PRESIDENT’S MESSAGE Happy New Year!
Welcome to 2013!
W
e are very excited about the upcoming year at SDDS. We will continue to have great opportunities in continuing education prog ra m s, Midw inter C onvent ion programming, monthly General Meeting speakers and many social and business meetings, as well as opportunities to make your practice and your “personal-and-funevents-side” of your life fulfilled. I look forward to serving as your SDDS President for 2013 and welcome the opportunity, the challenge and the honor. To our members: you are privileged to have at your access THE BEST dental component in California, if not in the nation! Many opportunities await you — all you need to do is get involved and remember that this is YOUR dental society. During my installation as your President in early December, I gave an overview of where our Board sees the vision and near future of SDDS. I would like to share with you the excerpts from my address… Last year I was able to host the annual Past Presidents Dinner and could not have been more in awe of the people who have gone before me. I can only hope to live up to the high bar that has been set by these former SDDS Presidents! As we went around the table, each former President talked about their year, including what challenges they and SDDS faced during their term. As you can imagine, it was inspirational and educational to hear the challenges and the accomplishments that each person faced. Also interesting were the changes that have taken place over the past decades. The constant theme that kept rising to the surface was: “What was best for the members and how will the decision being made affect the membership?” That is the question that we in leadership should always ask ourselves in making decisions — how does it benefit the member? Always, the member should come first! One of the things we will be moving forward on is moving to a new building. The people
4
who had the vision to purchase our current 28th Street building were forward-thinking people; they helped to make SDDS the great organization that it is and helped to place us in a solid financial and successful position. However, our growth over the last 20 years has made our current building too small for our expanding dental society. The challenges in our current office situation are, among others, not enough space, security issues, limited parking for our visitors, meetings and events, storage challenges and many others. We are currently looking for a new headquarters and it appears that we are close to closing a deal. As the information and details become clearer, we will certainly keep you informed as to the progress and will look forward to a bigger, safer and more accessible building in the near future. The plaque that is in the current Board Room recognizes and honors the many contributors who helped us purchase our current building; that Capital Campaign in 1993–4 was a tremendous undertaking! Thank you to all! When we relocate, the plaque will be placed in a spot of honor as well, but we have grown significantly. Just 20 years ago we had an annual budget of $500,000; today we are $1.2 million. Our membership numbered 1000; today we are approaching 1600 members. We had great visionaries but I don’t believe that anyone could have seen or predicted the great growth that we have experienced. Today our dental society has 80% of the market share of dentists in our area compared to just 65% 20 years ago; just as a family grows and outgrows a home, so has SDDS. Our plans for the new building are exciting and include a classroom for continuing education programs, a larger board room, an in-house peer review exam area, storage for supplies and programs, more administrative space (as our membership grows, so does the need for increasing staff and plans for future growth), LOTS of free parking, and

better security for staff and members. This space will allow us to bring more programs in-house and to be able to control rising costs of hotel/ meeting space. It will also give us a dental headquarters of which we will continue to be extremely proud. It is important that we remember our history but also plan for the future, looking forward to ways of

An alleged access challenge has led to the proposal of mid-level providers. On the face of it, creating more providers would seem to make sense. In reality, does it?
O
nce again we revisit Mid-Level Providers — the issue that seems to be immortal, a bit like Dracula. Re-printed here is Guy Acheson’s report from the California Academy of General Dentistry GPNews. Also reprinted are the views of Dr. Gordon Christiansen. Though himself a board-certified prosthodontist, Dr. C is probably best known to general practice dentists for his materials and products updates via his Clinicians Report newsletter and his Practical Clinical Courses, established in 1981. Within our profession he is likely the best-known dentist on the planet. Then our own Editor-In-Chief, Jim Musser, weighs in with a pediatric specialist’s take. It occurs to me that not all of our specialties would be affected to the same degree as others: for example, orthodontists have many procedures that are not “irreversible,” hence can be performed by auxiliaries. By contrast, in remote areas of Alaska, nondegreed providers can extract teeth without onsite supervision. Closer to home, there has even been talk of permitting auxiliaries to obtrude root canals (“reversible,” right?). So it may well be that CDA, with a great many specialist members, was not fully aware of
the ramifications. On the other hand, my conjecture is that CDA, taken as a whole and considering the unique ethnic diversity in California, was presented with a situation in which non-dental entities (Pew, Kellogg, the State Legislature) were clamoring for a “solution,” and they had the clout to do it. So we attempted to make the best of a bad situation. Which is understandable: in politics, making the best of bad situations appears to be the norm. What seems to have happened with the midlevel issue is the unforeseen consequences of good intentions gone awry. A real or perceived access challenge led sincere and well-meaning people to take ACTION. On the face of it, creating more providers would seem to make sense. However, if, say, a repeal of motorcycle helmet laws resulted in an overwhelming increase in number of head injuries, would it seem reasonable to provide some abbreviated training to operating room surgical assistants who would then do minimally supervised brain surgery? So the issue is not really dead, more like sleeping. The scary part is that it could be reawakened by legislative means. Stay tuned.

