D

elhi Chief Minister Arvind Kejriwal offered to quit as the national convenor of the AAP which he led to power in the capital barely a month ago, party sources said. Kejriwal’s offer came as the party’s top leadership met amid internal squabbling. Aam Aadmi Party leader Yogendra Yadav, one of the two leaders in the eye of the storm, was reportedly shunted out of AAP’s nine-member Political Affairs Committee (PAC) on March 4, TV reports said. Yadav had said before the meeting that he would “neither split nor quit” the party. The differences in the party leadership have come out in the open barely a month after it made a sensational electoral comeback, sweeping 67 of the 70 seats in the Delhi assembly. There were conflicting versions to Kejriwal’s offer to quit. In one,

Kejriwal apparently wrote a letter on February 27 to party secretary Pankaj Gupta saying he wants to quit as the AAP convenor. In the

on March 4 for 10 days of naturopathy treatment to check his high sugar level, said that he was “deeply hurt and pained” by the wrangling within the party. AAP sources have said the majority in the 21-member National Executive, favored ousting Prashant Bhushan, a leading Supreme Court lawyer and an AAP founder, and political pundit Yadav from the nine-member, decision-making Political Affairs Committee (PAC). Yadav refused to comment on Kejriwal’s offer to quit as party convenor. Yadav said that for the past three days there had been many messages from party volunteers on the social media asking them to stay united. “I am sure that in the evening we will be able to tell you that we have moved a step forward and not backward.” Kejriwal said he was pained and hurt by the new developments but he would not allow the “people’s trust to be broken”.

JAMMU: Upset over the portfolio allocated to him, Sajjad Ghani Lone of the Peoples Conference (PC) has refused to join the council of ministers in the PDP-BJP government headed by Mufti Muhammad Sayeed. Lone was miffed over allocation of the animal husbandry department portfolio to him by Sayeed. He did not attend his office in winter capital Jammu on March 4 and instead chose to fly back to the Valley. “Yes, he has refused to join the council of ministers. He has also surrendered all entitlements including security, official vehicle and other perks given to him as a cabinet minister,” said a Peoples Conference source.

HC rejects Chavan’s plea in Adarsh scam Telecast of Nirbhaya rapist interview stopped IANS, MUMBAI

NEW DELHI: Home Minister Rajnath Singh on March 4 said the government had taken steps to stop the telecast of a documentary based on an interview with a convict in the December 16 Delhi gang-rape case. In statements in both the Lok Sabha and Rajya Sabha, the home minister said the government condemns the December 16, 2012, incident and will not allow anyone to leverage such incidents for commercial use. The minister said it came to their notice that the documentary was to be telecast on BBC 4 channel on March 8. “The government has taken necessary legal action and obtained restraining order from the court on disseminating the contents of the film,” he said. “Our government condemns the incident of December 16, 2012, in the strongest possible terms and will not allow any attempt by any individual group or organization to leverage such unfortunate incidents for commercial benefits,” he said. “The respect and dignity of women constitute a core value of our culture and tradition... our government remains fully committed to ensuring safety and dignity of women.” Rajnath Singh also said that he was personally hurt when he got to know about the documentary. “I would like to make it clear. As

soon as I got to know about this incident I was personally hurt. I immediately talked to the concerned authorities and gave the instruction that it should not be telecast in any condition, and (restraining) orders were taken from court last night that whatever has been telecast should not be released,” he said. The minister added that he had sought information regarding the conditions under which permission was given for the interview. “In future, no one will be given permission to interview rapists,” he told the Rajya Sabha. “If needed, responsibility will be fixed (for granting permission),” Rajnath Singh said while making the statement in the Lok Sabha. Parliamentary Affairs Minister M. Venkaiah Naidu also said that the government will try to stop the telecast of the documentary internationally as well.

