grille, the iconic side window graphic, and the blue accent surfaces at the front, sides and rear have clearly adopted the BMW i styling that already featured on the BMW i Vision Dynamics presented in 2017. Unlocking the vehicle causes the blue accents to light up, accentuating its eye-catching lines. Glass surfaces such as the large windows and the lights are integrated seamlessly into the design and have the appearance of elaborate inlays. Kidney grille and “four-eyed” front end provide identity. In the centre of the front end stands a large, upright kidney grille. As with all electrically powered vehicles, the grille is blanked off. Florida Woman Objects to $250m Settlement in $1b+ State Farm Parts-Judge Case A member of the class of plaintiffs suing State Farm over its alleged conspiracy to elect a sympathetic judge has formally opposed a $250 million settlement announced the day of the trial. Lisa Marlow of Cocoa, Fla., filed the objection on Saturday, arguing that the attorneys settled for far too low a number and sought too large a cut in attorney’s fees. She noted that the plaintiffs’ own expert estimated the potential award should they prevail in Hale v. State Farm could be $7.4 billion. The class-action Hale et al v. State Farm et al litigation involved everyone who twice won the Avery et al v. State Farm $1.05 billion lawsuit for State Farm’s use of non-OEM collision repair parts

but who subsequently lost an Illinois Supreme Court decision following the election of allegedly State Farm-backed Judge Lloyd Karmeier. The Hale plaintiffs argued that Karmeier should have recused himself or been prevented from hearing the appeal. They alleged State Farm played a huge role in his campaign and contributed more than $4 million of Karmeier’s $4.8 million war chest, and then concealed their efforts from the State Supreme Court. State Farm has denied those allegations. Karmeier has said he purposefully didn’t look at his contributions during the campaign, and he found no evidence of State Farm contributions when asked to recuse himself.

According to an Illinois Issues story posted on St. Louis Public Radio: Although Avery v. State Farm had been argued in May 2003, it was still pending in December 2004, when Karmeier was sworn in. According to a timeline provided by Karmeier, he initially wasn’t going to participate in the case. But when his colleagues were still deadlocked in January 2005, Karmeier stepped in, voting to join the majority opinion overturning the billion-dollar victory. Eight days later, lawyers for the plaintiffs filed a motion asking that Karmeier not participate in Avery. The full court initially denied the motion, but eventually ruled it was for Karmeier to decide alone. He stayed in. “He was dead wrong,” collision

industry advocate and attorney Erica Eversman (Vehicle Information Services) said of Karmeier last month during a SCRS Repairer Driven Education panel at SEMA. A recusal is warranted any time there’s a question of people’s faith in the justice system being shaken, Eversman said. Marlow wrote that the plaintiffs had a history of beating State Farm in the years leading up to the trial. “The record shows they were wellsituated to succeed at trial,” Marlow wrote. She said the attorney’s concern over losing the case rang hollow. “Having achieved such enormous success in litigating the case, Plaintiffs and Class Counsel now seek to convince the Court that their RICO claims were not nearly as strong as it objectively appears, and that the case was vulnerable to various defenses that had already been repeatedly rejected by this Court and the Seventh Circuit,” Marlow wrote. “These self-serving arguments are a far cry from the positions espoused in their recent summary judgment briefing, where they vigorously extolled the strength of the evidence backing the RICO claims.” Settling for $250 million instead of going for the $7.4 billion was a “poor result” given the record of wins for the plaintiffs, she wrote. Eversman also called the $250 million settlement a “drop in the bucket” compared to the potential $7.4 billion but