SB694 (2011–12) — Rest In Peace

I
t is DEAD! SB694 (Padilla) is DEAD! This bill also would have completed a workforce study on Dental Assistants and Dental Hygienists performing tooth preparations for and placement of amalgam and composite restorations, preparation of teeth for and placement of stainless steel crowns, pulpotomies on deciduous and permanent teeth, and extraction of deciduous teeth in children up to the age of 21. Incredibly, not only were these procedures being promoted to be done by non-dentists, but under a variety of levels of supervision including remote supervision, where there would not be a dentist physically present where the procedures were being done.
The CAGD was resolute in its opposition to the concept of non-dentists performing surgical and irreversible dental procedures on children and held firm to our position in the face of strong pressure from the California Dental Association. We were repeatedly confronted with the question, “How can the Academy of General Dentistry, an organization committed to education and evidence based dentistry, oppose a study? … It is JUST a study… It is NOT a workforce project.” Our answer was that this study was to be a political theater whose outcome would be easily controlled from the onset and, as we predicted, it did become a workforce project!
The bill had sailed through the California Senate and was racing its way through the Assembly, until it hit the Assembly Appropriations Committee. The bill was not released from the Appropriations Committee, which killed it on August 16. For the past year, the California Academy of General Dentistry (CAGD) has been working to defeat this bill. We have been shouting out the true intentions of this legislation at virtually every dental society meeting and have been at the microphone at the 2011 CDA HOD and the Special HOD on SB694 last March. We have been very troubled with how CDA leadership and their media messages have downplayed the significance of this legislation and worked to make it seem to be a very low keyed topic.
The bill started out being instructions to the Director of Consumer Affairs to report to the Legislature on access to dental care in California. Later, it was amended to require the Dental Board of California to conduct an analysis on the dental care needs of California residents. It was further amended to order the creation of the position of Dental Director, a licensed dentist, who would first determine if a study of workforce was needed, and if it was determined to be needed the Dental Director would convene an advisory group to determine the design of the study. SB694 was amended seven times over its journey through the Legislature. In the end, the Dental Director position was made optional and, if it did exist, would only have administrative oversight on the study. The study started as an assessment of access to care for Californians and ended up being a workforce pilot project. At a stakeholder’s meeting with Senator Padilla, I personally

brought up my concerns about how the study was being designed while the bill was being pushed through the Legislature instead of waiting for the Dental Director. The Senator very boldly stated that it would be much better to have the study determined by 120 sets of eyes (the Legislature) than by one set of eyes. Senator Padilla was going to control the study to show what he and The Children’s Partnership wanted…that non-dentists performing surgical dental procedures was safe and effective.
CAGD is very concerned about the oral health of all Californians, especially our children. We fully support the concept of a Dental Director in California. Drs. Langstaff and Acheson met with Senator Padilla’s legislative staff two times in an effort to promote alternatives to creating a new dental provider in the effort to
The bill started in the Senate in January and was to pass through three committee hearings before going to the floor of the Senate for a vote. The first hearing was the Senate Business and Professions committee where Dr. Eric Wong spoke against SB694 on behalf of CAGD. The bill then moved to the Senate Health Committee where Dr. Bill Langstaff and Dr. Stephen Skurow flew up from southern California to testify. The last senate hearing was in Senate Appropriations and CAGD was not able to have a member testify, although Dr. Steve Leighty, a Roseville oral surgeon, spoke in opposition to SB694. He spoke as a representative of the California Association of Oral and Maxillofacial Surgeons, who had taken a position in opposition to non-dentists performing surgical dental procedures. Interestingly, the California Nurses Association also spoke against SB694 at all the hearings because of nondentists performing surgical procedures. By January 26 the bill was unanimously approved in all Senate committees and went on to the Senate floor where it passed 34–2 with four abstention/no votes.

Acheson and Langstaff, representing CAGD, and Dr. Harriet Seldin, representing the San Diego County Dental Society, spoke against the workforce study and for various methods of utilizing existing dental providers to address the dental care needs of children. Although we had the minority opinions in the room, Senator Padilla invited us to the meeting both times to hear our suggestions.

