While Modi figures in the category of “leaders”, Kejriwal is listed among the “pioneers” and Roy makes the grade among “icons” in the annual list released last week after an online poll of readers. Modi is described as “The divisive politician poised to lead the world’s largest democracy” in a profile by Fareed Zakaria, the Indian-American host of CNN’s Fareed Zakaria GPS.

US court dismisses 1984 riots case against Congress NEW YORK: A US court has dismissed a lawsuit against India’s Congress party relating to the November 1984 anti-Sikh violence, saying it did not sufficiently “touch and concern” the US court to exercise jurisdiction. However, even as he dismissed the case filed by the US based rights group Sikhs for Justice (SFJ), Judge Robert W. Sweet of US District Court here ruled that corporate entities like the Congress party of India can be sued under Alien Torts Statute (ATS). On the issue of corporate liability, Sweet citing the case of Balintulo V. Daimler AG ruled that “Daimler seems to concretely establish that a corporate defendant can be liable
under the ATS, assuming that the statute’s “touch and concern’ requirements are adequately alleged”. “Accordingly, the fact that defendants are incorporated does not, in and of itself, relieve them of liability under the statute or remove this court’s jurisdiction over plaintiffs’ allegations,” Sweet said in his April 24 ruling. However, “plaintiffs’ combined facts, even if credited, are insufficient to establish that the conduct sufficiently ‘touched and concerned’ the US to establish jurisdiction under the ATS and dismissal is appropriate under 12(b)( 1),” he ruled. SFJ said it will challenge the verdict before the US Court of Appeals within 30 days.
Indian man charged with groping woman on flight to US WASHINGTON : An Indian-origin man has been charged with simple assault for allegedly groping a sleeping fellow female passenger for about five minutes on a flight from London to San Francisco. Vinay Pochampally molested the victim by placing his hand down the woman’s shirt two hours into British Airways Flight 285 last on April 28, according to a US District Court criminal complaint cited by the

he government on April 20 disclosed to the Supreme Court the names of 26 people who had accounts in banks in Liechtenstein, revealed to India by German authorities. A bench of Justice H.L.Dattu, Justice Ranjana Prakash Desai and Justice Madan B. Lokur were given these names by Solicitor General Mohan Parasaran in two sealed covers having 18 and 8 names, respectively. The 18 names that were disclosed by the government are of those in respect of whom the investigations have been completed by the Income Tax Department and prosecution launched against 17 as one of the account holders has
expired. The court was told that second sealed cover has the names of eight account holders against him no there is no evidence of tax evasion in terms of Indian tax laws. As senior counsel Anil Divan urged the court that even these eight names should be disclosed, Justice Dattu said that he along with Justice Desai and Justice Lokur will deliberate on the matter and take a call on this issue. Taking the court through the Indo-Germany Double Taxation Avoidance Convention and the Reciprocity Agreement, Solicitor General Prasaran said India could get these names after a lot of effort and was under an obligation to maintain confidentiality. SC suspends execution NEW DELHI: The Supreme Court on April 28 stayed the execution of December 2000 Red Fort terror shootout convict Mohamed Arif’s death sentence on a plea that he has already undergone life sentence of nearly 14 years and could not be punished twice and referred the matter to a constitution bench. Counsel Tripurari Ray, appearing for Arif, said that carrying out the death sentence of Arif after he has already completed 13 years, four month imprisonment would be violative of article 20 (1) of the constitution. Counsel Ray told the court that under the provision, a convict could not be subjected to a punishment that is greater than which might have been inflicted under the law in force at the time of the commission of the offense. Referring the matter, a bench of Chief Justice R.M. Lodha, Justice Madan B. Lokur and Justice Kurian Joseph said that matter be heard early. As Chief Justice Lodha said that by an earlier pronouncement of the apex court, the law on delay in execution has already been laid, Ray told the court that Arif has not filed any mercy petition.
he Delhi High Court on April 30 fixed May 13 for hearing a plea for a CBI probe into licences granted to real estate developers in Haryana, including one allegedly associated with Congress chief Sonia Gandhi’s son-in-law Robert Vadra. A division bench of Chief Justice G. Rohini and Justice R.S. Endlaw posted the matter for May 13 after advocate M.L. Sharma requested the court to hear his public interest litigation (PIL) after the Lok Sabha elections as any move now will favour either the Congress or the Bharatiya Janata Party. M.L. Sharma moved to the court, saying several licenses were issued to developers and builders for turning 21,366 acres of agricultural land into colonies without complying with the statutory rules. The decision caused “serious financial loss of `3900 billion” to the exchequer, Sharma alleged. He contended in the plea that allocation of licences for developing colonies was contrary to provisions of the Haryana Development and Regulation of Urban Areas Act, 1975. It sought Comptroller and Auditor General (CAG) Shashi Kant Sharma’s letter of June 3, 2013, be quashed. The letter allegedly sought to roll back the
audit and inquiry into the grant of licence to Skylight Hospitality Pvt. Ltd., that is said to be associated with Vadra. The plea said the inquiry was ordered by Shashi Kant Sharma’s predecessor Vinod Rai. M.L. Sharma claimed that the department of town and country planning (DTCP) issued hundreds of licences for over 21,000 acres of land spread over Gurgaon city and other parts of the state from 2005 to 2012. “Issuing colony licences by the DTCP in Haryana in the name of an individual who is not the owner of a land, is not only illegal but also clear case of corruption within the provision of the Prevention of Corruption Act 1988,” the plea said.

