SC notice to Centre on prez’s rule in Arunachal An apex court bench ordered the central government to file its response, if any, by January 29 and directed further hearing in the matter on February 1 IANS, NEW DELHI

T

he Supreme Court on January 27 issued notice to the central government and Arunachal Pradesh Governor Jyoti Prasad Rajkhowa on a plea challenging the imposition of President's Rule in the north-eastern state on January 26. An apex court constitution bench of Justice Jagdish Singh Khehar, Justice Dipak Misra, Justice Madan B. Lokur, Justice Pinaki Chandra Ghosh and Justice N.V. Ramana also ordered the central government to file its response, if any, by January 29 and directed further hearing in the matter on Monday (February 1). The court recorded that senior counsel Satya Pal Jain, appearing for Governor Rajkhowa, "undertakes to furnish a copy of the governor's report and other material recommending issuance of a proclamation under Article 356 of the Constitution of India, to the court in a sealed cover". The court gave liberty to the petitioner, Congress chief whip in Arunachal Pradesh Rajesh Tacho, to amend the plea to "assail the report of the governor, and the consequen-

tial (presidential) proclamation". The court directed that Tacho be provided, during the course of the day, the date on which Rajkhowa sent a report recommending the imposition of President's Rule. At the outset of the hearing, senior counsel Fali S. Nariman told the apex court that ever since the last hearing on February 22, Arunachal Pradesh had been put under Presi-

dent's Rule and two advisors appointed to assist the governor in running the affairs of the state. Seeking the date on which the governor recommended the imposition of President's Rule, Nariman said senior counsel Harish Salve, who appeared for the governor, told the court on January 14 that nothing untoward would be done to precipitate the situation.

Describing as "crucial" the date on which President's Rule recommendation was sent by Rajkhowa, senior counsel Kapil Sibal sought to know the grounds and material relied upon by the governor while making the recommendations. Opposing the plea, Attorney General Mukul Rohatgi said that the governor's report was confidential and could not be shared with petitioner Tacho. However, he said, it could be shared with the bench. Nariman contested Rohatgi's plea that the governor's report was confidential. Justice Lokur confronted the attorney general with the apex court judgment wherein the governor's report was reproduced. The presidential proclamation mentions "a" report by the governor, Justice Ramana pointed out as Rohatgi said there were a series of reports by Governor Rajkhowa. "Whatever is the worth of this petition (by Rajesh Tacho), you reply. You may accept it or you may not accept it," the court observed as the AG contested the maintainability of the plea challenging the cabinet decision to recommend President's Rule.

NEW DELHI: The CPI-M has urged Prime Minister Narendra Modi to sack his ministers Smriti Irani and Bandaru Dattatreya, saying they are to blame for the suicide of a Dalit student in Hyderabad. An editorial in the CPI-M journal "People's Democracy" also said that P. Appa Rao, vice chancellor of the Hyderabad University, should also be dismissed for the January 17 suicide by Rohith Vemula. "The vice chancellor has to be removed forthwith. Both he and Dattatreya must be charged under the Scheduled Castes and Scheduled Tribes (Prevention of Atrocities) Act and for abetment of suicide," it said. "The continuance of Dattatreya and Irani as ministers in the union cabinet is untenable. "The prime minister should realize that if his government has to salvage some of the moral authority it has lost, they have to go," said the Communist Party of India-Marxist (CPI-M) journal. The editorial said there were times when a single incident can shatter the moral authority of a government. The death of Vemula, a research scholar, "who was driven to commit suicide is one such", it said.

Hot yoga guru to pay $6.5 mn in punitive damages WASHINGTON: After ordering celebrity yoga guru Bikram Choudhury to pay $924,500 in compensatory damages in a lawsuit for sexually harassing and firing a female employee, a US court has told Choudhury to pay $6.47 million in punitive damages. Plaintiff Minakshi Jafa-Bodden, Choudhury’s former legal adviser, said in the lawsuit that he inappropriately touched her and wrongfully fired her in 2013 after she began probing sexual abuse claims from other women. “I feel elated and vindicated,” Jafa-Bodden told the New York Daily News after the Tuesday verdict that was handed down by a Los Angeles

jury consisting of six women and three men. Meanwhile, 69-year-old Choudhury, Kolkata-born founder of Bikram Yoga - a form of hot yoga - testified that he is “almost bankrupt”. Jafa-Bodden filed her lawsuit in 2013 claiming Choudhury sexually harassed her with a barrage of misogynistic comments and threatened her and her daughter’s lives when she raised questions about sexual abuse claims brought by numerous women. Jafa-Bodden testified earlier in the trial that Choudhury made her life a living hell after she moved to the US from India to act as his personal lawyer.

