Five things San Clemente should know this week FAM to Open Thrift Store on El Camino Real THE LATEST: Family Assistance Ministries (FAM), a local housing assistance program and food pantry in San Clemente, will open a thrift store downtown in the coming weeks.

Mary Perdue, the director of FAM, said volunteers have been helping with the renovation of the store as well as stocking it with clothing, furniture and other donated items.

The organization signed a lease in June after an extensive search for a location, Perdue said.

“We looked for four years around Dana Point and San Clemente, and this came up at the right location,” Perdue said.

The thrift store will be located at 540 and 542 (upstairs) N. El Camino Real.

The store is intended to be open seven days a week, but Perdue said that may change depending on the demand.

Perdue said members of the Kiwanis San Clemente and members of Pacific Coast Church have helped establish the store.

“We’re very excited to help the community, and the income from the store will help our clients and get people into shelters to find permanent housing,” Perdue said.

In addition to the thrift store, Perdue said FAM has helped 93 homeless people find permanent housing or other assistance programs this year, 33 of whom were children. The FAMily House, which launched in April, has helped 52 of those people find housing options.

Perdue said the goal of FAM is to prevent people from becoming homeless in the first place.

WHAT’S NEXT: Perdue said an opening date has not yet been finalized, but the thrift store is expected to open sometime in September. The store will be run by two employees and there will be volunteers.

Incoming Middle School Students Get WEB Orientation at Bernice Ayer THE LATEST: Bernice Ayer Middle School San Clemente Times August 24-30, 2017

organized its second annual WEB Orientation on Aug. 17 to prepare incoming students for the new school year. Originated from The Boomerang Project, a student, peer and mentor nonprofit organization based in Santa Cruz, WEB is designed to assist as well as teach incoming sixthgrade students from primary or elementary school to secondary school such as junior high or middle school.

The sixth-graders are assigned to eighth-grade student-mentors and conduct a variety of activities throughout the entire school year, including group meetings, student rally events, pizza parties and movie nights.

Bernice Ayer’s Principal Nick Steyer said he was optimistic about the school’s relatively new transition program, which was organized and funded by both teaching faculty and parents through the middle school’s Parent-Teacher Student Association, or PTSA. During the orientation, more than 300 incoming sixth-graders were welcomed by more than 50 cheering eighth-grade WEB student-mentors as they walked through the doors of the school’s multipurpose room hall. Brief and fun exercises were provided to the students, and Steyer gave an encouraging speech to the new students.

WHAT’S NEXT: Patricia Holloway, the district 3 representative of the Capistrano Unified School District Board of Trustees, attended the WEB program and said since the start of WEB, reports of absenteeism and bullying have started to decrease.

“If those things are happening, then I think it would be beneficial to have it at the other schools, said Holloway.

Relay for Life is Aug. 26 at Jim Johnson Memorial Sports Park THE LATEST: San Clemente will host Relay for Life at a different location this year, at Jim Johnson Memorial Sports Park, located at 560 Avenida Vista Hermosa. Planning Commission Approves Emergency Shelter Zoning but Holds onto 300-Foot Buffer THE LATEST: The Planning Commission passed a zoning amendment on Aug. 17, to the emergency shelter overlay in San Clemente per city staff recommendation, but they left in a provision that would require emergency shelters to be at least 300 feet from one another.

WHAT’S NEXT: During deliberations, the commission voted 5-2 to pass on the amendment to City Council, which is expected to hear the issue in September.

THE LATEST: The Dual Diagnosis Treatment Center, Inc., also known as Sovereign Health, filed a motion in federal court on Aug. 15, requesting a judge unseal the search warrant from the Federal Bureau of Investigation (FBI) that allowed agents to conduct a raid on its facilities as well as the home of its CEO, Tonmoy Sharma, on June 13.

Sovereign Health is claiming the investigations were “induced” by the insurance company Health Net, Inc. (Health Net) in order to gain favor of the insurance provider’s existing lawsuit with Sovereign and other healthcare companies.

