord took,” said Ellen Davidson, a staff attorney with the Legal Aid Society.

Tenants can also band together in Supreme Court as joint plaintiffs to demonstrate a pattern of overcharges that points to fraud. The DHCR only accepts and investigates individual complaints.

2016, and has since struggled to get the landlord to repair her bathroom and cracks in the walls. Nneka won the city’s housing lottery two years ago and moved into a new apartment nearby, but is still an active member of the union. “It’s good that we have our little union, because … they don’t want us to talk to each other,” she said. “They don’t want us to know what’s going on.”

Renaissance Realty declined to comment on the repairs case, but provided a written statement on the overcharge case: “The Landlord has reviewed all of its records and find… that the rents charged to be in full [sic.] compliance of the law. We intend on mounting a rigorous defense, and expect to be fully vindicated by the courts.”

The comraderie of the union inspired DeSimone to renew her lease after her first year on Dean Street.

Tenants have more teeth in court As rent overcharge plaintiffs, DeSimone and 24 of her neighbors across 11 apartments hope to benefit from a new law that has flown largely under the radar of news coverage and the public.

The law codifies the tenants’ right to bring rent overcharge cases in Supreme Court. In doing so, they can put more pressure on landlords and sidestep the state’s severely backlogged Division of Housing and Community Renewal.

Their attorney, Ellery Ireland, believes that, taking into account possible damages and owed back rent, the group could win more than $1 million — between $24,000 and $214,000 per apartment.

“This case, if we had tried to take it in Supreme Court [before the latest reforms], they might have said, ‘You have to go to DHCR.’And now they can skip that,” Ireland told the Record. “It’s a really technical aspect of the rent laws that’s huge.”

Before the rent regulation overhaul this year, a precedent-setting March 2017 ruling in Manhattan Supreme Court found that the DHCR has “primary jurisdiction” for overcharge cases. In other words, a judge could rule that Supreme Court was not the correct venue for an overcharge case, and send that case back to the state agency.

Now, the law states, venue is “subject to the tenant’s choice.”

The Dean Street tenants meet regularly in the lobby of 1151 Dean St. “I have a case with a client who filed an overcharge case with DHCR during the first term of Barack Obama and it’s still kicking around,” says Matthew Chachère, a staff attorney with Northern Manhattan Improve-ment Corp. Legal Services, which represents tenants.

Attorney Adrienne Koch, who represents the landlords in the Manhattan case (full name, Collazo v. Netherland Property Assets LLC), argues that the DHCR is the correct venue for overcharge cases.

“It makes the most sense for the agencies with the expertise to address these issues in a uniform way,” she said, speaking generally and not on behalf of any client. Tenants can always turn to the courts if they are dissatisfied with the DHCR, she added.

“Ask, ‘Why is it that landlords were making all these applications to send these cases to the DHCR?’” says Chachère. “Because they thought it was a better place to be.”

Power in numbers While the Dean Street tenants’ overcharge case is underway, Bonaparte and several other long-term tenants are suing Renaissance for overdue apartment repairs. Old and new tenants have rallied together outside their buildings, and recently picketed their landlord’s house in Midwood.

“In the effort of fighting for our repairs we want to be a backbone for our newer tenants,” said Nneka Charles, 36, whose 62-year-old mother Christine has lived at 1155 Dean St. since 1994.

“My other roommates were interested in getting their own one-bedrooms, but when we were figuring out how it was going to go down we wanted to make sure at least one person stayed in this apartment,” she explained.

Attorneys say that they often prefer to take on group cases. “If you file a case on behalf of several people in the same building, you can accomplish more,” Languedoc said. “It’s more efficient. There’s a greater likelihood that you’ll find evidence of a scheme because you are able to compile evidence.”

Joel Feingold, an organizer with the Crown Heights Tenant Union who is advising the Dean Street tenants, says that the more tenants get involved, the more pressure they can put on the landlord to refund tenants and to make repairs.

Tenants in one neighboring building in Crown Heights had some success with a public shaming campaign and an eventual rent strike.

“It’s a long process, depending on how hard the landlord wants to fight,” he said. “That’s why we need direct action to make sure that they can’t get away with it, they can’t stall in court.”

FLATBUSH — MTA New York City Transit has written a letter to the city Department of Buildings saying that DOB should rescind notices of violation issued to several Brooklyn homeowners whose homes are next to the open cut that carries the Q and B trains through Flatbush. As the Eagle reported, DOB had issued notices of violation to these homeowners, saying that they were responsible for providing documentation that they have performed maintenance on the retaining walls between their homes and the subway right-of-way. In its letter, NYC Transit said that maintenance of the walls is the MTA’s responsibility and is done on a regular basis. 

CROWN HEIGHTS KOSHER FOOD CRAWL ATTACTS 500

CROWN HEIGHTS — Last Sunday, almost 500 Jewish Brooklynites, mainly Orthodox, held their annual Kosher Food Crawl, according to the Jewish Week. The crawl was organized by JMenu, an online ordering service for kosher food, and was a fundraiser for Toys for Hospitalized Children. Among the restaurant on the crawl were Gruit, a kosher beer garden; meat, a kosher steakhouse; Phomen, a kosher Vietnamese restaurant; and the Boozery, which served the group dairyfree chocolate and butterscotch desserts infused with alcohol.

Ellen Koevary, a self-described “Jewish foodie” from the Upper West Side, told the Jewish Week, “I got tired of your standard roast beef deli sandwich.” 