WASHINGTON: Calling Republican presidential frontrunner Donald Trump as the “best hope for America”, some Indian-Americans in the New York Tristate area have formed a Political Action Committee (PAC) to support and raise funds for him. Headed by Dr. AD Amar, a business professor with Seton Hall University in New Jersey, the ‘IndianAmericans for Trump 2016’ was registered as a PAC with the Federal Election Commission last week. Its sole goal is “to garner actively the support of all Americans, but particularly Indian-Americans, to have Donald J. Trump become the next President of the USA,” the PAC said in a press release. “On realizing that the agenda of Donald J Trump for President 2016 is focused on reviving the American economy, rightly bringing America on the world stage, defeating terrorism and establishing peace through strength; many Indian-Americans believe that he is the best hope for

America and the right candidate to be the next president of the United States,” the PAC said in a statement. The real estate billionaire has vowed not to take money from individuals or special interest groups, or seek support from PACs. There was no comment from the Trump campaign. Anand Ahuja, an attorney based in New York, and Devendra “Dave” Makkar, a businessman in New Jersey, have been “elected” vice president and treasurer respectively. Dr. Sudhir Parikh, publisher of some community news publications in New Jersey, has been named chair of fundraising and advisory committee of Indian-Americans for Trump 2016. “This is only the first step. We are on the side of Trump for this election,” Amar said, citing Trump’s policies on illegal immigration and economy in particular as the main reasons for his group to support the Republican contender.

Disney World sued for replacing American workers with Indians using H-1B visas ARUN KUMAR, WASHINGTON

isney World has been hit by two class action suits accusing it and two outsourcing firms of conspiring to replace workers with less costly foreign ones using H-1B visas, mostly from India. The lawsuits were filed in a Tampa Florida federal court by Leo Perrero and Dena Moore, who were among 250 Disney tech workers laid off from their jobs at Walt Disney World in Orlando in January 2015, according to Orlando Sentinel. Perrero and Moore said they were told they had 90 days to train their replacements with foreign workers with H-1B visas for highskilled workers. If they didn’t agree, they weren’t eligible for bonuses or severance packages. Defendants include HCL Inc and Cognizant Technologies, two

outsourcing companies, known for submitting a high volume of H-1B petitions each year, according to CNN Money. The Congress has set a quota of 85,000 H-1B visas each year. “These lawsuits are based on an unsustainable legal theory and are a wholesale misrepresentation of the facts,” Disney said in a statement.

The company said it hired more than 100 people back into other roles and offered Moore another position at comparable pay. The lawsuits were brought by attorney Sara Blackwell, who also brought the Equal Employment Opportunity Commission filings on the behalf of former Disney workers.

French President Francois Hollande and Prime Minister Narendra Modi also agreed to collaborate to construct six nuclear power reactors at Jaitapur in Maharashtra instead of two decided earlier. Earlier Modi and Hollande had “restricted talks” for about an hour. Hollande and Modi later took a Delhi Metro train to attend a function in Gurgaon in Haryana to lay the foundation stone of the International Solar Alliance (ISA) headquarters and inaugurate its Interim Secretariat. The two leaders jointly launched the ISA at the Paris Climate Change summit. India and France came out with a

joint statement which talked about the need for “all countries to effectively deal with terrorism emanating from their territory or territories under their control”. They agreed to intensify cooperation in homeland security, cyber security, special forces and intelligence sharing. Terrorism, they said, cannot be justified under any circumstance, regardless of its motivation.

