Dear Mr. Richardson: Are homeowners allowed to read or copy committee minutes? Our manager says no because they are not “standing committees” like the architectural committee. I say all records, receipts, minutes can be read and copied except for executive minutes. The Davis-Stirling Act is little confusing on this subject. Sincerely, P.W. Dear P.W.: Committee meeting minutes are treated differently than minutes of board meetings. If the committee has decisionmaking authority, then Civil Code Section 5210(a)(2) requires that minutes of such a committee be kept permanently and provided to members upon request. However, most committees do not make final decisions but instead make recommendations to the board, and so would not have “public” minutes. Committees normally make reports, not minutes. The one exception would be the architectural committee, which normally has decision-making authority over architectural applications. Normal committees also are not required to comply with the Open Meeting Act, unless the committee has a quorum of the board participating — then under Civil Code 4090 it is also considered a “board meeting” triggering compliance with the Open Meeting Act. Thanks for your question — Kelly Dear Kelly: I recently attempted to obtain a copy of our HOA rules from our association’s web site. They were dated 2016. The next day our manager sent me a copy of updated rules as of 2018. Isn’t it illegal to hide governing documents from the membership, especially rules that were implemented two years prior to a request? G.C.
Dear G.C.: Under Civil Code Section 5200(a)(11), governing documents must be made available to any requesting member. Civil Code Section 4530(a) requires the association to provide those documents within ten calendar days of a member’s written request. An increasing number of HOAs now post their governing documents in their web sites, but it is important to make sure the posted documents are current. If the rules are changed but the new rules are not posted on the web site, some owners could argue the rules were not published and so they have no actual notification of the rules and so are not bound by the rules. Best regards, Kelly Hi, Kelly: In recent years, the management company mailed out the annual budget statement and annual policy report in the form of a summary, but the summaries were incomplete. This year’s summary cover sheet stated a complete summary is available upon request at no charge via email, a hard copy will be at a charge. How can we receive the full reports and what happens if they don’t comply? Sincerely, M.M. Dear M.M.: The Annual Budget Report and Annual Policy Statement are collections of important disclosure documents required by Civil Code Sections 5300 and 5310 to be prepared and sent annually to the members. If the HOA sends out a summary, it must also advise members of their right to receive a free full copy (not, as your HOA said, a “full summary”) of the report. The failure to timely distribute the Annual Budget Report (30-90 days before the fiscal year ends) means that the HOA board cannot increase assessments during that year without a membership vote. There appears to be no direct penalty for failing to issue the Annual Policy Statement. Regards, Kelly

Question: My wife and I own a home in the Santa Barbara foothills that was built in the early 1990’s. Our kitchen is the kitchen originally built with the house and we are very happy with our cabinets, counter tops and appliances. However we would really like to upgrade the lighting. Currently there are 3 lighting circuits in the kitchen each controlled by a separate wall switch. One circuit has six recessed can lights that are spread out over the entire ceiling with incandescent light bulbs. The second circuit controls several recessed can lights over the sink also with incandescent bulbs, and the third circuit turns on and off a hanging light fixture with halogen bulbs over a small breakfast table. We have read much about the new types of LED lighting and would like information on possible ways to convert our kitchen lighting to LED. Your Handyman: I personally am a big fan of LED lighting for many reasons and my prediction is that within relatively few years LED lighting will become the dominant style of lighting for both residences and businesses. You may have read in the local news of the UCSB professor who is credited with the invention of the modern LED light, being awarded the Nobel Prize and being labeled in the press as a modern day “Thomas Edison”. The most noticeable feature of LED lights is that they emit a very clean natural looking bright light that brings out the true colors and beauty of granite counter tops, drapery fabrics and artwork in homes, and makes fine crystal and jewelry sparkle in stores at the mall. Incandescent, florescent, and compact florescent lights emit a light that is less pure and illuminates with a slight amber tint that tends to subdue and distort colors. I personally dislike most everything about the twisty compact florescent bulbs (CFL): especially the shade of light they produce and predict that they will soon go the way of the rotary dial phone. LED lights use a very small amount of electricity and the typical older style recessed can light designed to be used with a 100 watt incandescent interior flood light bulb, can be replaced with a LED light,

