I am running for a seat on the Board of Directors so that I can serve my colleagues in the Real Estate Industry.
The reason I am running for reelection to the Board of Directors for SAMCAR is simple. It would be an honor to represent each and every one of our members where I can make an impact and bring their cares and concerns to the people who can make a difference. Three years ago, when I first ran for the SAMCAR Board of Directors, I made “navigating change” my theme. I especially wanted to highlight the strength as well as the flexibility that would be needed to lead/guide members through the sea of change we were experiencing. The situation has not changed.
Dear Fellow Realtors: Since 1978, I have been active at both the local, San Mateo County Association of Realtors, and as a state Director of California Association of Realtors (CAR) and various other Realtor organization levels. I have taken the time to attend many meetings locally, in the Bay Area, and the State to convey our concerns. I have contributed to the local, state and federal political action funds and I am a founding member of the Realtor Golden “R”.
The Board of Directors works closely with our many Governmental Affair Teams, striving to protect and foster the interests of private property owners as well as protecting and informing the members of SAMCAR. I have been licensed since 2001 and am affiliated with Prudential Calif. Realty in Redwood City. I am currently on the South County Tour Committee where we host a Spring and Fall auction with the proceeds benefiting many non profit organizations, I have arranged for speakers to update us on various topics. I am a certified instructor for the National Association of Realtors. It was my pleasure to participate in our RSVP program for seniors and the disabled. My designation as a SRES has served me well. It is my belief that when we serve our organization both you and I benefit from the experience, and I encourage all of you to join a Board. I wish to have our voices heard on the Board of Directors as we move forward representing buyers and sellers in this ever changing real estate market. I have and will continue to take advantage of the many classes that our organization offers to us as well as the in house training at my office. These classes are designed to keep us up to date with our industries standards. I would like to be your voice on this Board.
I see the San Mateo Association of Realtors as being one of diversity, intelligence and professionalism. I would welcome the opportunity to be able to facilitate the changes the members want and need to stay on the leading edge of Real Estate. I hope to provide consistent, forward thinking, dynamic leadership. There will be unique challenges and opportunities presented. I am willing to rise to these challenges given the opportunity. The key is in executing on these ideas and thoughts, and in getting things done.
I have been the elected the President of the our Association in 1992 and 2006, the Regional Chairperson to CAR in 1994, 2005 and 2006, on the Executive Committee of CAR in 2004, and have participated and currently participating in numerous state and local committees. Currently I am the Chairperson of the PRDS Forms Committee and sat on the MLSListings (REinfolink) Board of Directors and the MLS Advisory Committee. In 2001 I was given the honor of being named the Realtor of the Year and in addition I have been honored by other Associations for various achievements. It would be an honor and privilege to continue to represent you on the Board of Directors. I have shown and will continue to place your interests in our industry first. I have many years of experience in being involved in organized real estate and believing in its function to promote the industry to the local and state communities and to provide you, the member, representation that affects our industry - legislation and education. As a your Director, I promise to continue listen to your opinions, try to lower your cost of doing business and still give you back more service from our Association.

