Dear Kelly: My association has taken the stand that a side fence on a zero lot line single family dwelling that is entirely on the dwelling’s property is shared 50/50 with the neighbor for maintenance or replacement costs. In my opinion, this is totally incorrect that a neighboring property owner would be responsible for a fence that is entirely on a neighbor’s property. Have you ever seen this with other zero lot line HOAs? Thanks, R.M. Dear R.M.: For the readers’ benefit, let me explain “zero lot line.” This normally means the buildings are built onto at least one of the property boundaries. There are two major items which can affect the responsibility for a shared fence. I am assuming that your HOA is a planned development and that the fences between neighboring yards are not located in common area. The CC&Rs might address responsibility for shared fences, or otherwise the board may want to consider proposing an amendment to clarify that subject. There is also Civil Code Section 841, California’s “Good Neighbor Fence Act of 2013” which took effect in 2014. Under that law, fences dividing adjacent properties are the shared responsibility of the two neighbors. Hoping this is helpful, Kelly Dear Mr. Richardson: I have a question regarding property ownership. Our condominium complex consists of free-standing houses each with a yard or patio yard. Our condominium plan has a map with boundaries that include the unit with the front yards/patios along with a description that a unit consists of the dwelling, garage and private yard areas encompassed by the unit boundary line

shown on the plan. This might conflict with other language in the CCR’s. This is coming up regarding a project in which one owner is of the opinion that based on the tract map the yard is his own private yard area and he owns it. It is my opinion that this is a condominium and that he doesn’t own the land but is exclusive use common area with input on the project by the HOA. Thank you for any direction you can provide. R.A. Dear R.A.: The condominium you describe is exactly like a planned development except for being called a condominium. This style of HOA is an increasingly common way for developers to avoid the various zoning requirements which otherwise would apply to a planned development projects and lots. So, for example, lot sizes and setbacks can be smaller. I refer to those as “lot line condominiums,” since the boundary of the unit as defined in the condominium plan is exactly the same as a normal planned development lot, with property lines — except it is called a “unit.” Your HOA should consult an experienced real estate or HOA attorney to confirm exactly what is “unit” and what is “common area,” in order to prevent future confusion and disputes. Your experience illustrates the importance of that often-overlooked document, the condominium plan. Its map and “notes and definitions” section are often very important in clarifying the property rights which are separately owned (“unit”) and shared (“common area”). The condominium plan is filed with your county Registrar-Recorder and so is public and easily retrievable through your HOA legal counsel or a title company. Sincerely, Kelly

Making Sense of the Eviction Moratoriums It can be confusing for renters and property owners alike when it comes to understanding and following the eviction moratoriums in place due to the COVID-19 pandemic. On Friday, Governor Newsom signed SB 91, a new bill that will use $2.6 billion in federal funds to help pay Californians’ rent. The current eviction moratorium was due to expire at the end of January and did not do enough to help property owners still struggling with trying to collect current and past due rents. The new bill, passed with bipartisan support, aims to help that situation. Under the previous eviction moratorium legislation, known as AB 3088, tenants had until January 31, 2021 to pay 25% of all back rent due since September 1, 2020. If they did not they would be subject to eviction. What SB 91 does is to extend those protections to June 30, 2021. The major difference is that the bill will use federal funds to pay property owners up to 80% of all back rent unpaid, going back to April 1, 2020. The program will cover property owners through the end of March 2021. In order to be eligible to receive the 80% funds a property owner will have to forgive the remaining 20% of all back rent due up through that same period. There are rules and stipulations for this program including income eligibility limits, noticing requirements and waiting periods. However, this is offering something new and that is coverage for property owners. Too many of the property owners in California are “mom and pop” operators who live off of this income. Additionally, these property owners were not getting relief from lenders or the counties when it comes to loans or property taxes. It is still not clear how quickly property owners will be able to take advantage of this or how many this will help but it is a start. On the commercial side of things, the Governor signed an order in September of 2020 that allowed local jurisdictions to extend their commercial eviction moratoriums through March of 2021. Recently, the County of Santa Barbara extended their commercial eviction moratorium through the end of March. This affects commercial properties in the unincorporated areas of Santa Barbara County. Businesses within the cities of Santa Barbara and Goleta also extended their commercial eviction moratoria through the end of March. For more information on other locations, it is advised that property owners and tenants consult their city’s website or offices. At the end of the day, the best advice that I can give is to talk to your tenant or your property owner. The laws can be difficult to understand and it is easy to get something wrong or give the wrong notice. Be prepared to show how COVID-19 has affected your ability to pay whether through the loss of work or by other means. By keeping the lines of communication open, you can come to an agreement that works best for all sides.