In other words, if the Plaintiffs’ evidence could establish the RICO violations

they allege, and Class Counsel repeatedly told this Court that was the case, because the sole injury was the loss of the $1.05 billion judgment and the post-judgment interest lost since 1999, the jury would have been hard-pressed to consider a different amount. And that amount, whatever it was, would have been automatically trebled by the Court. Thus, before prejudgment interest, the damages would have been no less than $3.15 billion, over twelve times the amount of the proposed settlement.” LKQ CEO Nick Zarcone suggested last month that State Farm might ramp up its usage of aftermarket parts following a formal court acceptance of the settlement, scheduled to be considered in December. Once the lawsuit is formally settled, “we would not be surprised if ultimately, State Farm joins most every other auto insurer and begins to slowly reintroduce the utilization of our high-quality, costeffective certified aftermarket parts — which by the way come with a lifetime warranty,” he said. years ago, the BMW Group launched “project i” as part of its NUMBER ONE strategy and promptly became a pioneer in electric mobility. Today, vehicles with combustion engines and plug-in drive systems are built on the same architecture. But Marlow argued an “inherent difference” existed between a deal with one plaintiff and “negotiating a contingency-fee contract with a plaintiff class where the anticipated recovery will differ substantially.” The plaintiffs have said more than 1.5 million class members had received direct notice of the litigation and many of the other estimated 4.7 million class members might have found out about it through “nationwide publication and social media efforts.” $250 million minus the attorneys’ bill works out to $160 million. Divided by 4.7 million, this works out to about $34.04 each. Splitting it among 1.5 million comes to about $106.67 each. According to Marlow, the Seventh

Circuit Court of Appeals has ruled that “'[a]n award fixed at 27.5% of a $200 million fund is exceptionally high’” and also “’at the outer limits of reasonableness.’” She felt the lawyers should get 21.81 percent for a payout of about $54.5 million. (Expenses weren’t mentioned.) The attorneys also are overstating the risk they assumed in taking the case, Marlow wrote. “This argument is belied by the fact that, as the case progressed, more and more law firms and attorneys began appearing on behalf of Plaintiffs and the putative Class,” Marlow wrote. “In other words, when this suit got under way, four of the original Avery plaintiffs’ law firms were listed as attorneys. There is no evidence that the plaintiffs’ bar saw this litigation as “too risky” for their practices. Indeed, the docket evidences that while four law firms filed the original RICO action in May 2012, as the case progressed, addi-

tional law firms and attorneys joined in to represent the Plaintiffs, and that by the time the case settled, seven additional law firms had appeared for the Plaintiffs and at least thirty-nine (39) attorneys entered appearances in the case for the Plaintiffs. Even early on in the case, reputable, prominent and nationally-known Plaintiffs’ law firms – class action powerhouses Hausfeld LLP and Lief Cabraser, and well-known Chicago mainstays Much Shelist and Clifford Law Offices – joined the case on behalf of Plaintiffs.” Marlow also felt that the named plaintiffs didn’t deserve $25,000 for their efforts, only $5,000, since none of them had “submitted so much as a declaration attesting to his or her efforts on behalf of the class, much less how the class benefitted from such efforts or how much time was expended on the case.”Copyright © 2018. Intelligent energy management optimises driving fun and efficiency. The intelligent energy management system controlled by the power electronics of the plug-in hybrid system ensures that the interplay between the combustion engine and the electric motor is optimised for both driving fun and efficiency in all situations. Using the power of the electric motor alone, the MINI Cooper S E Countryman ALL4 is able to provide locally emissions-free driving fun with hallmark brand spirit in many situations in day-today traffic. In the event of more intense acceleration, the electric motor supports the combustion engine via a boost function. A total system output of 221 hp and a combined torque of 284 ft-lbs. are available for athletic sprints. The MINI Cooper S E Countryman ALL4 accelerates from 0 to 60 mph in 6.8 seconds. Two power units, four drive wheels. Only one of the two power units is used when the car is moving, while the other one can be additionally enabled at any time to optimise traction, ride stability and agility. The signal required for this purpose comes from the Dynamic Stability Control (DSC) unit, which permanently analyses both the situation on the road and the driver’s wishes. “The result is an intelligent all-wheel drive system that ensures perfect movement in all weathers and on all road surfaces,” explains Uwe Seitz, MINI Cooper S E Countryman ALL4 project manager. The precisely controlled interaction achieved in the powering of the front wheels by the combustion engine and the rear wheels by the electric motor is the same as the principle that is applied in the BMW i8, only the other way around: it is a key factor that contributes to the exceptionally fascinating character of the plug-in hybrid sports car. In the standard setting AUTO eDRIVE, the MINI Cooper S E Countryman ALL4 runs on electrical power only up to a speed of 55 mph . At higher speeds and in the case of very intensive loads, the combustion engine is automatically enabled in addition. In MAX eDRIVE mode the vehicle 16