that believe it or not only uses 6 watts of electricity while producing an equivalent amount of illumination. This same LED can light is rated by the manufacturer to last for over 30,000 hours while a compact florescent light or incandescent light usually lasts for considerably less than 10,000 hours. Florescent lights work most efficiently when left on for extended periods of time like at a retail store and their life is greatly reduced when turned on and off for the shorter periods of time that are typical in residential use. The life of an LED light is not affected or reduced by being turned on and off in a residential application. LED lights emit much less heat than other types of light, especially halogen, and this is a major benefit especially in retail lighting where a significant amount of the energy consumed by the air conditioning system goes to reducing the heat created by the racks of lights that are typically spread over the ceilings of the most mall type shops. This can also be an energy saving benefit in newer energy efficient homes with high insulation values that trap any heat created by the lighting fixtures. The only disadvantage that I am aware of that is currently associated with LED lighting is that because it is a relatively new technology, the price is higher than other types of lighting, but this price difference will quickly shrink as production increases and technology advances. You can convert the lighting in your kitchen ceiling to LED in a couple of different ways. If there is good attic access over the kitchen then the ideal plan would be to remove the old can lights completely and install new LED can lights using the same wiring, all accessed in the attic. If you want to have the lights in new locations, then a little drywall repair and painting will be required. If attic access is a problem or if there is no attic due to a second story living area over the kitchen, then you can purchase conversion kits that allow you to use the existing recessed incandescent can by installing a new LED

By Kim Palmer With the pandemic still looming large, we’re facing a long slog at home during the winter months ahead. If that prospect fills you with gloom, consider it an opportunity to make some changes to your home so that it feels more inviting, enjoyable and functional. End-of-year trend reports and predictions for 2021 are full of ideas that homeowners can tap into to spruce up their spaces. Here are a few, culled from various sources: 1. Add some brown: White and gray have been the ubiquitous go-to color palette for interiors in recent years. But warmer neutrals, including brown and beige, are starting to make a comeback, according to the 2021 Home Design Predictions recently released by Houzz. Warm taupes, beiges, sand and other earth tones are surging in popularity, according to designers and builders that Houzz queried. It’s time for the pendulum to swing. And brown as an accent color can help bring some warmth into white and gray spaces, which can read as chilly. 2. Add some blue: We’re all seeking tranquility these days, and blue is the perfect hue to create a serene and soothing home, according to Better Homes & Gardens. The

magazine’s trend forecast for 2021 includes “Ocean Hues,” with shades ranging from deep inky blues to soft aqua. 3. Gain some privacy: The open-concept floor plan, so popular in recent years, was put to the test in 2020 as multiple household members struggled to take part in concurrent video meetings and classes without walls to muffle the sound. If your home has an open plan, consider adding sliding doors or partitions that can help block noise and create a sense of privacy. 4. Upgrade your home office: When the pandemic began, many workers hastily set up makeshift workstations at home. The trend of remote work will continue in 2021, Houzz predicts, and homeowners will seek ways to create more efficient dedicated home offices, work nooks and even backyard work cottages. If your home office isn’t getting the job done, now’s a good time to invest in some enhancements, such as a more comfortable chair, better lighting or a better system to organize and contain paper clutter. Video conference-worthy backdrops also are trending. If yours is lackluster, add a piece of artwork, a pop of color, good lighting and a little greenery, Houzz suggests. 5. Go retro: What’s a “Grandmillen-
nial”? It’s a youthful fresh take on “granny decor,” according to HGTV, and it’s trending as a reaction to modern minimalism. Get the look and the feeling by incorporating a few touches often associated with Grandma’s house, including cozy accents, pretty florals, ruffles and nostalgic throwback details such as needlepoint. 6. Soothe your stress: Bathrooms increasingly have become spaces for rest and relaxation, according to Houzz. You can make your bathroom soothing and hangout-worthy by adding a few spalike amenities — a steam shower, an aromatherapy showerhead or a bathtub filler or other attachment that can hold a cup of tea or glass of wine. 7. Upsize your tile: Large rectangular tiles are trending for bathrooms, according to Houzz. Big tiles mean fewer grout lines, require less cleaning and create less visual clutter. Large-format tile also can help a small space feel bigger. When using large tile on a bathroom floor, choose a matte finish for slip-resistance. 8. Create a destination space: With recreational travel a distant memory, many are craving that getaway feeling at home. Interiors inspired by “Distant Shores,” especially tropical locales, will be popular in