COPS SEEK MAN WHO PUNCHED TRAFFIC AGENT

PARK SLOPE — Police are seeking the public’s help in tracking down a man suspected of punching a traffic agent in Park Slope, according to the New York Post. The suspect punched the agent at 555 Fifth Ave. on Oct. 22 after he was issued a ticket for an expired meter, the Post reported. He told the agent to drop dead, then sped away in his 2008 Jeep Wrangler, police said. The agent had no visible injuries but was taken to a hospital as a precaution. 

DUMBO — A new five-part YouTube series produced by the Brooklyn arts organization BRIC follows a depressed Brooklyn woman who is transformed into a Babylonian goddess, according to the Brooklyn Paper. Before her transformation, Beth works at a public relations firm in DUMBO, and her co-workers treat her like a second-class citizen, the Brooklyn Paper reports. But once she becomes Ishtar, the goddess of love, people bow down before her and offer her flowers. Much of the show was filmed in DUMBO and Bay Ridge. 

FROM CBD TO NYPD FOR HEMP EXECUTIVE

EAST NEW YORK — A Brooklyn man who was arrested in the 75th Precinct and charged with possessing 106 pounds of marijuana says his product was legal hemp that was being used to make CBD. Ronen Levy, who was still facing six drug possession charges on Thursday, said he had $30,000 worth of hemp. Police told NY1 News they were still looking into the case. “We got information about a large package of drugs. We got it in here. We field-tested it as marijuana and called the individual in, who was placed under arrest,” said NYPD Chief of Department Terence Monahan. Material on the web describes Levy as “chief strategy officer at Trait Biosciences, a cannabis biotech firm.” 

CAB DRIVER SUES CITY AFTER CONCRETE FALLS ON HIS CAR

PROSPECT EXPRESSWAY — A livery cab driver is suing the city over a piece of concrete that he said fell from the Prospect Expressway and hit his vehicle while passengers, including a baby, were in the back, according to CBSNewYork. The concrete crashed into Uber driver Mohammed Hossain’s vehicle on Seventh Avenue on June 23. “There was a 6-foot piece of concrete that fell down that struck the car at this angle,” said attorney Alex Omrani. Hossain move to America from Bangladesh 12 years ago and said he thinks highways are better in his native country than in New York City, CBSNewYork reported. 

FIRE SWEEPS THROUGH GREENPOINT WAREHOUSE

GREENPOINT — A three-alarm fire swept through a large warehouse on Van Dam Street in Greenpoint around 2:30 a.m. last Friday, according to ABC7. The warehouse housed a woodworking business. Firefighters had to battle the flames from outside after the roof began to sag, making the building unsafe, ABC7 reported. More than 130 firefighters and emergency medical technicians responded to the scene, and the FDNY began to have the fire under control within a few hours.

Homeowners united with housing advocates and local officials on the steps of Brooklyn Supreme Court this week to unveil a set of principles aimed at preserving affordable homeownership, including a measure that would tax any investor looking to make a quick buck on the borough’s booming real estate market. “The Homeowner Bill of Rights” was unveiled on Tuesday by the Coalition for Affordable Homes. It calls for state passage of legislation including the Small Home Anti-Speculation Tax — which imposes a 15 to 20 percent tax on property that is transferred to a new owner within two years of ownership. The revenue that is raised through this tax will then be used to finance affordable housing efforts through the state’s Homes and Community Renewal program.

BUMPER CARS ON ICE DEBUT AT AVIATOR SPORTS

FLATLANDS — Bumper cars on ice made their debut last Friday at Aviator Sports at Floyd Bennett Field, just in time for the holiday season, according to amNewYork. These flying saucer-shaped cars are the first of their kind in the city, Aviator said. The cars have four-wheel drive and feature a dual steering system that can go in any direction. 

BEER AND BURLESQUE AT THE BROOKYN BREWERY

WILLIAMSBURG — The Love Show’s “Brooklyn Beerlesque,” described as “the world’s only beer and burlesque pairing,” comes to the Brooklyn Brewery in Williamsburg on the second Monday of every month, according to Patch. The event serves a selection of Brooklyn Brewery’s famous craft beers accompanied by performances by such performance artists as Apathy Angel, Cassandra Rosebeetle, Pearls Daily and comedian Zero Boy. This extravaganza will be presided over by “certified beer server” David Slone, who is also an attorney, Patch said. 

DETERIORATING CHURCH FACES UNCERTAIN FUTURE

CROWN HEIGHTS — The future of a former movie palace on Nostrand Avenue and Eastern Parkway, which now houses a Seventh-day Adventist congregation known as the Philadelphia Church of Universal Brotherhood, is unclear, according to The New York Times. The need for repairs in the building’s ornate lobby is evident, but “the lack of funds has really kept us back, because we’re not rich,” D. Liendra Jeffries, the church’s senior pastor, told the Times. The theater, which was known as the Loew’s Cameo (later the Kameo), was built in 1924 in a neo-Egyptian style and served as a movie house until 1974, when it was sold to the church. Pieces of outdoor terra-cotta and other masonry have fallen off the building in recent years, making the church erect a sidewalk shed to protect pedestrians. Jeffries said the church has been besieged by offers from developers, but “we’re not going to sell.” Still, the building is not a landmark and can be demolished as of right. 

EXCLUSIVE PRIVATE SCHOOL MOVING ABOVE MACY’S

DOWNTOWN BROOKLYN — An exclusive private school will be moving into 10 stories of a new development above Macy’s in Downtown Brooklyn, according to the Daily News. The school, Whittle School and Studios, will be located at 181 Livingston St. and open in fall 2020, the Daily News said. This will be the third in a chain of for-profit, high-end private schools sponsored by educational entrepreneur Chris Whittle. Whittle, a former publisher of Esquire magazine, hopes to open more than 30 of his schools, which focus on global studies, across the world. Larry Weiss, former head of school at Brooklyn Friends School, will lead the new school.