Thanks to the compact structure and arrangement of the eDrive components, the plug-in hybrid model variant of the new MINI Countryman has a versatile interior. The high-voltage battery is housed underneath the slightly raised rear seat, as is the 9.5-gallon fuel tank. The rear backrests offer the possibility of a 40 : 20 : 40 split; they can also be folded down and varied in their tilt angle. “The entire hybrid technology is installed in such a way that you don’t notice it inside the car at all,” says Uwe Seitz, MINI Cooper S E Countryman ALL4 project manager, “with the exception of the controls used to activate the various driving modes.” Hybrid-specific design features and displays. Discreet but equally unmistakable indications of the pioneering character of the car’s drive form are provided by the model-specific design features on the MINI Cooper S E Countryman ALL4 exterior. specific “e” badge on the side scuttles and also a yellow “S” in the model inscription on the rear as well as on the radiator grille and door sill finishers. The special features of the cockpit include a yellow start/stop unit at the centre of the toggle switch panel and a performance display in the instrument cluster on the steering column. CAPA Announces New Standard for Aftermarket Exterior Cameras CAPA Standard 702, for exterior cameras. The standard, which currently applies to rear-view cameras only, but may be expanded to include side- and front-view cameras in the future, includes requirements for: image quality, ingress protection, electric components, mechanics, performance, material identification, dimensions, appearance, function, construction, retaining features, electromagnetic compatibility (EMC) and vehicle test

fit (VTF). Certification of aftermarket exterior cameras will help to ensure that vehicles equipped with aftermarket replacement exterior cameras are comparable to original car company service (CCS) parts, and do not take vehicle systems out of original compliance as certified by the original equipment manufacturer (OEM). LKQ Sees State Farm Settlement as ‘Positive’ for Aftermarket Parts Industry LKQ CEO Nick Zarcone suggested last month that State Farm might ramp up its usage of aftermarket parts following its $250 million settlement of a lawsuit tied to a notable $1.05 billion parts case. The U.S. Southern District of Illinois in September granted preliminary approval to a $250 million settlement agreement for what might be as many as 4.7 million people in a class that had alleged State Farm conspired to elect a sympathetic judge and concealed those efforts from the Illinois Supreme Court. The class-action Hale et al v. State Farm et al litigation involved everyone who twice won the Avery et al v. State Farm $1.05 billion lawsuit for State Farm’s use of non-OEM collision repair parts but who subsequently lost an Illinois Supreme Court decision following the election of allegedly State Farm-backed Judge Lloyd Karmeier. Karmeier did not recuse himself from the decision. The new Hale lawsuit had initially sought new damages of $7.6 billion for the entire class. (State Farm and the other defendants disagree with that amount.) Ironically, the $250 million Sept. 4 settlement announcement came the same day as State Farm announced it had bought 18 years of naming rights to the Arizona Cardinals’ stadium. Despite the win before Karmeier’s