he Bombay High Court on March 4 rejected a plea by former Maharashtra chief minister Ashok Chavan challenging its ruling refusing permission to CBI to delete his name as an accused from the charge-sheet in the Adarsh Society scam. The CBI had approached the court in November 2014 with a plea seeking to drop Chavan’s name from the Adarsh Society case charge-sheet on grounds that the Governor had declined to sanction his prosecution. Rejecting the CBI’s plea, Justice M.L. Tahaliyani had ruled that the Governor had refused permission to prosecute Chavan on the conspiracy charges, but he (Chavan) could be

prosecuted under corruption charges. In December 2014, Chavan had moved the Bombay High Court against the ruling. The CBI chargesheet has alleged conspiracy by Chavan and questioned his actions as

revenue minister and then as chief minister at the relevant time. Among other things, Chavan has been accused of suggesting inclusion of civilians in the society, meant for defense personnel, in an alleged bid to get flats allotted to his relatives. The latest development implies that Chavan would have to stand the trial in the Adarsh Society scam case, delivering a major setback to the newly appointed Maharashtra Congress president. In 2012, the CBI had lodged a charge-sheet against 13 persons, including Chavan, accusing them of various wrongdoings, including conspiracy, for their role in getting the land allotted for the 31-storey Adarsh CHS building. in the prime Colaba area of south Mumbai.

RBI cuts key rates, markets cheer IANS, MUMBAI

I

n a surprise development that sent stock markets soaring, India’s central bank cut its key lending rates by 25 basis points on Wednesday, expecting inflation to soften in the coming fiscal even as it expressed concern over the postponement of fiscal consolidation by a year. Getting some positive cues from the national budget tabled last week, and sensing an economic recovery, the repurchase (repo) rate has been cut to 7.5 percent from 7.75 percent, while the reverse repo rate has been adjusted to 6.5 percent from 6.75 percent.

The rate cuts immediately follow a far-reaching agreement between the government and the Reserve Bank on Monday, under which the central bank will aim to

bring the country’s retail inflation below the 6-percent mark by January 2016 and to around 4 percent by the end of 2016-17. The announcement, which came just ahead of the opening bell for stock markets, brought much cheer to sentiments, prompting the sensitive index (Sensex) of the Bombay Stock Exchange to open nearly 345 points higher, over the previous close at 29,593.73 points. The key index soon breached the 30,000-point mark to touch a historic high of 30,024.74 points, and was ruling at around 29,890 points around 30-minute into trading, with a gain of 300 points or 1 percent.

Defense allocation: Need for structural review H

Modi promise of moving from ‘red tape to red carpet’ must become a reality if the integrity of the defense allocation is to be preserved

owever, a radical review of the strategic and fiscal underpinning of the defense allocation is imperative — if the current military inventory stasis is to be redressed and Prime Minister Narendra Modi’s vision of ‘Make in India’ is to be realized. The primary objective of the defense allocation is to enhance India’s composite military capability in a tangible manner, which means paying attention to the quality of the gun and the human resource behind the gun. The deeper strategic underpinning would also call for an objective threat assessment, the techno-strategic trajectory of modern warfare and arriving at an affordable option. Concurrently, innovative planning

and management of the funds so allocated ought to contribute to the overall national design and manufacturing eco-system that will progressively reduce import dependence and allow for export of military inventory. Regrettably, for the last two decades this has remained an elusive goal. In July 2014, Jaitley had announced `2290 billion as the BE (budgetary estimate) for the defense expenditure for 2014-15. This was estimated to be under 1. 8 percent of the GDP for that period. Whether this amount has been utilized in the manner that was envisaged will be evident on but the trend analysis is far from reassuring. Over the last 15 years going back to NDA-1, rarely have the funds allocated for defense been fully utilized or spent as per the specific categories they were meant to be

expended on. In the NDA years from 2000-01 to 2003-04, the annual amount that was returned unspent to the central pool was of the order of `89 billion, `77 billion, `93 billion and `52 billion. The Congress-led UPA had a

board. In some years, 2008-09 onwards, the defense spending exceeded that which was allocated and this was ascribed to the additional expenditure incurred due to the revision of pay scales as per the Sixth Pay Commission and the

The Modi promise of moving from ‘red tape to red carpet’ must become a reality if the integrity of the defense allocation is to be preserved and India’s import dependence reduced.