PERSAUD HOSTS DISCUSSION ON YOUTH VIOLENCE

BROWNSVILLE — State Sen. Roxanne Persaud (D-East New York-Brownsville-Sheepshead Bay), chair of the New York State Senate Social Services Committee, recently hosted a roundtable discussion titled “Examining the Prevalence of Youth Violence.” The discussion began with Persaud and her colleagues speaking directly with high school-aged youth about experiences with, or perspectives on, the pervasive culture of violence. Then, Persaud and colleagues continued the discussion with youth development advocates, youth service providers, anti-violence organizations and other. PARK SLOPE — A cook at Princess Pizza on the corner of 14th Street and Fifth Avenue in Park Slope was underpaid for more than a decade and then fired after he had a stroke at work, a new lawsuit claims. The suit claims Manuel Yunganaula worked as many as 86 hours a week while getting minimum wage or less with no overtime pay, Patch reported. In May, he had a stroke, had trouble speaking and started doing “strange things” at work., the lawsuit said His bosses, told Yunganaula to go home and assured him that his job would be waiting for him when he recovered, but when he eturned, he found another cook had been hired, the lawsuit said. 

Under clear blue skies on Monday, Nov. 11, residents flanked Whitney Avenue to honor community veterans for the annual Gerritsen Beach Veterans Day Parade.

The event took place in the early afternoon along Whitney Avenue and ended at the Memorial Monument at Burnett Street, where supporters gathered for a ceremony.

The parade was sponsored by Argonne Marine Park Veterans of Foreign Wars (VFW) Post 107.

“This is for the community. It’s to make sure the community keeps aware, teaches the young kids about what it means to be a veteran, and shows the respect and honor the veterans and the flag deserve,” said VFW Color Guard Capt.

Marchers included VFW Auxiliary Post 107 members, local Boy Scouts, the VFW Post 107

Marching Band and the Knights of Columbus.

The turnout was received enthusiastically

by George Broadhead, a New York State Senate Veterans’ Hall of Fame honoree, who said of area residents, “Love them. It’s Gerritsen Beach; it’s a great community, great people.”

The ceremony included a wreath-laying and gun salute by the members of VFW Post 107.

VFW Auxiliary Post 107 President John Reilly spoke about the veterans’ sacrifices, and the crowd stood in silence as Jim Brandow and Gary Wasserman laid wreaths by the memorial.

Many veterans, some decorated with war medals, proudly saluted the American flag that flew above the memorial site.

The wreath laying was followed by Taps, played by bugler Jim Markson.

Ceremony attendee Natasha Minze said, “It’s great that [the parade] brings the community together. Let us celebrate the veterans and remember this important day.”

Community activist Gloria Melnick dead at 79

Gloria Melnick, one of Bay Ridge’s most respected and revered community leaders, has died at 79. She was an unsung hero who remained an active part of the Bay Ridge community for decades.

Melnick was a past president of the Bay Ridge Community Council and longtime executive secretary of the organization, and remained on the board of directors until recently. She was also very active in the BRCC’s Halloween art contest. Melnick also served as president of the Ragamuffin Children’s Parade and the Bay

Ridge Women’s Club.

“I remember Gloria as always being pleasant and hardworking,” said former City Councilmember Vincent Gentile.

“She was president of the Bay Ridge Community Council where I first worked with her.

She so impressed me that when I became the city councilmember, I appointed her to join Community Board 10. I remember her being actively involved in our community downzoning efforts during the building boom in the early 2000s as well as other efforts. She loved and was loyal to Bay Ridge and we loved her.

The effect of her work is still felt today.”

Longtime friend and BRCC

member Jane Kelly echoed Gentile’s sentiments.

“Gloria Melnick was a true Bay Ridgeite. She was involved in every aspect of activity in Bay Ridge. She will be sorely missed,” said Kelly.

Throughout the years, Melnick chose to keep a low profile while being actively involved in many projects behind the scenes. She was a retired teacher with the Board of Education, and always worked toward the betterment of her neighborhood.

CB 10 District Manager Josephine Beckmann recalled Melnick’s tenure with the board. “On behalf of Community Board 10, I would like to extend my condolences to

Gloria Melnick’s family. She was a dedicated community member and volunteer who will be greatly missed.”

Former State Sen. Marty Golden said that even though he didn’t always see eye to eye with Melnick, he always had great respect for her. “Gloria and I would debate about a number of different issues in our community,” he told this paper.

“She was an activist, she worked hard, she was a teacher, she was a great community person and she will be missed,” Golden said. “She would be at all the community board meetings and all the different events over the years until recently.

I’m sorry to see her gone. It is a great loss to our community.”

Sometimes you need an urban adventure. How about a stroll beneath a highway?

If it leads you through Red Hook, it’s totally worthwhile.

There’s a gritty beauty to the underside of the BQE when you see it from Hamilton Avenue.

Don’t worry. There’s a sidewalk, so this route is safely walkable. I’m heading to Columbia Street — which runs past leafy green parks and an urban farm that contrast with the highway system’s blacktop, concrete and steel.

If you don’t live in transit-challenged Red Hook, the closest subway stop to the neighborhood is the F and G station at Smith and 9th streets. The station is a couple blocks from Hamilton Avenue.

A WALKWAY IN THE SKY The starting point on this stroll is the sidewalk on the Hamilton Avenue Bridge over the Gowanus Canal.

