was having a conversation with my Office Manager, “Ric Hernandez” about all the great things that we have going on here in San Clemente this year. The Outlets of San Clemente is close to completion and now open for business just in time for the Christmas shoppers, bringing great job opportunities for many people to work close to home. The final coastal new home project, “Sea Summit” has the models open and already selling first and second phases. Contact me if you have any questions on these homes, I stay up to date and can answer all your questions on all models with one phone call. To accommodate the traffic coming through San Clemente we have the 5 freeway widening project moving along quite well and since Talega was planned the La Pata extension, 15 years in the process, is in it’s final stages to be completed in 2016. It’s going to be really nice having four different choices to access the north bound freeway or head up to the transportation corridor off Antonio Pkwy., also another option for high school, San Juan Hills will be closer than San Clemente High School for many. 15 years building our great community, Talega is just about complete with only a handful of new homes left to sell, I am sure all homes will be completed in 2016 and Talega will be completely finished! The average Days On Market(DOM) shows how many days the average Property is on the Market before it sells. An upward trend in DOM tends to indicate a move towards more of a Buyer's market, a downward trend a move towards more of a Seller's market. The DOM for October was 62, up 8.8% from 57 days last month and up 8.8% from 57 days in October of last year. The October 2015 DOM was at its highest level compared with October of 2014 and 2013.

City of San Clemente Hospital and Legislative Update City of San Clemente Pubic Forum called for December 9, 2015 12.2.15…San Clemente, California… At the November 3, 2015 City Council meeting, the Council directed staff to prepare a rezone and General Plan amendment to ensure that the current hospital property is zoned only for the essential hospital purpose it was designated for when purchased by Saddleback Memorial Care in 2007. State zoning law gives the City the ability to review and update its zoning laws to make sure that they protect the public peace, safety, and welfare, including public health and quality of life. Additionally, staff was directed to send Memorial Healthcare a letter requesting they provide data on Saddleback Memorial Care San Clemente Campus’s financial standing, and to request a meeting with its Board of Directors to continue discussions to benefit the citizens of San Clemente. At that same Council meeting, the City Council also directed staff to review the opportunity of seeking potential hospital suitors that may be interested in coming to San Clemente. The City will be meeting with those the potential suitors in early December of 2015. When the City of San Clemente became aware of the potential closure of the Saddleback Memorial Care San Clemente Campus in late 2014,

the City took immediate steps to understand the impacts, seek community input, involve stakeholders and seek plans to mitigate this potential impact to the City. The City conducted a series of public meetings with the Saddleback Memorial San Clemente Hospital Advisory Committee. This Advisory Committee recommended seeking legislative relief to authorize a satellite Emergency Department. Thus, Assembly Bill 911 (Brough) and Senate Bill 787 (Bates) were introduced. The City of San Clemente hired the Sacramento lobbying firm of Aprea & Micheli to immediately begin seeking legislative support for these bills. These bills eventually were referred to an interim study for further review. In September of 2015, members from the Assembly and Senate Health Committees conducted an onsite tour and had a series of presentations made by various stakeholders at the San Clemente Hospital to better understand the unique situation facing San Clemente. This tour was very beneficial to understanding the needs of San Clemente as it related to pending legislation. As a part of its commitment to the residents of San Clemente, the City Council has begun taking additional steps to explore other alternatives to ensure the community’s healthcare needs are met. These alternatives do not include increasing taxes on San Clemente residents. San Clemente City Council will be hosting a Healthcare Workshop on December 9th from 4 pm – 6 pm in the San Clemente Community Center Auditorium located at 100 N. Calle Seville. It will be comprised of local government officials and their representatives and various stakeholders to discuss the current legislation.