T

here may be a deeper and more unsettling reason for Rahul Gandhi’s present farewell to active politics than the explanation that he has gone away to mull over the factors which led to the Congress’s recent electoral reverses. Even the reticent and reclusive heir apparent cannot be unaware that a spell far away from the madding crowd will not be long enough for him, or anyone else, to understand why the party is facing an “existential” crisis, to quote one of the 44-year-old prince’s acolytes, Jairam Ramesh. Arguably, Rahul Gandhi may want to pore over the various points which he imbibed during his prolonged sessions with party functionaries from the time of the party’s crushing defeat in last year’s general

election. However, there has been nothing to show in the period when Rahul Gandhi has been in active politics that he is of an introspective bent of mind. This is borne out of the fact that there is nothing out of the ordinary

in the idea of organizational elections that he favors for a revamp of the 130-year-old party. Nor in his castigation of the fact that most parties, including his own, are run by closed coteries. If Rahul Gandhi really wants to

do away with such self-serving groups — his father called them “power brokers” — he should have begun by not accepting the vice president’s post. It is possible, therefore, that in addition to the instincts of a haughty loner which is the result of a privileged upbringing, Rahul Gandhi is chafing against the curbs he is apparently facing in the implementation of his ideas. A hint of his approach was available from the observations of the Congress general secretary, Digvijay Singh, when he said that Rahul Gandhi wanted to “run a Kejriwaltype campaign: open the party up, allow people to come in, put a greater emphasis on mass contact, but unfortunately he was not allowed to give a new direction by the establishment”. It is not easy to make out who Digvijay Singh referred to as the

“establishment”. To outsiders, the Congress establishment or high command comprises Sonia and Rahul Gandhi. It is their word which is law. Or is this assessment an over-simplification ? Do the “power brokers” still exist? Have differences arisen as a result between the mother and the son over the running of the organization? Doubts may arise over Rahul Gandhi’s outlook not only because of his Left-leaning ideas but even more so because one of his heroines is Indira Gandhi. A combination of his grandmother’s Leftism - her ideology was derisively called Left-ofself-interest - with her authoritarianism will be a fatal mix. It is not only the Congress which will wait eagerly to hear Rahul Gandhi’s articulation of his vision when he comes out of his hideout to become the party president.

US blogger’s murder in Dhaka condemned Assailants hacked Bangladeshi-American Avijit Roy to death and injured his wife in Dhaka University campus

T

he prime accused in the murder in Dhaka last week of writer-blogger Avijit Roy has been arrested by the elite anti-crime Rapid Action Battalion (RAB) of Bangladesh, media reported on March 2. Farabi Shafiur Rahman was earlier also arrested for inciting attacks on bloggers on the social media after blogger Ahmed Rajib Haider’s murder in 2013, bdnews24.com reported on March 2. He had then secured bail from the Dhaka High Court. RAB’s Additional director general Ziaul Ahsan said Farabi Shafiur Rahman was nabbed on March 2 morning from Dhaka’s Jatrabarhi area while he was trying to leave the city. “Fundamentalist blogger Farabi is the prime suspect in writer Avijit Roy’s murder,” Ahsan said. Farabi Shafiur Rahman had also threatened an online bookshop, rokomari.com, to pull out Roy’s books from their site. Roy, a 42-year-old bio-engineer working in the U.S., was hacked to death by two attackers wielding machetes in Bangladesh capital Dhaka on February 26, when he was leaving a book fair with his wife Rafida Ahmed Banna, who was also seriously wounded in the attack. Bangladesh Foreign Minister Abul Hassan Mahmood Ali said it has decided to take help of the US’ Federal Bureau of Investigation (FBI) in the probe into Avijit Roy’s murder. threatening Roy over his active campaign against Islamist extremism and for strengthening secularism in Bangladesh. He has been facing threats from Islamist radicals for his secular blogging.

On February 26, Roy and his wife were dragged off a cycle rickshaw at a Teacher-Student Centre (TSC) intersection by two unidentified assailants and attacked with machetes. Roy died of a fatal gash to the head while his wife and fellow blogger Rafida Ahmed Banna was severely injured. Lok Sabha passes bill to amend Citizenship Act IANS, NEW DELHI

he Lok Sabha on March 2 passed a bill that allows the central government to notify that Persons of Indian Origin (PIO) card-holders shall be considered Overseas Citizen of India cardholders. The Citizenship (Amendment) Bill, 2015, which was passed by a voice vote, seeks to replace the ordinance brought by the government in January. The bill seeks to amend the Citizenship Act, 1955 and provide, among other things, for “registration of overseas citizen of India card-holder and also that the persons of Indian origin card-holders

