I am happy to report that the fund-raiser that we held in conjunction with the San Francisco Association of REALTORS® for Senator Leland Yee was a tremendous success – over $16,000 was raised at the event. Senator Yee was scheduled to stop in for 15−20 minutes, and ended up staying for most of the event! Thank you to everyone who assisted in ensuring this was a success. As I mentioned last month, SAMCAR is in the midst of real estate legislative activity. SAMCAR senior staff and leadership recently returned from incredibly productive meetings in Washington DC, and are off again to Sacramento on state issues next week. AB 2678, which CAR opposes because it requires energy efficiency audits at point of sale.

SB 1055, which would eliminate the tax penalty from the “phantom” income created when lenders forgive some of a homeowner’s mortgage to allow a “short” sale. Homeowners who are already in some distress are then taxed on this “phantom” income. SB 1055 would eliminate the tax liability for ONLY two years. CAR will support this bill if it is amended so that it conforms to federal law and allows THREE years of such relief.

SB 1448, which will increase fines to be sought by district attorneys when someone practices real estate without a license. CAR supports this bill because unlicensed practice is a growing problem and current deterrents are not working.

Yes, there is always room for improvement, but I am proud to say that SAMCAR is achieving momentum on this important front. With that said, please let me know how you think we are doing. Did you know that SAMCAR’s two main focuses are legislation for property rights and home ownership and Ethics? It’s true! RSVP Realtor® Service Volunteer Program
Once again, SAMCAR REALTORS® came together and generously volunteered to make the 2008 RSVP, a huge success. 115 SAMCAR members contributed heir time and helped to serve 105 seniors throughout San Mateo County. This year, RSVP was widely advertised, with applications and brochures sent to every senior center in San Mateo, distributed by Meals on Wheels and Senior Assist of the Peninsula, as well as to churches, the Salvation Army, and Goodwill. SAMCAR Goes To Sacramento to Support AB 1991
Half Moon Bay Beachwood Settlement Rescue Bill
SAMCAR Realtors® went to Sacramento last week to express their support for AB 1991(Mullin) before the Assembly Appropriations Committee. AB 1991 is a special local rescue bill to help the City of Half Moon Bay avoid payment of an $18 million settlement for a $41.1 million court-imposed liability resulting from a dispute with the owner of property known as Beachwood. The bill is narrowly and carefully drafted to preserve the City’s and State’s commitments to protecting wetlands and the environment, and it sets no precedent for building on land with manmade wetlands. This is because AB 1991 is predicated on three facts unique to this situation only that combined into a perfect storm for the City: (1) the wetland conditions on Beachwood

are man-made, accidentally resulting from a City drainage project; (2) development was approved in 1990 after a review found no environmental impact; and (3) the City faced a court-imposed liability that would have bankrupted the City. The bill explicitly states in its preamble that, without these three facts, it cannot be used as precedent. SAMCAR Government Affairs Director George Mozingo and Government Affairs Coordinator Dimitra Bizos attended the Appropriations Committee hearing and supported the Legislation. The Appropriations Committee approved the bill thereby moving it forward for a vote on the Assembly floor this week. It is unknown exactly when the full Assembly will vote on the bill, however the Legislative house must complete all floor votes by the end of this week. We may be going up to Sacramento in the future to continue our support of AB 1991 in the future. SAMCAR Government Affairs office will keep you apprized.

An Afternoon on Capitol Hill As traditional holds, SAMCAR Realtors® made their way to Capital Hill during this year’s NAR midyear meetings. We initially had the distinct pleasure of meeting with our newly appointed Congresswoman Jackie Speier. A lively discussion began to erupt and soon we were discussing the issues of the day, such as pending bills, FHA reform and the National Flood Insurance Program. It seemed that our meeting was coming to an abrupt end – Rep. Speier needed to make her way to the House of Representative – however we were quickly surprised with an unprecedented invitation. We were invited to accompany Rep. Speier to the House of Representative and continue our discussion in the Rayburn Room. Now gathered in the Rayburn Room,

SAMCAR Realtors® had the distinct pleasure of Representative Anna Eshoo join in on the meeting. SAMCAR Realtors® effectively vocalized their concerns and engaged both Representatives in discussion involving FHA reform, GSE reform, Homebuyer Tax Credit, and the National Flood In-
surance Program. Unfortunately all good things must come to an end, however as we walked away from this meeting we all felt assured that we can expect our Representatives to be a strong collective voice for San Mateo County in the halls of Congress.