PROTECT YOURSELF FROM EL NINO FLOODING On a Sunday morning in 1941, the radar officer saw a large blip and warned the Lieutenant in command. The Lieutenant replied, "Don't worry about it." I am now going to be your radar operator so please listen before you say don't worry about it! El Nino happens every few years when the water along the equator is warmer than average. This warmer water creates weather patterns that increase rain and snowfall for us in California. Sometimes the effects of an El Nino are hardly noticeable, other times, like the El Nino Experienced in the fall and winter of 97/98, massive storms raged over Southern California causing millions of dollars of property damage. During this El Nino, the water temperature was 4 degrees warmer than usual. Currently the water along the equator is 5 degrees warmer than it should be. Better grab those rain boots! There is currently a 95% chance that we will have heavy El Nino storms for fall 2015 and winter 2016. This will cause flooding, mudslides, roof leaks, road closures, and major structural damage in California similar to that experienced in 97/98. So now that we know it is coming, how can you prepare for it? First look at getting flood insurance for this coming fall and winter storm season. Review your policy, I bet you do not have flood coverage for water coming from the outside. Call your agent and get yourself covered as soon as possible. Now that the paperwork is done, lets get to work on the property itself. Inspect and repair your roof. Make sure no debris is obstructing any valleys or scuppers and clean out the gutters for proper drainage. Have all known roof leaks repaired now before the roofers become too busy to even provide you a tarp. Now that we have the roof covered, lets go over the landscaping. If you have landscape drains, make sure they are working by flushing them out. Review the drainage on your property, is there anything blocking the exit of a lot of water? Insider Investing 2015 Tax Tip The details of the new tax change are expected to be released in the coming weeks, but what we do know is that the government effectively raised the deductible amount of depreciable assets from $500 to $2,500. As such, when investors make improvements to properties or buy assets for the rentals, we may be able to take an immediate tax deduction instead of needing to depreciate it over many years. The net result is a potentially larger tax write off in 2015 to generate a higher tax refund. Let’s go over an example. Let’s assume Tom is a real estate investor who owns several rental properties, which are single family and multi-family units. In 2015, Tom made some improvements to his single family rental and incurred $2,000 for new cabinets and another $2,500 for new kitchen appliances. Before the new tax change, all of the money that Tom spent above would generally need to be depreciated over many years. Instead of deducting the entire $4,500 spent on cabinets and appliances, it would generally be depreciated over a 5-year period. However, as a result of the new tax change, Tom may now be able to deduct the entire $4,500 spent on cabinets and appliances to reduce 2015 taxes. Let’s assume that Tom’s tenants in the multifamily have been complaining about the old washers and dryers in the units. Tom was on the fence about replacing the old appliances because he knew it would be a large cash outlay. Tom was thinking about purchasing 50 washers and 50 dryers for $800 each. However, based on the old tax rules, Tom would generally need to depreciate the $80,000 asset purchases over 5 years, which delays his tax write-off. With this new tax break, Tom is now able to potentially deduct the entire $80,000 of appliance purchases immediately in 2015 because each item is under the $2,500 threshold. Assuming that Tom is in the 40% tax bracket between federal and state income taxes, the new tax change can result in $84,500 of IMMEDIATE tax deductions increasing his refund by close to $34,000!

Significant Tax Savings As you can see, for those of us who invest in real estate, this can result in significant tax savings for the 2015 year. The great thing about this tax change is that unlike a lot of other tax perks, this may be available for all business owners and investors, regardless of their income level. What is even better is that although the new change is official as of November 23, 2015, the benefits may be applied retroactively back to 2012. This means that for some taxpayers, this may be an opportunity to file amended tax returns to claim refunds on taxes paid previously. So what does this mean for you? If you have not done so yet, be sure to touch base with your tax advisor before December 31st to determine the best way for you to take advantage of this new tax break from Uncle Sam.

Fannie, Freddie Loan Limits to Rise in 39 High-Cost Counties On December 2nd, the Federal Housing Finance Agency said conforming loan limits for mortgages purchased by Fannie Mae and Freddie Mac will remain at existing levels except in 39 high-cost counties. The current loan limits are $417,000 nationwide and $625,000 in high-cost areas. The limits will rise in 2016 in 11 counties in Colorado, five in Massachusetts, two in New Hampshire, four in California, 14 in Tennessee and three in Washington. In California, Napa County's loan limits will be the highest in 2016 at $625,500, followed by San Diego County at $580,750 and Sonoma County at $554,300. Colorado will see the highest increases in 2016, up $34,500 to $458,850 in 11 counties including Denver and Boulder. The FHFA, the regulator of Fannie, Freddie and 11 Federal Home Loan Banks, sets higher loan limits in high-cost counties as a function of area median home values. The FHFA kept loan limits unchanged in most of the country after determining that the average U.S. home value of $207,051 in the third quarter still remained below the $215,083 average in the third quarter of 2007.
