Roads-funding process begins anew

T

he Alamo Area Metropolitan Planning Organization on June 1 issued a call for projects to include in its Transportation Improvement Program for 2017-20. The MPO is charged with developing a TIP, which prioritizes major road, street, highway, bicycle, pedestrian and public-transportation projects for federal funding in Bexar, Comal and Guadalupe counties and part of Kendall County. MPO officials said projects approved in the next TIP will receive $100 million. In the upcoming months, residents will be asked to chime in by submitting emailed comments and attending public forums until next February. The MPO will begin narrowing down its list of potential projects before submitting its final plan to the Texas Department of Transportation next May. While this biennial process satisfies the transportation wants of some communities, it leaves others out in the cold. During the MPO’s 2015-18 TIP process, it whittled down its initial list of 100 projects to 50 semifinalists and then to 34 finalists. Additional projects were added earlier this year after Texas voters last November approved Proposition 1, a statewide funding mechanism that local MPO officials estimated will provide an additional $650 million for area projects over the next decade. Many area public officials doubted that estimate, leading some to find ways to fund their projects through other means. The MPO’s Transportation Policy Board, comprised of regional elected officials and representatives, will finalize revised TIP plans to include in Mobility 2040, the longterm regional transportation blueprint. The MPO will host two workshops on July 29 for agencies interested in learning more about the process that leads to acquiring federal funds for transportation projects. It’s only the first step in a long road which will eventually prove fruitful for some locales while frustrating others.

However, it’s not the kind of appraisal you get when you want to sell or buy a home, where you hire a professional to come out and give you an independent appraisal. By necessity, appraisal districts use other methods – comparing home-sales prices in the area, and estimating the amount you would pay to replace your home. Even if you have the crummiest house in the neighborhood, it’s not unlikely you will get popped with a higher tax bill. When I got my property-tax bill this spring, I saw the market value of my little condo had risen by nearly 25 percent since last year. Fortunately, there’s a way to at least try to reduce your own property tax – filing a protest with the appraisal district. Your appeal is heard by an independent appraisal-review panel, which theoretically

has no direct ties to the appraiser’s office. The last few years I’ve sworn to myself I would do it, and then missed the June 1 deadline. This year, I finally got serious. I’ll learn a little about the process, at the very least. San Antonio had its own politicalfootball game recently, with one candidate claiming he had helped ease the appraisal process with a bill he passed while in the Legislature, and another candidate claiming the bill made the appeals process much harder, and all the major candidates promising tax relief if elected. Don’t hold your breath. The political-football game is likely to keep going as long as politicians are out there politicking. Personally, I find good old gridiron football much more entertaining. damning criticism from another player, who then touted his or her alternative plan’s powerful pluses. The Texas Senate wanted to cut sales taxes. The state House worked to cut property taxes. Everybody had a different solution for the holy grail of tax relief, and everybody had tons of data to prove they were right. Perplexing. In fact, the Legislature is expressly forbidden to levy property taxes in Texas – thus the end runs and endless interpretations of the state Constitution. However, lawmakers can — and have — set limits on tax rates imposed by county tax collectors each year. San Antonio hasn’t raised property tax rates in a dozen years. The thing is, the rates don’t have to rise to blow up your tax bill. A cut in the property-tax rate is a drop in the bucket compared to the rising valuations of most properties. It’s the market value that keeps climbing, and raising your taxes. According to the Pew Charitable Trusts, median property taxes have risen more than 60 percent since 2000, much faster than the rate of inflation. This year in Texas, Dallas property went up 15 percent on average, while Austin and San Antonio got a relative break with an average of 11 percent.

Nuisance protests don’t inspire support

T

he right to peacefully assemble is enshrined in the First Amendment, which recognizes people are allowed to protest government actions so long as no harm is done.