In June, the craziness began all over again as the bill passed through Assembly Committees. Dr. Acheson testified at the Assembly Health Committee. In July, American Student Dental Association leaders Marquis and Hellickson joined Dr. Penumetcha in testifying against SB694 at the Assembly Business and Professions Committee. The California Nurses Association continued testifying against SB694 at both meetings. Finally, in August, the bill went to the Assembly Appropriations Committee, was placed on the Suspense file and kept in Suspense so that it would not reach the Assembly floor for a vote. In the craziness that exists in the mirrored halls of the Legislature, SB694 was defeated in Assembly Appropriations Committee by being held in Suspense with no public testimony and no public votes. We really don’t know what issues or arguments really killed SB694. The unfairness of a two tiered dental system? The degradation of patient safety by allowing non-dentists to perform surgical procedures on children under remote supervision? The reality that there are more dentists per capita in California than any other place in America and that dentists are leaving the state because of lack of business? The several studies that demonstrate that non-dentists don’t make economic sense? Or was it the concern that creating the Office of Oral Health would obligate California to pay for the office and staff when private funds ran out that killed the bill? We really don’t know. But what I do know is… DEAD IS DEAD! Warning: this issue will be back. Get ready.

he following expresses my candid opinions on the now in-vogue concept among politicians — midlevel dental practitioners. As a long-time educator, practitioner and researcher, I have watched opinions vary as history has repeated itself for over the last one-half century. At this time, we are in yet another movement to satisfy the “access to care” challenge by saturating the dental manpower marketplace. Several factors are evident currently that relate to this movement. There is no question that auxiliary dental staff persons can accomplish some oral preventive and treatment procedures. I am well-known to be a proponent of dentistsupervised staff persons accomplishing many clinical tasks.

Many dentists are unemployed. New dental schools are opening across the country. Most of them are NOT in conventional research and service-based universities. These schools

A few months ago, I made a survey of the profession relative to the challenges “real world” practitioners see, and I provided that survey to the ADA Board of Trustees. The survey supports my points made above:

As I provide courses around the country — 80 programs in 2012 — I see THOUSANDS of dentists in major financial distress. There are dentist bankruptcies in almost all cities. Although the recession appears to be slightly recovering, dentist financial challenges are still present. Many specialists
New dentists have school debts that average between $250,000 and $300,000. They are financially stressed and forced to do anything to survive. Many new dental hygiene schools have opened in recent years. In numerous geographic locations, dental hygienists cannot find employment.
Practitioners of any type choose the place they prefer to practice, and market saturation has NOT improved access to care in those locations where others have tried it.
It is time for those who actually deliver oral health care and see the challenges on a daily basis to speak up! Currently, mid-level practitioners are not needed, have not been in the past and will not be in the future, to satisfy the access to care problem! Beware
the Camel’s Nose

After months of sturm und drang, the bill finally died in committee, among grave portends of what would happen next, and how much influence organized dentistry would have on the next version. The impression that dentistry had “dodged a bullet” and we had seen the last of this monster was quickly squelched. As a pediatric dentist, I have several concerns about the inevitability of mid-level care providers in California, and the Editor of this issue has asked me to share them with the membership. So here goes:

render almost all types of care on pediatric patients and the early dentition. Disregarding for a moment (and it’s a BIG disregard) the difficulty of treating these patients, the procedures that were being discussed: dental restorations, pulpotomies, stainless steel crowns, and extractions, all done under local anesthesia, seemed to be more in the province of a USC pedo grad student than a mid-level provider two years out of high school. I have a hard time believing that an SSC placed by one of the newly minted midlevel care providers would be at the same level of excellence. This, of course, leads to the obvious question of how many of Senator Padilla’s children would be treated by a midlevel provider, or any members of the State Legislature’s children for that matter.

Around this time last year, the main topic of conversation in California dental circles seemed to be about Senator Alex Padilla’s (D-San Fernando Valley) SB 694, the “Mid-level Dental Provider Care Bill.”
The lack of “access” urban legend I always hear how impossible it is for children to be treated in California these days. A three month wait to get into a clinic; if specialty care is needed the wait is even longer. I personally have not run into this situation. Children are referred to me from all over northern California and rarely have to wait more than a couple of weeks to be treated, if that long. If the “access” is really the problem, why not direct the State’s efforts toward making more treatment times available in surgery centers and not toward creating a new level of provider?
The camel’s nose argument, or incrementalism always happens. When I first was presented with the arguments for mid-level providers it was by the highest of the officers of CDA and CSPD, people for whom I have immense respect. When I asked them to assuage my fears about the inevitable “mission creep” of the providers, I was told that CDA would be on top of it at all times so there was nothing to worry about. That IS a camel’s nose you see under the tent flap, but we have that camel restrained so well it will NEVER make it any further into this tent. So, I, along with many of the other attendees at that meeting were left with the uncomfortable choice of believing this will be the first time in history the camel doesn’t make it into the tent, or opposing the proposed legislation. As I stated earlier, all of these concerns became moot when the bill died in Committee; however, it is absolutely certain another attempt will be made to advance some sort of legislation of this type in a future legislative session. It will be of extreme interest to me to determine how the new incarnation will address these old concerns of mine.