Both leaders called for decisive action against the Pakistan-based Lashkar-e-Taiba, Jaish-e-Mohammad, Hizb-ul-Mujahideen and Haqqani Network as well as groups such as Al Qaeda. Modi and Hollande praised each other after the signing of 14 agreements. Earlier, Hollande, who flew into Chandigarh on Sunday, was given a ceremonial welcome at the Rashtra-

pati Bhavan on the second day of his three-day visit to India. After the bilateral talks, Modi said financial details need to be worked out in finalizing the muchawaited purchase of Rafale jets from France, adding this would be concluded soon. Modi had, during his visit to Paris last year, announced India’s intention to buy 36 Rafale medi-

um multi-role combat aircraft built by Dassault. The deal is valued at around Rs.60,000 crore (almost $9 billion). “Only financial aspects of the Rafale deal is left. The inter-governmental agreement has been finalized. It will be done soon,” Modi said. Hollande said: “It is a decisive step for India to purchase the fighter jets and also for France to make them available to a great country like India.” On the financial aspects, he said: “It will be sorted out in a couple of days.” Foreign Secretary S. Jaishankar, who briefed the media after the bilateral talks, said 30 agreements were signed between the two sides since Sunday. Referring to the civil nuclear cooperation, he said: “At Jaitapur, we will collaborate to construct six nuclear power reactors.” The joint statement said Modi and Hollande encouraged their industrial companies to conclude techno-commercial negotiations by the end of 2016 to build six nuclear power reactor units at Jaitapur, with due consideration to “localization of manufacturing in India”. rime Minister Narendra Modi, known for his sartorial taste, chose a well-tailored fawn-colored bandhgala with a saffron Gujarati turban; as opposed to the crisp white shirt and formal suit sported by French President Francois Hollande, the chief guest at the 67th Republic Day Parade here. Hollande, who keenly watched the colorful parade that showcased India’s military prowess and cultural diversity, looked suave and dapper in tune with the perception that French men have a style of their own. Alongside him was Modi, whose traditional look for the special occasion left Indian designers impressed. He was as “appropriately” dressed for the event as he is at other times, said fashion designer Amit GT, who has earlier showcased his creations in Paris, Milan and Vienna. “His bandhgalas are always immaculately tailored. His look during the Republic Day was appropriate, if not fashion forward. He has to connect with all citizens of India, so if he sports a turban or anything related to India, it should be admired. “He is a smartly dressed politician,” Amit told IANS. This is not the first time that Modi sported a turban at a public event. During last year’s Republic Day parade too, he teamed his traditional bandhgala with a bright red

rench President Francois Hollande has offered his country’s assistance in the development of at least three smart cities — Chandigarh, Puducherry and Nagpur. The announcement came during two back-to-back meetings which the visiting head of state, along with Prime Minister Narendra Modi, held here with the key corporate leaderships of the two countries. The first meeting was with the Indo-French CEOs Forum. Following the first economic engagement, the two leaders then attended the larger India-France Business Summit hosted by India’s Department of Industrial Policy

The businesses of the two sides also signed 16 pacts mainly in urban development and clean

energy, but also covering one agreement on aerospace between the French giant Airbus and India’s Mahindras. Addressing the meeting with the Indo-French CEO’s Forum, Prime Minister Modi said India today presented immense opportunities to the global investing community both as a market and a hub for manufacturing. “India is the fastest growing economy in the world. We have the labor and the market for your products,” Modi said. “India is also a source of hope and confidence for the entire world community,” he said adding that the investment climate had also improved considerably in the country. Modi, who recalled having met

the French president five times last year, also said that France’s greatest strength has been innovation, which can fit well with India’s talent. “This kind of partnership can achieve a lot.” Hollande, on his part, said his visit here had two main goals -consolidating the strategic partnership with India in a host of areas, including security, and implementing the climate change goals that were set forth in the global conference in Paris last year. Some 30 business leaders from the two countries attended the half-hour meeting of the IndoFrench CEO’s Forum, which was formed in the year 2009 to identify new avenues to push bilateral economic ties between the two countries.