Infuse a room with tropical brights, lush flower or foliage prints and beachy accents to create a space where you can refresh and recharge without leaving home. 9. Exercise your green thumb: Houseplants have made a comeback during the pandemic, and their popularity will continue into 2021, according to HGTV. Refresh your air and brighten your mood with some live flora. Or go all out and create a trendy “living wall” of plants. 10. Have some fun: With fewer diversions available to us, due to the pandemic, at least we can turn our creativity loose on our homes. Question: My wife and I own a home in the Santa Barbara foothills that was built in the early 1990’s. Our kitchen is the kitchen originally built with the house and we are very happy with our cabinets, counter tops and appliances. However we would really like to upgrade the lighting. Currently there are 3 lighting circuits in the kitchen each controlled by a separate wall switch. One circuit has six recessed can lights that are spread out over the entire ceiling with incandescent light bulbs. The second circuit controls several recessed can lights over the sink also with incandescent bulbs, and the third circuit turns on and off a hanging light fixture with halogen bulbs over a small breakfast table. light and baffle that connects with spring arms that match the way that most baffles and trim rings connect to the recessed can. The LED light has a threaded connector that simply screws into the old light socket, you then next connect the spring arms, slide the new light into the old recessed can, and your new LED light is ready for use. Your hanging light over the breakfast table can be switched out to an LED fixture just as any light fixture is replaced once you are able to purchase a new LED fixture that you like. Any online lighting supplier now carries a large selection of all types of LED fixtures. The style of your light is probably a surface mounted fixture which is the most common style for a ceiling. If you are considering under cabinet lighting or ambient lighting on top of the cabinets, then LED ribbon lights are a fabulous solution. The ribbon lights are about a ¼’ wide and have a tiny LED light every ½” or so and have a peel and stick backing with permanent 3M adhesive. The power supply requires a small transformer that can easily be hidden in a cabinet and is fully dimmable. A typical installation has the LED ribbon running along the perimeter of the bottom of the cabinets where they are concealed from view and fully illuminate the countertop and backsplash. The ribbons can also be installed along the top of the cabinets providing illumination to an area of the kitchen ceiling that is often left in shadows. If you want to have your new LED lighting controlled by a dimmer switch then you will need to install LED compatible dimmer switches. Dimmer switches that worked with your old incandescent lights often will not dim your new LED lights.

Housing economists predict prices to increase in 2021, but not as rapidly as this year By Phillip Molnar
Top national real estate economists at an online conference predicted home prices would continue to rise in 2021. The well-known analysts said a lot of the same factors that pushed up prices in 2020 — low mortgage rates and lack of homes for sale — would continue in 2021. They were speaking at the 54th annual conference of the National Association of Real Estate Editors, online for the first time because of COVID-19. They said what will likely be different in 2021 will be an increase in homes for sale, which should slow price appreciation. It should be noted many of their predictions hinged on widespread vaccination occurring throughout 2021. Frank Nothaft, a senior vice president and chief economist at CoreLogic, predicted national prices would increase 4.1 percent. That is down from a 7.3 percent annual increase as of October. He said low home inventory has led to rapidly increasing prices across the nation as dedicated buyers compete for a limited number of homes. However, he said the number of homes for sale will increase with widespread vaccination for the coronavirus, which kept some of the most vulnerable homeowners from selling this year. “Older homeowners at greater risk of complications from COVID-19, and who have flexibility in the time of their listing, chose to postpone listing their home until we were post-pandemic,” Nothaft said. Lawrence Yun, chief economist at the National Association of Realtors, said what a lot of people might have been thinking: That many experts were taken back by how much prices soared throughout the pandemic. He said he expected home prices to stay stable in 2020 throughout the pandemic-induced downturn, primarily because credit requirements for mortgages are much higher now than before the Great Recession. Also, he said home inventory was low even before the pandemic, so that should have kept demand steady. “I did not anticipate home prices to soar once the economy reopened,” Yun said. “It was quite a surprise.” He predicted home prices would increase 3 percent in 2021, down from his end-of-year forecast for 2020 of 6 percent.
Yun said he hopes, for affordability reasons, that prices will not appreciate as quickly as they did in 2020. He said a new stimulus package from the federal government will be crucial for parts of the economy that have been hardest hit by shutdowns. “The economic backdrop is strong growth in a healing economy,” Hale said. Danielle Hale, chief economist at Realtor.com, said the top performing real estate markets in 2021 will be mostly on the West Coast because of their ties to the tech industry. Hale said the top two markets would be Sacramento and San Jose. Riverside and Oxnard rounded out the top 10. San Diego was not ranked. Hale said San Francisco is not on the list because people are increasingly taking advantage of being able to work from home. No one predicted widespread foreclosures if unemployment remains high because of growing equity in homes as prices rose in 2020. Simply put: Even if owners are falling behind on mortgages, they still have a very strong market to sell before they get foreclosed on. Nothaft said many families were helped by forbearance programs that allowed them to pause payments but it isn’t a guarantee there won’t be some homes lost. “The (federal) forbearance program will help to mitigate how many of these seriously delinquent loans go into distressed sales,” Nothaft said. “But it will not prevent all of them.” Yun went so far as to say that even if home prices dropped by 5 percent next year that it likely would not create an avalanche of foreclosures because of increased equity.
