We are staunch advocates for our clients because we want the best for them and their families. To better serve our clients and the community, now more than ever, REALTORS® must be prepared and willing to reach out. We must become familiar with and participate in our local communities throughout San Mateo County. We can be active through working with schools, serving a volunteer organization, or becoming involved politically. As REALTORS® we must demonstrate our commitment towards supporting the diversity, growth and sustainability of our San Mateo County communities. This year, my hope is to ensure that SAMCAR provides members with the tools and resources necessary to ensure our professionalism, through education and training. But most importantly, I want to create and identify more opportunities for SAMCAR REALTORS® to become engaged in our communities. REALTORS® can and will make a difference. I am excited to embark upon 2010 with this focus in mind, and welcome each of you to give your advice, feedback and time towards the effort.

appy New Year! It is nice to have 2009 behind us. Congratulations to 2009 President Olivia Edwards for her progress during a challenging year, and the best of luck to 2010 President Jennifer Tasto moving forward. I think that we are all hoping that 2010 is a stronger year for real estate, the economy, and all of our collective businesses. In 2010, SAMCAR will continue to focus on providing many separate and different educational offerings for the membership. We plan to build on the RE Tech Series that was offered throughout 2009, as well as add additional options within the series. We are currently reviewing the types and frequency of NAR designation classes that will be offered throughout the year as well, so please let us know if there is something specific that you might like to see offered. This year we also plan to do more outreach to the members – both through member surveys, and through broker outreach. Member outreach is critically important to ensuring that SAMCAR is providing members what they need to continue to be successful. Ongoing input from the brokerage community will also help ensure that those offerings are properly-aligned with the needs of the brokers. SAMCAR will continue to move forward and gain momentum in these important areas, however, it will be under new leadership.

I will be passing the baton next month as your Chief Executive Officer. he San Mateo County Recorder’s Office will increase its recording fees effective January 1, 2010. The current standard recording fee of $9 to record the first page of a document will increase to $15 while the $3 for each additional page recorded will remain the same (no increase). The current base recording fee was established in 1985, nearly 25 years ago, and it has not been raised since that time. The increase was established as part of a new state law, SB 676 that the Governor signed on October 11. Counties may increase their recording fees, consistent with this legislation, if the local Board of Supervisors approves an increase by a 4/5ths vote of their body. The San Mateo County Board of Supervisors approved this conforming legislation at their December 1, 2009 meeting. This new fee will help the office recover the cost of conducting business. Government is not allowed to make a profit or charge fees that exceed the cost of providing a service. An independent consultant conducted a fee study in 2008 and determined in a preliminary evaluation that the recording fee in San Mateo County was well below the cost of providing the service.

Midcoast LCP Update
O
n December 10, 2009, the California Coastal Commission held a public hearing in regards to the proposed San Mateo County Local Coastal Plan (LCP) update. At the conclusion of the hearing, the Commission decided to reject the County’s proposed policies relating to issues such as the annual growth rate, groundwater management, private wells, service capacities for affordable housing, public works capacities and lot retirement systems.
What does this mean?
How to proceed is now back as a decision for the County Board of Supervisors. Approximately ten years ago, the County elected to update and amend its policies pertaining to the Midcoast. However, as much of the unincorporated area of the Midcoast falls within the Coastal Act, any amendments to the LCP must be vetted and approved by the Commission. For the past three years, the County has worked with the Commission and other interested parties, such as the REALTORS® to resolve the outstanding issues and areas of disagreement, mentioned above. In February of this year, the Commission staff released an initial set of recommendations that would significantly revise the amendments proposed by the County. Soon thereafter, the County voted to reject the Commission’s proposals and move forward with the amendments as originally conceived.
As a REALTOR® you are part of one of the strongest, respected political voices in the country. Your collective voice has been the catalyst for a tremendous amount of legislation promoting homeownership, ethics, affordable housing and the preservation of private property rights. Do your part towards continuing this long tradition of political advocacy and involvement.

Accomplishments
Federal Tax Credit for Home Buyers Extended and Expanded. The tax credit will be extended through April 30,
from the GSEs, among other things, NAR called for a 12-month moratorium on April 20, 2009. NAR later extended the time of the moratorium to 18 months. Staff from both GSEs met with the Appraisal Committee at NAR’s 2009 Midyear Meetings. The conversation focused on the implementation of HVCC. NAR has created several education documents for members that can be found with other resources at www.realtor.org/hvcc.
Conforming Loan Limits Extended Through 2010.
RESPA Reform. Provisions of HUD’s final RESPA rule went into effect on January 16, 2009 after NAR successfully urged HUD to make significant changes to the proposed rule that will benefit real estate brokers and agents, including: elimination of the “closing script”; creation of a 30-day cure period; and improved uniform formatting of GFE/HUD-1. The limits will be $417,000 for most areas in the U.S. and $729,750 for high-cost areas, including many in California.

