AMCAR exists for you, our members! I am always energized about our Association and our business of real estate as I meet and speak with all of you at various SAMCAR events and meetings. In July, we will have elections for the SAMCAR Board of Directors. I am asking you to consider running for a position on our Board. SAMCAR is a member-driven organization. If there is a policy or initiative you want to see at SAMCAR, as a Director you may have direct influence in making that happen. It is essential we have leaders who have an understanding of what is happening in our industry. This way, we can make the changes necessary to better serve our members, so that we can all succeed in our business. This role as a director is an opportunity for those of you to “give back” to an organization that exists not only for you, but also for your fellow REALTORS®. Elections for positions on the SAMCAR Board of Directors will be held in August. Deadline to submit an application is Wednesday, JULY 14, 2010. Criteria for candidates for Board of Directors position 1) Candidates must be in good ethical and financial standing with SAMCAR and have no ethics sanctions for the past 3 years, and be actively involved in the practice of Real Estate 2) Candidates for the election shall not be allowed to serve on the election committee. 3) A list of responsibilities shall be provided to the candidates and signed by the candidate and will be included with their application submittal. 4) Must have served on a committee for one year prior to running for Board Position. 5) After a Director has been elected to serve two consecutive terms, two years shall elapse before he or she shall be eligible for reelection as a Director. Golf Tournament

SAMCAR’s annual charity Golf Tournament is fast approaching. It’s hard to believe, but our golf tournament is almost upon us. We’ll be teeing it up at Green Hills Country Club on Monday, July 19, 2010. We still have a very few hole sponsorships left and room for more golfers. Redwood City Update Combined Budget Issues with Excitement on Upcoming Projects Contributed by Julie Ziemelis

The June Combined Tour Meeting

on June 2nd got off to a quick start with an in-depth Redwood City update by Redwood City Councilmember, Jeff Gee. Councilmember Gee gave a list of the Redwood City Council priorities: 1. Public Safety 2. Infrastructure 3. Legal Compliance 4. Fiscal Responsibility The Councilman gave the sobering news that 9 million dollars in reserves went into the operating budget. The Council thought the economy was turning around when they made the decision to dip into the reserves. The City Council now foresees the market taking another 10 years to recover. The City Manager has been tasked to bring in a balanced budget and to do that, 30 to 50 staff members will be laid off. A focus on core services will be paramount. Councilman Gee said, “We need to spend the money that we have on the things continued on page 4

to extend anti-deficiency protections to homeowners who have refinanced “purchase money” loans and are now facing foreclosure. Most homeowners didn’t even know that when they refinanced they lost their legal protections, and now may be personally liable for the difference between the value of the foreclosed property and the amount owed to the lender.

Home Buyer Tax Credit and National Flood Insurance Program

After a close brush with the deadline, Congress has passed an extension of the Homebuyer Tax Credit closing deadline through the Homebuyer Assistance and Improvement Act (H.R. 5623). The extension applies only to transactions that have ratified contracts in place as of April 30, 2010 that have not yet closed. The legislation is designed to create a seamless extension. The new closing deadline for

eligible transactions is now September 30, 2010. There will be no gap between June 30 and the date the President signs the bill into law. NAR worked closely with Congressional leaders on both sides of the aisle to enact this important legislation. Extending the Tax Credit Closing deadline will help provide additional stability to real estate markets across the nation. Additionally, the United States Senate has passed the National Flood Insurance Program Extension Act of 2010 (H.R. 5569) an extension of the National Flood Insurance Program until September 30, 2010. This will allow transactions to move forward. The bill is retroactive and covers the lapse period from June 1, 2010 to the date of enactment of the extension. Council member Gee continued his update with economic development news: • The city is looking to create incubator spaces for small businesses.

• They are working on a downtown Precise Plan which will include entertainment, housing, and retail.

• In-N-Out will be opening in a few months. • Fox Theater has new ownership and will open in July

with the PAL Blues Festival. • Private development 885 Woodside Road is a 42 unit development with market and below market units. • The Preserve at Redwood Shores will have 154 town homes.