“That and other aspects of the warrants suggest that the affidavit likely contains false and misleading information and omits other material information,” the motion stated. “Sovereign and Dr. Sharma thus seek to obtain a copy of the warrant in

order to determine whether the searches were lawfully authorized, and to take appropriate action if they were not.”

When inquiring about the reasons behind the FBI raid on the Sovereign facilities, FBI spokesperson Laura Eimiller told the San Clemente Times on two separate occasions—once immediately following the raids and another at the beginning of August—that the warrants are under seal by a federal judge and that the bureau could not disclose the nature of its investigation.

The FBI did confirm, however, that it was conducting an investigation at the company’s Southern California locations as well as Vedanta Laboratories where agents were seen carrying out materials and speaking to employees on June 13.

The lawsuit claims that during the raids, the FBI illegally seized property “outside the scope of the authorized seizures, traumatizing both employees and patients” as well as being responsible for reputable damages to the company. Sovereign is also claiming the investigation pertains to insurance fraud because there is no “genuine concern of evidence destruction or witness intimidation” and therefore, should be unsealed, making the warrant documents public.

Counter to the alleged claims for the raid, Sovereign turns the fraud allegations finger to Health Net, citing their “checkered history of fraud and other unlawful… conduct.” Health Net provided insurance services to Sovereign’s clients, but those provisions soon became prohibitively expensive due to the increased demand and access to services, according to the lawsuit.

“On June 30, 2016, Sovereign filed a complaint against Health Net in the Los Angeles Superior Court, alleging bad faith, breach of contract and other state law claims resulting from Health Net’s wrongful denial of over $55 million in claims by Sovereign,” the lawsuit stated.

The Aug. 15, lawsuit mentions the insurance provider is currently under investigation by the U.S. Department of Justice for Medicare claims fraud. Sovereign’s legal team said Health Net has provided millions of dollars in settlements for other investigations.

Sovereign Health has had a tumultuous relationship with the city of San Clemente for some time.

Since at least 2014, residents have staged protests in front of their corporate headquarters or other residential facilities in the city that are owned or operated by the company. Reasons behind the various protests against Sovereign Health range from complaints about continued disruptions to not following ordinances.

Distillery in San Clemente becomes Orange County’s second since Prohibition

rains of wheat ferment and other spices fuse with flavor. Heated by the distillery, the molecules trickle down into a copper still to combine with alcohol.

This chemical processing creates Drift Distillery’s signature whiskey and vodka, San Clemente’s newest liquor and spirits operation and the second distillery in Orange County since the Prohibition Era, according to owner and operator Ryan Winter. Winter and his wife Lesli will be opening the doors of the new South Orange County business in the near future.

Ryan describes Drift’s whiskey as more of a moonshine, but tamer. Made of 100 percent wheat mash, he said it’s made to be barreled and they have started to bottle it for purchase. Although Drift is only currently concocting whiskey and vodka, Ryan says they also have plans to make gin and rum, made with molasses or sugar cane juice. The Winters also have an interest in producing a rye whiskey and bourbon.

When asked, Ryan said his favorite part of distilling whiskey and vodka is “drinking it.” But he said he enjoys the process of bottling it and seeing the final product too.

“My favorite part of the process is the fermentation,” Ryan said. “Seeing it bubble and the smell; it kind of smells like a bakery. There’s a lot a going on, and you can actually see the process of it bubbling. If you go to a brewery, everything is closed so there isn’t any ‘contamination.’”

For Lesli, the triumph is in the finale.

“I just like seeing the bottles fill up with the finished product; it’s such a sense of accomplishment,” Lesli said.

A FAMILY BUSINESS Originally hailing from Kansas, the husband-and-wife team have transformed Drift into a true family business. However, the irony behind the Winters home state is that Kansas has historically some of the strictest alcohol laws in the country, and there are still multiple “dry,” or alcohol-prohibitive, counties as of 2013.

“On a Sunday during a football game, you would have to drive across the border to Missouri (to buy alcohol) because their doors were open,” Lesli said.