court, State Farm had still for the 20 years since the initial Avery case “largely had not used aftermarket parts,” Zarcone told analysts on an Oct. 25 third-quarter earnings call. (Special thanks to Seeking Alpha, whose transcript of the call helped us to check quotes.) He said that after years of having to answer “‘no new news'” to questions about State Farm, “there’s finally been some new news.” Zarcone said the settlement needed to be finalized by a court. U.S. Southern District of Illinois Judge David Herndon will hold a “final fairness hearing” on the settlement at 9 a.m. Dec. 13. Class members can file objections until Nov. 17. “To our knowledge, State Farm has not made any public statement regarding its intention to reinstate the use of aftermarket parts,” Zarcone said last month. However, once the lawsuit is formally settled, “we would not be surprised if ultimately, State Farm joins most every other auto insurer and begins to slowly reintroduce the utilization of our high-quality, cost-effective certified aftermarket parts — which by the way come with a lifetime warranty.” Zarcone said that while LKQ couldn’t comment on when or how much State Farm would increase its aftermarket parts usage, but “we generally view this as a

positive for our industry.” He said LKQ keeps meeting with State Farm — the nation’s No. 1 auto insurer — regularly and it would tell analysts if there’s any material information on this front. “We view this as a positive,” he said. LKQ’s North American aftermarket parts segment is about a $3.5 billion business already, Zarcone estimated. Months before the settlement, a May memorandum provided by a Select Service source indicated State Farm had agreed to allow new classes of certified aftermarket parts on customers’ vehicles. The May 3 document stated: When an estimate is prepared by State Farm or a Select Service repairer, the following new non-OEM crash related parts, when subject to certification standards developed by an organization approved by State Farm,* will be certified unless otherwise requested by the vehicle owner: Bumper components Lighting components Radiator supports/tie bars and associated mounting components Outer sheet metal and plastic / composite parts LKQ / State Farm Turn to Page 20

CIF Requests Donations to Assist California Fire Victims The Collision Industry Foundation (CIF) said its' Disaster Relief Task Force is in full swing providing aid to industry victims of the most recent California fires. With this new batch of wildfires including the Woolsey Fire and Camp Fire, the latter of which has thus far killed 77 people and destroyed more than 12,794 structures*, and now becoming California's deadliest and most destructive wildfire on record. Just in front of the Thanksgiving holiday, and inching close to #GivingTuesday, CIF aims to bring awareness of its' mission and seek support for disaster victims. Tax deductible dona-

tions are requested to assist collision repair professionals in need. A paint jobber in Chico, Calif., just 14 miles away told CIF they are fine; however, the smoke is thick and low, and the entire staff is wearing respirators while working. "At this time when we give thanks, we need to think of the folks in our industry needing our help," stated Bill Shaw, CIF President and PPG Director of Business Development. "We encourage all industry stakeholders to support our efforts and to make tax deductible donations."n

A month before the memo, State Farm announced the first of a series of rate cuts for more than 30 states. The reports come following premium cuts in numerous states by State Farm, raising the question of if the carrier is attempting to offset the decreased revenue with denials on the claims side — regardless of what OEM procedures dictate or what at least one State Farm executive has learned from automakers.n