Beware: Assembly Required Question: My husband and I are finally empty nesters and we are converting one of our children’s old bedrooms into our new office. We ordered two large executive style desks with hutches, a credenza and two bookcases from an online home office business. The website said that assembly is required but we were shocked when we saw how many parts and pieces were packed in each box. How much time will it take to put together our new office furniture? Your Handyman: There can be quite a surprise in store for the typical homeowner when they open up the skinny flat boxes that holds their new desk, bookcase or nightstand and see all the parts and fasteners and an instruction manual with as many pages as Time Magazine. It wasn’t too long ago that there was a thriving wood furniture industry in Southern California but in the 1980’s most all of the industry moved across the border into Mexico due to the expense of complying with air pollution laws affecting dust, staining and painting. Then in the late 1990’s the high-tech low wage factories of China started to dominate world furniture production and freight costs were prohibitively high to allow for the shipment of furniture that wasn’t completely unassembled. So, the good news is that the price of most furniture, especially office furniture, has really dropped over the past 10-15 years, but the bad news is: ASSEMBLY REQUIRED. It is not uncommon for an experienced assembler using power tools to take 3-4 hours to assemble a large executive desk with drawers on both sides and an additional 2-3 hours to assembly the hutch that sits on top of the desk. This same desk and hutch may take a typical home-

owner an entire weekend or more to assemble. The furniture feature that requires the most assembly time is drawers, which require not only assembly of the drawer itself but also the cabinet and drawer suspension hardware that support it. So, with all that being said, if you or your husband are not particularly mechanically inclined, you may want to hire a professional to assemble your new office furniture. If you do decide to take it on this job, my suggestion is to first inventory all the parts to make sure you have everything prior to starting, separate out all the fasteners into individual piles, and have a large, carpeted area to work on. The most important piece of advice is to read and follow the instructions carefully with patience. Do not even consider shortcuts or taking off on your own without diligently following the instruction manual. What you do not want to have happen is to find yourself having problems at step 58 only to then realize that you made a mistake at step 32.

Question: I am concerned that we may have a leak in our bathtub. The drywall at the bottom corner of the tub is all flaky and the paint is bubbled. Some of the grout in the tub enclosure is cracked and maybe this is where the water is leaking from? Your Handyman: What you are describing is quite common and is usually caused by water either spraying out from the shower when the door is opened or from someone regularly stepping out of the tub while still soaking wet. The first step in diagnosing the cause of your drywall damage is to turn the shower on, let

My suspicion is that it will remain dry but if it doesn’t then it may be time for a new shower door if the door unit shows signs of water damage, rust, or build up of minerals and soap residue. Flaking or cracked grout will not allow water to leak into the wall because if the tile was installed correctly there will be a moisture barrier behind the concrete backing surface. The solution to your wall damage is to not have the shower door open while the water is running and to encourage your family members to towel off completely while still standing inside the shower. Once the drywall is dried out completely it can be repaired and painted and should no longer be a problem.

Question: For some unknown reason, our dishwasher has recently started to rock forward when we open and close the door and it seems to be getting worse. Other than rocking it is working simply fine. Do we need a new dishwasher or can this one be fixed? Your Handyman: The front top of a dishwasher has two small metal tabs with holes that need to be screwed to the underside of the countertop in order to secure the unit from rocking when the door is opened and closed. It sounds like your dishwasher has either come loose at these tabs or possibly was not installed correctly. If the screws are loose then they simply needed to be tightened and if they are missing you will need to find new screws that are of the proper length to complete the attachment. Screws that are too long may go all the way through the wood and possibly damage the countertop material. If there is no wood to screw into on the bottom of your countertop, then you will need to use a construction adhesive like Liquid Nails to fasten a small piece of wood in place in order to make the attachment. As part of this job, you should also check to make sure that the dishwasher is level both from side to side and front to back using a carpenter’s level. The front legs are usually adjustable in height by turning them with a wrench and shims can be placed under the back corners as needed when leveling. Once the unit is level and correctly fastened in place, your dishwasher will operate at it most efficient and quietest level.

If you are still living in your home at 75 years of age, my guess is you have a garage problem. Garages are used differently at different times in our life. In some ways they reflect our lifestyle. We store bikes, surf boards, kids athletic gear and clothes in middle age. But when we reach 75 years old, many of those items no longer fit with where we are in our lives.

February Garden Calendar A chore for every day of the month By Jessica Damiano

Happy Hump Month! That’s a designation I made up to celebrate the halfway mark of this gloomy season. Specifically, the exact timing of the midpoint between the winter solstice and the spring equinox falls on Feb. 2, Groundhog Day. Here are some tips and chores to keep you distracted in February, regardless of what the little rodent predicts. It’s all downhill (toward tulips!) from here.

1. Wipe foliage of large-leaved houseplants to help them photosynthesize properly.

Check on stored tubers and bulbs, and mist if they are beginning to shrivel. Discard any that have rotted. 10. Search for woolly adelgid egg sacs among hemlock branches (they look like cotton swab tips). Remove, destroy, discard. 11. Inspect tree wrappings and adjust, if necessary, to ensure protection from hungry critters. 12. To avoid winter leaf-drop, water houseplants only with roomtemperature water. 13. Clean and refill bird feeders, and don’t forget the water.

22. Prune grapevines to four or fewer fruiting canes, leaving just seven to 10 buds on each. 23. Hold off on pruning spring-bloomers like lilac, crabapple and forsythia until their flowers have faded. 24. Start slow-germinating herbs like lavender and thyme indoors. 25. Start pruning all deciduous trees except maple, beech, dogwood, elm and sycamore. These “bleeders” should be in full leaf before they’re trimmed. 26. Start seeds of beets, broccoli, Brussels sprouts, cabbage, cauliflower and celery indoors. 27. Don’t remove winter mulch from beds yet — March can come in like a lion.