With family members still in the state of Kansas, cutting costs of materials for the Winter’s distillery is a bit easier than what most businesses may experience. A large portion of the grains and wheat needed to make the liquors is given to the couple by their parents from their Kansas farms.

surplus. Even the pair’s two daughters help with the processes in their business.

REGULATIONS BEHIND OPENING A DISTILLERY Despite the excitement with opening a distillery, the Winter’s have traveled a long road to get to opening day, including a lengthy process of regulation approvals and proposals.

Lesli said the business has passed every inspection it needed from the federal government down to local municipal requirements. The Alcohol and Tobacco Tax and Trade Bureau requires distilleries to first have a permitted commercial space in order to open its approval.

“It took 10 months to get approval, and there’s a bit of a risk in securing a lease,” Ryan said. “We’ve leased this space for three years, and had been in it 10 months before we even knew we were approved.

Then it’s about getting all the equipment.

It took about a year to get the still made.

Then it’s planning, making sure your landlord knows what you’re doing, letting the city know what you’re doing. And for the tasting room, I had to get a CUP (conditional use permit) during a public hearing.”

But after going through the process with the city, Lesli said government officials were hospitable to their business proposal.

“That was one of the reasons why we wanted to (open another business here in San Clemente) because of the community,” Lesli said, mentioning their previous business endeavors in the digital advertising agency world. “It’s so supportive of local businesses.”

The couple have lived in San Clemente for more than 20 years, and Ryan said they had established their reputation, at least enough to convince people they would be attentive owners of such a business.

“I think our current goals are to get the tasting room open (consistently) because opening a distillery is nothing like opening a brewery or winery,” Lesli said. “We have so many hoops that we have to jump through, and literally the last hoop we were waiting for is the Orange County Health Care Agency.”

Lesli said their second goal is about increasing distribution.

“We keep in touch with a lot of friends around the country and they want to know when we will open officially and when we will start distributing,” Lesli said.

Ryan said liquor laws require the business to use a distributor for their wholesale products rather than distributing the beverages themselves, which differs from the distribution of beer.

“Prior to 2016 (in California), there were even stricter regulations,” Lesli said. “You could have a distillery and a tasting room, but you couldn’t sell to consumers directly.”

Although the bureaucracy behind Drift has primarily passed, Ryan said the one other element that is difficult about distillation is keeping the tanks clean.

“The milling process, the mash, is not too difficult,” Ryan said. “We’ve got forklifts that will help lift stuff, kids who will help carry buckets. But when you love what you do, none of it is really work.”

HOW BASIC DISTILLATION WORKS Distillation is a process of heating and separating liquid from solid materials that dates back before Common Era. It is a function of heating ingredients and alcohol to a point where they condensate and collect in a chamber, which leaves the finished product.

The kind of distillation conducted at Drift Distillery uses columns to turn the mash into vapor that is cooled after being boiled.

Depending on the ingredients and alcohol content, it could be a whiskey, rum or other kind of alcoholic product.

San Clemente Youth Artist Joins Eco Challenge Poster Contest Hall of Fame San Clemente resident Tanner Salgado, 13, won Orange County’s 2017 Eco Challenge Poster Contest. City to Host Hike of Proposed Toll Road Routes The public is invited to join San Clemente City Council member Lori Donchak for a “Toll Road Trek” hike on the Forster Ridgeline Trail from 9-10:30 a.m. on Saturday, Sept. 23, from 9-10:30 a.m. The purpose of the hike is to help citizens learn more about the potential impacts of the alignments being studied by the Transportation Corridor Agencies (TCA). A naturalist will also participate in the hike and discussion.

The starting point for the three-mile hike is at the trail at Avenida La Pata and Camino Del Rio. Participants are asked to park on Camino Del Rio in Forster Ranch and to carpool if possible. This can be a strenuous three-mile hike on a dirt trail.

Wear tennis shoes, sunscreen, a hat and bring a water bottle. Dogs on leashes are welcome.

