Notice is hereby given that the Town of Swanton Selectboard will conduct a public hearing on Tuesday, July 2, 2019 at 7:15 p.m. in the Town Office Building at 1 Academy Street for the purpose of considering the discontinuance of sections of three public roads and one trail that may no longer be needed for public purposes following a site visit to each one to examine its condition. If the discontinuances are approved, the land beneath each one shall revert to the abutting landowners. The proposed discontinuances are listed below: A. Consider a Section of Robin Hood Drive for Possible Discontinuance: Following a site visit to 100 Robin Hood Drive, a Class 3 highway, and after viewing a section that extends into the Fosgate property for about 350‘, the Selectboard will now consider that section of Robin Hood Drive (TH69), as illustrated in black on a map, for possible discontinuance. Consider a section of Champlain Street (TH11) for Possible Discontinuance: Following a site visit to the northeast corner of the intersection of Lakewood Drive and Champlain Street, a Class 3 highway, and after viewing it, the Selectboard will now consider an unused section of it, about 300’ in length through the Case property, as illustrated in black on a map, for possible discontinuance. The map is available at the Town Clerk’s office and on the Town of Swanton website on the Highway page. The Selectboard will take testimony from interested persons including the abutting property owners at the public hearing. Within 60 days of the examination and hearing, the Selectboard shall return a report of their findings and actions taken on the proposed discontinuances of the public road sections and trail mentioned above. Any discontinuances that are approved by action of the Selectboard shall be submitted to the Town Clerk for recording in the Town’s land records. Examine a Section of Robin Hood Drive for Possible Discontinuance: The Selectboard will conduct a site visit to 100 Robin Hood Drive to view a section that extends into the Fosgate property for about 350‘ and consider that section of Robin Hood Drive (TH69), as illustrated in black on a map, for possible discontinuance as a Class 3 Town road. Examine a Section of Babbie Trail for Possible Discontinuance: The Selectboard will conduct a site visit to Babbie Trail and consider It, as illustrated in black on a map, for possible discontinuance of the 205 foot long Town Trail. Examine all of TH67 (un-named road) for Possible Discontinuance: The Selectboard will conduct a site visit to TH67, a Class 3 highway, and consider it, as illustrated in black on a map, for possible discontinuance of its full 260‘ length into the Cargill property. Examine a section of Champlain Street (TH11) for Possible 1 Discontinuance: The Selectboard will conduct a site visit to the northeast corner of the intersection of Lakewood Drive and Champlain Street, a Class 3 highway, and consider an unused section about 300’ in Length, as illustrated in black on a map, for possible discontinuance of its about 300‘ length through the Case property. The map is available at the Town Clerk’s office and on the Town of Swanton website on the Highway page. Following the site visits, the Selectboard will conduct a public hearing on the proposed discontinuances of the three Class 3 road sections and the one trail at the Town Office Building at 1 Academy Street at 7:15 p.m. The Selectboard will take testimony from interested persons including the abutting property owners. Within 60 days of its examination and hearing, the Selectboard shall return a report of their findings and actions taken on the proposed discontinuances of the public road sections and trail mentioned above. Any discontinuances that are approved by action of the Selectboard shall be submitted to the Town Clerk for recording in the Town’s land records.
