Stop The Fights Over Records Requests!

Seniors and Their Homes Not by any design or plan our business clientele is at least half seniors and by and large they are the best customers any businessperson could wish for. Santa Barbara is blessed with a vibrant community of seasoned seniors of whom most all seem to be happy with their station in life, are very pleasant to work for, appreciate quality work, and have very flexible schedules if kept updated when we are running early or late. I thought that for this week’s article I would share my observations of home maintenance work that seems to be typical for seniors and offer a few suggestions. Grab Bars: A properly installed grab bar in the shower or bathtub can mean the difference between a slight misstep and a debilitating fall. Grab bars can be purchased at most hardware stores, some drug stores and are typically available off the shelf in white and stainless steel, while colors like nickel or oiled bronze can be special ordered. A typical installation usually has a 36” wide bar along the long side of the tub, a 12” bar along the short side and often an additional 12” bar installed vertically right outside the tub or shower. Grab bars can be easily mounted on ceramic tile or natural stone and with a little more work onto an acrylic or fiberglass tub or shower unit. An experienced installer will know to use the right drill bits and will avoid any cracks or chips to your tiles. Handrails: Handrails for outside steps or walkways can be an attractive accent to your yard while at the same time providing a safe handhold when going out for exercise or making a trip to the mailbox. A new handrail can be fastened to walls, bolted down to concrete steps with expanding concrete anchor bolts, or supported by posts in the ground set in cement. Simple and affordable handrails are often fabricated from ornamental iron or redwood and many homes have custom wrought iron work which is beautiful but usually pricey. With a little design and instal-

lation knowledge an attractive and safe handrail can be installed at just about any location around the house. Access Ramps: Even the smallest step or incline can be a challenging barrier for someone relying on a walker or wheelchair for mobility and a well thought out ramp can be the answer. For safe access, the slope of a ramp should not exceed 1” of rise per foot of length, needs to be a minimum of 36” wide, and ramps spanning more than a step or two should have a sturdy handrail. At a safe slope of 1” per foot it can often be surprising how long the ramp needs to be to go up over just a few steps but often a landing and a midway change of direction can be the solution. Sometimes a large oak threshold at the front door can be hard to negotiate with a walker, and the solution may be replacing the oak threshold with an aluminum threshold with a much lower profile. Motion Sensor Lights: Most homes have a porch light at the front door or wall mounted light for the driveway area to provide illumination for those approaching the home at night. A motion sensor light fixture can be installed at these spots that turn on automatically when a visitor approaches or a car pulls into the driveway. They come with easy adjustments for sensitivity to turn on for a person and not every raccoon or possum that forages by, and for the length of time the light stays on allowing for enough time to get from the car to the front door. Basic fixtures can be bought at the hardware store but more decorative fixtures that match the style of your home can be found at a lighting shop or online.

Over the many years I have been writing this column, the clear number one ranked dispute between homeowners and their associations regards records and information access. These disputes are never productive, and generally avoidable. Here are some tips for HOAs regarding producing requested records and some tips for requesting homeowners. The law has improved dramatically in recent years in this regard. Civil Code 5200 provides a very clear list of what are “association records” which members may request. However, battles continue, and unfortunately HOAs sometimes control the flow of information from critics, and some homeowners use records demands as a weapon. When a board is under severe criticism it is a natural impulse to be defensive and close ranks, but the board cannot refuse a legitimate document request just because it expects the information to be used against it. The more a board stalls or resists providing reasonably requested documents, the higher the suspicion of the requestor that the board “has something to hide.” In my experience, that is almost never the case — but ego and pride is usually the problem. The increasingly common use of HOA web sites presents a great opportunity to provide required transparency with little expense. If the association instituted a habit of making sure that all “association records” for the current year and previous 2 years (the time limit of the statute) are routinely posted on the members only section of the web site, members could access anything they had a right to see without inconveniencing the manager or board. What do members NOT have the right to inspect? Correspondence, member disciplinary matters, pending bids or draft contracts, and member delinquency infor-