Running a world-class manufacturing facility while also making it a priority to be good stewards of the environment is a model for manufacturing in Tennessee.” Volkswagen Group of America’s commitment to Tennessee began with its decision in 2008 to build a plant in Chattanooga along with a promise of environmental stewardship in connection with the operation of the plant. Volkswagen committed to restoring the area wetlands, which were destroyed by the former occupants. As of 2018, the Volkswagen wetlands have grown from 40 to more than 88 acres. Adjacent to the 88 acres of wetlands is the 33-acre Volkswagen Chattanooga Solar Park. The park contains 33,600 solar modules which produce 13.1 gigawatt hours of electricity annually. The electricity from the solar park meets more than 12 percent of the plant energy requirements during full production and 100 percent during nonproduction periods. In 2011, Volkswagen’s Chattanooga manufacturing plant received a platinum certification from the U.S. Green Building Council’s (USGBC) Leadership in Energy and Environmental Design (LEED®) green building certification program. The facility is the first and only automotive manufacturing plant in the world to receive the USGBC’s Platinum certification. Volkswagen strives to maximize gains in energy conservation while balancing manufacturing operation energy requirements. Electric motors used in manufacturing require high energy costs, however Volkswagen uses high-efficiency motors saving up to three million kwh annually. In addition, Volkswagen installed T5 lightbulbs throughout the facility that save approximately 1.15 million kilowatts a year, or enough energy to supply 280 households. Beyond managing energy consumption, Volkswagen implemented innovative environmentally engineered production processes. The company’s paint shop uses a new technology—waterborne base coat— that incorporates the primer, eliminating a step in the painting process and, more importantly, an entire oven-baking session, which helps cut carbon dioxide emissions by approximately 20 percent. Volkswagen Chattanooga collects rooftop rainwater and repurposes it into cooling the welding robots. Colorado Dealership Shop Warns Insurers It Won’t Deviate From Oem Procedures By John Huetter A Colorado dealership chain’s collision center last month issued a powerful open letter vowing to use OEM repair procedures and hold staff and insurers who didn’t document or support them accountable. Rickenbaugh Automotive Group, which owns Cadillac, Volvo and Infiniti dealerships in the Denver area, wrote its garagekeepers carrier warned that failure to follow automaker instructions could jeopardize its protection from litigation. “Our insurance partner called the meeting to ask us what our processes and procedures were with regard to following OEM repair procedures, position statements, and programming of vehicles equipped with ADAS systems,” the Oct. 5 open letter by Rickenbaugh Vice President Nick Pacifico states. The letter references the John Eagle Collision Center litigation that saw a Texas body shop slapped with

a $31.5 million verdict for failing to follow Honda repair procedures. (The case was later settled for an undisclosed amount.) “Our insurance partner wanted us to verify that we are following all recommended and required repair procedures for all OEM’s,” Pacifico wrote. (Emphasis his.) “They informed us that in a court of law there would be no difference in how the court viewed the words recommend and required. They felt that any procedure that was labeled recommended would be viewed as required and we would be liable in a court of law.” Pacifico explained in an interview Monday that the letter’s description of garagekeepers carrier Sentry was exaggerated to make a point. Based on the interview, it also appears to be a composite of conversations with both Sentry and the shop’s attorney. But the end result remains the same: “Due to the extreme liability

Pacifico said Rickenbaugh’s attorney told him that a court would indeed view the terms required and recommended as having a “similar scope.” Sentry said that to be protected under its coverage, the shop needed to follow OEM procedures “within reason,” according to Pacifico. (He said he disagreed with a couple of position statements, including wheel reconditioning, rhetorically asking “How much liability is in that?”) When it comes to issues like a millimeter width of difference affecting an advanced driver assistance system, who shoulders the liability? Pacifico said. “I do, as the repairer,” he said. Staff accountability The shop also vowed to fire any

managers failing to document OEM procedures. (If a shop follows OEM procedures but lacks that documentation for court, “you’re screwed,” Pacifico agreed.) “We are also requiring all of our leaders (Managers) to properly document each and every file to verify that any and all OEM required and recommended procedures were performed as specified by the OEM,” Pacifico wrote in the letter. “They have been told that failure to do so will result in immediate termination.” Pacifico said his managers understood this position, and it didn’t come as a surprise. “I’m not in the business of just making money,” he said, calling Rickenbaugh’s a “customer-centric business.” Asked about technicians, Pacifico said: “We got their buy-in first.” He said he met with three key team members and discussed what would be the “greatest customer ben-

efit” and how it maximized business opportunity. The dealership concluded it would “completely abandon” anything an insurer told the company to do and take the stance, “‘We’re experts, not you.'” “I don’t care what they signed up for,” Pacifico said, referring to customer policies. The liability still fell on the shop. “We will also be documenting any and all instances where an insurance provider attempts or recommends deviating from a required or recommended OEM repair procedure or position statement to the Colorado Insurance Comission for review,” Pacifico wrote in the letter. “Please remember that we are in the business of saving lives, not cutting costs. If your company will not comply with the recommended and required OEM repair procedures we will not be able to fix the vehicle.” An insurer would either have to

