Clear Cooperation Leads to a Fair Playing Field Last year, the National Association of Realtors implemented a new policy across the country called Clear Cooperation. The policy states that within one business day of marketing a residential listing to the public, brokers must submit the listing to the MLS for cooperation with other members. Most people when they learned of this policy would ask, “Weren’t they already doing this?” and “What’s the big deal?” To understand why it is a big deal we really start with understanding the first question of was this done previously. As it turns out “pocket listings” or listings that are selectively marketed were becoming very popular across the country. The use of these pocket listings had the effect of excluding consumers and undermined the commitment that Realtors make to providing equal opportunity access to housing. Numerous studies out there show that different demographic groups have different experiences in the housing market and the National Association of Realtors is committed to working to reduce inequalities in housing thus this new policy. It is important to understand why Clear Cooperation is a benefit to both consumers and to our profession. Clear Cooperation protects the consumer. By marketing a property on the MLS, it exposes the property to the largest group of potential buyers making sure that a seller can achieve the best outcome for their property. It also adds transparency to the home buying process. If it is out there being marketed to everyone then there will not be any questions from a client to an agent about why that agent did not tell their client about the listing. Sellers become better informed about the exposure of their property to the market and buyers have fair and equal opportunity to purchase. Concerning our profession, transparency is key. We are trusted advisors for a reason. We earn the trust of our clients and that means keeping their best interests in mind. Additionally, we owe that same level of professionalism to our fellow agents. That means making sure that one segment of the public does not have more information than other consumers have. It also means that we agree to follow the rules that we have set up for ourselves. By allowing these “pocket listings” it creates a shadow, secondary market that can be controlled by a smaller group of agents who may or may not allow other agents or customers access to. This creates inequality in the housing market and consumer distrust about our profession. At the end of the day, we have to decide what kind of profession we want to be. One that earns the trust of the public through a transparent transaction process or one that fosters different levels of access and information for different groups. I am proud of my fellow Realtors for having adopted this policy and for their commitment to equality in housing.

The 2021-2022 legislative session is underway and by mid-January the Legislature does not have any HOA bills pending. The past two years were eventful due to 2019’s Senate Bill 323’s substantial changes to the election processes, and 2020’s Assembly Bill 3182’s new protections of rentals within HOAs. In case a Legislator or their staff is reading, (or you want to suggest some improvements) here are ideas to HELP California HOAs. First, resolve the questions remaining about HOA elections. The new law lists only 5 possible board candidacy disqualifications, so, for example, term limits are apparently barred. Second, the statute references only board candidacy, so can boards fill vacant seats by appointing a person who would be ineligible as a candidate for election to that seat? Third, new Civil Code Section 5100(g) allows board elections by acclamation if the number of eligible candidates after close of nominations equals the number of open positions. However, this opportunity only applies to HOAs with 6,000 or more members — perhaps ten HOAs statewide. This help should be available to all California’s 50,000 HOAs, so they can forego the expense and effort of sending out ballots if there are not enough candidates for a competitive election. Small HOAs struggle with the election requirements and deadlines. It is ludicrous to require 10-unit HOAs to have Inspectors of Election, secret ballots, and a 90-day election process. A simpler process should be allowed for HOAs under a certain size. Some law changes could help HOAs keep up with an increasingly digital society. For example, allow HOAs to choose electronic membership voting. HOAs are still the only type of corporate entity specifically not allowed to vote electronically. Many nonprofits such as unions, trade associations and other
corporations already vote electronically, but Civil Code 5115(c) requires that paper ballots and envelopes be sent to all members. HOAs are still in the 1980’s in this regard, until the law finally catches up. Another helpful advancement would be to change Civil Code 4055 so that HOAs can send notices to members electronically, unless members opt out and choose paper notices, so that electronic is the default notification method. Members currently must opt-in for electronic, and most are unaware. Small HOAs are typically managed by volunteer homeowners without attorneys or professional managers. Those associations are choking on the ever-increasing complexities of the Davis-Stirling Act and desperately need help. The Commercial and Industrial CID Act (Civil Code 61006876) is a lighter version of the DavisStirling Act. Why not have a “smaller CID” act applicable to HOAs of 25 homes or smaller? Many HOAs struggle to attain quorum for board elections, and their governing documents do not provide for reduced quorum meetings. A new subpart “h” could be added to Civil Code 5115 so that the members, after failing to meet quorum, could proceed on a reduced quorum of 25%, to enable more elections. New Fair Housing Regulation 2 CCR §12176(b) requires that HOAs keep confidential anything about a disabled person’s request for accommodation. Therefore, such board discussions must be in closed session. Since Civil Code 4935, (listing the permissible closed session topics) does not include this subject it should be added to the list so boards can comply with Fair Housing confidentiality requirements. Is it time to plant Roses? By Colleen Swiatek
A
re you a gardener? Do you have a green thumb?