ndia’s 67th Republic Day was celebrated across cities and towns on January 26, with the country’s military might on display in the capital where French troops made history by joining the impressive parade. French President Francois Hollande, the chief guest, watched admiringly the 90-minute splendor where President Pranab Mukherjee took salute from the military. It ended with colorful tableaux marking India’s cultural diversity, a daredevil motorcycle show and a grand flypast by air force fighters. Across the country, governors and chief ministers unfurled the national flag and took salute from military and police units. The celebrations went off peacefully everywhere. At the official function at the Maualana Azad stadium in Jammu, Jammu and Kashmir Governor N.N. Vohra hoped the state will get an elected government soon. He also paid tribute to late chief minister Mufti Mohammad Sayeed, whose death on January 7 led to Governor’s Rule in the troubled

state. In Srinagar, separatist leaders were put under house arrest to foil protests. In Maharashtra, Governor C.V. Rao unfurled the national flag and took the ceremonial salute in Mumbai. The day was celebrated across Karnataka with patriotic fervor. Governor Vajubhai R. Vala hoisted the tricolor and reviewed guard of honor at the Manekshaw Parade Ground in Bengaluru. Tamil Nadu Governor K. Rosaiah unfurled the national flag at the Marina beach in Chennai and took the salute from contingents of the armed forces. In Vijayawada, Governor E.S.L. Narasimha said with double-digit growth in the first half of the current fiscal, Andhra Pradesh was making big strides despite the problems following its bifurcation. In Patna, Governor Ram Nath Kovind hoisted the tricolor and took salute at an impressive parade. He said the rule of law prevailed in Bihar. Chief Minister Nitish Kumar hoisted the flag at his residence. The main event in Rajasthan took place in Bikaner, where Governor Kalyan Singh unfurled the

ammu and Kashmir on Tuesday celebrated the Republic Day on January 26, with Governor N.N. Vohra saying the state will benefit the most from Prime Minister Narendra Modi's peace initiative vis-a-vis Pakistan. The official Republic Day functions in both Srinagar, the state's summer capital, and Jammu, the winter capital, passed off peacefully. The main Republic Day function was held at the Maulana Azad Stadium in Jammu where Governor Vohra hoisted the national flag and took salute at an impressive parade of the army, security forces and school children. Speaking on the occasion of the 67th Republic Day, Vohra said the people of the state would be the greatest beneficiaries of the peace initiative started by Modi between India and Pakistan. and cultural troupes entertained the audience with their programmes highlighting the country's unity in diversity. A thick security blanket was thrown around the stadium. More than 1,000 security personnel were deployed. In Srinagar, the main function was held at the Bakshi Stadium where Divisional Commissioner Asgar Samoon hoisted the national flag and took salute at a parade. he Republic Day was celebrated across Maharashtra on January 26 with Governor C.V. Rao unfurling the national tricolor here at the main state function and taking the salute at a ceremonial parade. Lakhs of people enthusiastically participated in various events in Mumbai, Pune, Nagpur, Nashik and other parts of the state. Chief Minister Devendra Fadnavis, legislative council Chairman Ramraje Naik-Nimbalkar, legislative assembly Speaker Haribhau Bagde, Mumbai Mayor Snehal Ambekar and top officials of the armed forces and police were present at the main event in the state capital here. In his address, Governor Rao said the state government has launched a special drive to provide apprenticeship training to one lakh young people under the trade apprenticeship scheme. Referring to the drought facing 15,747 villages in the state, the governor said a special package of

The parade was led by a cavalcade of horses trained and provided by the Amateur Riders Club here, along with contingents of security forces from the navy, air force and army. There were various cultural performances like the Lazim, Bhangra, Gujarati folk songs and more at the event, where Poonam Mahajan and Priya Dutt hoisted the national flag. Nickelodeon Toons from “Motu Patlu”, “Pakdam Pakdai”

and “Dora The Explore” walked the parade, and the entertainment channel’s ‘superkid’ Shiva led the cycle group with more than 150 children. Together, they promoted ‘The Big Green Help’, an initiative for a greener environment. “We are happy to have associated with Nickelodeon for the annual Republic Day Parade in Mumbai. We loved the Nicktoons being a part of the parade along with the children and marching in respect for the country,” said a source close to the organizing committee. With over 40 schools participating for the parade and more than 20,000 spectators, the channel along with the children had a one-of-a-kind experience to salute the country and honor the heroes, read a statement.