The span was constructed in 1942 and is a “bascule bridge,” which is a type of drawbridge made of two parallel leaves for the northbound and southbound roadways. The toxic canal is a federal Superfund site.

On its far shore, at 595 Smith St., you’ll see a single wall standing on a vast empty lot. This is a remnant of the historic S.W. Bowne Grain Storehouse, which was constructed in 1886.

Activists and elected officials fought to get the building landmarked. Its owner, the Chetrit Group, tore it down.

Head up Hamilton Avenue in the direction of Court and Clinton streets.

Some of the streets that run into Hamilton Avenue are lined with handsome rowhouses, for instance Nelson Street and Henry Street. Here and there, you’ll see businesses such as auto repair shops.

I never realized it until I took this walk the other day, but the highway’s got a pedestrian overpass that connects Red Hook and Carroll Gardens. Its entrance ramp is located at the corner of Hamilton Avenue and Luquer Street.

When you’re scared of heights like some of us (meaning me), walking over a highway on a fenced-in path definitely qualifies as an adventure.

In this case, the scenery was so interesting. You can see the top of the World Trade Center. And at the far end of the walkway, there’s a sunlit red-brick wall that’s the side of the Brooklyn New School on Henry Street.

There are lots of picturesque things to see on a walk along Hamilton Avenue and Columbia Street in Red Hook.

This is 5 Luquer St., which is in contract.

After you double back on the overpass, Hamilton Avenue continues for a couple more blocks to the Hugh L. Carey Tunnel.

This is the Brooklyn-Battery Tunnel, which was renamed to honor the governor who played a big role in rescuing New York from financial collapse in the 1970s.

BTW, it’s North America’s longest continuous underwater tunnel, the MTA’s website says.

There’s a sidewalk by the tunnel’s entrance at the corner of Hamilton Avenue and Columbia Street. You can get a good view of the World Trade Center without straying into traffic.

LUNCH AND LOVELY ROWHOUSES After the highway scenery along Hamilton Avenue, the first block of Columbia Street rowhouses seems especially tranquil and charming.

This block is a great place to linger if it’s warm enough for the outdoor seating at Camila’s Cafe (358 Columbia St.) on the corner of Seabring Street. Across the street, Jam’It Bistro (367 Columbia St.) serves Jamaican food.

There’s lots of cool stuff to see at the next intersection.

You’ll notice the cross street is Commerce Street on one side and Luquer Street on the other. The street grid is complicated

in this part of Red Hook.

A mural on the facade of low-rise 22 Commerce St. is eyecatching. The trash bins in front of the building are painted to be part of the mural, which is a nice touch.

An online posting says that Re:Gen:Cy is located in the building. It’s “a community and event space supporting sustainable development” by hosting educational programs, supporting small businesses and providing “a platform for regenerative projects to form.”

On the corner of Luquer Street, at 379 Columbia St., there’s an Italian sandwich shop that has been in business since 1922.

The shop, which is called Defonte’s, is known for its huge hero sandwiches.

A bit further down the street, the bright-white painted brick facade of 5 Luquer St. caught my eye. Between the time that I took my walk and sat down to write this story, the New York Post mentioned this house in an article about five Brooklyn neighborhoods that are great places to live.

The story noted that the house was for sale for an asking price of $1.65 million. A posting on listing broker Compass’s website says the house is in contract.

When you turn back onto Columbia Street, you’ll soon see it forms a traffic triangle with Dwight Street. The third leg of the triangle is called Nelson Street at the corner of Columbia Street and Delavan Street at the corner of Dwight Street.

A portion of the street across from the triangle is blocked from vehicles with skinny bollards and painted with an aquatic mural.

A big former industrial building at 5 Delavan St. is called the Monarch Luggage Factory Lofts. It photographs well when viewed from the corner of Dwight and Verona streets, too.

On Columbia and Verona streets, there’s an apartment complex the U.S. Department of Housing and Urban Development foreclosed on in 2001, city Finance Department records show.

Later that year, HUD sold a package of properties that included the complex to a private owner for $100,000. The deed specifies that all the apartments in the complex must be maintained as affordable-housing units for 25 years from the date it was signed.

Past the corner of Verona Street, Columbia Street runs down the middle of the multi-block Red Hook Houses. HUD’s Regional Administrator Lynne Patton visited this New York City Housing Authority complex in August to hear residents’ complaints, the Brooklyn Eagle previously reported.

On the corner of Verona and Dwight streets, you’ll see eight-acre Coffey Park. It’s a leafy oasis.

After Columbia Street crosses Lorraine Street, you’ll pass a huge vacant lot at 55 Bay St. A single-story, 95,787 squarefoot development is planned for the site.

Past the intersection of Columbia and Bay streets, you find Red Hook Park.

The running track looks newly refinished and is bright red.

A fence surrounding Red Hook Soccer Field 3 in the middle of the track reminds you it’s off limits because the ground is contaminated with lead. A soil cleanup by the U.S. Environmental Protection Agency and the city Parks Department is in the works.

Across from Red Hook Park, an eye-catching new building at 556 Columbia St. houses a school called Basis Independent Brooklyn. It is on the corner of Sigourney Street.

On the opposite corner of Sigourney Street there’s picturesque, productive Columbia Street Farm. Rows of leafy greens look ready to eat. There’s a composting site.

The 2.75-acre urban farm at 560 Columbia St. was created in 2001 on the site of a concrete baseball field, its website says.

The Monarch Luggage Factory Lofts stand on the corner of Delavan and Dwight streets.

The most eye-catching feature of the terminal is the 120foot-tall Red Hook Grain Terminal, which was built in 1922.