Letters to the Editor RESEARCHING THE TCA CORD BAUER, San Clemente

While researching the history of the Transportation Corridor Agencies (TCA), I found that while the projections for the toll roads were under $800 million, the final costs were over $4 billion. It’s breathtaking how the TCA blew past projections by $3 billion. It made me think of the Solyndra Scandal and how that cost taxpayers over $500 million, which is peanuts compared to the TCA. I found that 2.7 percent of OC residents work in San Diego County, while 22.7 percent work in L.A. County. Estimated ridership numbers on the toll roads still haven’t been met, even after 20 years. Surprisingly, traffic on Interstate 5 has been mostly stable for the past 20 years. A recent OCTA study backs this up.

During my research I also found an article from 2008, when the TCA chose the Green Alignment. It says, “But TCA notes that there were 38 alternatives studied, and they all failed for various reasons—primarily due to their negative effects on both natural habitats and homes and businesses,” said Jennifer Seaton, TCA spokeswoman.

I’d like to know how all these failed

alignments are now back in play, when the only real changes are increased TCA debt and toll rates.

What checks and balances have they put in place to protect Orange County taxpayers? What’s stopping the TCA from feeding us more cost overruns and missed ridership projections with the next extension?

Perhaps the TCA is gambling that a revolving door of board members will stifle accountability. Maybe they want to pit one community against another in a bid for new toll routes. Either way, it’s been done before.

For 20 years the TCA has been doing the same things over and over and expecting different results. We need to dissolve the TCA to end this insanity.

SAN CLEMENTE TOLL ROAD AND TRAFFIC POLLUTION FREDERICK PRICE, San Clemente

According to a Los Angeles Times article published on Aug. 8, “L.A. needs to make sure air filters are being installed in homes near freeways,” the article stated, “... A mounting number of scientific studies link living near traffic pollution to asthma, cancer, heart attacks, pre-term births and an array of other health problems.”

This article went on to say that a 2016 ordinance, signed by Los Angeles City’s Mayor Eric Garcetti, requires “...new homes within 1,000 feet of a freeway to have air filters meeting a standard of 13 on

a 16-point industry scale—the minimum efficiency reporting value—that measures how effectively they block tiny pollution particles.”

If the foregoing is true, and I have no reason to doubt that it isn’t; how can the Foothill/Eastern Transportation Corridor Agencies (TCA) even consider building a toll road (Route 14) that will pass well within 1,000 feet of existing homes and San Clemente High School? Have they chosen to ignore well-established (and published) facts on the health hazards caused by freeways located too close to homes and schools? Or is it that they simply don’t care?

Ed Sachs, chairman of the Foothill/ Eastern Transportation Corridor Agencies, and Mayor Pro Tem of Mission Viejo (and his cohorts) have championed Route 14 through San Clemente as the best alternative to build a toll road. By doing so, they have shown a total disregard for the health and well-being of those affected by their erroneous decision.

Soderbergh Makes ‘Logan Lucky’

inematic auteur Steven Soderbergh is an intriguing enigma. He made the successful transition from indie filmmaker to studio director effortlessly, being one of only two directors to ever be nominated for “Best Director” twice in the same year. His public image has mystique too, with multiple pseudonyms behind the scenes, sometimes with bizarre interview gimmicks and erroneously announcing an early retirement in 2013, only to go back to work with Logan Lucky, which is now in theaters.

As a quick way to make some big money, Jimmy recruits his brother, Clyde (Adam Driver), to come up with a scheme to rob the Charlotte Motor Speedway, along with

their sister, Mellie (Riley Keough), and convicted safecracker, Joe Bang (Daniel Craig).