Patriotic fervor in Karnataka BENGALURU: The Republic Day was celebrated across Karnataka on January 26 with patriotic fervour as Governor Vajubhai R. Vala hoisted the tricolor and received guard of honor at the Manekshaw Parade Ground in the city center. Clad in a light grey suit, Vala went around the rectangular-shaped ground in an open jeep and reviewed the parade, waving at and greeting about 8,000 people who flocked to the venue on a sunny morning with winter chill in air. A military helicopter showered rose petals over the dais on the ground where Vala unfurled the national flag and took salute from military and police battalions. After addressing the gathering in Hindi, Vala witnessed a colorful march past by about 20 contingents, includ-

Guard against intolerance, embrace consensus: President President Pranab Mukherjee urged Indians to shun violence, intolerance and unreason and said that decision making must be based on cooperation and consensus-building

He said with investments in infrastructure, manufacturing, health, education, science and technology, India was positioning itself to achieve a higher growth rate which in 10-15 years will help banish poverty. The president said that as the 20th century ended with a remarkable revolution in science and tech-

nology, there were reasons for optimism that the 21st century would see the last of extreme poverty. “That optimism has faded in the first 15 years of this century,” he said, adding the scourge of terrorism had reshaped war into its most barbaric manifestation. “Terrorism is inspired by insane objectives, motivated by bottomless depths of hatred, instigated by puppeteers who have invested heavily in havoc through the mass murder of innocents. He said terrorists seek to undermine order by rejecting the very basis of strategic stability, “which are recognized borders. If outlaws are able to unravel borders, then we are heading towards an age of chaos”. Without taking any country’s name, the president said that there were bound to be disputes among nations. “As is well-known, the closer we are to a neighbor the higher the propensity for disputes. There is a civilized way to bridge disagreement; dialogue, ideally, should be a continual engagement. “But we cannot discuss peace under a shower of bullets.” The president ended his speech with Tagore’s immortal words: Move ahead, the roll of drums announce your triumphal march; With feet of glory, you shall cut out your own path; Delay not, delay not, a new age dawns.

In his annual Republic Day eve address, the president also said that while rebellion was also a virtue of democracy, “let us also applaud what our democracy has achieved” since independence in 1947. Saying reverence for the past was one of the essential ingredients of nationalism, he said that it was important to ensure that all citizens got justice, equality, and gender and economic equity. “When grim instances of violence hit at these established values which are at the core of our nationhood, it is time to take note,” he said. “We must guard ourselves against the forces of violence, intolerance and unreason.” The president said that to revitalize the forces of growth, the country needed reforms and progressive legislation. “It is the bounden duty of the law makers to ensure that such legislation is enacted after due discussion and debate. “A spirit of accommodation, cooperation and consensus-building should be the preferred mode of decision-making.”

Saying no one nation could be an oasis of growth, he pointed out that India’s economy also faced the blowback. Nature was also unkind to India last year, he added, referring to drought and floods, affecting rural income and employment. Excerpts from president’s message The following are the excerpts of the address to the nation by President Pranab Mukherjee on the eve of the 67th Republic Day: l India today is a rising power, a country fast emerging as a global leader in science, technology, innovation and start-ups, and whose economic success is the envy of the world. l The year 2015 has been a year of challenges. During this year, the global economy remained subdued. Weak investor sentiments led to withdrawal of funds from emerging markets including India putting pressure on the Indian rupee. Our exports suffered. Our manufacturing sector is yet to recover fully.

l In 2015, unusual weather conditions impacted our agricultural production. Rural employment and income levels suffered. l India is building and implementing strategies to solve these problems. This year, with an estimated growth rate of 7.3 percent, India is poised to become the fastest growing large economy. l Over 19 crore bank accounts opened under the Pradhan Mantri Jan Dhan Yojana is the single largest exercise in the world at financial inclusion. l The Saansad Adarsh Gram Yojana aims to create model villages. The Digital India programme is an effort

to bridge the digital divide. The Pradhan Mantri Fasal Bima Yojana targets farmer’s welfare. The Make-in-India campaign will boost manufacturing by facilitating easy conduct of business and improving competitiveness of domestic industry. The Start-up India programme will foster innovation and encourage new-age entrepreneurship. Let us continue to complain; to demand; to rebel. This too is a virtue of democracy. Indian businessman gets 21-month jail