More than two-thirds of the respondents predicted a resounding defeat for the incumbent Congress party and the opposition Bharatiya Janata Party (BJP) likely to be swept to power in the 2014 Indian elections. A survey conducted by Indian Link media group has revealed overwhelming support for the BJP in Australia’s Indian community, as opposed to the Congress party that has been in power for 10 years. Who all have bought your paintings?” Responding to Modi’s attack, Trinamool national spokesperson Derek O’Brien called Modi the “butcher of Gujarat” and accused him of making personal attacks as he “has no answers to Bengal’s development model”. he Congress is increasingly coming around to the view that it is unlikely to win the 16th general election on its own and that it may have to work with a Third Front to stop the BJP from coming to power. At least four Congress leaders have already hinted that allying with the Third Front, or a coalition of parties not allied to either the United Progressive Alliance or Democratic the National Alliance, is a possibility for the party in order to stop the BJP from coming to power. The latest to do so is Ahmed Patel, Congress president Sonia Gandhi's closest aide, who told a leading national daily that the party was willing to consider the possibility of working with a Third Front. Admitting that a Third Front government cannot come to power without support from the Congress, the Communist Party of IndiaMarxist (CPI-M) is actively working towards the victory of candidates belonging to non-National Democratic Alliance (NDA), non-United Progressive Alliance (UPA) coalitions, a CPI-M source told IANS.

wo researchers at Indiana University, including an Indian-American, are leading the way towards developing a new potential non-insulin drug for diabetes and obesity, which needs to be taken only once a week. Dr. Arnab De, who has a PhD from Columbia University, and Prof. Richard DiMarchi of Indiana University have worked on developing a pro-drug or an inactive substance that is converted to a drug within the body, to stabilize a sugar reducing peptide hormone called GLP1.
Indiana University Research and Technology Corporation (IURTC) have applied for international patents for these pro-drugs and they are currently being licensed to leading biotech/pharmaceutical companies for optimization, De told IANS. But it may take five years or so before the new drug hits the market after optimization and clinical trials, said De. Talking about his research, De said: “Patients often have to take an insulin injection after every meal. An overdose of insulin may drastically reduce blood glucose leading to life-threatening diabetic coma. Hence we wanted to develop a non-insulin drug, which would hopefully act for a prolonged period of time so that patients do not need to take it every day,” he said. De said they looked at a peptide hormone called GLP1, which reduces blood sugar and obesity without any risk of coma.