shall be deemed to be overseas citizen of India card-holders”. Participating in the debate, N.K. Premachandran of the Revolutionary Socialist Party said the government had brought the ordinance to fulfill the promise made by Prime Minister Narendra Modi to over-

seas Indians during his visit to the US. Referring to the bill, which the government had withdrawn before introduction of the new bill, he said it reflected the “callous manner” in which the previous bill was drafted. Intervening in the debate, Home Minister Rajnath Singh said the government intended to give benefits to overseas Indians before the day marking the 100th year of the return of Mahatma Gandhi to the country and had brought an ordinance for the purpose. The bill also provides for conferment of rights on overseas citizen of India card-holder, renunciation of the card and cancellation of registration of the card-holder.

In his 93-minute budget speech in the Lok Sabha, the finance minister said a new law on black money stashed abroad will call for an imprisonment of up to 10 years, while another proposed legislation will clamp down on benami property in India with both confiscation and prosecution. The finance minister said while individual tax payers would stand to gain as much as `440,200 by way of enhanced exemptions he has proposed in his two budgets since July last year, the corporate sector can benefit from a cut in tax rates from 30 percent to 25 percent over four years, albeit with a sharp reduction in the exemptions. Credit positive for corporates, mixed bag for banks: Moody’s IANS, CHENNAI

lobal credit rating agency Moody’s Investors Service has said India’s budget for 2015-16 is credit positive for corporates and a mixed bag for the banks. The increase in service tax, however, is credit negative as it would increase the production cost for Indian corporates, the agency said. “Measures designed to reduce and rationalise taxes, boost economic growth and increase the ease of doing business will support the credit profiles of Indian non-financial corporates, but a reduction in

the fuel subsidy allocation is credit negative for upstream oil and gas companies,” Vikas Halan, a

Moody’s vice president and senior credit officer was quoted in a statement.

For non-financial corporates generally, Moody’s notes that the budget proposes to reduce the corporate tax rate to 25 percent from 30 percent over the next four years, and also seeks to rationalise the tax structure, in part, by increasing the excise duty rate and introducing a unified Goods and Services Tax from April 1, 2016. On the other hand, the proposed increase in the service tax — the indirect tax paid on the value of services consumed — is credit negative because it will raise the cost of production for Indian corporates. Another credit negative factor,

and specifically for upstream oil and gas companies, is the decision to lower the fuel subsidy allocation for fiscal 2016. For the infrastructure sector recommendations in the budget would both raise public sector investment and encourage private sector investment. “A significant increase in planned public sector capital expenditure, coupled with measures to increase investment and financing in the private sector, will be credit positive for infrastructure companies,” said Abhishek Tyagi, a Moody’s vice president and senior analyst.

Opposition calls budget pro-rich NEW DELHI: The NDA government Saturday hailed the Union Budget 2015-16 with Prime Minister Narendra Modi calling it “progressive and practical” while the opposition slammed it for being “pro-rich”. Modi, commenting on the budget presented by Finance Minister Arun Jaitley, said it had a “clear vision”. “It is a budget that is progressive, positive, practical, pragmatic and prudent,” he tweeted. Modi said the budget has “distinct focus on farmers, youth, poor, neomiddle class and the aam nagrik (common man). It delivers on growth, equity and job creation” while also being “investment-friendly and removes all doubts on tax issues”. Bharatiya Janata Party (BJP) leaders joined Modi in appreciating the budget, and Home Minister Rajnath Singh called it “pro-farmer, pro-poor, and pro-unemployed youth budget that will make India a modern nation”. The opposition parties, however, slammed the budget for being prorich. Former prime minister Manmohan Singh, an eminent economist, criticised Jaitley’s budget, saying it has good intentions but no adequate roadmap. Black money abroad? Be ready for jail IANS, NEW DELHI

inance Minister Arun Jaitley unveiled a slew of stringent steps to battle black money stashed abroad, including a new law that will entail rigorous imprisonment of up to 10 years and a penalty of 300 percent on its perpetrators. Those evading tax by sending money to foreign countries will not be allowed to approach the Settlement Commission too, Jaitley told Parliament while announcing his 2014-15 annual budget. Two bills — one on illegal money stashed abroad and another to curb ‘benami’ transactions within the country — are likely to be brought in the ongoing budget session of Parliament, he said. The issue of black money, unearthing which was a major election promise of the Bharatiya Janata Party, figured prominently in Jaitley’s speech. Giving details of the measures in the proposed bill on money stashed abroad, Jaitley said that not filing income tax returns or filing them with inadequate disclosures would lead to rigorous imprisonment of up to seven years. Undisclosed income from any foreign assets would be taxable at