Sawan ‘Sunny’ Shah BY A STAFF WRITER OLUMBUS, GA-- An Indian American businessman in Columbus, Georgia, Sawan Shah aka Sunny, was sentenced to serve 21 months in prison, followed by three years of supervised release and ordered to forfeit $1,357,476.18 for operating an unlicensed money transmitting business. According to court documents, between February 2013 and March 2014, Shah owned, operated and managed several money transmitting companies in the Columbus area, the Justice Department reported. Shah offered check cashing services to the public, including cashing of checks that exceeded $1,000. He knew that he and his companies were required to be registered with Financial Crimes Enforcement Network (FinCEN) and with the State of Georgia. But neither Shah nor any of the businesses he controlled were registered with FinCEN or the State of Georgia as a money transmitting business or as a check cashier. As part of his plea, Shah admitted that several individuals approached him about cashing tax refund checks that were issued in the names of other individuals. He agreed to do so and did not require proof of identification for the individuals listed on the checks. Shah charged fees of between 10 and 30 per cent of the value of the check, due to his knowledge that the checks were involved in tax fraud. In 2013 and 2014, Shah cashed approximately 567 federal tax refund checks that totalled $1,357,476.18. Shah admitted in plea documents that those checks were the result of fraudulent claims for income tax refunds submitted in the names of stolen identities.

Indian couple jailed for cheating Kohl’s BY A STAFF WRITER ILWAUKEE, WI-- An Indian couple from Andhra Pradesh living in New Jersey, who admitted to defrauding a Kohl’s department store customer rewards program of $600,000 has been sentenced and ordered to pay restitution in federal court in Milwaukee. Pavan Gurram, 35, a computer programmer who has been working in the US for six years on a work visa, was sentenced last week to a year and six months in federal prison and ordered to pay nearly $450,000 in restitution. His wife, Vanaja Gattupalli, 27, received six months of probation. The couple used a computer program to steal cash certificate numbers belonging to Kohl’s customers. Investigators determined Gurram was the mastermind of the fraud and Gattupalli was his accomplice. The couple will be deported to India after they complete their sentences. Gurram did not explain why someone with no criminal record and no apparent need for money would devise such a fraud. The couple had earlier pleaded guilty to the fraud in federal court before US District Judge J.P. Stadtmueller. Michael Cohn, attorney for Gurram, noted the couple had paid back nearly $380,000 to Kohl’s and would face severe stigma and shaming when they are deported back to India. Sentencing guidelines called for four to five years in prison because of the amount of fraud. Stadtmueller said that much time was not warranted given the cooperation the couple gave to the FBI and their willingness to already pay restitution. But he said some punishment was necessary as an example for others who would come to the United States and try to “bite the very hand of commerce” that is helping them. “America is the land of opportunity. It will not be the land of opportunity for those who engage in fraudulent activities,” the judge said.

Three charged in murder of Virginia Tech student BY A STAFF WRITER LACKSHURG, VA-The Virginia Tech community is struggling to come to terms with yet another tragedy, after cops arrested three in connection to a promising young student’s death. Samanata Shrestha, a 21-year-old biology major, was identified as the victim of a homicide that took place this weekend. The police have already arrested three people for their involvement in the crime. Jessica Michelle Ewing (22) was charged with one count of second-degree murder. Keifer Kyle Brown (23), a recent graduate of the school, and Michael Christian Heller (23), a Blacksburg resident, were both charged with Accessory after the Fact. The police accused Brown of helping to transport, conceal or alter the dead body. The case began as a simple welfare check. The victim’s parents, Dr. Manik Lal Shrestha and Rajshree, last heard from their daughter on January 15. But they couldn’t reach her the next day. The police started a homicide investigation on January 17, sending out an alert for a black 2004 Mercedes. The car, which belonged to the victim, was found on January 8. Shreshtha was found in the car with marks around her neck that indicated that she was strangled. Ewing is a senior at the school, double majoring in fisheries science and biological sciences. Brown graduated last August with a degree in interdisciplinary studies. They are both being held without bond. Brown is in the Montgomery County Jail, but Ewing has been transferred to the Western Virginia Regional Jail. In an open letter to the community, Virginia Tech President Charles Steger said