Political Involvement
and Contributions Yield Results at the
National Level
Housing Stimulus FHA and GSE reform includes an increase to the conforming loan limit and homebuyer tax credits. The House passed a housing stimulus bill which combines all of these provisions into one bill and allows the FHA to insure up to $300 billion in troubled subprime loans in an attempt to stave off foreclosures. In addition, the housing stimulus bill contains language that will increase the FHA and GSE conforming loan limits, including $15 billion so cities can purchase foreclosed bonds and include homebuyer tax credits. The Housing Stimulus package has passed the House, and the Senate passed its own version, H.R. 3221.
Recently, thousands of REALTORS® traveled from all over the country to our nation’s capitol, for NAR’s annual midyear conference and meetings with federal legislators. In preparation for the meetings, attendees were briefed on the legislative successes that have been accomplished or are in progress. During these briefings it became quite clear that the REALTOR® voice has been heard, loud and clear. Through member contributions to the REALTOR® Action Fund and RPAC, coupled with direct involvement – including rapid responses to Red Alerts, Calls to Action and meetings with elected officials – REALTORS® have lobbied for, and achieved a number of important legislative accomplishments.
Permanent Increase of the GSE & FHA
Loan Limits GSE Reform Increases to FHA and GSE conforming loan limits are needed in high-cost states such as ours, where homeowners are being shut out of the market or forced to pay drastically higher rates for loans. While others in the nation are able to get safe and affordable access to FHA loans and GSE loans, high cost states are forced into higherrate jumbo loans and are experiencing a capital shortage because of the current credit crunch. A permanent increase is needed to truly have the strongest effect on the housing market, especially in high-cost states, and to give lenders the needed confidence to start offering these loans as true conforming loans instead of conforming jumbo loans. Legislation has been introduced in the House and has been included in the House stimulus package.
Congress needs to pass legislation that will raise the conforming loan limit in high-cost areas for Fannie Mae and Freddie Mac so that low and moderate income home buyers and first time homebuyers may benefit from access to lower interest rate conforming loans. H.R. 1427, the Federal Housing Finance Reform Act of 2007, passed the House but has not yet been introduced in the Senate. GSE reform has been included in the House stimulus package.

These successes illustrate the importance and effectiveness of REALTOR® political involvement, and demonstrate the stellar support for real estate-related issues by our representatives in Congress. Now, in this critical time for the real estate industry, it is imperative that you continue these efforts. Become a Legislative Liaison. Make your REALTOR® Action Fund contributions. Respond to Red Alerts and Calls to Action. Get involved politically – at the local, state and national level whenever possible. And most importantly, VOTE.
FHA Reform Efforts to reform FHA are supported by both CAR and NAR. We are urging both the House and Senate to include FHA reform in the Housing Stimulus Package so that FHA may be used by more borrowers. Two bills – H.R. 1852 and S. 2388 – have passed. A conference committee from both the House and Senate was to have produced a final version of the legislation. However, the effort has stalled. Of the two bills, CAR supports the House version, because it contains the higher loan limit of $729,750.
Flood Insurance Flooding claims from the 2005 hurricanes and other storms put the National Flood Insurance Program (NFIP) more than $17.5 billion in debt to the US Treasury – a debt that cannot be repaid solely through premiums. Reforms to the NFIP are needed to guarantee additional income to the NFIP to pay future claims. The NFIP expires on September 30, 2008. The House passed a comprehensive NFIP reform bill, HR 3121. This bill extends the NFIP for five years; increases coverage limits to $335,000 for residential and $670,000 for commercial properties; raises the cap on annual premium increases to 15% from 10%; phases out subsidies for non-primary residences and non-residential properties beginning in 2011; and allows for the purchase of wind insurance through the NFIP.
National Disaster Insurance NAR and CAR believe Congress should look to implement legislation that will create a government backstop for private insurance providers, create incentives for homeowners to take steps to mitigate the effects of a natural disaster on their property, and update insurance regulations and the tax code so that insurance companies may better prepare for disasters. In November, 2007, the House passed the Homeowners Defense Act of 2007 – HR 3355. The bill creates the ability for states to pool their catastrophe risk with one another; allow states to transfer risk to the private markets through catastrophe bonds and reinsurance contracts; and create the National Homeowners Insurance Stabilization Program to provide low interest federal loans to states impacted by severe natural disasters.

