If a petition signed by 5% of the legal voters of the Town of Highgate objecting to this sale is presented to the Town Clerk within 30 days of the date of the posting and publication of this notice, then the Town will cause the question of whether to sell the property as set forth above at a special or annual meeting called for that purpose. Terms of the sale at auction are as follows: 1) The sale by auction shall occur at the Highgate Town Offices, 2996 VT Route 78, Highgate Center, Vermont on June 28, 2018 at 11:00 AM. 2) Town Attorney Edward Adrian shall conduct the sale. 3) The minimum bidding shall start at $18,000.00 for the Cherry Hill Property and $15,000.00 for the Dalcourt Property. Lower bids will not be accepted. 4) Each succeeding bid shall be in increments of $100.00 or greater. 5) All successful bidders must immediately pay at least 10% of the final bid to the Town of Highgate at the end of the sale. The successful bidder must pay the full amount to the Town of Highgate, by June 29, 2018 at 4:00 PM. The Town reserves the right to sell to the second highest bidder in the event that the highest bidder fails to pay to pay the full amount, or to the third highest bidder in the even the second highest bidder defaults. 6) Cash money order, certified bank check or cashier’s check shall be they only forms of payment accepted. No personal or business checks accepted. 7) All sales are final. It is the responsibility of the buyer to know what is being purchased before a bid is placed. Potential buyers should inspect the property and search the title and relevant Town, State and other governmental records. 8) Other then the issuance of a limited warranty deed, the Town of Highgate and its attor-
ney/auctioneer make no representations that the property is free and clear of defects of title, which may include environmental contamination, limitations on habitability, undischarged liens and mortgages, zoning and other land use and regulatory prohibitions.
