Part 2
Proposition 19 was approved in November of 2020. Its goal is to give seniors, people with disabilities and victims of disaster the ability to take their current property tax assessments with them when they move within California. Previously, only 11 of the state’s 58 counties had opted in to the property tax portability laws that allowed an owner to sell their property in one county and move to another and take their tax assessment with them as long as the replacement property didn’t exceed the value of the relinquished property. This was helpful for seniors looking to downsize or move closer to family without seeing a huge increase to their property tax bill. It also allowed a property to come to market that might not have otherwise. The intent of Proposition 19 was to expand this to all 58 counties in the state. It also expanded the opportunities from just seniors to those with disabilities and those impacted by fires and other disasters. These were all positive outcomes for portions of our society that could be most at risk from new property tax assessments when they move. In order to pay for this measure there were changes to the inheritance laws for real estate. One big change was the closure of the “Lebowski Loophole”. This is in reference to the inheritance rules in California that law allowed parents or grandparents to pass on a property to their children or grandchildren after their death and the property would not be reassessed for tax purposes. A 2018 Los Angeles Times article reported on how Jeff Bridges, the actor famous for “The Big Lebowski” and his siblings were benefiting from this by paying only $5,700 per year in property taxes on an ocean side home in Malibu that his parents bought in the 1950s while renting it out for $15,000 per month. Mr. Bridges did nothing different from thousands of other Californians who utilized the same law in the same way to benefit their children or grandchildren but because of the circumstances his situation became fodder for the Legislature to look to overturn these rules. After the failure of Prop 5, a similar effort to allow for property tax portability in 2019, the authors realized that the state was going to go after these loopholes and if they could work with state legislators and other groups they could try and salvage as much of the inheritance protections they could while giving seniors and others the much needed tax portability that would benefit them and increase the supply of housing for all Californians. Thus, the compromise of Prop 19 was born. The inheritance rules were changed so that a primary residence could be passed down but it would have to remain the primary residence of a child or grandchild and there would be no reassessment on the first $1 million of current assessed value. So if a parent bought the house for $500,000 and it was now worth $1.5 million the house would not be reassessed. The exemptions for rental or investment properties were removed altogether so those would now be reassessed upon the transfer. Additionally, the proceeds from Proposition 19 are set to go into a fund that is to support fighting fires around the state. Now the question becomes, “What can I do to protect my real estate investments for my children or grandchildren?” There are avenues out there that should be investigated. They include making gifts now to your children or setting up the properties into entities that would allow for them to transfer upon the death of a parent to a child without more than a 50% change in ownership. These options and others should be considered in consultation with your attorney, CPA and real estate professional. Everyone’s situation will be different and there’s no one cookie cutter solution. There will be tax implications not just for property taxes but for income taxes and capital gains. However, by working with your trusted advisors you can protect your family and investments for generations to come.

Board members were provided a lengthy document prepared by management, containing specific details on water usage, maintenance requests, and detailed financials. I queried if the report was available, and was told no, they are only provided to board members. In city council meetings, documents that don’t violate confidentiality or executive session privilege must be made available for review in advance of the meeting. Does the Davis-Stirling Act require something similar? – Sincerely, D. R. Dear D.R.: Civil Code Section 5200 includes a long list of “association records” which HOAs must produce upon member request. A typical board meeting packet, prepared by the manager to inform the board prior to its meeting, may contain documents that are included in the list, but the board packet itself is not a document which is required to be shared with all members. HOAs, even the largest ones, do not have the same resources as cities, and the requirements of the Davis-Stirling Act on community associations are not as strict as the Government Code requirements applicable to public agencies. Board packets can be anywhere from 20100 pages for most HOA board meetings, so the cost of distributing them would be prohibitive. Furthermore, the audience doesn’t need the board packet in advance, since the board and not the audience is deliberating. However, documents may be identified during the deliberations that are “Association records” which you can later request to see. – Thanks, Kelly Dear Kelly: Our HOA has not been publishing meeting minutes for many months. have written twice to the management requesting copies and received no reply. This lack of transparency is concerning. What are the requirements for an association to publish their minutes and activities to the members of the association? – Regards, P.R. Dear P.R.: The approved minutes or draft minutes, must be available to members within 30 days of an open board meeting, per Civil Code Section 4950. The statute does not require that minutes or draft minutes be published to all members, but many HOAs post minutes on their web sites for all members to see. If a member requests copies and reimburses the HOA for the cost, minutes or draft minutes must be provided. If they are not provided, a member may file a small claims court claim under Civil Code Section 5235. Court action should only be taken as a very last resort, but the HOA should be reminded of these statutes. – Best regards, Kelly Hi Mr. Richardson: I had requested a copy of the contract between our current attorney representing our HOA. I received an email indicating that I was not entitled to receive a copy of the agreement. Is this correct? Any recommendations in receiving copies of vendor contracts? – Sincerely, R.K. Dear R.K.: While Civil Code Section 5200(a)(4) provides that executed contracts may be inspected by members, there is an exception for privileged contracts. Attorney fee agreements are specifically designated by Business and Professions Code as “confidential” documents. I have not encountered any other form of contract which is designated as “privileged,” so members should be able to review all other executed contracts. – Sincerely, Kelly