• Redwood Shores Elementary School:

Opening in Fall 2010 with 15 classrooms k-5 • Peninsula Park will have 231 Units of town homes, both market rate and below market rate.

Councilman Gee wrapped up his presentation by discussing some of the challenges facing the city including the new jail in downtown being proposed by County.

The new jail would be located at the County government center. Architects will try to create the jail to blend in with the building.

The Saltworks (aka Cargill) plan is being looked at for the impact to the community. The Redwood City port wants to expand, as it is a big economic engine for the area. There are not enough playing fields in the city. High tides and winter bring floods. 6 in-2 ft of standing water can occur. The Council is trying to figure out how to solve these problems. It could take 2 to 3 years of study before the planning commission will look at it. Councilmember Gee closed with the fact that recovery is a long way off and the City knows it needs to work on housing and permitting issues. MLSListings Inc. Update

New Landing PageJulyDebuts 13, 2010 In just over three weeks, MLSListings,

Inc. will be launching a new landing page at pro.mlslistings.com. This is the first milestones in progression toward a new technology platform by the end of the year. By this November, members will search, manage clients, and generate reports and statistics more exclusively in the Matrix interface. The new landing page more fully represents the evolution of MLSListings’ business model, from a data-only enterprise to a comprehensive service model addressing all of the business needs of the real estate in-

dustry. The welcome video on the new landing page will direct users to their most commonly-used functions, and introduce the rest of the features available with a single click. It will also direct members how to quickly get back to the Pro environment you are used to, to ensure minimal business workflow interruption.

Reciprocal Access Results in a Win for Buyers, Sellers Since MLSListings, Inc. launched

its reciprocal access agreement with six neighboring MLSs, nearly 4,150 MLSListings subscribers have used the reciprocal access program to search listings in the East Bay MLSs, and more than 4,500 agents in the East Bay have used the system to search listings within MLSListings’ five home counties on behalf of clients. It is clear that MLSListings and the MLS operations in the East Bay service overlapping markets.

Announced in March, the reciprocal access program encompasses a total of seven MLS organizations sharing property and listing information representing 21 counties and more than 65,000 subscribers. The MLSs involved in this agreement include Bay Area Real Estate Information Services Inc.; Bay East Association of REALTORS®; Contra Costa Association of REALTORS®; East Bay Regional Data, Inc.; MLSListings, Inc.; MetroList Services, Inc.; and the San Francisco Association of REALTORS®. While subscribers can also access MetroList and SFAR through MLSListings’ California Edition data share, the new agreement with the East Bay MLSs has launched new access for all subscribers, also known as MORE, the Multiple Organization Reciprocal Exchange. AB 1919: We asked legislators to vote “NO” on this bill, which will essentially create a $10 transfer tax on the filing of grant deeds. Existing law allows a county board of supervisors to create a survey monument preservation fund which can be financed by the imposition of a fee of up to $10 to be charged upon the recording of a grant deed. Issues related to appraisals: C.A.R. sponsored two bills to improve the cost and quality of appraisals, but both faced extreme opposition and stalled in the Legislature. REALTORS® were asked to share their stories about appraisals and to urge legislators to support legislation that would clarify the Office of Real Estate Appraisals has the authority to regulate Appraisal Management Companies (AMCs) and make appraisals “portable” if transferring lenders. How the budget gap poses threats to REALTORS®: There are three potential threats to REALTORS® if the budget gap remains open, and members were asked to explain the implications of each to the industry. (see box at right) Thanks to each of our members who traveled to Sacramento for the day, and represented SAMCAR and REALTORS® so well!

Forced Overwithholding On Independent Contractors:

This proposal was defeated previously, but may come back. As proposed, the broker would need to withhold 3% of a commission and pay it to the Franchise Tax Board. When the agent files their state income tax return the following April, they will deduct the withholdings along with the quarterly estimated tax payments from their tax liability and, in theory, receive a refund for the 3% that was withheld. This allows California to have immediate care of those funds and earn interest on your money.