His departure follows a rumor posted two days ago on the app Secret that, “Vic Gundotra is interviewing,” according to technology site CNet. Citing a person familiar with the matter, it said that Gundotra had problems with Google’s management team.

DEVRAHA BABA WHO LIVED FOR 250 YEARS

n the pantheon of saints and yogis in modern India, one name stands out: Devraha Baba, who is believed to have lived up to the age of an amazing 250 years. Yes, there is proof that he was indeed over 250 when he gave up his body in 1990. But it is not important how long he lived, it is important what level of spirituality he achieved and what he contributed to the society. The post-Independence generation grew up reading about the living legend named Devraha Baba. There used to be his black and white or sepia photographs--matted locks and all--in newspapers and magazines, aloft a ‘machan’ (wooden platform), blessing people, from pauper to the prince, by putting his foot on their heads. Eminent people who sought him out regularly included Indira Gandhi and Rajiv Gandhi. He also ‘touched’ the lives of visiting dignitaries from abroad. There are various claims of Baba’s longevity, starting from 150 years and above. The most credible account comes from none other than Dr. Rajendra Prasad, the first President of Independent India. Dr Prasad wrote in his autobiography that he could personally establish that Devraha Baba was at least 150 years old. At the age of 73, more than 50 years ago, Dr Prasad wrote that

his father had sat at the feet of the Baba as a child - that is, in the middle of the nineteenth century - and Devraha Baba was already elderly at that time. The appearance of Devraha Baba at the Kumbh Mela which takes place every 12 years was recorded 12 times. The last time he was at the Allahabad Kumbh Mela in 1989. Famous BBC correspondent Mark Tully has recorded his observations of the Baba from that Kumbh Mela, which formed a chapter in ‘Penguin Book of Indian Journeys’. Tully was told that one reason for Baba’s amazing longevity was that he was forever in Uddiyana Bandha (literally, ‘upward energy lock’, it moves the energy up from the earth, water and fire centers into the heart or air chakra). When Tully asked, “What does the Baba
eat?” his interlocutor replied: “Air. He does not even eat fruit. You see, any great yogi can extend his tongue from inside until it touches the top of his head. That’s where the nectar is situated and one drop of nectar is all you need to live for a very long time.” So, a fairly scientific hypothesis of how Baba dramatically prolonged his lifespan is that he drew his required energy from cosmic sources, thus eliminating the toxic fallout (free radicals, etc) that occurs from eating food. Secondly, meditation and a hermit lifestyle lowered his metabolism, minimizing wear and tear in the body. Thirdly, yoga postures and mudras stimulated his endocrine system. From most accounts, we know that Devraha Baba was born in the Deoria district in Uttar Pradesh and was the eleventh in the lineage of Sri Ramanuja Acharya who founded Vaishnavism. Though an itinerant yogi, Devraha Baba was often stationed in Mathura on the banks of river Yamuna, where huge crowds would gather to have his darshan and blessings. We may never fathom the higher levels of spirituality he achieved, but we can salute what he contributed to the society. His very existence inspired people to believe in and take to the yogic path. All-loving and prescient, he guided people who sought him out on the right course to take in life. Apocryphal anecdotes have him warning famous personalities against impending danger. ATERTOWN — An armed man wearing a mask robbed the Dunkin Donuts on Main Street The robber entered the business around 9.:30 pm and threatened an employee with a gun. The suspect seemed familiar with the cash register system and took an undisclosed amount of money from the main register and also from the register at the drivethrough, the police said. The suspect, who is said to have fled in a silver Volvo station wagon, has been described as a white male, between 5-feet 10-inches and 6-feet 2-inches tall, and wore black clothes with a black, mesh mask over his face. ata released recently by the US Department of Health and Human Services indicates that 344 doctors nationwide received more than $3 million each in 2012 from Medicare. Overall, about two per cent of clinicians accounted for one-fourth of all Medicare payments. Indian American and other South Asian doctors are a significant presence among the US physician community, so it was no surprise that they appeared prominently on the Medicare payout list. The 12th highest payment to an individual physician nationally by Medicare in 2012 went to Dr. Vikas Malhotra, an Indian American hematology and oncology specialist in Spring Hill, Fla. He billed Medicare $27,288,429 for 520,461 services to 1,783 beneficiaries and received $8,419,117 in payments. In 14th place on the list was Dr. Bilal Ansari, who received his medical degree from Dow Medical College in Pakistan. He billed $25,062,194 for 486,329 services to 1,115 beneficiaries and was paid $7,873,711. Other Indian or South Asian American doctors receiving more that $4.7 million in