SEAGULLS AND A VIEW OF SUNSET PARK If you want to take a break, there are benches on the sidewalk where you can sit and listen to gulls’ cries. When you look north, Brooklyn Heights and Downtown Brooklyn towers are arrayed on the horizon.

When you start walking again, that’s Erie Basin on your right. Businesses such as VIP Fire Sprinklers Inc. are located there.

Columbia Street curves. When you look out over the water, you’ll see Industry City down in Sunset Park.

The building at the very end of Columbia Street is the NYPD’s Erie Basin vehicular evidence storage facility.

You’ll have to turn around and retrace your steps to public transportation — city buses pick up passengers outside IKEA — or to get to Van Brunt Street for afternoon tea or happy-hour drinks.

RIP TODD SHIPYARD

This is GBX-Gowanus Bay Terminal.

IKEA is nearby at 1 Beard St. I didn’t go inside because I would have stayed for hours browsing through the housewares.

Instead, I continued walking down Columbia Street to Erie Basin Park. IKEA was required to construct the 6.3-acre park after the City Planning Commission okayed the demolition of historic Todd Shipyard to make way for the construction of the Swedish furniture retailer’s megastore.

The shipyard dated back to the 1860s.

Gantry cranes that were salvaged from the shipyard are displayed in the park. They stand pretty far away from the Columbia Street side of the recreation area. You should walk to the other end of the park so you can take good photos of them.

When you return to Columbia Street and head south again, the sidewalk runs right along the shoreline. A facility called GBX-Gowanus Bay Terminal is there on your left.

John Quadrozzi Jr. is the president of the terminal, where a wide range of industrial businesses such as scrap metal processors and fuel companies are located.

ON NOV. 12, 1938, the Brooklyn Daily Eagle reported, “Berlin (AP) — Jews today were assessed 1,000,000,000 marks ($400,000,000) as a penalty for the murder of Ernst vom Rath, German diplomat in Paris, it was announced officially. Field Marshal Hermann Wilhelm Goering, as director of Germany’s fouryear plan, issued a decree, effective next Jan. 1, prohibiting Jews from conducting retail businesses, mail order and commission houses and independent handicraft enterprises. Goering’s decree further banned Jews from heading any industrial or commercial concern by forbidding them to hold the position of ‘betriebsfuehrer,’ which every factory or similar undertaking must have under the national labor law. At the same time, semi-official sources said that 1,600 Jews had been arrested in Berlin alone. (The United Press estimated 6,000 Jews arrested in Berlin.) These sources said it was impossible to estimate how many other Jews had been seized in the rest of Germany since the killing of vom Rath, secretary of the German embassy in Paris, which incited nationwide burnings of synagogues and destruction of Jewish stores Thursday.”

Brooklyn Daily Eagle cover from Nov. 15, 1940

ON NOV. 15, 1915, the Brooklyn Daily Eagle reported, “Dr. Booker T. Washington, leader of the negro race in America, and president of the Tuskegee Institute, at Tuskegee, Alabama, died yesterday from hardening of the arteries at his home, near the institute, only a few hours after arriving there from New York City, where he had been under treatment in St. Luke’s Hospital all last week … His funeral will be held on Wednesday morning from Tuskegee Institute, the school for negroes which he founded, and for which he worked with unflagging zeal during all of his active career … Dr. Washington was born a slave on the plantation of a family named Burrows, at Hale’s Ford, Virginia, probably in April, 1958. He did not know the exact date of his birth, for in those days records were seldom kept of the birth of slave children, and all he knew about it was what he could gather from hearsay in after years.”  ON NOV. 15, 1925, the Eagle reported, “The new Madison Square Garden, which is being constructed at 8th Ave. and 50th St., Manhattan, is rapidly nearing completion, and plans for the grand opening have been completed. The initial event will serve to reintroduce ice hockey to the New York public, after a lapse of some years, and will bring together the 1925 world’s champions, the Canadiens of Montreal, and the newly assembled team representing the New York Hockey Club, in an international match.

This opening game will be held on Dec. 15 and will be a benefit for the Neurological Institute … The New York Hockey Club will be a member of the seven-club international league which will include representatives of Ottawa, which won the world’s championship in 1920, 1921 and 1923; Montreal, Toronto, the Canadiens of Montreal, who won the world’s championship in 1925; Boston and Pittsburgh.”  ON NOV. 15, 1940, the Eagle reported, “Coventry, England (U.P.) — Squadron after squadron of German airplanes divebombed this ancient industrial city for 10 1/2 hours in an attack which ended early today, leaving at least 1,000 casualties and wrecking the town as thoroughly as an earthquake. The survivors of the Nazi air fury today wandered through broken streets and row after row of houses and buildings shattered to matchwood and rubble by the explosion of thousands of bombs. The history of this present day industrial center of 167,000 population dates back to a medieval past brightened by the famous ride of Lady Godiva clad only in her golden hair. Coventry is 85 miles southwest of London.”  ON NOV. 15, 1950, the Eagle reported, “Tokyo (U.P.) — U.S. Marines reached the shores of the Chosin power reservoir — one of the great prizes of the North Korean campaign — yesterday, to find that its Chinese defenders had fled. But the Chinese were striking back hard in the west, forcing the South Korean 8th Division into a four-mile retreat. A motorized patrol of the Marine 7th Regiment, led by Regimental Comm. Col. Homer L. Litzenberg, Jr. of Philadelphia, reached the shores of the Chosin at 4 p.m. (2 a.m. Brooklyn time), and a half hour later troops began scrambling onto high ground commanding the southern tip of the artificial lake. ‘We’ve come a long way to look at this,’ said Litzenberg, pointing across the reservoir … The Chosin, supplying the bulk of North Korea’s hydroelectric power, had been defended bitterly by the Chinese, apparently to give them time to dismantle the power equipment. The Marines several days ago overran heavy crates of equipment the Chinese had not had time to remove.”