I am curious because I admire the rose in so many ways. Not only are they beautiful I’m told that rose water soothes skin irritation, sore throats, enhances mood and even relieves headaches. It said somewhere, as I perused the internet, that daily consumption can be up to 2 cups. On a Vitamin C bottle I even saw that rose hips were part of the ingredients. Are you hooked yet? Well there’s more! The rose bush comes in an array of colors and shapes. Their petals can be used in an assortment of ways. Being an admirer of Roses I notice things. For instance, there are recipes for soap, bath oils, bath salts, facial masks, potpourri, and candles. And I bet there is someone out there reading this who can tell me of other uses. The romantic cannot say, now, that they have no idea what to give the person they admire or love. What do roses say? Red: romance, love, beauty, & perfection Dark Red: represents humility Orange: passion Peach: gratitude

ccording to Juanita Collins, aka The Bee Lady of Montecito, the bees in our leafy, lush village are about to leave their hives and go on a feeding frenzy, followed by mating madness the likes of which hasn’t been seen in a decade — a pheromone phenomenon. The pert 67 year-old red head (whose other sobriquet is Bee Professor). Collins teaches on-line “Beginning” and “Intermediate Beekeeping” for the Santa Barbara Beekeeping Guild. She explains that what will cause Montecito’s worker bees to feast and queen bees to engage in sex sprees is torrential rain. “The exceptional Spring blooming-to-come was kick started by a day’s heavy rain in late December.” Montecito’s bees have been clustered (hunkered down in bee talk) for a month, feeding on honey, awaiting an apiarian valentine. “The bees are also beginning to think ahead and evaluating whether their queen is strong enough to make it through the summer. If they decide she isn’t or, if they are feeling too crowded, they will decide to replace their queen. If they decide to replace their queen, nurse bees will begin to feed a few of the eggs royal jelly. The result of a pure royal jelly diet is the birth of a virgin queen. If the female worker bees decide to swarm and keep the old queen, they will put her on a diet so when she leaves the hive with half the bee population, she is svelt enough to fly. “When a new queen bee is born, she needs to stay safe inside the hive while her chitin (bee bones) harden for 2-3 days. During this time all she does is eat. After a week or so, she will take short trips outside the hive in order to orient herself so she can return to her hive after her mating flights. “When the queen finally leaves her hive, she heads out to find drones (male bees) who are A jar of JC’s Bees! honey not from her hive. She emits an alluring pheromone that causes the drones to follow her and mate with her while both are flying. Once the drone successfully mates with the queen, his mating organs are ripped out and left inside the queen, and he dies. These mating organs are removed by the worker bees once the queen returns to the hive. The queen may make several mating flights within a few days. She may mate with as many as 30 drones or as few as 5 or 6. You could say there’s a Bee Too Movement alive and well in Montecito,” says Juanita. Eight years ago Juanita enrolled in a beginner beekeeping course with the Santa Barbara Beekeeper’s Association and took the on-line “Apprentice” and “Journeyman Beekeeping” classes with the University of Montana. “It was a challenge; there is so