REALTORS® Call for a
Permanent Increase to Conforming Loan Limits The National Association of REALTORS® (NAR), in a letter to members of the U.S. House of Representatives, urged Congress to make the FHA and conforming loan limit increases permanent as part of the 2008 Housing Stimulus bill, which is expected to be marked up this week. On May 5th, Reps. Jerry McNerney, D-Calif., and Gary Miller, R-Calif., introduced H.R. 5958, the Homeowner Opportunity Act, making permanent the increase to FHA and conforming loan limits for high-cost areas. The bill will be considered as an amendment to the larger housing stimulus bill. A permanent increase to the conforming loan limits, here in San Mateo County, would be optimal. Until recently, the limit on FHA-backed loans was $362,790. The
cap on mortgages through Fannie Mae and Freddie Mac was $417,000. As a result, FHA guaranteed only 5,000 loans in California, as of 2005. On March 5th, in response to the passage of the stimulus package, the Department of Housing and Urban Development raised both the FHA and Fannie Mae-Freddie Mac limits
to $729,750 for high cost areas, including Santa Cruz County. The temporary increases on conforming loans allowed a number of troubled borrowers to refinance out of sub-prime loans, and concurrently, made it easier for many new buyers to qualify for mortgages. “By making the loan limit increases to FHA, Fannie Mae and Freddie Mac permanent the mortgage market will achieve an immediate increase in liquidity,” said NAR President Dick Gaylord, a broker with RE/MAX Real Estate Specialists in Long Beach, Calif. “This increased liquidity should help drive down mortgage costs and create stability in the mortgage market.” “As the leading advocate for homeownership, NAR applauds the bipartisan efforts by Congressmen McNerney and Miller in sponsoring this amendment. This can also help veterans, teachers, nurses, police officers and other working families to achieve the dream of homeownership by offering a safe and affordable alternative to risky subprime loans,” Gaylord said.
Higher loan limits are critical to ensure that homeowners and those who aspire to own a home are given the same safe alternatives for mortgages regardless of where they live. “It is simply a matter of equity for American families who live in high-cost communities,” according to Gaylord.