Seth MacFarlane, Sebastian Stan and Hilary Swank also make up some of the big-name cast. Logan Lucky is a solid, straightforward heist flick, akin to a southern Ocean’s Eleven (2001), also from Soderbergh. With his usual pseudonyms as cinematographer, editor and screenwriter, Soderbergh reminds us that even with a big budget he hasn’t abandoned his indie roots and doesn’t feel the need to pander. With NASCAR inside jokes and a guitar-heavy score surrounding a backwoods atmosphere with an amusing ensemble cast, Logan is a decent way to end the summer movie season. SC

Widow Puzzled by a Friend’s Warning

obyn, 62, a widow of five and a half years, contacted me regarding a comment a friend made to her about the problem of waiting too long to start dating again.

Robyn emailed, “I am curious about something, after being told recently by a friend that ‘If you wait too long, you will get used to being alone, and attempts at re-partnering will become futile.’

“I was married 32 years. After the first year of widowhood, I entered a very shortterm relationship, and then six months later, began a relationship that lasted just over two years. I ended the latter relationship (it was going off the rails anyway), as I felt that I needed more time to sort things out and set a new course in life.

“I do wish to re-partner at some point, but feel I am not quite ready to make any overt move in that direction. I have signaled to a couple of trusted contacts that I am open to meeting their single male friends, but am in no great rush to do so.

“However, is there a point of no return, as my friend has suggested? I have read stories of people getting to a place in their lives where they thought they would be alone forever, only to find a most wonderful person to spend their later years with.

“Is it crucial that I get to a place in life

where I don’t want a companion, so that I inadvertently attract a potential mate?”

My response to Robyn: You say you wish to re-partner, but aren’t ready to make any “overt” move in that direction. I assume what that means is you aren’t ready to actively or aggressively look for a potential mate. However, I think you may be more willing than you realize since you wisely have signaled to a couple of contacts that you are open to meeting single men.

That’s ridiculous. Nothing is farther from the truth. Becoming comfortable living alone can be an important and attractive characteristic to have. In that way, you are building self-confidence. You are comfortably dealing with loneliness. And you are privately thinking, I don’t need a mate to make me a complete person. But I’d like to have a person with whom to share my life.

Often, older singles are so lonely, they look too hard and come off as desperate and needy. But in your case, you invested ON LIFE AND the time to discover who LOVE AFTER 50 you truly are, and you are

But, sitting back and doing nothing isn’t a great idea either. You need to live life with or without a mate. Get more involved in activities that interest you. Meet new people.

Develop friendships with women, which can make going places easier since you’ll have friends to tag along with.

Yes, we often hear that singles meet a new mate when they aren’t looking, when they least expect it. But, that doesn’t happen by just staying home, being reclusive and thinking they’d be alone forever. It happens because they have a positive attitude and are out in the world, enjoying life and socializing.

Singles need to smile and be willing to chat it up with strangers. They must leave their baggage aside and not complain about members of the opposite sex, or being a victim of bad luck.

So, no, you aren’t past the point of no return. Just crank it up a bit. Plus, the fact that you were involved in two relationships since you were widowed is a good thing.

That means you are open to sharing your life, but, of course, with the right person, and not just anybody who comes along.

illions of people across the continental United States came out in droves to see the total solar eclipse that took place Aug. 21. In South Orange County, about 60 percent of the sun was blocked by the moon, according to NASA. This was the first total solar eclipse that

could be seen in the continental U.S. in almost 100 years.

People in San Clemente made their own makeshift devices to watch the eclipse safely and bought specialized sunglasses to view the moon blocking the sun. The next total solar eclipse is expected to place in 2024, but it will only be visible on the East Coast. SC

A New World Beneath the Waves Summertime is prime for spearfishing in Orange County

imply put, late summer is prime time for spearfishing in South Orange County. As summer winds to a close, the world below the waves comes to life, and Picket Fence Media wanted to highlight a few of the most important things you should remember when entering the water in order to remain safe and to ensure you get the most out of your spearfishing experience this season.

TIS’ THE SEASON With coastal water temperatures hovering around 70 degrees and off-shore surface temperatures regularly reaching 80 degrees, August and September are an ideal time to begin your spearfishing journey. These warm currents have brought recognizable pelagic fish such as the bluefin and yellowtail tuna, dorado and wahoo to offshore environments.