However, while peaceful assembly to address a societal ill is a cornerstone of American democracy, recent protests of late — including a gathering on the Northeast Side that tied up traffic, according to reports — are rarely welcome when they complicate the lives of others or lead to violence. Such dissent does little to convince folks to join the protesters’ cause. Peaceful assemblies should seek to inspire and motivate; create consensus; foster a sense of community; and empower change. Unfortunately, some recent protests over the deaths of black men in police custody started out peacefully, but turned

into orgies of looting and violence. There is no excuse for such wanton destruction. No amount of anger or feelings of alienation justify burglarizing stores, burning down pharmacies or damaging other property. Thankfully San Antonio has been spared such outbreaks, but a recent act of civil protest apparently became more of a nuisance than a rallying point. In the episode, local protesters in a show of solidarity with residents in Baltimore — the latter group angered by the death of a black man after he suffered a spinal injury while under arrest — blocked a portion of Perrin-Beitel Road and Loop 410 at a restaurant. Though San Antonio police said the assembly remained peaceful, media accounts reported that many motorists were irked when the traffic flow became interrupted. No matter how important your cause, very few people will be inclined to sympathize if you are impeding their way to work or home, when they are picking up their children or when they are trying to go about their business. -The Local Community News editorial board includes Harry Lees, Gregg Rosenfield and Thomas Edwards.

GARDEN RIDGE RESIDENTS are continuing their war against an asphalt plant going up in the 21800 block of Old Nacogdoches Road, or FM 2252, where two subsidiaries of Summit Materials LLC, began construction of a 21-acre facility in April on property leased through Hanson Aggregates. The Texas Commission on Environmental Quality approved required permits to the project’s general contractor and both companies, which expect to launch operations at the site later this summer. Residents have engaged in a letter-writing campaign urging Hanson to cancel its lease agreement with the companies constructing the plant. They also cited the plant’s possible threats to the environment and nearby historical properties during recent city council meetings in Garden Ridge, Schertz and New Braunfels. Each of those councils adopted resolutions supporting the opponents, though none of those cities control zoning and landuse issues associated with the plant.

IBOLO – City administrators and elected officials hope their plans to foster business growth — including adding 2,000 jobs — will funnel additional sales taxes to municipal coffers.

Currently in Cibolo, ranked as one of the nation’s fastest-growing cities, the tax structure is predominantly supported by residents paying property taxes. “The goal is to diversify the (city’s) tax base, to have it not so heavily dependent on (residential) rooftops,” said City Manager Bob Herrera, who last year estimated 92 percent of the town’s income derived from single-family residences.

“As we continue to grow, we know we’ll have to add some additional amenities.” Getting those services – and more – depends on whether Cibolo can find additional revenue. Herrera credits steps taken by Economic Development Corp. Director Mark Luft, the EDC board and a revamped City Council for creating a roadmap to success. “We’re really excited about everything that’s finally coming to Cibolo,” Mayor Lisa Jackson said. “We’re welcoming businesses here, and working through everything associated with their coming here.” At times, the road taken has included potholes such as the backlash against the city’s stance in approving a new Walmart Supercenter, as 2013 and 2014 voter retribution resulted in the return of only one incumbent council member. However, that controversy is in the rearview mirror now. The new Walmart on Cibolo Valley Drive and North Main Street is scheduled to open in September, and is among a host of business developments slated to provide employment and in-town residential retail options. “Everyone is working together and

Our residents and business owners here now have a supply chain of consumer products here. It’s tangible – you can see it helping drive the city’s economy.” Cibolo Marketplace, a 24,000-square-foot retail strip center, is already up at 701 N. Main St. Other recently completed city projects include The Commons at Turning Stone and Trident Medical Offices – both located off FM 1103. A new H-E-B will anchor one development at the corner of North Main and FM 1103 while across the street, a CVS pharmacy is being constructed along with an Auto Zone. Herrera and Luft estimated all recent activity – including new establishments and existing-facilities expansion – would bring at least 2,000 city jobs, with Walmart offering up to 300 and four others within Schneider Industrial

Both officials said those businesses and others would provide greater job opportunities for area youths and retirees. “A city has to look at the right balance,” Herrera said. “When I say that, I mean there’s a need for us to also attract businesses that offer positions for senior citizens, college students or recent high school graduates who don’t want (fulltime) jobs. There are also high-paying

positions for those who want them, but we want to find the right balance.” Herrera said San Antonio-based H-E-B remains committed to locating in Cibolo and expects to submit a buildingpermit proposal before year’s end. “They have not changed their business model, which is for a 75,000-square-foot store and another 25,000 square feet for retail,” he said. Access to all future businesses will require improvements along 1103. Herrera said Cibolo has already pledged its share in the Texas Department of Transportation’s plan to expand the route from two to five lanes, including a center turn lane, from Schertz’s city limits to Steele High School. “We estimate it to be a $30 million project, (to) which the city will commit $7 million,” said Herrera of the plan, which could see additional financial support from Schertz. Construction bidding could start by late 2016 or early 2017. “Even though the city is coming to the table with money in hand, the state will put up three to four times the amount,” Herrera said. “It’s something the City Council has worked really hard to get accomplished.”