Issue of diversity becomes paramount during hearings on court consolidation

The New York State legislature held its first public hearing on Chief Judge Janet DiFiore’s proposal to consolidate the court system, and while nearly everyone in attendance felt that the court could be improved, there was a lot of disagreement over whether the proposal in front of them was the way to do it.

The proposal put forward by Chief Judge DiFiore would eliminate the current 11-court system and replace it with a three-court system that would consist of a Supreme Court, a Municipal Court and the current Justice Court system that serves towns and villages.

To do this, the Court of Claims, county courts, Family Court and Surrogate’s Court would be merged into the current Supreme Court. The Supreme Court would then be made up of six divisions — family, probate, criminal, state claims, commercial and general.

The proposal would also merge the New York City Civil and Criminal Courts, the District Courts in Long Island and the 61 City Courts in upstate New York into a new Municipal Court.

The current means of selection would remain in place, which means that voters would still vote on Surrogate’s Court judges. However, those judges would theoretically be assigned to the probate division of the Supreme Court. Under the proposal, there is nothing that prevents judges, once they are elected (as they are to Surrogate’s Court, for example), from being assigned to different courts.

The proposal would eliminate the constitutional cap of one judge per 50,000 people in a district. This would immediately increase the number of judges in Brooklyn Supreme Court, which often has to rely on judges transferred from lower courts under the title of acting supreme court justice, in order to cover the number of cases that are heard in the borough.

In addition, under the current system, judges are often elected to the Civil Court in Brooklyn and then automatically assigned, usually for two years, to the Criminal Court.

Finally, the proposal would authorize the legislature to change the number of Appellate Division departments once every 10 years. There are currently four different divisions that were initially separated into four equal parts. However, due to population shifts, the four divisions are lopsided and the Second Division, which includes Brooklyn, represents roughly 50 percent of the population of the state.

Wednesday’s hearing was led by Assemblymember Jeffrey Dinowitz and State Sen. Brad Hoylman, who chair the Judiciary Committees in their respective chambers. They were joined by State Sen. Luis Sepulveda, another member of the State Senate’s Judiciary Committee.

More than 20 people spoke at the five-hour hearing including Hon. Lawrence Marks, chief

administrative judge for the state; Hon. Jonathan Lippman, the former chief judge for the state; Hon. Alan Beckoff, who sits in the Brooklyn Family Court; and Hon. Wayne Saitta, who sits in Kings County Supreme Court, Civil Term. Other speakers represented various bar associations and judicial associations from across the state.

Impact on diversity in the courts

While there was certainly no consensus on support for the proposed changes to the court system, many who spoke Wednesday raised concerns about how the changes would affect the diversity of the court system, with Sepulveda leading the charge.

After being questioned by Sepulveda on the issue of diversity, Chief Administrative Judge Marks explained that he feels that the proposal would improve diversity in the Appellate Division, the second highest court in the state, and the Court of Appeals, the highest court in the state, because there would be more Supreme Court judges eligible for promotion.

Judge Marks pointed to the third judicial department of the Appellate Division, which didn’t have a single judge of color because, he said, there were no judges of color from the pool of Supreme Court judges within that district to choose from. He said that the court was forced to ask a judge from the Bronx, Hon. Sharon Aarons, to agree to sit on the upstate court.

However, Sepulveda made it clear that he wasn’t buying that argument because judges would still need to be appointed to the Appellate Division and a bigger pool of applicants, he said, wouldn’t necessarily mean more minority appointments. Hon. Sallie Manzanet-Daniels, president of the Latino Judges Association, was similarly dissatisfied.

Justice Manzanet-Daniels said that officially the Latino Judges Association wouldn’t support or reject the proposal until a diversity impact assessment is done.

Justice Manzanet-Daniels explained that there was concern that the proposal did not directly address diversity issues. She went on to say that the Latino Judges Association was concerned that both the ease by which judges could be transferred and lifting the cap of one judge per 50,000 people could have a negative impact on the Hispanic community.

“At this time, and until information is provided that shows how they would improve the diversity of the judiciary, we as the Latino Judges Association cannot take a position,” Justice Manzanet-Daniels said.

While addressing the hearing, New York State Bar Association President Henry Greenberg, who used the word “genius” when referring to Chief Judge DiFiore’s proposal during his statement, admitted that there is a crisis of lack of diversity on the bench, particularly

upstate. He said that of all of the proposals to amend the court system over the last 50 years, this was the first to address diversity, and also brought up the Appellate Division, Third Department, as an example.

Greenberg explained that under the proposal, judges elected to the Supreme Court would no longer run districtwide, but instead would run countywide. It is his belief that this would make it easier to elect judges of color.

“If court modernization went into effect on Jan. 1, you would have six more diverse judges on the Supreme Court than you now have in the Third Judicial District,” Greenberg said. “In the seven counties in those districts, it is virtually impossible for a person of color to win districtwide.”

Judicial transfers

The issue of judicial transfers was also frequently brought up. Assemblymember Thomas Abinanti noted that a hypothetical governor could appoint a judge to the Court of Claims and then immediately transfer that judge to the Appellate Division, and could even name him or her chief judge, all without an election.