Pavan Gurram Kohl’s Cash is a loyalty program by the Menomonee Falls-based retail chain that gives customers $10 certificates when they spend $50 at the store or online. Gurram developed a computer program to steal legitimate Kohl’s Cash certificate numbers and use them to buy merchandise online, which the couple kept or sold. He also sold the stolen numbers to others, including businesses that resell gift cards. The investigation was opened by the FBI after customers complained to Kohl’s that they were not able to redeem cash rewards certificates they had received. Gurram used cash benefits from more than 7,000 customers between June 2014 and June 2015. He placed more than 1,000 orders with Kohl’s, buying items such as electronics, jewelry, sports memorabilia, clothing and household items. The items were used by the couple, sold to others who didn’t know they were stolen, returned for store credit or sent overseas to relatives as gifts. John Campion, attorney for Gattupalli, said every decision was made for her in the traditional Indian culture she was raised. She went to college, but her father picked the classes. Her marriage to Gurram was arranged. Once in the US, she never went to a store without her husband.

Shrestha was a senior from Vienna, Va. The honors student had dreams of going to medical school. The Epsilon Sigma Alpha fraternity at Virginia Tech and the Nepalese Student Association held a candlelight vigil for Shrestha who was an active part of both these organizations. The death is particularly tragic for the young woman’s family because Shrestha’s parents are still recovering from the death of another child. In December 2008, the parents lost 22-year-old daughter Manisha Shrestha to a motorcyle accident in the family’s native country of Nepal.

The rules also require the state government to stipulate relief and rehabilitation measures for victims including basic needs such as the right to legally marry, a right to which they have been deprived; and the right for Jogini children to list a father’s name officially on their birth certificate, enabling the family to access benefits and enrolment in school.

BY A STAFF WRITER ANTA CLARITA, CA -- An Indianorigin businessman claiming to be a Hindu monk who performed healing rituals has pleaded not guilty after being ordered to stand trial on charges of sexually assaulting three women. According to Los Angeles County Deputy District Attorney Maren, ‘Swami’ Gokula Nanda of West Hills, Calif., was ordered to stand trial on December 4 last year for six counts of sexual battery. Nanda, 63, is scheduled for a pre-trial hearing on February 29 at Los Angeles County Superior Court, Torrance branch. Owner of Hari-Om India Market in Santa Clarita, Calif., Nanda was arrested on May 13 following allegations that he sexually assaulted female clients in Torrance and Santa Clarita. He was released in July on a $100,000 bail pending further court proceedings. According to testimony at the preliminary hearing, Nanda sexually abused the victims while claiming to be a swami by performing healing rituals at various locations, including his Eastern medicine store in Santa Clarita and a park in Torrance between April 2011 and April 2015. He faces a possible maximum sentence of 19 years in state prison if convicted as charged. The case remains under investigation by the Torrance Police Department. Nanda studied at Sivananda Ashram at Vedanta Forrest Academy. He hails from Kalapathara in Odisha (India).

BY A STAFF WRITER IAMI, FL -- A Miami doctor has been placed on administrative leave after a video surfaced of her assaulting an Uber driver. In the video of the January 24 incident, Anjali Ramkissoon, a fourth-year neurology resident for Jackson Health System, can be seen yelling profanities and hitting an Uber driver. She demands a ride, and begins throwing things out of his car. A hospital spokesperson said that Ramkissoon had been ”removed from all clinical duties” and that “Jackson has launched an internal investigation.” “The outcome of the investigation will determine whether any disciplinary action will be taken, up to and including termination,” the statement says. The Miami police say they responded to a call of a disturbance, but did not arrest her. The driver did not want to press charges, and that Ramkissoon gave him a small amount of money as an apology.