EW YORK -- New York City’s 9,000 cigarette dealers seem to be choking on a ticket blitz. There’s reportedly been a 70-fold increase in the number of tickets written up by the Department of Consumer Affairs. The fines can run as high as $1,000 for not having the proper signs posted to warn about the dangers of smoking. The department is believed to have issued 2,229 signage violations in 2013, compared to 628 in 2012 and just 32 in 2011. This year, that number is down as businesses get on board with the new rules. in Florida since 2003, told the Tampa Bay Times that most of the money his office gets from Medicare pays for drugs, lab tests and other expenses. Payments to oncologists typically include the cost of medications, which are purchased by the practice. “That doesn’t represent the income of the physician,” he told the newspaper. Dr. Saadia Chohan of Oklahoma City, who was second on Oklahoma’s list of the highest paid by Medicare in that state at $3.4 million, pointed out to the Tulsa World that most physicians are not taking in millions of dollars because some of their patients are receiving expensive patented drugs, such as a new prostate cancer vaccine that costs nearly $100,000 per patient. “Most of these drugs are pass-through for us in Medicare. We make, if anything, our cost,” she said, adding, “Medicare reimburses us 80 per cent of the cost of the drug.” Cardiologist Dr. Ashish Pal of Davenport, Fla., a graduate of the University of Delhi, received about $4.5 million from Medicare. According to him, his billing was appropriate, although he acknowledged it was high because he has multiple cardiology-
related specialties, and because he works in an outpatient setting and bills the government for facility fees. However, another case shows that following the money can turn up potential problems. Detroit-area cancer doctor Farid Fata, originally from Lebanon, among the top recipients of Medicare payments, currently awaiting trial on federal charges he intentionally misdiagnosed patients and ordered unnecessary treatments. Fata claims he is innocent in the case. AP chose a threshold of $3 million in payments for its analysis of individual doctors because that was the figure used by HHS inspector general in an audit last year. The report recommended that Medicare probe billings above a set level that has not been disclosed by the federal government. Topping Medicare’s list of highest paid physicians in the US was Florida ophthalmologist Salomon Melgen, whose relationship with Sen. Robert Menendez, D-N.J., made headlines in 2013 after news broke that the lawmaker used the doctor’s personal jet for trips to the Dominican Republic. Medicare paid Melgen $20.8 million.

Cabot Professor of Genetics and Professor of Medicine at Harvard Medical School in Boston who is renowned for his contributions in advancing understanding the biology of cancer by using genetic/genomic approaches, received the Outstanding Scientist in Cancer Research Award. Dr. Sanjiv S. Gambhir, a Virginia and D.K. Ludwig Professor for Clinical Investigation in Cancer Research at Stanford University School of Medicine in California, received the Lifetime Achievement Award for his contributions in advancing imaging assays to monitor fundamental cellular/molecular events in cancer patients. Dr. Vimla Band, an Ardith and Anna Von Housen Professor and Chair Department of Genetics, Cell Biology and Anatomy at the University of Nebraska Medical Center, Omaha, received the Outstanding Woman Scientist in Cancer Research Award for her contributions

in breast cancer research. In addition, the AAISCR presented Young Investigator Awards to four individuals for their outstanding work in cancer research. In a message, AAISCR president Dr. Saraswati Sukumar emphasized the need for young members of the scientific community to set up a network of peers who can guide and help them to grow and succeed in their scientific career. She highlighted the steps the organization has taken to launch a mentorship program to achieve this goal. The highlight of the meeting was an open discussion by a panel of officers from the NCI/ NIH who answered questions from the audience about the NIH grant mechanisms and the future of federal funding to support cancer research.