pay for a repair or explain to its customer why it wouldn’t, he said. Pacifico said Rickenbaugh was selective about which insurers it did direct repair program business with, and those carriers have supported the dealership’s position. Asked how other carriers have reacted to the position, he said they keep citing the Magnusson-Moss Warranty Act, which he called not applicable. It’s unclear why Magnusson-Moss would be a relevant insurer counterargument to following repair procedures. Though the law says an OEM can’t void a warranty on the basis of a unrecommended part being installed, the manufacturer can void a warranty if that part fails and compromises something else on the vehicle. Finally, while the law also ensures a warranty stands when someone other than a dealership does repairs, the work still needs to be done correctly to avoid risking a warranty claim being rejected, according to a Federal Trade Commission webpage which also references OEM service intervals. NAPA also in a September blog post wrote that an automaker can void a warranty if the owner does “something with your car that the manufacturer does not recommend or that conflicts with specifications for maintenance.”

“For the most part,” good insurers have accepted the stance and agreed to reimburse the shop, Pacifico said. “It’s the crappy ones” which pose a problem, but fortunately, most of Rickenbaugh’s clientele doesn’t have those carriers, according to Pacifico. He said the company has opted not to bill customers for the work in situations where the insurer still refuses to pay. He said he felt insurers would fight OEM repair procedures in general and “lose dearly.” “You can’t come in as a third party” and attempt to override the manufacturer of the product, Pacifico said. “You have no credibility,” he said. “Somehow, as an industry, we got weak,” he said. “… It has to stop.” Pacifico said the company

uses official automaker websites to research procedures on core brands and ALLDATA in other situations. He said the company had diagnostic equipment for its core brands and planned to switch to asTech for the rest, for “we could still be in trouble” for using aftermarket scan tools. It uses OEM parts “as much as we can be,” he said. To some degree, this decision was out of his hands. Pacifico mentioned that the body shop was recently audited by Volvo, which now demands 95 percent OEM parts at certified shops and will mandate 100 percent in 2019. Trackhawk From Page 24 The breakthrough supercharged engine is designed and manufactured using only the strongest and most durable materials. Its cast iron block features water jackets between the cylinders for optimal cooling. A forged-steel crankshaft with induction-hardened bearing surfaces is so strong it can withstand firing pressures of nearly 1,600 psi (110 bar) – the equivalent of five family sedans standing on each piston, every two revolutions. The unique, specially tuned crankshaft damper has been burst tested to 13,000 rpm. The coating enables tighter clearance between the rotors. This reduces internal air leakage, delivering improved compressor performance and higher efficiencies. The coating can withstand the temperatures generated by compression, and provides superior corrosion resistance. The supercharger is sealed for life with premium synthetic oil, uses a drive ratio of 2.36:1 and has a maximum speed of 14,600 rpm. The supercharger drive system’s one-way clutch de-coupler improves refinement, while allowing for precisely the kind of powerful sound certain to captivate Jeep Grand Cherokee Trackhawk drivers. The performance of the 2018 Jeep Grand Cherokee Trackhawk is bolstered by various upgraded driveline components engineered to handle the additional torque output from the supercharged engine.

Grand Cherokee Trackhawk is equipped with the Jeep Quadra-Trac ondemand four-wheel-drive system, which includes an electronic limited-slip rear differential and a single-speed active transfer case. The new, full-time active transfer case uses forged steel chain sprockets and a wider chain for added strength and durability. A strengthened rear drive shaft connects to a new, stronger rear axle. The differential features a revised housing design, revised ring-and-pinion tooth geometry and new four-point axle mounting scheme for better load distribution, additional torque capacity and overall durability. Torque is delivered to the rear wheels via new ultra-high-strength 300M low-alloy vacuum melted steel half-shafts with upgraded eight-ball outboard constant velocity joints. Standard Launch Control optimizes the Grand Cherokee Trackhawk’s performance by coordinating the engine, transmission, driveline and suspension for a textbook launch and consistent straightline acceleration. A new standard Torque Reserve system provides improved engine torque response and quicker vehicle acceleration in Launch Control by pre-positioning the supercharger bypass valve to generate boost and minimize manifold filling time, while cutting fueling to individual cylinders and managing spark timing. This generates a reserve of torque that can be instantaneously delivered upon acceleration from a standing stop.