Similarly, Abinanti pointed out that the current system allows for the election of Surrogate’s Court judges, who cannot be transferred out of that court. However, under the proposed plan, there is nothing to prevent judges elected to one court from being transferred to a different court, the same way judges are currently elected to the Civil Court and then immediately assigned to the Criminal Court.

In their rebuttals of this point, many speakers conflated the issue of judicial transfers and said that they would never send a judge from Buffalo to New York City, without directly addressing the issue of the Surrogate’s Court.

When pressed, former Chief Judge Lippman called the issue a “straw man” and denied that there was serious reason for concern.

“It’s a dated view of the court system and this fear of a centralized administration,” Lippman said. “Every court system in the country has gone to this centralized system.”

In response to the issue of judges being appointed to a lower court only to be promoted immediately to the Appellate Division, Hoylman suggested the possibility of State Senate confirmation hearings. When presented with this idea, Hon. Carmen Beauchamp Ciparick said it was an interesting idea that she would be open to.

Multiple courts, multiple judges One of the biggest claims made by proponents was that with less division in the courts, resources could more easily be allocated.

Judge Marks brought this up when he talked about the 2008 housing crisis. He explained

that the system had made it hard to give proper attention to the foreclosure cases that rose out of it, and that as a result, nearly 12 years later, the court is still dealing with a backlog of foreclosure cases.

Another common complaint is that, especially in the Family Court, litigants can often be in front of two, or even three or more, judges for related issues.

Hon. Alan Beckoff, president of the Association of Family Court Judges of New York State, said that one family can come to his court for a custody hearing, but have to go to a different court for related domestic violence issues and another for the divorce.

He explained that what happens is that one part of the case can be put off or judges in different courts can give conflicting orders.

This sentiment was echoed by the Legal Aid attorneys who spoke at the hearing.

However, Abinanti questioned whether this real issue could be solved in a way that didn’t include such a drastic merger.

“Everybody is assuming that you are going to have access to a Family Court with the professional organization of the Supreme Court,” Abinanti said. “What I’m hearing today are all of the complaints and problems, and they’re real, but I’m concerned with how this proposal would solve them. I don’t understand how this solves a problem.”

What’s next There will be another hearing on the merger proposal in Albany next week. Judge Marks said that by that time, the Office of Court Administration would have a financial report detailing the expenses of the merger, which he estimated to be approximately $13.1 million, primarily to cover raises for judges and their staff.

Merging the courts as proposed would require an extensive process. The proposal would have to go in front of the state legislature for a vote, potentially twice, and finally would have to be put in front of the voters in a referendum. The chief judge expressed a hope that this could be done by 2022 to begin a five-year phase-in that would be completed by 2027.

Similar proposals have been made over the years; in fact, five major proposals have been made to revamp New York’s courts over the last 50 years. This time, however, the proposal could be considered for the first time by a wholly Democrat-led legislature, a significant difference, according to many observers, who suggested that having both the State Senate and Assembly under Democratic control could make passage more likely.

Attorneys told the Record that they expect to see more overcharge lawsuits in Brooklyn Supreme Court in the coming months. Not only do the new rent laws enshrine tenants’right to go to court to recover money they overpaid in rent, they also help lawyers build stronger cases.

could only draw on four years of rent history to determine if their rent had been illegally inflated. Now they can search as far back as necessary to find an accurate rent. Tenants who are found to have been overcharged can also win up to six years of treble damages or triple the amount of rent owed. Under the old laws, the maximum for treble damages was two years.

Davidson of the Legal Aid Society also notes that the new rent laws enshrine tenants’ so-called “preferential” rents. Roughly a third of all rent stabilized tenants pay such arbitrary rents, which are below the actual, or “legal,” rent listed on their leases. In DeSimone’s case, Renaissance Realty originally told her that the actual rent on her apartment was $4,604.42, though she would be charged a preferential rent of $3,200.

Until this year, landlords could revoke preferential rents at will.

“It was really risky to complain because they could lose those rents,” Davidson said. “I think there’s going to be a lot more challenges … now that people have the right to keep their preferential rent, and I think we’re going to find that a huge percentage of those ‘legal’ rents were made up out of whole cloth.”

Not a silver bullet

Forming a union and managing the logistics of two group lawsuits is not easy, tenants acknowledge.

DeSimone’s sister Devon, 26, moved in with her this year from another apartment in the neighborhood where tenant organizing efforts faltered. “There were way fewer long-term tenants,” she recalled. “They were mostly gone at that point, and the young people moving in weren’t particularly interested.”

Even the Dean Street tenant union has struggled to bring in all of their neighbors, according to the elder Charles, Nneka’s mother.

“The young people are moving in and they won’t say hello to the older people they meet,” Charles said.

“And this is where they can be lost because we can inform them of the things that’s happening within our building. Because we’ve been here so long, you know?”

Ireland, the Dean Street tenants’ attorney, is confident that the overcharge case will prevail. But he’s more pragmatic about the repairs case. “It’s really, really hard to get your apartment repaired,” he said. “I think the problem is really the enforcement.”

He also acknowledges the possibility that the landlord may not have the money to pay his overcharged tenants. Ireland also represents a group of tenants in Clinton Hill, whose landlord is currently in bankruptcy proceedings, putting the overcharge case on hold. “There’s a practical aspect of, where does the money come from?” Ireland said.

At minimum, he added, tenants can expect to eventually have their rents rolled back. Ideally those rents would remain affordable for generations of tenants to come.

At a recent meeting in the lobby of 1151 Dean St., tenants said that regardless of the outcome of these cases, they’re glad to be organizing.

“I don’t think that any of us would have regrets about the time that we’re spending,” said Latonia Gray, 50, who has lived in the buildings her entire life.