BY A STAFF WRITER ONESBORO, GA -- An Indian American psychiatrist in Jonesboro, Ga., has been accused of overprescribing opiates and benzodiazepine over several years. According to Clayton County police chief Mike Register, Dr. Narendra Nagareddy overprescribed the pills which in turn led to the deaths of dozens of patients. More than 40 law enforcement officers from several agencies converged on Nagareddy’s office January 14 to arrest the psychiatrist and search his office. The police also had searched Nagareddy’s home as part of the raid. “The guy may call himself a doctor, but if the allegations are true, I call him a drug dealer,” said Register. Legal documents say 36 of his patients have died, 12 of them confirmed to have been the result of prescription drug overdoses. Nagareddy has been charged with prescribing pain medication outside of his profession and not for a legitimate use, according to the county’s district attorney Tracy Graham Lawson. Aside from the criminal charges, the Clayton County District Attorney’s Office has also filed a RICO civil action to seize Nagareddy’s assets. Throughout his 15 years of practicing medicine, Nagareddy has had no ethical complaints filed against him. The doctor was released on bail January 18.

BY A STAFF WRITER ANTA ANA, CA -- A man has been sentenced to 25 years to life in state prison for the strangling murder of his wife in their Irvine apartment. Shalabh Rastogi, 42, was found guilty by a jury on November 17, 2015, of one felony count of first-degree murder. At the time of the crime, Rastogi was experiencing marital trouble with his 40-yearold wife Jalina George, with whom he had three school-going children. During the evening of May 21, 2012, the defendant strangled and murdered George in the bedroom of their apartment. He then left the victim’s body in the bedroom closet and called the police later that night. The Irvine Police Department, who investigated the case, immediately responded to the scene and arrested the defendant. The couple’s three children were not at home at the time of the murder.

Rice varsity post-doctoral Fellowship in Jain studies BY A STAFF WRITER UGAR LAND, TX-- Officials at Rice University have signed off on establishing a full-time Bhagwaan Mahavir postdoctoral fellowship program for Jain studies at the university. The signing took place at the Jain Society of Houston, with members of Rice University, the Houston Jain community, Jain Vishwa Bharati Meditation Center and Sugar Land, Texas, Indian American councilman Harish Jajoo, among others, in attendance. According to past-president of JAINA and chairman of the International School for Jain Studies in the US Sulekh Jain, there are no course offerings of Jainism at any Houstonarea universities. Houston-based Rice University, which has been around for more than 100 years, will be the first. The announcement confirms that Rice University will hire a full-time post-doctoral fellow Jain scholar with a proven track record of leadership and publication, a joint statement by Jain and Payal Kapadia Patani said. Rice and the Jain Society will split the cost in half for the collaboration, which will include the study of Jainism, its philosophy, history, art, culture and contributions to the world. The to-benamed scholar will create a platform for discussion, learning and awareness of Jainism and will offer classes each semester. Additionally, the scholar will interact with the Jain community in Houston to facilitate learning of the tradition of Ahimsa, Anekant and Aprigraha – the three jewels of Jainism, Jain and Patani said. Ordered off plane, Sikh, 3 Muslims sue airline BY A STAFF WRITER ROOKLYN, NY -- A Sikh man and his three Muslim friends are seeking retribution after they were ordered off an American Airlines plane last month, because their appearance made the flight’s captain uneasy. Shan Anand, a 25-year-old Sikh, and his three Muslim friends--Faimul Alam, 25, a Bangladeshi Muslim, 23; and an Arab Muslim, 29--were ordered off flight No. 44718 headed from Toronto to New York based on their perceived race, color and ethnicity. The group has sued the airline and is seeking $6 million in compensation. Anand and Alam switched seats with a pair of strangers after boarding to sit next to each other and, minutes later, a flight attendant asked the Bangladeshi to get off the plane, according to the lawsuit filed on January 18 in Brooklyn (NY) Federal Court. Anand, Alam and the Arab were all asked to get their bags and leave the plane shortly after. They had initially thought they were being asked to leave as part of an emergency evacuation. The township police said the two teen girls left a note on the floor of the school’s hallway saying a bomb would go off at 1:30 pm. School officials had all the students “shelter in place” in their classrooms, while school staff and police detectives searched the building and quickly determined the threat was a hoax. The names of the girls were not released because they are juveniles. Several high schools in Bergen County and Passaic County received threats Tuesday morning. “They will be suspended for at least 10 days,” Union police director Daniel Zieser said. He said the police investigation was continuing and the Union County Prosecutor’s Office would decide if the girls would face criminal charges.