In recent years, the ubiquitous home thermostat has evolved a great deal, from traditional dials and needles to electronic screens to models that can predict your HVAC needs. While basic models work well for some, more advanced models offer major benefits in terms of both comfort and energy efficiency. Here’s a rundown of the major types and what you can expect to pay for them.
MECHANICAL NON-PROGRAMMABLE THERMOSTATS
Mechanical thermostats are the lowest costing option, averaging between $15 and $30 to install. These are your old-fashioned style that function entirely by turning a dial left or right to select the temperature. This will be your least expensive option, but it also comes with the fewest features. Although mechanical thermostats are very common, they are being phased out of use because they contain mercury.
NON-PROGRAMMABLE ELECTRONIC THERMOSTATS
Non-programmable electronic thermostats cost around $20 to $50 to install. They need to be adjusted manually and have very few other features beyond those offered by a mechanical thermostat. However, they usually feature a digital display that can make it easier to select a specific temperature, and have become very common in homes in the last few decades.
PROGRAMMABLE ELECTRONIC THERMOSTAT
Until recently, these were the most advanced and expensive option available at a cost of $20 to $150. Features include the ability to set heating and cooling options, and program temperatures according to preset weekday, weekend, and week-long programs. Many of these models can have numerous programs set for days at a time. These components help control homeowners’ HVAC costs. They may illuminate for easy access in the dark. And many of the newest models have touch screens.

SMART THERMOSTATS
Installing a smart thermostat can cost between $200 and $300. They are significantly more expensive than other options, but the additional features can save energy and money. They can be remotely operated by your mobile device or computer no matter how far away from home you’re at. Some highend devices can learn your preferences and automatically adjust the temperature in your home to suit you. “Learning” devices are best suited for homeowners with a consistent schedule, since that learning curve is defined by your everyday habits. Most high-end equipment also “communicates” with the heating and cooling systems they are controlling. Wiring for these systems is more advanced, but the added work comes with extra benefits like troubleshooting assistance and maintenance warnings. Electrical work such as thermostat installation should be left to a professional to prevent injury or damage to your home. While it may cost more money up front, ensuring the job is done right can save you time and money in the long run. Most electricians can install or replace a home, apartment, or business thermostat in two hours or less at a rate of $65 to $85 per hour for a total labor cost of less than $170. Whether you opt for a modern, digital model or a simple, manual one, the installation costs will not differ by a significant amount. Question One owner in our condominium is a troublemaker. He uses profanity and threatens other residents, has removed signs, written on the elevator wall and even broke the lock on the bulletin board. What can we do to live in peace? – Harold

With proper care and maintenance, you can expect your carpet to last up to 10 years or longer.
Many communities have one or two people that seem to make most of the trouble that a community association must deal with. This seems worse in condominiums where people live closer to each other than in single-family home communities. Dealing with a troublesome neighbor can be difficult, and it is even worse for a board member. Board members are volunteers working to benefit their neighbors but often take the brunt of residents’ frustrations about matters outside of the board’s control. Still, you must remember that the troublemaker is also a resident and may have his say at meetings just like everyone else, even if they say things roughly. It is generally not against the law to be obnoxious or offensive. Matters change when unsavory turns into threats and verbal assault. If you ever feel physically threatened, call the police. As with any other issue that may involve the law, take good notes to help law enforcement or your association’s attorney resolve the problem once it crosses the line. While your association can only do so much about objectionable behavior, there are better options for dealing with damage to community property. The board can assess a resident for the cost of repairs for the damage they, or their guests, cause. However, your community will need to weigh the costs of assessing and enforcing these assessments against the money that may be recovered while keeping in mind that weakness invites further aggression. While it can be difficult, you will need to find a middle ground with your neighbor, allowing him his eccentricities while taking action when he crosses the line.