much to know about bees. There are more than 2,000 different bee species. They are so intelligent. Edible honey was discovered in Egypt’s pyramids and is the only known food that can be preserved forever. Its antibiotic qualities, have been used for healing wounds and really helps with allergies. When my husband Evan and I moved here twenty five years ago from Phoenix, Evan had terrible allergies. I’d read that honey could be an effective treatment. He puts a tablespoon in his breakfast oatmeal and in his tea as well. He’s been free of allergies for years. Before my trainer comes to the house, I take a tablespoon of honey and I’m all set to go. Last year, I harvested 200 pounds of honey; this year I’ll double that,” says the busy Bee Lady. Juanita’s initial hive has now expanded to 12. Next month she is going to have to split at least half her hives as her bee garden, overlooking the Pacific, can’t sustain more hives. A hive has around 60,000 bees. One thousand are drones and the rest are females. She’s heard via the grapevine (bees love budding grapes) that some of Montecito’s residents have been buying rescue dogs during the Covid-19 lock down for company. She wants the word to get out that honey bees are also great additions to family life.” Lots of teachable moments with bees”, adds the grandmother of four young children. The Duke and Duchess of Sussex’s recently acquired, in Montecito, a 12-acre estate that once supplied much of the fruits and vegetables to the village. Juanita wonders if the couple, along with neighbors, Oprah (who has 50 acres) and Natalie Portman (who has 10 acres), could add honey and royal jelly to their recently formed oat milk company. “They could call it ‘Royal Jelly’. With so many fertile acres they could have enough bees to harvest a lot of honey and royal jelly, which is harder to harvest than honey and goes for $30 for 2 oz”. Juanita sells her honey for $15 for 400 mls. She would be happy to sell a few hives at $200 each, including a queen, to these local entrepreneurs or anyone to get them started in a fun and fruitful past time. Filling your home and rooms with rich and indulgent touches doesn’t have to cost a fortune and can even be family-friendly, Dallas stylemakers say. The trick? Finding small ways to introduce wow-worthy details and choosing forgiving materials and fabrics. Accessible, posh living that makes you feel like a million bucks: Isn’t that a rich idea? FUNCTIONAL AND FABULOUS Emily Sheehan Hewett has made it her mission to showcase just how stylish and sophisticated it can look when you mix form with function. “Our entire brand is based on livable luxury,” the principal designer at A Well Dressed Home says. When designing for families, Hewett

keeps in mind that life gets messy. Washable, workhorse fabrics are key to keeping a living room clean and fresh. An ivory sofa isn’t off-limits when it’s covered in a nearly indestructible fabric, she says. And an ottoman used as both a foot rest and coffee table stays safe from spills and stains in a family-friendly velvet. Make sure pillows have removable covers so they can easily be thrown in the wash or dry cleaned, says Hewett, the mother of school-age twins. INDULGE YOUR SENSES Sure, luxury looks good, but it’s more than that. “When done right, luxury hits you on every level,” says Tara Lenney. Go beyond making a space just look pretty and aim to incorporate texture, scent, sound and taste. “Cuddling up with a cozy faux-fur throw, burning an amazing candle that you’d normally reserve for company, and drinking a cocktail from a special glass
turns an everyday Netflix marathon into a luxurious experience,” the Richardson designer says. LITTLE BY LITTLE Dallas designer Abbe Fenimore knows well how little moments and touches can add up to a big impact. “Having those little things front and center in your home can create a happy haven,” she says. Try a funky table lamp for a desk or a fabulous tray to keep accessories organized on your desk or a side table. “They will instantly lighten up the mood as you work through a stressful day,” Fenimore says. And don’t forget the fresh flowers. “Splurge on a beautiful bouquet and arrange them in a glitzy vase for an instant bit of luxury,” says Fenimore.