Four Out of Ten Recent Buyers
Relied On FHA Loans
A
ccording to the most recent REALTORS® Confidence Index, 39 percent of recent buyers purchased a home with a Federal Housing Administration-insured loan. REALTORS® who took part in the November survey also reported that the number of first-time home buyers continued to climb to 51 percent. “FHA helps provide affordable mortgage financing to homeowners, particularly first-time home buyers who are so important in drawing down inventory to help stabilize the current housing market,” said NAR President Vicki Cox Golder. “These recent survey results reaffirm that, despite its current challenges, FHA is a critical part of the American housing fabric.” The RCI results also indicated that distressed sales increased to 33 percent of all home sales last month, and that both investors and first-time home buyers are
competing for these properties. The preponderance of distressed properties on the market has also influenced buyers’ perceptions of other homes for sale. REALTORS® report that many buyers have pricing expectations that treat every property as if it were in foreclosure. In addition, REALTORS® expressed ongoing concerns with the impact of the Home Valuation Code of Conduct on recent appraisals. According to some survey respondents, inexperienced or out-of-area appraisers continue to rely heavily on sales prices of distressed properties, even when other comps are available. “As the first, best source for real estate information, REALTORS® have their finger on the pulse of current housing trends,
and their knowledge and experience offer valuable insights into today’s real estate market,” said Golder. “We know that an economic recovery is not possible without a housing recovery, and we will continue to work with policymakers at all levels to ensure that this happens.” The RCI is a key indicator of housing market strength based on a monthly survey of more than 50,000 REALTORS®; in a typical month there are more than 3,000 usable responses. Participants are asked about their expectations for the demand for homes, price of homes, and other economic conditions.

In 2009, C.A.R.’s Government Affairs Team, including thousands of REALTOR® volunteers, fought hard to keep you and your business safe from bad legislation and to promote proposals that would support homeownership.
Three percent REALTOR® Withholding Defeated.
Sacramento proposed a three percent independent contractor withholding requirement that would have forced REALTORS® to make no-insterest loans to the state.
Multiple Point-of-Sale Mandates Beaten. C.A.R. beat three seperate legislative proposals that would have established costly point-of-sale mandates.

Rising to the enormous need in the community
this year, members of the San Mateo Association of REALTORS® held annual charity auctions at the tour meetings and raised thousands of dollars to benefit the community during the holidays. Kicking off the spirit of giving was the Pumpkin Auction at the Combined Tour in October which raised $3000 for both the Second Harvest Food Bank and the SAMCAR Foundation. The Coastside REALTORS® raised $3000 in Half Moon Bay at Cameron’s Pub to benefit Coastside Hope. SAMCAR members chose Coastside Hope for the work they do to feed the hungry in the seaside community. At the North Tour, REALTORS® and Affiliates donated coats and funds to benefit the “Coats for Kids” program. The group raised $2500 with a raffle and an auction, along with the warm jackets, to ensure kids of all ages did
not have to face a cold winter without a warm coat. The South Tour REALTORS® and Affiliates raised $2100 at their live auction for the St. Anthony’s Padua Dining Room, Catholic Worker House, San Carlos Educational Foundation, and Belmont/Redwood Shores School Force. There was even a brownie bidding war where two boxes of “special recipe” brownies fetched $400! “Our members show such generosity each year to support these wonderful non-profit programs in our communities. We are blessed with the good fortune to be able to assist the groups that each year strive to do more

The exclusion applies to natural children, children adopted before the age of 18, stepchildren (as long as the parents are still married), and sons- and daughters-in-law are considered children under this exclusion program.
Weissman discussed Propositions 58 and 193 and how you can save your clients money in the transfer of property between parents and children and even grandchildren. These propositions are geared towards keeping property “in the family” and both propositions help avoid a forced sale if the home is reappraised and the taxes go up exponentially making it too difficult for the family member to make the payments on the home.
What most REALTORS® do not know is that the claim must be filed within three years after the date of the purchase/transfer or prior to the transfer of the property to a third party, whichever is earlier or within six months after mailing of the notice of supplemental assessment.
Weissman injected humor with legal issues as he discussed the pitfalls and unknown risks of family members’ claims to a parent’s or grandparent’s property.
Proposition 58 provides property tax relief by preventing an increase in property taxes when real property is transferred between parents and their children. Proposition 193 broadens the tax relief to include transfers between grandparent and grandchildren, or from grandchildren to grandparents. This transfer is only exempt in cases where both parents of the grandchild are deceased. The Parent-Child Exclusion applies to any real property purchases or transfers between parents and children, which occurred on or after November 6, 1986.
A parent may transfer their principal residence and any other property valued up to $1,000,000 to their children. The properties will not be reappraised providing that the proper Claim for Exclusion from Reappraisal form is filed and approved by the Assessor’s Office. Weissman used several case studies on how to avoid reappraisal using a variety of scenarios. Weissman stressed the importance of not deeding a home to a child before the death of the parent homeowner in case of unforeseen calamities like bankruptcy, divorce or even death of the child before the parent.