By Megan Linhoff Carpeting offers a number of benefits. Not only is it cozy, quiet and easy to install, but it’s also more affordable than many other flooring options. And high-quality carpeting can last a decade or more with proper care and maintenance. Of course, even the best carpets will eventually need to be replaced. Here are four signs that it’s time to retire the existing carpet in your home: Wear and tear: Irreparable matting, tearing and ripping are telltale signs it’s time to replace your carpet. Polyester carpet fibers are known to matte and lose their form — and once this happens not even professional cleaning can revive them. Nylon carpeting is more resilient than polyester. When there is life left in nylon carpet, it will typically respond well to cleaning. It’s also possible to repair some small rips and tears. Significant damage is difficult to address, however — particularly on stairs and major walkways. Stains: Most carpeting comes with a stain-resistant finish. But over time, this treatment fades and leaves the carpet and pad unprotected. At this point, your carpet becomes more susceptible to deep and stubborn stains — particularly those caused by bleach, wine, mustard and biological substances such as pet urine. Professional carpet cleaners offer heavyduty extraction services to address these stains, though biological substances can absorb into carpet padding and cause mold and mildew buildup. When this happens — or when professional carpet cleaning fails to remove stubborn stains from your carpet — it’s probably time to consider replacing it.
Lingering odors: Odors resulting from pets and other causes such as tobacco smoke should be eliminated or noticeably diminished after a professional cleaning. If odors remain, this could indicate that they have penetrated deep into the carpet fibers, the carpet pad or the subfloor. And, in the case of pet urine and other biological sources, it may even indicate mold and mildew growth. In these cases, it is typically most cost-effective to replace the carpet entirely. Age: After several years, even the highest-quality carpeting will start to show signs of wear. Carpet fibers will start to lose their texture and tuft. Professional cleaning will yield sub-par results. And color loss, fading and rippling will likely begin to occur. You may also notice increased allergy symptoms as older carpets collect and disperse more allergens and particulate matter. Most manufacturers say carpet will last about 10 years with proper care. If your carpet is nearing 10 years or older, you may want to start considering a replacement.

HOW MUCH WILL NEW CARPET COST? The cost to replace your carpet will depend on the square footage of the carpeted area and the kind of carpet you choose. Carpet prices start at roughly $2 per square foot and increase with quality. Mid-grade carpet typically runs from $3 to $4 per square foot, and higher grades cost $5 or more. Experts say you can expect to pay an additional $2.50 to $6 per square foot for new carpet padding and an additional $2 to $6 per square foot for installation.

The floral world was turned upside down in 2020 and thankfully not by COVID challenges but by an idea long in coming to fruition. I’ll call it a Heart to Heart Christmas. Indoor decorating for Christmas 2020 was given a new jolt and that appropriately involves a plant that has long been known as the Heart of Jesus. Proven Winners probably didn’t know what they had created when they debuted the new series of Heart to Heart caladiums. So beautiful,in their design and colors, they have already sparked a fire or revival of this South American tropical. But the challenge and success in creating a floral work of art for Christmas was like everlasting ripples from a tsunami. The Heart to Heart Christmas initiative took Proven Winners, the greenhouse industry, and the artistic vision of some of today’s leading garden influencers. When you look at the varieties of Heart to Heart you see immediately the colors of Christmas, rich vibrant red, shades of pink, luscious green and pristine white. You’ve got to be thinking, Christmas is the dormant or sleep season for caladiums. That is particularly true in the Northern Hemisphere. But just as the industry can force daffodils or hyacinths, or provide artificial dark for poinsettias and Christmas cactus, they can do the same with caladiums. Even as a caladium lover I admit I had some skepticism. Then I watched the videos of Jenny Simpson at Creekside Nursery in Dallas, North Carolina, and Laura LeBoutillier the star of Garden Answer and I was immediately sold. Bountiful containers of Heart to Heart caladiums will allow you to do just about anything you can do with a poinsettia, cactus, cyclamen or rosemary topiary. In December, I wrote about frosting your poinsettia with Diamond Frost euphorbia. That will always be a good idea. But wait until you see how Jenny combined Heart to Heart Snowdrift white caladiums, with green veins and margins, and a red poinsettia; as I like to say this is a “holy wow” combo! Laura at Garden Answer demonstrated their beauty several ways, using them in a festive look in proximity to the Christmas tree and in a celebratory fashion with three colors of caladiums on a table with stacked books, a lamp and a molded crown. Her stand-alone container of Heart to Heart Fast Flash in an Old World style urn literally takes my breath away every time I look at it. It looks priceless and you have no problem imagining it being in a prominent place in the queen’s palace. Then there is a container that shows the power of white used indoors with White Wonder the Proven Winners National Caladium of the Year for 2021. It brightens the room and clearly demonstrates the increased leaf count one gets with a lance or strap-leafed variety. The indoor caladium has the same enemies as all other Christmas plants: heat, low humidity and darkness. Like you have learned to succeed with those and build family traditions, you’ll learn to manage your Christmas Heart to Heart caladiums. East or West facing windows are ideal, but like you, I’ll put some on the mantle and use them throughout the house. I’ll watch the water and like you probably get busy and forget some.
