ecently, we traveled to Washington D.C. for the National Association of REALTORS® Mid-Year meetings. NAR’s meetings draw REALTORS® from all across the United States, including Hawaii and territory of Guam. Since political advocacy is an integral part of what NAR does, we had the opportunity to meet with our Congressional delegation: Representative Jackie Speier and Representative Anna Eshoo to discuss the issues that affect our industry. Specifically, we discussed legislation regarding: (1) commercial mortgage market liquidity; (2) GSE (Fannie Mae and Freddie Mac) reform and GSE loan limit; (3) affordable property insurance including flood insurance; and (4) FHA reform and FHA high loan limits.

In addition to these issues, Congresswoman Eshoo and Congresswoman Speier were concerned about the foreclosures and short sales in San Mateo County and how the banks have been in working with our REALTORS® and the consumers. The issues above are addressed in the House and the Senate, along with the thousands of bills and specific hearings. We, as REALTORS® have a deep commitment to political advocacy on the issues and legislation that affect how we do business as real estate professionals. In a related matter, the Call to Action Program of NAR is a tool to reach the nearly 1.2 million REALTORS® in the country. It is a vehicle through which REALTORS® can more directly and effectively lobby their State and Federal lawmakers. find that it is best to start a new relationship with an introduction. My name is Steve Blanton, and I am very pleased to be SAMCAR’S new Executive Officer. While I may be new to SAMCAR, I am not new to the Bay Area. I grew up in Los Gatos, attended all local schools and served twelve years on the Los Gatos Town Council including a stint as Mayor. I am also not new to real estate. From 1998-2002, I served as the Government Affairs Director for the Silicon Valley Association of REALTORS®. After serving as the Executive Director for a non-real estate related trade association, I returned to the world of organized real estate as the CEO for the Rogue Valley Association of REALTORS®, and when the position of Executive Officer of SAMCAR opened, the prospect of returning home and working in an industry I love was too good to miss.

.A.R. is sponsoring SB 1000 (Correa), making appraisals “portable” if a buyer must change lenders.

C.A.R. is sponsoring SB 1000 to address the problem caused by lenders requiring the preparation of another home appraisal even if an appraisal has already been obtained and paid for by the buyer for another lender. SB 1000 was to have been voted on in the Senate Banking, Finance and Insurance committee. However, opposition from Senator

Summary of the scam and suspects

Suspects Roger and Diana Buack will pose as interested home buyers of high-end homes; approach Realtors and claim to have several million dollars coming to them from “overseas accounts.” After developing a relationship with the Realtor, the suspects will tender an offer for the property, but claim that the money is being held up overseas due to various excuses. The suspects will ask the Realtor to loan them money for the down payment, plus money to help them pay customs fees to free up their overseas money, often giving fake documentation to support their claims. In exchange for a loan by the Realtor, the suspects will promise a 100% return on their investment within 48-72 hours of the loan. If you meet suspects Roger or Diana Buack and encounter suspicious activity, you are urged to call the Alameda County District

Protecting Affordable, Safe Financing for American Families Congressional Action requested: Strengthen the FHA mortgage insurance program, make permanent the higher FHA loan limits and exercise caution before considering additional proposals that may have a profound adverse impact on FHA programs that serve such a critical role for our nation’s families.

GSE Reform and GSE Loan Limits Congressional Action requested: Enact legislation to restructure Fannie Mae and Freddie Mac (the GSEs) in a manner that provides the federal government a continued role in the secondary market in order to ensure mortgage liquidity in all markets. and volunteers who stepped up to the challenge of helping seniors during the REALTORS® Service Volunteer Project the week of May 3rd through 7th. There were more senior homes in need of maintenance work this year than there were volunteers, so we were thrilled when

The Team Captains were instrumental in spearheading the effort to lead the SAMCAR volunteers in helping 100 seniors in San Mateo County with tasks around their homes, including safety checks and installation of new smoke detectors. Certification

really mean anything

when it comes to home inspectors? Contributed by Jeff Frishof, Eagle One Services LLC

Certification is a word tossed around in many professions and in some cases can be misleading. It is the public’s assumption that if a firm calls themselves certified that this lends creditability to that firm. It is important to note that certifications are usually earned from a professional society or educational institute, not the government. Where the home inspection profession is concerned here in California, there are no state mandated certifications or licensing programs. The State of California governs the profession under California Business and Professions Codes §7195-7199 which were enacted in 1998. Where does this leave the profession and how does the client or Realtor® know if the home inspection firm they hired is qualified? Certification of the home inspector is through one of the many associations that one can become a member of. The two most prominent are the American Society of Home Inspectors (ASHI) and the California Real Estate Inspection Association (CREIA). Lesser recognized associations tend to attract the newer inspector as it is generally easier to become a member. They also have been around for less time than ASHI or CREIA. What sets ASHI and CREIA towards the forefront is not only their longevity of existence but their stronger requirements for membership and testing. The tests that are required to be taken to become full members are psychometrically valid tests. That means that they have