“If we win, yay. If we lose, okay we tried. But we’ve been learning a lot actually, as well.”

If the landlord finds a new way to make life difficult, Gray said, “We know what we’re supposed to do.”

The Brooklyn Bar Association partnered with the Kings County Housing Court Bar Association to host one of its most well-attended continuing legal education lectures in at least a year on Tuesday, Oct. 29 titled, “The Tenant Protection Act Of 2019: New Housing Court Rules” Part of the reason for the high turnout was because of the ambiguity of the new act. However, Michael Rosenthal, president of the Kings County Housing Court Bar Association, had bad news for some of the attorneys who came looking for clarification on certain issues.

“A lot of what you will hear is that we don’t know how the court will interpret this because many of the things we talk about the statute sound specific, but they don’t cover as much as you think it would and a lot of it is left to interpretation,” Rosenthal explained. “Also, because it’s so new, we don’t know how judges are going to interpret it yet.

BBA is hosting a holiday drive for homeless youth

The Brooklyn Bar Association's LGBTQ+ Committee is hosting a holiday drive for homeless youth, and members are hoping for donations.

In conjunction with the Ali Forney Center, which houses and protects LGBTQ+ homeless youth, the BBA will keep a collection box located on the first floor of the Bar Association building in Brooklyn Heights.

Donations can be dropped off during regular office hours until Tuesday, Nov. 26.

People are being asked to donate gift cards in $10 denominations to Ali Forney Center approved vendors: McDonald's, Applebee's, Dunkin Donuts, Old Navy, Starbucks and H&M. They are also asked to donate new hats, gloves, scarves and socks.

The committee is also soliciting new men's and women's undergarments including underpants, bras and undershirts.

In addition to housing homeless youth, the Ali Forney Center also provides them with medical treatment, mental health professionals, mentoring, education, life skills and career training.

Christina Golkin, chair of the BBA's LGBTQ+ Committee, is also able to help out people who are interested in hosting a collection box in their office.

“You are going to find that different judges will take different positions on a lot of these things and until the Appellate Division starts making rulings on it, we’re not going to have definitive answers,” Rosenthal said.

Rosenthal, a senior partner at Hertz, Cherson & Rosenthal, was joined for the CLE by a team of attorneys that included Hal Rose, senior associate at Goldberg, Lustig & Steckler; Peter Sanders, a partner at Capell, Barnett, Matalon & Schoenfeld LLP; Michele Slochowsky Hering, a partner at Slochowsky & Slochowsky LLP; and David Troupp, a senior associate at Hertz, Cherson & Rosenthal.

“Mike joked about us having 140 years of combined experience, but ever since June 14 (when the Tenant Protection Act of 2019 went into effect), it’s like we’re starting from scratch,” Rose said.

During the two-hour CLE, Rosenthal covered how the laws have changed the non-payment practice; Troupp discussed holdovers; Slochowsky Hering covered ex parte orders; Rose covered changes to the New York State Real Property Actions and Proceedings Law, Section 7112, which covers the grounds for commencing a summary proceeding, and Section 745, which addresses the rules of a trial during a summary proceeding; and Sanders covered individual apartment increases and major capital improvements.

As Rosenthal warned from the start, the crowd of over 100 attorneys did not always get concrete answers to their questions, but Rosenthal and his team did their best in explaining what they’ve seen in court so far and explained the best practices they have seen for making sure that they’re being more cautious rather than less.

“The landlord has to notify the tenant when they didn’t get paid,” Rosenthal said. “They have to wait until the rent is five or more days late. If it’s due the first, not until the sixth, but that notice, if not given, can be used as an affirmative defense to any nonpayment proceedings. What is that affirmative defense? We don’t know. The statute doesn’t say.

Some judges say it’s a complete bar to collecting the rent. Period. I don’t think that will be held up in the Appellate Court.”

Unambiguity was the word of the night.

Without a lot of answers to questions, the attorneys suggested doing things in ways that will be the least confusing possible.

Troupp explained that when landlords are not going to offer a renewal for unregulated tenants, or want a 5 percent or greater increase in the rent, they must give a 30-day notice to tenants who have lived in the apartment for less than one year, a 60-day notice for tenants who have lived there between one and two years, and a 90-day notice for tenants who have lived in the apartment two years or more. However, Slochowsky Hering quickly chimed in and told the group to be careful that notices are not ambiguous.

“If you word it correctly, it’s not ambiguous — I’m seeking a raise of such and such amount and if you agree, you have to pay it by this date; otherwise, your tenancy is terminated effective this date,” Slochowsky Hering said. “You would probably have to add to that notice, very clearly, that you would have to vacate by this date.”

Sanders’ discussion focused less on procedural issues and more on policy implications. In general, he was very grim about landlords’ situations since the implementation of the act and suggested that the majority of them would let their houses and buildings fall into disrepair.

“Are landlords going to be continued to be motivated to make improvements in their buildings and maintain the housing stock in the city and state of New York?” he asked rhetorically. “I think it’s clear from the discussions that people are having since the law was passed that this is no longer the case.

We may very well go back to the days of ‘the Bronx is burning’ because there is little or no incentive for landlords to make any improvements whatsoever.”

The Brooklyn Bar Association hosts regular CLEs for attorneys at its headquarters in Brooklyn Heights. The organization’s next CLE will be the 2019 Annual Update on Friday, Nov. 15; it is a daylong CLE worth eight credits. It will be presented in conjunction with the New York State Academy of Trial Lawyers and will feature 10 different attorneys including the academy’s president Angelicque Moreno.