Cibolo will soon update the city’s master plan, perform an FM 78 corridor study to project and attract suitable area businesses, and revise the EDC’s strategic plan. “There are lots of things to consider,” Luft said. “We need to keep working toward improving on the accomplishments we’ve made so far.”

Jackson encouraged residents to see Cibolo’s business boom as a gateway to the future. “People moved here for the country feel of the city, and we still have that,” she said, “but we can’t continue on the same path that doesn’t (generate additional) sales-tax revenue. We’ve needed retail for quite some time and it seems like we’re getting it all at once.” Residents will still recognize the town they have grown to love, the mayor added. “Only one corner of the city (FM 1103/North Main/Cibolo Valley Drive) is going to change dramatically, but the rest of Cibolo will pretty much remain as it is,” Jackson said.

and wide for weekend tourneys. “Those tournaments create revenue for the city,” said Kim Turner, Universal City’s director of development services. “Also, weekly team practices and tournament play will likely have a significant impact on food and beverage sales for Universal City establishments.” Turner said the city has created maps indicating local eateries, including one on a large poster at the facility’s entrance, and on flyers distributed to tournament participants and spectators. The Sportsplex can be reached from Interstate 35 and Interstate 10, with FM 78 and other secondary roads providing convenient access to its 3.3 acres. Understanding the gym’s potential fiscal impact, Universal City’s economic board awarded a $350,000 incentive to project developers. The city’s risk was quickly rewarded when the gymnasium’s promise was realized during the weekend of May 23-24, when a few teams held a tournament at the Sportsplex after another facility was unable to host. Turner characterized the turnout as “great,”

Brown and his wife, Grace, have hosted hoops tournaments for nearly two decades, operating as Alamo City All-Stars since 2007. Their nonprofit grew out of a basketball program for disadvantaged youth in Houston. The Browns originally planned to construct the project on property they

owned on Judson Road, but Universal City had other ideas. When the couple was within a month of closing, city officials who learned of their plans for the sports complex and wanted it for their own community approached the Browns. “We met with the city government there and figured out it was going to be a win-win,” Brown said. City Manager Scott Wayman pictures SoccerZone as a welcome spot for youth leagues and others seeking a late-night locale for practices and workouts. “The thing that’s so interesting is that people will be able to come to the city and go there – at all hours of the day and night – to enjoy that service,” he said of the venue, which will feature an upstairs mezzanine for spectators and a food court. “It’s already under construction – it looks like a big hay barn,” Wayman said, adding one of the two pad sites adjacent to the facility will house various shops and offices, with a restaurant to be located on the other. In addition, a Hilton Garden Inn and Conference Center will include 139 rooms and a 14,000-square-foot space able to accommodate up to 800 people. The center will include a banquet hall, kitchen and several meeting rooms. In exchange for future facility use, Live Oak agreed to rebate a portion of the city’s Hotel Occupancy Tax money to the developers, who will receive yearly incremental returns

Matney said Nicha’s Comida Mexicana’s third San Antonio-area location is also now open at 7929 Pat Booker, in the former Mama’s Cafe site adjacent to Gold’s Gym. Live Oak also completed a $140,000 extension of Oak Terrace Drive connecting Shin Oak Drive with Palisades Drive. In between, a new senior assisted-living and memory care unit is under construction. The 80-bed facility is slated to open next spring. Officials said the city provided no sweeteners for businesses to expand or relocate. “We haven’t done incentives for any of the other projects on Pat Booker,” Matney said. “It’s really (the growth) in this region right now and we’ve just been very lucky. Toepperwein Road and the Loop 1604 access, the city now intends to go it alone. Wayman said the city twice failed to receive funding through the Alamo Area Metropolitan Planning Organization. Three years ago the federal government approved grant funding, but he said the requirements associated with acceptance – which specified construction necessities – actually increased the expenses. “It made it three times more than what it would’ve cost if we just built it ourselves,” he said. “We stayed with it as long as we could, but the (added) requirements drove up the cost by over $1 million.” A CPS Energy rebate, and contributions from the city’s Economic Development Corp. and the city’s general fund will supplement Live Oak’s share of the project, now projected to total $450,000 to $500,000. “We were going to pay for 25 percent of it anyway – through the EDC pledges and CPS rebates,” Wayman said. “We just figured out we could build it ourselves and not have to jump through all the hoops the federal money brought with it.”