NAR Launches Commercial Real Estate Web Site The National Association of REALTORS® has launched a new Web site focused on commercial real estate, which includes a commercial property listing database that offers access to commercial property listings from all 50 states. The new site will reside at www.commercialsource.com, previously the site for the REALTORS® Commercial Alliance’s online convention. “REALTORS® are industry innovators, and this new site creates an online marketplace for investors and consumers to view land and commercial properties for sale and lease,” said Jan Hope, vice president of the REALTORS® Commercial Alliance, NAR’s commercial real estate division. “The site is a virtual landscape that includes a national commercial real estate property listing database, an online convention and trade show, industry news and events, research data, and feature articles. We expect this site to be a valuable and competitive resource, one that will provide commercial brokers with a high quality toolkit to assist them in their business success.”
Commercial information exchanges (CIEs), multiple listing services and practitioners may upload basic listings at no cost. More comprehensive listing information can be added at a nominal pricing. Individual practitioners will be encouraged to upload their listings through their local CIE if they are within an existing CIE market area. eProperty Data will operate and provide technological support for www.commercialsource.com. NAR recently acquired eProperty Data, of Gig Harbor, Wash., which provides commercial information exchange services and solutions to the commercial real estate industry. The company operates some of the largest CIEs in the country, including Commercial MLS. com in Seattle and CommercialGateway. com, operated for the Houston Association of REALTORS®. The REALTORS® Commercial Alliance has been processing requests from state and local real estate associations to aggregate and upload their commercial listings onto the new site.
The REALTORS® Commercial Alliance of Greater Miami and the Beaches is one such association. The association’s president, Thomas Byrne, said, “NAR’s CommercialSource online marketplace platform is at the forefront of providing our South Florida commercial members with the ability to showcase our dynamic market to buyers and sellers across the country.” On June 17, the new Web site will host the CommercialSource virtual convention and trade show. This year, NAR’s Chief Economist Lawrence Yun will be the keynote speaker, providing an overview of economic conditions affecting commercial real estate in today’s market. More than 80,000 NAR members are engaged in commercial real estate services; 70,000 are engaged full-time in commercial practice. C.A.R. Strategic Defense Program C.A.R. has created an innovative approach to protecting its members from undue and burdensome litigation. Albert Cordova, the featured speaker at May’s combined tour meeting, introduced the C.A.R. Strategic Defense Program. This newly created program provides a powerful assembly of experienced and seasoned attorneys joined together to focus on improving the current litigation climate in California, as well as to address the Errors & Omissions Insurance dilemma in the state. In 2003, C.A.R. leadership created the Errors and Omissions Insurance Task Force. This group was charged with identifying and investigating a variety of strategies for the purpose of increasing the long-term availability, and ensuring the affordability of, E&O Insurance for California REALTORS®, including legislation, member risk management programs, as well as internal and external business opportunities.
In its final report, the Task Force created both the Defense Strategy Advisory Committee and the Strategic Defense Program. The purpose of the Advisory Committee was to further explore risk management issues and make recommendations for solutions to this important issue. The Strategic Defense Fund was created to implement the recommendations of the Task Force. The Strategic Defense Program involves a panel of 15 attorney members, distributed geographically throughout the state. These are attorneys who have agreed not to sue REALTORS® and instead, specialize in broker defense. Through this agreement, C.A.R. members are afforded a discounted hourly rate, and have the benefit of a repository of legal tools, including pre-drafted motions, jury instructions and expert depositions. Members are also able to take advantage of a semi annual legal update, to apprise agents of new laws that affect their E&O insurance.

MLSListings, Inc. UPDATE
Project Moves Ahead Quickly
MLSListings staff members reviewed 7 viable vendors for its 2FA initiative last week and have already narrowed the selection down to 3. A detailed review of each candidate’s RFP response is being conducted before one vendor is chosen to conduct a pilot. Two Factor Authentication or 2FA represents the next step toward assuring that MLSListings provides the most effective level of security for the proprietary and sensitive data in the MLS. 2FA introduces a security step beyond simple user name/password authentication. The use of a randomly-generated PIN would also be required before a subscriber could log-in to the MLS system. The PIN is generated, usually using a token or fob, either by the push of a button or as it automatically changes every 60 seconds. Many MLS’s already use this method of authentication, and it is quickly becoming an industry standard.

New MLS Rules in Effect Since April 30 The latest MLSListings’ MLS Rules went into effect on April 30. These rules replace the RE InfoLink and CVMLS MLS Rules on which the organization had been operating. There are only 4 areas of significant difference to the previous rules: Listings or Exclusions The time limit for loading a listing or submitting the exclusion form (Authorization to Exclude) is 72 hours, with no exceptions for weekends or holidays. Status Change The time limit for reporting any status change, including a sale, is “by the end of the next business day.” Remarks The rules in section 12.5 for both public remarks and private/ confidential/agent remarks have been clarified and made much more specific. Infractions & Penalties Appendix A to the new rules has a very specific list of citable infractions and associated penalties. These infractions and penalties are cross-referenced throughout the rules text.
MLSListings staff will provide an overview of the 2FA project to the MLS Advisory Group on May 15. MLSListings anticipates setting up special activation and training event throughout our service areas to assist subscribers with the transition to 2FA. We will be in close touch with you to coordinate these events.
MLSAlliance Update Contract Expires June 30
