CSHP Seminar continues to offer plenty of educational sessions including a few sessions on legal and legislative updates. Below are some of the highlights of pharmacy related law and legislative update from Seminar 2022.

CCR §1746.4 Pharmacist Initiating and Administering Vaccines (Effective Jan 25, 2022)

Regulations Effective 2022 -Must complete 1 hour of CE focused on immunizations and vaccines from an approved provider once every 2 years. -At request of a patient, shall notify each patient’s PCP of any vaccine administered (within 2 weeks of vaccine administration)

CCR §1704 Providing Addresses (Effective April 1, 2022)

AB 2789 (2018) e-Prescribing 19 (Starting 1/1/2022)

AB 1064, Fong Pharmacy practice: vaccines: independent initiation and administration

-Each applicant holding a license who has an electronic mail address shall provide to the Board and maintain a current electronic mail address with the Board and notify the Board of any change of electronic mail address within 30 days

Statutes Effective 2022 -Prescribers must have the capability to issue an electronic data transmission prescription on behalf of a patient and to transmit that electronic data transmission prescription to a pharmacy selected by the patient. -Pharmacy, pharmacist, or others authorized under California law to dispense or furnish a prescription shall have the capability to receive an electronic data transmission prescription on behalf of a patient.

-Permits pharmacists to independently initiate and administer any vaccine approved or authorized by FDA. -ACIP recommendation, 3+ YO, Immunization training, Give Epi and diphenhydramine if needed

-Advanced Practice Pharmacist (APh) - completion of one requirement is subsumed within completion of another requirement -Eliminates requirement of collaborative practice agreement for Advanced Practice Pharmacists -Expands collaborative practice agreement to include any health care provider with prescriptive authority -Authorizes a pharmacist to provide medication-assisted treatment pursuant to a state protocol (pending change in DEA regulations) -Permits any registered pharmacist to engage in a collaborative practice agreement (no requirement for residency)

SB 306 – Pan: Sexually transmitted disease: testing

SB 362 – Newman Chain community pharmacies: Quotas

AB 2194 Cultural CE for Pharmacists (Effective 1/1/24)

-Permits a pharmacist to dispense a drug to treat sexually a transmitted disease (STD) without the name of an individual for whom a drug is intended if the prescription includes the words "expedited partner therapy" or the letters "EPT.” -Requires health plans to cover home test kits for STDs -Permits HIV counselors to perform rapid STD tests

-Prohibits a chain community pharmacy from establishing a quota to measure or evaluate a pharmacist or pharmacy technician’s performance of duties -Authorizes the BOP to take enforcement action against a community pharmacy that establishes a quota related to a pharmacist or pharmacy technician duties.

Statutes Effective 2023

Complete one of cultural competency Course, as defined in BPC 4231 during the preceding two years. 1. focuses LGBTQ and “gender nonconforming” or persons “who question their sexual orientation or gender identity and expressions, 2. accredited by BoP approved entity, 3. covers health disparities faced by Black, Indigenous and people of color, and 4. contains elements demonstration how sexual identity is directly impacted through intersectionality.