he Desai family will add more donations to the $225,000 to increase the amount raised to some $400,000 so that 10 more community centers can be built in India. As a result, the tip resulted in more than $260,000 in illegal profits to a friend, the US Attorney’s Office for the Eastern District of Pennsylvania said in charging papers. The SEC said his family members made more than $41,000 based on the information. GSI Commerce, which specialized in creating and running online shopping sites for retailers, was purchased by eBay in June 2011 for $2.4 billion. Saridakis served as president until he resigned in January for what he said were personal reasons. In 2013, the company was renamed eBay Enterprise. The criminal charges against Saridakis were announced on April 25. However, he was not indicted, but named in a federal information statement. The information statement may indicate a plea deal has been reached. The charges were announced the same day the SEC said Saridakis had agreed to pay $664,822 to settle claims related to insider trading with the eBay sale. His
penalty is equal to twice the profits of the people he tipped off. In addition to Saridakis, the SEC also filed claims against five traders who made stock purchases based on the information from Saridakis. Together, their penalties total more than $490,000, according to the SEC. Dr. Suken Shah, an orthopedic surgeon at Nemours/Alfred I. duPont Hospital for Children, was one of the traders involved in the insider trading, according to an administrative proceeding from the SEC. An order says Shah netted $9,838 in profits as a result of stock purchases he made based on Saridakis’ information. He also shared the non-public information with his brother and a business associate, who also made stock purchases. Shah has agreed to settle the SEC’s charges by paying $76,418, a penalty three times the amount of his profits and those of the people he shared the information with, according to the SEC. Saridakis was employed by Gannett Inc., owner of The News Journal and delawareonline, from 2005 to 2010, leaving as chief digital officer.

Federal regulators allege Christopher Saridakis, 45, was head of the marketing solutions division of GSI Commerce in 2011 when he provided family members and friends with confidential information about eBay’s plans to take over the King of Prussia-based company. “Saridakis chose to dole out confidential, market-moving information to enrich relatives and friends, and the nonpublic details then spread further through multiple levels of tippers and tippees,” said Scott Friestad, associate director of the enforcement division of the US Security and Exchange Commission (SEC). he Asia Society Texas Center in Houston will organize a unique exhibition depicitng Hindu gods and goddesses, “Transcendent Deities of India”, from May 2 to September 14. The show includes some 60 images, including Vishnu, Sarasvati, Laxmi and Shiva, in drawings, digital works, photographs and modern chromolithographs. The exhibition which is being held at the Louisa Stude Sarofim Gallery, is funded in part by a grant from the City of Houston. Distinguished Hindu statesman Rajan Zed, in a statement, commended the City of Houston for funding this exhibition through Houston Arts Alliance. Rajan Zed, who is President of Universal Society of Hinduism, urged cities of New York, Los Angeles, Chicago,
Philadelphia, Phoenix, San Antonio, San Diego, Dallas, San Jose and Austin to also
support Hindu art-focused exhibitions, “thus sharing the rich Hindu art heritage with their populations”. “Art had a long and rich tradition in Hinduism, and ancient Sanskrit literature talked about religious paintings of deities on wood or cloth”, Zed added. LBANY (NY) -- New York’s state Assembly has authorized hundreds of new speed cameras for school zones in New York City and Long Island, endorsing a key part of New York City Mayor Bill de Blasio’s plan to reduce traffic fatalities. The legislation, okayed on April 28 and now awaiting Senate consideration, would allow up to 69 cameras near schools in Suffolk County and 56 in Nassau County. New York City already has 20 of the cameras and could get up to 120 more. Speeding drivers caught by the cameras would be mailed $50 tickets, but the infraction would not impact their auto insurance rates. The cameras would be activated during and immediately before and after school days and events. Speed cameras would raise millions of dollars in revenue for local governments, but supporters argue safety is the primary objective.
“This Bill will truly save lives,” New York City Mayor Bill de Blasio said in a statement after the Assembly vote. “Speeding is one of the primary causes of pedestrian fatalities, and addressing this epidemic has been a priority for my administration from the beginning. We can no longer accept these fatalities as inevitable. Critics question the value of cameras
as an alternative to uniformed police officers and suggested revenue was the true motivation. “It’s government attempting to entrap its citizens,” said Assemblyman Michael Fitzpatrick, a Suffolk County Republican. “This is a ruse. It’s all about raising money.” The Senate is expected to take up the legislation soon. Democratic Gov. Andrew Cuomo supports the bill. The devices are expected to raise as much as $50 million or more for cashstrapped Nassau County, which declared a fiscal emergency in 2011 and has been under a state-imposed financial authority for more than a decade. Officials plan to use the money to help lift a wage freeze on county workers. Suffolk County officials estimated this year that 20 speed cameras would raise $2 million a year. The Assembly vote was 103-24 in favor of the Bill.