H-4 SPOUSES MAY BE ELIGIBLE TO APPLY FOR EMPLOYMENT AUTHORIZATION (EAD) BY ATTORNEY PARVEEN GOYAL HS has proposed to amend rules for spouses on H-4 to be able to apply for employment Authorization (EAD) provided the following conditions are satisfied: The principal H-1B spouse has an approved immigrant visa petition (Form I-140); OR The principal H-1B spouse’s is in H-1B status beyond his or her sixth year of H1-B pursuant to AC 21.. In other words period of stay is authorized under sections 106(a) and (b) of the American Competitiveness in the Twenty-first Century Act of 2000 (AC21). AC21 §§106(a) and (b) provide for a one-year extension of H-1B status beyond the six-year limitation established by INA §214(g)(4) and the principal H-1B nonimmigrant is the beneficiary of a labor certification application or an I-140 petition that has been pending for at least 365 days prior to reaching the end of the sixth year of H-1B status. H-4 spouse who meets this criteria and requirements, will need to apply for employment authorization document (EAD and has to pay the appropriate fee to DHS. Even though the USCIS has stated the reason to issue EAD to H-4 spouse to encourage H-1Bprofessional to remain in the United States, so that they do not abandon their efforts to become lawful permanent residents, if their spouses are not able to work in the U.S because of

their current status of H-4. The proposed rule does not go far enough. AFAYETTE, LA -- A $650,000 settlement has been reached with two businesses and convicted physician Dr. Mehmood Patel over allegations he performed unnecessary medical procedures and billed Medicare. US Attorney Stephanie Finley made the announcement last week in a news release. The settlement was reached with Acadiana Cardiology LLC, Acadiana Cardiovascular Center and Patel, who was convicted in 2009 on 51 counts of health care fraud and is serving a 10-year prison sentence. The U.S. government intervened in a civil lawsuit filed by Dr. Christopher Mallavarpu, a cardiologist who previously practiced with Patel in Lafayette. Mallavarpu’s lawsuit was brought against Acadiana Cardiology LLC, Acadiana Cardiovascular Center LLC, Mehmood Patel professional medical corporation and Dr. Patel, Finley wrote. The government intervened in the lawsuit to seek damages under the False Claims Act. The act, a federal civil fraud statute, allows individuals who witnessed fraud to

The statute allows the government to recoup money obtained through fraud and misrepresentation. In August 2006, Our Lady of Lourdes agreed to pay a $3.8 million settlement and in January 2008, Lafayette General agreed to pay a $1.9 million settlement to settle claims. Patel, who practiced in the Lafayette area for 25 years, was indicted in 2006 on 94 counts of health care fraud. A jury found him guilty in 2008, following a two-month trial, of 51 counts of health care fraud. Experts said he used radiation, angioplasty stents and balloons in healthy arteries, lying to patients and falsifying records. Patel billed Medicare and private insurance companies more than $3 million over three years, including nearly $542,000 for unnecessary work. He was sentenced to the maximum 10 years in prison and five years supervised release. He started serving his sentence in December 2012. Patel also was ordered to pay $387,511 in restitution and a $175,000 fine, He had been free while appealing the case, but the 5th US Circuit Court of Appeals in November 2012 rejected his request to stay free while appealing to the U.S. Supreme Court.