Meanwhile, resident species such as sheepshead, rockfish and halibut can be seen just offshore.

“This time of year is the best. The water is warm enough to just hop out there in trunks, some fins, a snorkel, a mask and your gun,” said Eric Martin, owner of Lost Winds Dive Shop on El Camino Real in San Clemente and a spearfisherman with 15 years of experience. “Between the biodiversity, access to beaches and fishing spaces, Southern California is one of the best environments to learn to spear in the whole world.”

LEAVE THE GEAR AT HOME With the abundance of fish and the beautiful climate necessitating minimum gear requirement, spearfishing has never been more accessible. With that said, there are still a few key fundamental pieces of equipment every spearfisher should have when entering the water.

FINS: The longer, more flexible shape of dive-specific fins allows for more fluid, long-distance movement. However, especially when near-shore spearing, the molded body board fins found in most garages will do just fine.

The mask should be comfortable. “Every face is different. Polarized, glass, plastic, whatever it is. Fit is the key,” Martin added.

SNORKEL: Relatively self-explanatory, a snorkel well-fitted to the user’s head and mask allows you to skim the surface and evaluate the depths below before diving for a possible kill.

GUN: The best gun for a spearfisher is dictated by their desired catch, size and skill. Made of metal, or wood, spear guns are as personal of a choice as any surfboard or vehicle. A large variety of quality guns are on the market, and Martin suggests you come into your local dive shop to speak with a professional that can outfit you with the best gun for your physical size and desired experience.

PRESHO, TEAM USA ADVANCE IN WORLD VOLLEYBALL CHAMPIONSHIP San Clemente’s Kyler Presho and the U.S. Boys’ Youth National Team is making a run through the FIVB U19 World Championship in Bahrain.

Presho, who graduated from San Clemente High School in June, along with 11 other American players, have been competing on the other side of the world for the past several days.

The USA squad finished second in pool play, and will head to the knockout stage of competition today.

Team USA opened pool play with a four-set win over host-nation Bahrain on Aug. 19. Presho notched eight kills and had a team-high four blocks in the tournament opener. The Americans then defeated Puerto Rico and Tunisia before suffering an upset loss to Egypt on Aug. 22. Egypt went on to win the pool.

The tournament finals will take place on Sunday, Aug. 27.

LIVE LIKE NICK 5K SET FOR AUGUST 27 The fourth annual Live Like Nick 5K Run/Walk will take place at San Clemente High School on Sunday, Aug. 27.

The event honors the life and legacy of standout SCHS student-athlete and UCLA football player Nick Pasquale, who died in an accident in 2013. The event raises funds for the Nick Pasquale Foundation, which provides scholarships for San Clemente youth. The foundation also uses funds to support SCHS athletics, Triton Football Pop Warner and Cheer.

The run/walk will take participants around SCHS and the surrounding area.

ow does little brother get out of big brother’s shadow? Well, four wins in one weekend at an NSSA contest is one way.

Last weekend, 12-year-old Dane Matson, younger bro of rising star, Kade, caught some serious fire in Huntington Beach. Surfing in a doubleheader in the NSSA’s highly competitive Southwest Explorer conference, Dane got to work early and never looked back. By Sunday afternoon, he’d won two Boys divisions and two Menehune divisions.

And if things are still congested, perhaps there’s a softer approach? At one point, even the TCA suggested a smaller artery connecting La Pata to Cristianitos was a viable solution. Then they said, “we don’t do arteries.”

It’s not an ideal solution, as it would still cut through park land, but it would certainly be less intrusive and impactful if done right.

This all may be a moot point, anyway. In a few years, the Navy and Marine Corps could decide not to renew the lease agreement for the State Park land, in which case the TCA would be handed off to the federal government, and the process would begin anew. For the effort, Dane was named NSSA Surfer of the Week and now he’s your Grom of the Week. When asked about future goals, his response was swift and confident: “To keep the roll going and rack up some more wins.”