The real estate industry is changing more than ever and I believe we have two choices; sit and let the change happen or get involved and try to shape what happens. There is a very real possibility that we are going to experience further consolidation in associations due to the decline in membership. The associations that are going to survive will be the fiscally strong and those that provide the most benefits to its members.
When I first earned my salesperson license in 2005, I knew I needed to join REInfoLink for the MLS but wasn’t sure why it was different than SAMCAR. So I spoke to a long-time friend who had worked with the Placer County Association of REALTORS®. That’s when I learned that not all real estate agents are REALTORS®. Only those agents who join the Association of REALTORS may use the REALTOR® designation because we pledge to abide by a Code of Ethics and submit to the Association’s professional standards and arbitration processes. I wanted that distinction because I believe our ethics is what sets us apart -- not only as people but as professionals.
Having been salesperson, manger and broker/owner, I believe helps me understand the needs of all the association members. I’m a strong believer in education and helping our members to stay informed at the local, state, and national level. I also wanted to join SAMCAR, and in turn C.A.R. and N.A.R, because of what organized real estate does for all of us. These three associations work in the legislative arena to follow proposed laws that might affect private property rights. They work in the legal arena to fight or support lawsuits that might have an impact on homeownership or private property land uses. And, they keep an eye on legislative and legal actions that might affect our ability to conduct business as independent contractors. I am proud to be a REALTOR®, and I would be honored to serve on the SAMCAR Board of Directors.
I started my career as a Realtor in 1988 and am employed at Prudential California Realty in San Bruno. I am an active member of SAMCAR having served as a member of the Board of Directors in 1993, 1994, 1997-2000, 2002-2007. I have served on the Finance, Property Management, Consumer Protection, Equal Opportunity, Manufactured Housing, Risk Management and Common Interest Development committees at CAR. I have been Chair and Co-Chair of New Member Services, Chair and Co-Chair of the RSVP program, Chair of the Grievance Committee and have served as a member of the BORPAC and the special events committee. I am excited about the opportunity to run for the Board of Directors and continue to keep the membership of SAMCAR well informed of what is happening on the local level as well as the State level.

But it doesn’t make it any easier, does it? SAMCAR recognizes the difficulties we all face, not only in this market, but in every day life right now, too. Of course, these kinds of challenges are ongoing, even when the market is stronger. Challenges happen in the real estate business, but it doesn’t mean we need to give in or give up. The solution is to work through it, gather in and gather up. To help you get through these tough times and to give you the information you need to work through these challenges, SAMCAR has put together an ongoing free “Members Support Workshop.” These workshops will take place twice a month between 12:30 p.m.-1:30 p.m. at SAMCAR located at 850 Woodside Way, San Mateo. Our format will include sharing, support and solution finding. Come in with your questions, concerns, challenges, accomplishments, ideas and leave knowing you have answers that will help you survive and thrive, and you’ve helped a fellow member, as well. Proposed 3% Withholding for 1099’s

.A.R. opposed a proposal to force those making payments to independent contractors to withhold 3%. This provision was included in a budget gap proposal approved last month by a Budget Conference committee in the California legislature. C.A.R. strongly opposed this forced withholding because it unfairly singled out independent contractors to shoulder the burden of the state’s budget troubles and failed to address systematic problems in California’s budgeting process. Numerous sources have reported that the proposal is not in the budget recently agreed to between the Governor and the Legislature. Please look for further updates from SAMCAR.

Property Profiles ARE Permissible
P
roperty profiles again may be provided to you by title companies. As you may have heard, the California Dept. of Insurance (CDI) issued a letter June 12 that was unclear in this respect. C.A.R.’s Governmental Affairs Dept. met with the Dept. of Insurance on July 2 and expressed concern about the interpretation of the June 12 letter and its impact on the market. The CDI said they did not intend their letter to be interpreted to prohibit property profiles, and agreed to look at the matter, recognizing the urgency and the need for immediate action. Clarification was received on July 7th.

ecently, a preliminary analysis of a NAR survey was released, which indicates that the implementation of the Home Valuation Code of Conduct (HVCC) appears to be having adverse impacts on the housing markets. 40,000 NAR members were surveyed, with 3,600 responses received. Approximately 76% of Realtors representing buyers or sellers indicated that the time to obtain a completed appraisal increased after May 1. Among those indicating an increased appraisal time noted additional time to get to closing with 69% saying it increased the time to close by more than a week. Lost sales due to a delayed appraisal were reported by 37% of Realtors attempting to complete home sales, with 16% reporting one lost sale
U.S. House of Representatives:
Passes Climate Bill
with Energy Labeling Exemptions
T
he U.S. House of Representatives approved H.R. 2454, the American Clean Energy and Security Act by Reps. Waxman (D-CA) and Markey (D-MA). Following NAR’s long-standing policy to only take a position on legislation, or provisions within legislation, that have a direct effect on real estate, NAR worked with its Congressional allies to strip the Energy Bill of provisions that would have adversely affected the real estate industry. Overall, REALTORS® succeeded in making a number of positive changes affecting the real estate provisions of the bill. The House-approved bill:
• Does NOT create a federal energy audit requirement for real property • Exempts existing homes and buildings from any federal guidelines for new construction energy efficiency information labels • Prohibits the implementation of any labeling during a sales transaction • Leaves the decision to states as to whether to require energy audits, disclosures, etc. • Provides property owners with significant financial incentives, matching grants and tools to make property improvements and reduce their energy bills • Prohibits the EPA from regulating residential and commercial buildings under the Clean Air Act • Eliminated an early proposal to allow citizens to sue over minor climate risks under the Clean Air Act • Establishes green building incentives for HUD housing, including a loan program for renewable energy, block grants and credit for upgrades in mortgage underwriting