Oh my gosh… have we been BUSY! Current status of the 1 Tooth or 1st Birthday Medical Outreach Task Force. st

Tooth or 1st Birthday hit the streets HARD in 2012. In one year we went from an action planning task force to a full-on outreach campaign that IS making an impact on children’s oral health. st
We developed a PowerPoint presentation to use in reaching out to pediatricians and I presented that program at the general membership meeting in September. We developed refrigerator magnets to distribute to pediatric offices with the 1st Tooth or 1st Birthday message, the SDDS phone number, and SDDS web address. These emphasized SDDS being a one-stop-shop, providing names of dentists who welcome young children in their practices and helping sort through any insurance issues the young families might have. I have presented our program to The Sierra Sacramento Medical Society, The Greater Sacramento Sutter Pediatric Group, Sutter Elk Grove Pediatrics, Kaiser Rancho Cordova Pediatrics, Kaiser Folsom Pediatrics, Kaiser
Elk Grove Pediatrics and Kaiser Point West Pediatrics. Mercy system pediatricians are next on our list. Cathy Levering, Dr. Chester Hsu and myself were interviewed by radio personality Kat Maudru for her program that aired on The Eagle and The End over several days. I even had patients tell me they heard the program and enjoyed it. We launched public service announcements on the radio about 1st Tooth or 1st Birthday, paid for by subscribing member dentists, which has been very successful in driving traffic to the SDDS office, website and participating dentists. 2013 will see us continuing to present to area pediatricians and pediatric groups. Our goal is to make contact with every pediatrician in the greater Sacramento area. At every opportunity, we talk about First Tooth or First Birthday with politicians and educators. We are discussing a possible joint continuing education program for dentists and pediatricians on early children’s dental caries. Want to help? Call Cathy or me.

T
he Dentists Insurance Company (TDIC) reports needlestick injuries as its number one workers’ compensation claim, and with this claim comes the concern of exposure to hepatitis B (HBV), hepatitis C (HCV) or human immunodeficiency virus (HIV), also known as bloodborne pathogens. Because of the potentially serious nature of a needlestick accident, TDIC recommends that dental practices have a post-exposure plan in place.
Post-exposure plan necessities include:
patient testing. Employers are required to pay for the employee’s evaluation. However, all workers’ compensation policies, including TDIC’s, cover testing for employees in the event of a needlestick injury, said Deborah Boyd, Workers’ Compensation Claims Manager for TDIC. In the event of a needlestick exposure, a wound that has been in contact with blood or bodily fluids should be washed with soap and water; mucous membranes should be flushed with water. If an employee declines a post-exposure medical evaluation, complete an “employee informed refusal of post exposure medical evaluation” form. This form is located on thedentists.com under the Risk Management/Recordkeeping link. The best practice is to also send the source patient for testing.
• Immediate reporting of a needlestick injury to the dentist
“Depending on the result, this can eliminate the need for the exposed employee to take precautionary antiviral medications,” Boyd said.
• Forms documenting the exposure and, when necessary, employee or source patient refusal of medical evaluation or testing
TDIC covers insureds for source testing under TDIC’s Professional and Business Liability Policy.
• A sharps injury log • A preselected physician from the medical provider network (a referral list provided by the workers’ compensation carrier) who can evaluate the exposed dental professional within 24 hours
TDIC Risk Management analysts are available to assist dentists with the appropriate language to use when asking a patient to have a blood test following a needlestick exposure to an employee. However, the source patient is within his or her rights to refuse testing.