mation are examples of items which are not “association records” subject to inspection. Homeowners, here is what NOT to do when requesting records. Don’t ask for more than the current year and the two prior years. You probably don’t really want to see decades of records anyway. Don’t just parrot the categories of Civil Code Section 5200 — do you seek a specific contract or paid bill? Make a real request, and you’re more likely to receive a real response. Don’t demand management investigate a topic for you. The statute allows inspection of existing documents and does not compel the creation of a document. These very specific requests which are trying to force the manager to study something for them. Don’t punish the HOA with repeated huge document demands. Even though the management cannot pass along to the requestor all its costs in responding, the HOA is still likely incurring extra management expense. Show some grace regarding the deadlines. The person responding to your document request is either a volunteer in the self-managed association or is a frequently overloaded manager. Keep it professional and neighborly. Civil Code Section 5235 allows lawsuits to be filed against the HOA in small claims court. If your first focus is on a fight, and you are anxious to take your neighbors to court, you may be a destructive influence in your HOA. Boards must remember the members are not merely stockholders but are neighbors, and members must remember that the board consists of neighbors. This should never be a point of conflict. Work together — neither of you are the enemy.

Staining Interior Wood By Steve Ozab

It never fails! Even when decorative molding is stained with the exact same stain used on your cabinets, the color doesn’t match. You stain your baseboards to match your floor. Same thing. No match. Different woods sometimes stain darker or lighter. In fact, the exact same species of wood may stain lighter or darker. So, what’s the solution? How do you make dissimilar stain colors match? If your stain is drying too dark or appears uneven and blotchy, here are a few suggestions to make the color lighter and more uniform. •

Sand the wood smoother with 320 or 400 grit sandpaper. Rough wood absorbs more stain.

Wipe on—don’t brush--the stain briskly with a cotton t-shirt or flannel fabric.

Choose the right variety of stain. (Lightest to darkest) Gel, wiping, and pigmented/dye.

Apply a pre-stain sealer or stain-controller prior to staining.

Add increasingly greater amounts of pre-stain sealer directly to the stain to dilute the opacity.

Apply a coat of sanding sealer prior to the stain.

Bleach the wood to a lighter color, then stain.

Apply a base coat of paint and proceed with a “wood graining” procedure. This requires extra steps and tools.

Consider painting instead.

Stain too light? Here are a few suggestions to make your stain darker: •

Hold up a piece of your wood to a light source. If the bare wood has a bit of sheen, that’s mill glaze and it will not allow stain to penetrate. Break the glaze by sanding with 180 or 120 grit.

Brush on the stain and allow it to penetrate for several minutes (oil-based stains can sit longer than latex stains).

Wipe off excess stain gently in the direction of the grain, allowing more of the stain to remain on the surface.

Choose a “color rich” stain. Some brands offer a short line of intense deeper colors.

Choose the right variety of stain. (Darkest to lightest) Pigmented/Dye, wiping, gel.

Choose a latex stain. They dry faster and extra coats may be applied to make the color darker. Extra coats of oil-based stains do not work as successfully and require days of dry time.

Apply a shaded top coat to deepen the color. This is an absolute necessity when trying to match factory finishes which may have been top-coated with multiple coats of a pigmented lacquer. Stains may not be enough.

Always test these methods on a scrap piece of wood or on an inconspicuous area before proceeding.

lights one year on a two-story house with a slate roof despite being in his late 70’s at the time with macular degeneration. We continually take calls from ladies calling to get our help with a project before their senior husbands’ dust off the ladders and take on the job themselves. Setting up a ladder and working on it for even a smaller job takes a certain level of core body strength that most people just don’t have after they qualify for Medicare, and it really is best just to hire someone or put it off until you can get the help of a younger person. Hire Local: Santa Barbara has a thriving community of trade’s people and most every type of contractor you will ever need for work on your home. I recently was contacted by a senior client who had a new furnace installed by a Chatsworth based contractor who was running an ad in a local coupon magazine, the work was not done to code, wasn’t finished properly and damage had been done to her beautiful upper eastside home. After just a simple Google search for this firm’s business name dozens of complaints popped up along with the first F rating I’ve ever seen given by the Better Business Bureau. Like all small businesses, contractors live and die on their reputation and there is a long list of local HVAC contractors who would have done this job correctly without a hassle probably for a lower price. Ask friends and neighbors for referrals of contractors that they have used and resolving a prob-