and 20% reporting more than one lost sale. The number of Appraiser members reporting they obtain over 50% of assignments from Appraisal Management Companies increased from 13% to 40% after May 1st.
While H.R. 2454 includes many positive changes, NAR will remain vigilant to address provisions that impact real estate such as the bill’s building energy code targets. The Senate must still pass its version of an energy and climate bill. The timing for a vote in the Senate is not clear as the Environment and Public Works Committee still must develop the climate provisions to “cap and trade” carbon emissions. The Senate Energy and Natural Resources Committee has approved energy provisions that are less burdensome and preserve state flexibility to develop and enforce building codes. Here are some “myths and facts” regarding this legislation, that may answer questions and concerns you may have. NAR Myths & Facts Claim: “The bill mandates energy audits and labeling before any home in America is sold.” Fact: The bill does not create a federal energy audit or labeling requirement. As introduced, the original bill would have required energy audits and labeling at the time of sale. However, Realtors succeeded in making many positive changes before the bill passed. Many published reports are not based on the version of the bill that was considered by the House.

As approved, the bill:
• Does not create energy audit requirement for real property at time of sale • Exempts existing homes, multifamily and commercial buildings from any federal energy labeling guidelines such as the existing federal Energy Star label program • Leaves the decision entirely to state governments whether to pass a law to require labels, but expressly prohibits labeling during a transaction
Claim: “The bill federalizes building codes.” Fact: The bill would create a national building code standard that improves upon building energy efficiency. States would be given 1 year to bring their state codes into compliance with the new national standards. If a state fails to do so, the federal government would set and enforce the state’s energy codes. Throughout the bill’s development, NAR has worked as part of a broad real estate coalition to address concerns with the House bill’s building-code provisions. NAR and the real estate coalition were unable to secure committee passage of amendments to limit these provisions. An amendment to strike the provisions was defeated along a party line vote. NAR will redouble efforts in the Senate where the energy committee has reported a bipartisan alternative to the House’s that sets more realistic energy reduction targets while preserving state and local authority. If and when the Senate takes up its bill and it reaches a HouseSenate conference to resolve the bill differences, NAR will undertake the necessary efforts and activities to ensure onerous provisions are not imposed on real estate markets. Claim: “NAR should have read the bill.” Fact: NAR reviewed the entire amendment and bill before taking

a position. NAR was directly involved in the development of the 308-page amendment. Claim: “The bill contains a new federal policy that requires residential and commercial buildings to be retrofitted to federal “green” standards prior to the time of sale. Fact: Section 202 does NOT contain point-of-sale retrofit requirements. The bill does:
• Provide states with the funding for financial incentives to property owners who voluntarily decide to make energy efficiency improvements. • Provide that financial incentives may include grants, loans, loan guarantees, and/or mortgage interest rate buy-downs. • Establish a sliding scale for incentives – i.e., if a home owner makes improvements that result in a 10% reduction in energy consumption, the owner would be eligible for an award of $1,000; a 20% reduction would be eligible for a $2,000 award, etc. up to a maximum award of 50% of the retrofit cost for each building • Require state voluntary retrofit incentives programs that use federal funding for incentives to meet federal guidelines for certifying private contractor training, equipment and practices for energy audit/retrofit services eligible for federal funding
Claim: The Green Act provisions of the bill require owners of federally assisted housing to retrofit their building to energy efficient standards. Fact: The Green Act requires the HUD Secretary to establish incentives for energy efficient programs of HUD- assisted properties. The bill also provides the Secretary discretion to incorporate energy efficient standards into HUD-assisted program.