EW BRAUNFELS – Comal Independent School District officials will be spending most of the summer plotting a timetable to implement projects in the $147.4 million bond measure approved by voters May 9.

Most of the money – $92 million – is designated for two new middle schools to relieve enrollment at Smithson Valley and Canyon middle schools, both reaching capacity by 2018. “We’re pleased voters approved Bond 2015 so we can continue to address the rapid growth in Comal ISD,” said Superintendent Andrew Kim. “We are very appreciative for the support and we will work to ensure

that the process of implementing these bond projects is transparent, so that we can be held accountable by our community.” CISD plans a 1,050-student school

near Hubertus Road and FM 482 in Garden Ridge, and a 1,150-pupil facility near Bulverde Road and East Borgfeld Drive in the Kinder Ranch area of north Bexar County. Comal ISD officials were unaware an asphalt factory was being built a mile from its proposed middle school site until angry Garden Ridge residents informed them in late April. The district remains committed to constructing there – at least for now. “We certainly did not want an asphalt plant to be there,” Kim said of the location, which the district purchased years ago without considering that an industrial development might someday locate not far away. “Now we’re seeing some signs of that and we’re now caught in this situation, but we’re committed to not spending the extra dollars trying to (build) somewhere else. “We’re keeping a close eye on the asphalt plant, to see what kind of traffic patterns result and the environmental issues that could come up. We’re supportive of the folks and Garden Ridge, and hope the situation can be resolved – one way or the other.” CISD’s other new middle school will be near Kinder Ranch Elementary School, which opened in August 2011

on Bulverde just north of Borgfeld. Both academies are slated near sites the district intends for future high schools. The rest of the 2015 bond will fund technology improvements ($21.3 million); capital betterments at existing facilities ($20.1 million); districtwide safety and security upgrades ($5.4 million); and land acquisitions for future structures in CISD’s high-growth areas along U.S. 281 and Interstate 35 ($6.1 million). CISD voters denied a $451 million bond proposal in 2013, the district’s first bond-election rejection since 1997. The 2015 bond request was slimmed down, making it more palatable to the electorate, who approved it 5,692 to 2,701. CISD residents last approved a bond in 2008. District administrators said in coming months they’d set a timetable for construction and districtwide improvements. At the June 11 board workshop, trustees approved Request For Proposals associated with new buildings and campus enhancements. “It will involve construction for the 2015 middle schools and other projects,” Kim said. “The selections from the RFPs will

Once we have the architectural and engineering services on board, then we’ll begin the design process.” Overseeing all of those plans is John Tucker, who was named CISD’s new director of facilities and construction in April. Tucker succeeded Helen Keaton, who mainly spent her twoyear tenure identifying and helping rectify overbill issues connected with the district’s 2008 and 2005 bond measures, which totaled $205.5 million and $189.2 million, respectively. Internal and external audits conducted in 2013 and 2014 indicated the primary contractor for 2008 bond projects overbilled CISD by nearly $7.1 million. Temple-based Baird/Williams Construction Ltd. agreed to pay CISD $5.9 million in a deal which also cleared the company of similar possible offenses after being appointed lead contractor following the district’s 2005 bond passage. CISD severed involvement with the company, as well as the primary architect for its 2008 and 2005 bond projects. Additionally, district reviews

indicated flaws in protocols to review procedures governing bond expenditures and line-item expense disbursements. It led the board to adopt a “best practices” measure to guide the district’s future procurement of professional architectural, engineering and construction services, as well as implement ways to improve district oversight over construction spending. At Dallas ISD, Tucker, a retired architect, helped execute $2.5 billion in school-construction programs and designed new internal and web-based document distribution procedures for all DISD construction procurements. “We are pleased to have been able to find someone with the degree of talent and experience that John has to lead our facilities and construction department,” Kim said, adding Michael McCullar, hired 18 months ago as the district’s director of purchasing, will provide additional oversight. “We’ve put strict processes in place to make sure the contracts will be written by school-district attorneys,” Kim said. “The checks and balances in the new system will increase the level of transparency involved in the process.”