Come to think of it, 20 years ago, Mishra and Pahwa could have comfortably played the lead of an uncomfortably married couple here. Ayushmanna Khurrana is the under-educated Kumar Sanu fan from Haridwar who doesn’t seem to have much ambition in life except to marry a pretty girl. Newcomer “with a commodious qammara” Bhumi Pedneker is the

HICAGO, IIL -- The mother of Pravin Varughese, an Indian American student of Southern Illinois University at Carbondale, who died one year ago under mysterious circumstances, has said that she is upset that the state’s attorney has decided not to bring criminal charges against anyone. According to a report, Lovely Varughese, whose 19-year-old son died in February 2014, believes her son was murdered. The official cause of death was hypothermia. The Varughese family, however, had paid for a second autopsy, which suggested that Pravin was murdered. But now, she is discouraged by news that a grand jury was convened downstate – and that the Jackson County state’s attorney has decided not to bring charges. “It makes me so sad that this is the

Police said bar surveillance video helped the MPD track down 21-yearold Ahmed Saeed H. Al Mutlaq. According to the MPD, the man entered Whiskey Jacks, at 552 State St., on Feb.21 and left with a 21-year-old student’s jacket. Police said her credit card was used to make unauthorized purchases prior to the suspect being identified and arrested.

one-year anniversary of Pravin’s death was held recently, attended by not only family members and friends, but two former law enforcers, Salvatore Rastrelli and Ira Robins, who represent the Archangels of Justice. Archangels of Justice have been investigating corruption in the judicial system and are volunteering their time probing the way the case was handled. “There is absolutely no doubt that Pravin did not die of natural causes,” Robins said earlier. “(He) was murdered.” “I hope we get justice,” Priya Varughese, Pravin’s sister, had said. “I hope we get closure. Nothing is going to bring him back, but I hope something like this doesn’t happen to another family.” Robins had called for newly-elected Governor Bruce Rauner to appoint a special prosecutor to investigate how the case was handled.

LINTON TOWNSHIP, MI -Rajan Patel, a 30-year-old Indian American physical therapist from Clinton Township, Michigan, along with a patient recruiter, has been convicted in a $1.6-million Medicare fraud scheme. He was found guilty last week of one count of conspiracy to commit health care fraud, three counts of health care fraud, and three counts of making false statements relating to health care matters. Co-conspirator Reginald Smith, 54, a patient recruiter, was found guilty of one count of conspiracy to commit health care

fraud and one count of conspiracy to solicit and receive health care kickbacks. Four other individuals charged in the case pleaded guilty to conspiracy to commit health care fraud in connection with their roles in the fraud scheme. Sentencing hearings are scheduled midApril. According to evidence presented at trial, Smith worked as a patient recruiter for Angle’s Touch Home Health Care LLC (Angle’s Touch) in 2011 and 2012 and solicited patients for foot care services at adult foster care homes. Smith then referred the patients to Angle’s Touch for medically unnecessary

home health care services in exchange for kickbacks. The kickbacks were disguised as payments to Smith’s nonprofit Medicare provider, People Helping People of Detroit. Patel worked as a physical therapist at Angle’s Touch. According to the evidence, Patel and others recruited patients from an adult daycare center in Flint, Mich. Patel then fabricated patient medical records to make it appear that the recruited patients qualified for and received the home health care services, when they did not. Evidence presented at trial showed that Medicare paid Angle’s Touch over $1.6 million during the course of the conspiracy.

ASHINGTON, DC -- A Pakistani American husband and father of three children in Louisville, Mukhtar Kentucky was shot dead by Ahmed a stranger after he had just dropped off his 13-year-old daughter to school, and was driving on Interstate 71, on February 26. Mukhtar Ahmed, 41, was shot multiple times through the passenger door of his black SUV, and he died on the spot. The alleged shooter, Christopher L. McCullum, was arrested three hours later and charged with murder. There was no indication of business dispute and no apparent connection between the individuals. The police believe it to be a case road rage. According to Khalid Kahloon, Ahmed’s family attorney, the Asian-American Muslim community living in America is very sensitive and apprehensive, and wondered why a member would be murdered in this way. “We cannot say it is for certain about race, but deep down in our hearts we cannot say that it was just another senseless murder on the American highway.” Kahloon described the Louisville PakistaniAmerican community as small and tight-knit, with about 100-150 families, 700-1000 people, mostly professionals, physicians, and business people. According to 2010 US Census Bureau data, 2.2 per cent of Louisville and Jefferson County’s 597,337 population is Asian. Ahmed was working with his brother in a grocery retail business.

Civil Defense Director Amado Avila said the three men and a woman apparently got caught in strong currents on March 1 off Playa Macao near the resort community of Punta Cana.