Make Your Real Estate Transaction Close on Time:
Red Flags To Consider Contributed by: Julie Ziemelis At the July 14th Central Tour, a panel of escrow officers discussed “Escrow Red Flags”. Panelists were Christine Quinn, North American Title, Claudia Arshad, First American Title and Theresa Linnane, Fidelity Title and Moderator, Tami Cirigliano, Fidelity National Title.
Some of the key points the panel discussed included
There are new condo insurance requirements if your client is applying for funds from Fannie Mae or Freddie Mac. The owner must carry home owners insurance to cover the inside contents of the home. The insurance premium can cost between $200-$500 a year, based on the loan amount. The insurance must cover the replacement costs of the interior including the carpets and appliances. Address this with your lender BEFORE the transaction gets to docs to avoid holding up the escrow process.
Bring in a cashiers check at least two days prior to close of escrow or have the funds wire transferred. Title companies need clear funds to close escrow. Some checks can take anywhere from 7-10 days to clear, which will hold up closing. The panelists suggested wiring funds to avoid this problem. If you are using a Cashiers check, the monies must be drawn on California funds. Some Cashiers checks are drawn from banks in Delaware.
It is important to get the social security number of your client. By having the social security number, the title companies can be sure there are no liens or judgments against your client. A social security number is especially needed on common names like John Smith. The IRS is currently taking up to ten days to get information back to the escrow officer.
Be more realistic on the contingency period with your clients. Don’t promise a quick close of escrow as there are many new circumstances occuring in the market right now that are holding up the transactions.

East Bay Promo Reciprocal
Program Extended MLSListings has offered to extend the promotional reciprocation program with Bay East, CCAR and EBRDI through the end of 2009. As of June 30, Bay East has agreed to extend their reciprocal service for an additional three months for $20. EBRDI and CCAR have extended their reciprocal service through December of 2009.
MLS Rules Changes Effective August 15th
• Residential listings with existing buildings will require a photograph to be included in the listing within 72 hours after MLS entry. • Listings that will, or may, require court confirmation must be designated as such upon listing entry. • If a lockbox is present on a property that is located in the MLSListings service area and is listed for sale in the MLSListings system, there must be an electronic lockbox that is accessible by an electronic key issued by one of the lockbox Authorized Providers (Associations).

SAMCAR President, Olivia Edwards and SAMCAR Foundation Chair, Suzan Getchell Wallace will be hosting these drop-in, roundtable workshops every second and fourth Thursdays of the month from 12:30 to 1:30 p.m. at SAMCAR. The first four workshops will be held on August 6, August 20, September 3 and September 17. As long as the group would like to continue meeting to learn from one another, support each other’s efforts in the real estate industry and share their expertise and knowledge with others, the workshops will continue through the rest of the year. Come in with your questions, concerns, challenges, accomplishments and willingness to walk out having helped yourself and someone else. 2009 Annual Charity Golf Tournament
SAMCAR Golf Tournament Hits a Hole in One Contributed by: Julie Ziemelis
T
he San Mateo County Association of REALTORS® (SAMCAR) hosted its annual Charity Golf Tournament on Monday, July 20, 2009 at the Peninsula Golf & Country Club with a dinner and live auction. Assemblyman Jerry Hill provided his voice as the evening’s auctioneer to help raise funds for the SAMCAR Foundation. Over 55 golfers enjoyed a beautiful sunny day out on the course playing golf and sampling the delicacies offered by the hole sponsors such as sushi, Mojitos, Sangria and vodka shots. Congratulations to the following individuals and groups that picked up prizes for their outstanding day on the green:

The proceeds from this annual event benefit the SAMCAR Foundation . . . Since 2002, the Tournament has raised approximately $170,000. focused on improving the quality of life for our residents, with particular emphasis upon those that work to provide more affordable housing opportunities. Since 2002, the Tournament has raised approximately $170,000. Previous recipients of the tournament proceeds include the San Mateo County Housing Endowment and Regional Trust (HEART), HIP Housing, Habitat for Humanity, and the Shelter Network.