VILL AGE PROPERTIES lem with a local contractor is much easier than trying to work things out with a smooth talker from out of town. License & Insurance: Unless he is a friend, relative or neighbor it’s just not a good idea to have anyone working on your property that doesn’t have a contractor’s license and insurance. Things do go wrong sometimes, workers do get hurt, pipes do get broken on accident and trucks do get backed into walls and gates. Any trades person that is serious about their business will have a license and insurance and will provide proof of both on request without any fuss. A contractor who shows any reluctance to provide proof of license or insurance is best avoided. Payment: It’s my observation that most contractors will not ask for a deposit for a job of less than $5000 or so unless there are custom ordered materials involved and California state law limits a deposit to 10% or $1000 whichever is less. I ask our clients to “pay upon completion and satisfaction of owner” and I would be wary of a contractor who insists on a deposit for smaller jobs. For larger jobs it is best to pay on a percentage of completion basis, but the final payment should be held on any job until the homeowner has a chance to make sure all the loose ends are tied up, no construction debris has been left onsite, everything is working as it should and you are completely happy with the work.

Your January Gardening Chores

By Jessica Damiano It’s January — a new month, a new year, and a time for new beginnings. Synonymous with resolutions to do better, January is rife with hope, as is the garden, even when it’s dormant and bleak. I suppose that, too, parallels life, as even when we’re at our lowest, there is hope for a new and better tomorrow. So this month, while we’re resolving to diet or quit smoking or simply be better people, let’s acknowledge that our human condition holds all the promise of an unplanted seed or a dormant rose bush. Happy New Year, everyone, with best wishes for a bountiful and beautiful harvest — in the garden and out. • Today is a day for fresh starts. • Mist houseplants every other day with roomtemperature water, or run a humidifier.

• Here’s a project for you: Soak seeds (alfalfa, barley, flax, etc.) in a cheesecloth-covered jar of water overnight. Strain, then rinse two to three times daily until sprouted. Add to salads and sandwiches.

• Inspect indoor plants for pests, taking care to check under leaves, where many prefer to live.

• Restock bird feeders and be sure to provide clean water. • Deadhead African violets and other flowering houseplants. • Keep houseplants away from heat sources, and rotate pots a quarter-turn daily to ensure even sunlight exposure.

• Inventory seeds and supplies, making note of what you’ll need to replenish for spring.

• Check tree branches for gypsy moth egg cases — gray blobs that resemble used chewing gum. If found, remove, destroy and discard in the trash.

• Gardening catalogs should be trickling in. Place plant and seed orders soon, lest they run out of popular items. They’ll typically be shipped when the time is right.

• If you’ve rooted cuttings in the fall and they’re growing leggy, pinch them back a bit and change the water.

• Time to take down the Christmas tree. Recycle branches for mulch over garden beds. In spring, add to compost or chip into mulch.

• Dust houseplant leaves so lenticels (tiny pores that allow gasses to reach plant tissue) can do their job.

• Prune broken tree and shrub branches so they don’t rip off in windy conditions and damage property or injure people. • If you neglected to store clay pots indoors and they’ve cracked, don’t discard them. Break them up and use them to aid soil drainage in spring. • If ornamental grasses look unkempt, cut them back. Waiting until March is fine, too. • Replenish deer and rodent repellents. • Easily eradicate mealy bugs from houseplants by touching them with an alcohol-soaked cotton swab. • Repot indoor plants, but don’t fertilize until next month. • When blooms are faded, deadhead forced amaryllis, but discard paperwhites.