EW YORK-Gursant Singh, who converted to Sikhism over three decades ago, says he will still go to court for the jury duty next week with community leaders, asking for a chance to serve with his kirpan, a short sword, which is carried as an article of faith by baptised Sikhs. “I feel very strongly that as a citizen of the United States that I should be able to serve as a juror,” says Singh. “They’ve put me in a quandary. Either I violate my code of conduct with my religion, or I break the law,” he added. However, the court justified its stand on not allowing Singh to serve on the jury duty with a kirpan in the court room. “It’s important that we provide a safe environment for people’s issues to be heard,” Sutter County jury commissioner Mary Beth Todd told a news channel, adding that they are trying to provide alternative options to Singh. One idea is what some Sikhs have done in other counties, including storing the kirpan with security, she noted. “It’s extremely important that we be sensitive to this, and we’re trying to be sensitive to it, and we’re trying to find a solution that will work for both sides,” Todd said. In a statement, North American Punjabi Association (NAPA) urged all government agencies to respect the law of the land and not violate the law in the name of security.

The Congress president was on the second leg of her election tour of Telangana, where the simultaneous elections to assembly and Lok Sabha will be held on April 30.

ormer union minister Kavuri Sambasiva Rao April 28 resigned from the Congress and announced his decision to join the Bharatiya Janata Party (BJP). Rao, who resigned as the minister earlier this month, told reporters in Eluru that he would join the BJP on May 1 at Bheemavaram in the presence of party’s prime ministerial candidate Narendra Modi. He said he was joining the BJP for the state’s development. Rao resigned from the cabinet on
April 3 to protest bifurcation of Andhra Pradesh. He has also announced that he would not contest the Lok Sabha polls on Congress ticket. He said that the central government did not even take his views into consideration while taking a decision to bifurcate the state. The MP from Eluru in West Godavari district was inducted into the union cabinet in June last year. After the bill for formation of separate Telangana state was passed in parliament in February, Rao wanted to join the Telugu Desam
Party (TDP). However, the TDP leaders in West Godavari district opposed his admission into the party. Rao had a three-decade-old association with the Congress. He was first elected to Lok Sabha in 1984, and re-elected in 1989, 1998, 2004 and 2009. He is the second central minister to quit over the State’s bifurcation and join the BJP. Last month, D. Purandeswari had resigned as a minister and also quit the Congress. She is contesting for the Lok Sabha from Rajampet constituency.

NEW DELHI: Bangalore will host India’s Davis Cup World Group playoff tie against Serbia Sep 12-14. “In consultation with the captain and players of the team, AITA has decided to hold the next Davis Cup World Group Qualifying tie against Serbia in Bengalore. This tie will be held from 12th to 14th September 2014,” said All India Tennis Association (AITA) secretary general Bharat Oza in a statement on April 28. The winning nation will qualify for the World Group in 2015 while the