Enterprise Holdings Stresses Collaboration, Transparency at SEMA's Collision Repair Technology Summit Open, secure access to data is best way to protect rights of vehicle owners and consumers At this year's Specialty Equipment Market Association (SEMA) conference in Las Vegas, Enterprise Holdings stressed that collaboration, transparency and technology-neutral standards across the automotive industry are essential ingredients for maximizing the potential benefits of connected vehicles. Enterprise's Assistant Vice President of Technology Innovation, Derik Reiser, spoke at the conference as one of four participants in a panel discussion sponsored by the Society of Collision Repair Specialists. The panel discussion – which focused on "The Future Impact of Telematics, Technology, Transportation and the Collision Industry" – also included CCC Information Services, Subaru of America and Verisk. TEDx Speaker and Author John Ellis, of Ellis & Associates, moderated. The panel reviewed work currently being done to integrate pointof-impact data, telematics and connectivity. The session also provided visibility into what connectivity means for repairers and work done on the shop floor, as well as how it impacts relationships with consumers and others in the process. Enterprise Holdings – which owns the Enterprise Rent-A-Car, National Car Rental and Alamo Rent A Car brands – believes open, secure access to data not only is the best way to protect the rights of vehicle owners and consumers, but also to ensure third-party

suppliers have every opportunity to collaborate and compete. "The true value is when you can connect all the ecosystems," Reiser noted. "We're optimistic about the future of vehicle telematics, but there's a lot we must do as an industry to make it right so that it adds value to people and streamlines processes." Enterprise Holdings, which recently announced its fiscal year 2018 results and acquisition and investment strategy, remains an industry leader in mobility, innovation and technology. In fact, since 2008, Enterprise has spent almost $2.4 billion making acquisitions and corporate-venture capital investments or commitments in the U.S., Canada, the U.K., France, Ireland, Spain, Brazil and China. Acquisitions include car rental companies, carshare operations, technology platforms and franchises. "We all need access to vehicle data to make mobility seamless for the end customer," Reiser said. "With a robust, competitive market in place, innovation will flourish, and businesses and consumers alike will experience tremendous benefits." That's why the company's goal is to draw attention to potential threats to competition that could negatively impact consumers as well as mobilityrelated industries, including but not limited to car rental. Enterprise Holdings' focus remains on how the competitive landscape – for autonomous vehicles, their suppliers and the entire mobility ecosystem of service companies – could

be impacted by policies deciding who has access to, and ultimately controls, the data. For example: The Canadian Standing Senate Committee on Transport and Communications published a report – "Driving Change: Technology and the Future of the Automated Vehicle" – at the request of the Minister of Transport. More than 78 witnesses, including Enterprise, provided testimony as the committee focused on regulatory and technical issues related to the deployment of automated and connected vehicles. Enterprise Holdings also submitted a brief. The report featured 16 specific recommendations, including "monitoring the impact of automated and connected vehicle technology on competition between the various sectors of the automotive and mobility industries, in order to ensure that sectors such as the aftermarket and car rental companies continue to have access to the data they need to offer their services." The Canadian Advanced Technology Alliance (CATA), of which Enterprise is a member, published a blog: "Canadian Innovation Leadership or Not in the Automotive Sector: Should Just the Automakers Control Access To Data from Autonomous Vehicles?" CATA also developed, in partnership with Enterprise, a video outlining the importance of open access to autonomous vehicle data, including perspectives from the European Economic Community and U.S. markets. n