As of November 28, 2012, dental practices are required to post a new notice to consumers. The notice must be accessible to public view on the premises where dental services are provided. The notice must be in at least 48-point type font and include the following statement and information:

Sales & Use Tax Rate Increase Sales and Use Tax Rate Will Increase on January 1, 2013 Due to voter approval of Proposition 30, the statewide sales and use tax rate will increase one quarter of one percent (0.25%) on January 1, 2013. YOU ARE A DENTIST. You’ve been to school, taken your Boards and settled into practice. End of story? Not quite. Are you up to speed on tax laws, potential deductions and other important business issues? In this monthly column, we will offer information pertinent to you, the dentist as the business owner.
Practice Transition:
Active Patient Files From Western Practice Sales (SDDS Vendor Member)
I
s the number of “Active Patient Files” an important issue in a practice purchase?
Great Question! My answer is emphatically YES! When you buy a practice, you are paying mostly for the “book of business” generally referred to as “goodwill,” “cash f low,” profitability, etc. What you are actually buying is the opportunity to meet all the patients of the practice and win them over
Of course, it is up to the buyer to determine if they can fill the shoes of the seller. to continue their treatment in that office. Unfortunately, there is no single definition of what constitutes an “active patient.” In a recent situation, the seller’s patient count was 1800, while my count was 1500 and the buyer’s count was 450 patients. Amazingly, the buyer actually increased the practice production in the first month of ownership! Obviously the buyer’s definition of an “active patient” was much more stringent than the seller’s, but the actual number did not matter as the buyer proved to be much more adept in treatment planning the existing patients. Of course, it is up to the buyer to determine if they can fill the shoes of the seller, continuing to perform as well with that “book of business.” The problem is that if we put a patient in

the middle of ten dentists, we might get ten treatment plans that are light years apart. This could even happen with ten classmates from the same school, who respect each other! Conclusion: 800 active patients (whatever the definition) in one doctor’s hands might yield a $1 million practice and the same patients in another doctor’s hands might yield half that amount. In the case of a practice where a classmate who is a conservative treatment planner buys out the more aggressive treatment planner, chances are that this buyer may go broke as he will never produce what the seller produced. Result: Lawsuit, name calling and finger pointing, regardless of the patient count! Reverse the scenario and the result will be a buyer who doubles production in the first year and the broker is a genius! I recently had a buyer’s attorney remove the contract clause that took the responsibility of the patient count out of the buyer’s hands. While that might help the buyer if a lawsuit ensues, all parties lose if poor due diligence results in a bad transition and a lawsuit. All buyers need to do a chart review themselves and confirm that they are capable with their own skill set and/or agree with the philosophy and treatment being prescribed to that patient base. The best way to prevent a misunderstanding or poor result in a transition is to make sure the buyer does his own due diligence concerning the practice philosophy of treatment planning. A patient count, whatever the definition, is important, but should not be used as ammunition to defend poor due diligence.

DOES THE MEDICAL DEVICE EXCISE TAX APPLY TO DENTISTS? The Patient Protection and Affordable Care Act of 2010 introduced a new 2.3% excise on the sale of medical devices beginning in 2013. For the past two years dentists and dental labs have contemplated if this tax applied to them. In February 2012, the IRS issued proposed regulations and deferred to the Food and Drug Administration to define a medical device. Although these regulations are not final, in their current form, under the federal Food, Drug and Cosmetic Act (FDAC), the FDA requires all manufacturers, producers and importers of medical devices to register with the FDA. Although these “listed” medical devices are subject to the new 2.3% excise tax, subsection 510(g) and regulation 807.65 of the FDFA provide exceptions: The registration rules (except for importers) do not apply to licensed practitioners who prescribe or administer devices, and who manufacturer these devices solely for use in the course of their professional practice. The FDA regulations explicitly states that dentists (and dental labs) that manufacture or alter medical devices exclusively for use in their practice (or labs that provide devices to be dispensed by dentists) are exempt from registration. If dentists or dental labs are not required to register with the FDA, the devices they manufacture are not subject to the new excise tax. Based on these regulations, domestically manufactured crowns, bridges, dentures, dental implants, orthodontic devices, retainers, etc. are not subject to the new excise tax on medical devices. CORNER I have a dental laser I use in conjunction with periodontal therapy. Can I charge an extra fee for performing laser curettage or therapy over the cost of a periodontal treatment I am providing (i.e. prophy, scaling and root planning)? Unfortunately the answer is no. You cannot charge extra for use of a laser in periodontal therapy. It is generally assumed that during periodontal therapy or after treatment instruments such as a scalier, ultrasonic scalier, medicated rinses and lasers could or will be used. It is a breach of section seven of the CDA code of ethics which states ‘A dentist has the obligation to submit any billing for services rendered or to be rendered in a manner which is not fraudulent, deceitful, or misleading.’ Currently there is only one excepted extra charge to periodontal therapy, the use of atradox or Arestin CDT D4381.