been reviewed by specialists in test creation and will hold up in a court of law. In 2009 ASHI asked the Institute for Credentialing Excellence, (www.ice.org) an internationally recognized accreditation body, to review their certification program. After review by their board, ASHI was able to pass their stringent guidelines. These are expensive reviews and not all associations have the funds to spend. ASHI with its 1000’s of members as support were able to afford this review process. Whether the firm you retain is a single mom & pop or a multi inspector inspection firm they all should be questioned as to the qualification of the person that will be inspecting the residence or commercial property. Without the proper training and oversight of that individual, there is the potential for critical issue to be overlooked. An experienced inspector should be able to provide upon request, a truthful resume. There is within the associations such as ASHI and CREIA and through the California Coalition of Home Inspectors or CCHI, a push to improve the current laws as referred to above. These improvements range from a minimum amount of inspections that are reviewed by their peers to a minimum amount of education every year. In closing, certification in the home inspection profession is not that hard. To be qualified to provide an honest, non biased report of the conditions within the home requires constant education, experience, periodic review by their peers and strong writing skills. The report may appear to be attacking the home when in reality the report should be providing the information to the reader so to make a clear decision. A BIG kudos to Alan Louie, who opened his home (and cut and marinated meats, made pies, shopped, etc) and hosted the RSVP Wrap Party as way of showing appreciation for the volunteers. Everyone enjoyed a gourmet bbq and recounted stories of how the seniors were so happy to have the volunteers visit and help them. SAMCAR President, Jennifer Tasto and new Executive Officer, Steve Blanton both were on hand to give a round of personal thanks to all the volunteers. A behind-the-scenes thanks to Julie Sanchez, SAMCAR Customer Service Representative, for coordinating the volunteers, seniors, and supplies to help make the week run smoothly for all.

Steve gave a brief overview on himself and briefly discussed his goals for SAMCAR, which included: focusing on professional standards, political advocacy, education and media outreach. Jennifer Tasto convened the Annual Meeting and reported that SAMCAR membership was strong at 3,000 and gave a brief update. Anne Lanphar, Vice President and Legal Counsel, First American Professional Real Estate Services then provided an update on escrow issues that were currently affecting REALTORS® and mortgage professionals. The foreclosure crisis has made following procedures paramount to closing an escrow successfully. To ensure a clear title, title companies will continue to be diligent and investigative in making sure that lenders have performed their jobs correctly. Federal Tenant’s Rights law Effective May,

2009, if a tenant is living in a home that has been foreclosed upon, the tenants are still covered by public law 111-22. A bona fide lease is still in effect after the foreclosure and the tenants need a 90-day termination notice. A new buyer of a foreclosed property needs to know that the lease has to remain effective. MLSListings Inc. Update

MLSListings Announces Progression to Matrix Technology by Year End MLSListings is excited to announce

a significant enhancement to its enterprise technology − coming this November − which will impact the way subscribers search, manage clients and conduct other routine transactions on the MLS. By the end of the year, Matrix will become the primary search engine interface within the Pro platform, providing all search, reports, client management and statistics functionality. MyListings, Strong Authentication, Account Management, Data Share and Reciprocal Access will

remain unchanged. Since the Matrix interface was first integrated with the Pro platform in June 2009, over 30% of subscribers have converted to the application. Over the next eight months, MLSListings will guide you through the progression to the new Matrix application from the current Pro application. You’ll make this switch smoothly and gradually with the help of training tools and resources, available whenever and however they work best for you.

and can shop their loans, they would save an average of $700 on the transaction. On page one, there is a summary of loan terms which are fixed for 10 business days and can not be changed by the lender. Page two breaks down the origination charges that will be assessed against the borrower including title insurance and lender fees. Page three provides general information to the consumer as to how best to use the form to comparison shop.

The HUD1 terminology now matches the Good

Faith Estimate language, which, again, makes it easier for the consumer to compare rates. The GFE helps make the loan terms and rates crystal clear as to avoid “closing shock” when the consumer is at the signing table.

The GFE and the HUD1 are tied together, and a transaction can not close without the two documents being sent to escrow together.

California SB 306 If a lender has agreed to a short sale, they have 21 days to respond. They have four days to approve a HUD1. This should help get short sales to close more quickly.

Ms. Lanphar discussed some of the C.A.R. Residential Purchase Agreement changes and stressed that every REALTOR® needs to be familiar with the changes.

MLSListings Inc. Update On June 1st, MLSListings will debut a new portal page called “MyNewPro”. This portal page will be your one-stop-shop for all of the information you need to get acclimated to the new Matrix interface. User guides, video tutorials, access to the training calendar, quick-tip sheets, checklists, feedback forms and much more will be found here. MLSListings is also developing a series of announcement and reminder notices in various formats to ensure users are on-track with their education curriculum, and engaging the resources of Associations to help provide training solutions and coordinate the dissemination of key information about the Progression. This new technology platform is the culmination of a nearly year-long development that was con-

ceived, driven and supported by subscribers, Broker-based Board of Directors, the MLS Advisory Group, and many others. The new platform will provide the same functions agents use in their daily operations, plus provide exciting new features − and both interfaces will be accessible through the new landing page.