Tax on Services: Several attempts have been made to tax services like we tax sales of goods. A tax on real estate related services will increase the cost of housing because all services involved in purchasing a home will be taxed (e.g., home inspection, structural pest control inspection, escrow services, etc.). It will prejudice California based businesses, and put small companies at a disadvantage to big companies using in-house employees. The Mortgage Interest Deduction:

Preserving the mortgage interest deduction is one of C.A.R.’s major tax objectives but legislators see it as a “cost.” Both sate and federal law now limit the deduction to the interest paid on a maximum $1 million of mortgage debt plus $100,000 in home equity debt. The Legislative Analyst’s Office has recommended changing or eliminating the mortgage interest deduction. They are wrong. The deduction encourages homeownership. The U.S. has achieved one of the highest rates of home ownership in the world since the deduction came into common use. Homeownership promotes community stability and pride, employment, savings and long-term investment.

their fourth annual executive briefing and benefit lunch on Wednesday, May 12 to again highlight the need for affordable workforce

The SAMCAR Foundation was one of two major sponsors for the HEART event entitled: “Housing Our Employees: Affordable Homes for Sustainable Communities.” Attended by 284 people, the event raised over $60,000 to create more affordable homes, both rental and first-time homebuyers loans, and also featured speakers Julie Stock, a schoolteacher at San Mateo High School who was able to buy her first home in Pacifica, with the help of Foundation Chair, Suzan GetchellWallace.

Toni Burrows Hisco/CRES Home Warranty An 18 year veteran of the home warranty business, Toni Burrows approaches her business

with professionalism. Toni was born and raised in Livonia, Michigan and relocated to the Bay Area over 30 years ago. Knowing she had a knack and a passion for sales, Toni followed that route and worked in outside sales in the packaging industry and then gravitated towards the real estate industry 18 years ago. An avid walker, Toni says she passes familiar people on the path and knows their pet’s names (but not necessarily the owners). Her husband says she never passes up the opportunity to pet a dog. A true advocate of the Humane Society and Pets in Need, Toni loves animals. “I have a big passion for people and animals”, Toni said. Currently, Toni owns a cat (that acts like a dog), and

was the proud owner of two large dogs for many years. Toni is a Senior Account Executive for Hisco/ CRES Home Warranty. She services San Mateo County and a portion of Santa Clara County . Toni is an active member of both the SAMCAR and SILVAR Associations and is a member of WCR, as well. She has volunteered for 15+ years on the SAMCAR Special Events committee where she has helped to organize and execute a multitude of events. Currently, Toni is working on making this year’s SAMCAR Annual Charity Golf Tournament one of SAMCAR’s most successful events coming up on July 19th. Toni also volunteers her time to review the grants that the SAMCAR Foundation receives. “I LOVE what I do! I feel blessed to have met so many wonderful people while truly enjoying

my career. In fact, I met my husband George Monaco doing what I do. At the time he was manager of the Coldwell Banker office in Los Altos, he threw me out of his office because of an affiliation they had with another company. 9 years later we married.” Toni is proud to tell her Realtor clients, “I work hard, all the time.” I tell my clients, “If you’re working, I’m working.” I am always happy to take their calls, weekends included. I’m there when needed and I take pride in my work ethic.” Toni and her husband, George, live in Foster City and enjoy spending time and boating at their second home in Clearlake. As of July 1, 2011, homes are required to have carbon monoxide detectors installed if the home has a fireplace or burns any type of fossil fuel (i.e. a gas stove) The new contract will ask the seller: Is the property equipped with a carbon monoxide detector?

Gov said that although this is not a point of sale requirement, buyers will most likely ask to have the detectors installed if they see the seller has marked “no” on the form. Gov spent over an hour reviewing the changes on the Residential Purchase Agreement. Later that day, over 80 REALTORS® attended a four hour class taught by Gov on the RPA. spent many hours designing and building a festive float for the 4th of July parade to be held in downtown Redwood City on, when else, Sunday, July 4th at 10 a.m. The Redwood City Parade is the largest parade in Northern California and attracts thousands of spectators. Come out and show your support for our REALTORS® and Affiliates who are promoting homeownership and REALTOR® community involvement. They will also be vying for cash prizes.
