Kelly: Do you have any information regarding the expiration of CC&Rs? I’ve heard 20 years from the time of the recorded filing of the CC&Rs. My subdivision development of homes has no common areas but does have an HOA. The CC&Rs don’t show up in the San Mateo county recorder system. I need to confirm whether the HOA should have renewed and recorded the revitalization of the CC&Rs as they are over 30 years old. Any information would be appreciated. O.M. Dear O.M.: Unless the CC&Rs were recorded on the property they do not automatically bind all owners, so some title research help may be needed. The recording information on CC&Rs should be reflected on title insurance policies as a coverage exception, so you may find information that way. In past decades, developers filed CC&Rs with expiration dates. However, CC&Rs in recent years normally do not have expiration dates, or included automatic renewal. Associations with expired CC&Rs do not fall under the Davis-Stirling Act, because Civil Code Section 4200(a) requires, among other things, a recorded declaration for the Act to apply. This can be a calamity for larger communities, since reinstating the CC&Rs requires the consent of all members and mortgage holders. Research is needed to determine if the CC&Rs were ever recorded (filed with the County Registrar-Recorder). If the CC&Rs have not expired, take the necessary steps to amend the document and delete the expiration date. If the document has expired, legal help will be needed to explore the available options. All HOAs, and particularly HOAs older than 30 years, should note whether their CC&Rs ever expire. Sincerely, Kelly
Hi, Mr. Richardson: I am on the board of a small HOA. I am new to this so I truly appreciate and learn so much from your column. We are having a slight existential crisis because our Articles of Incorporation state our HOA name but the CC&Rs do not mention the name at all. So, our board is confused if the HOA only exists to care for the common area or if we are to uphold the CC&Rs even though we have no document linking the two. I assume that the two are linked but some of my colleagues need more explicit proof. N.P. Dear N.P.: When creating new HOAs, developers file Articles of Incorporation with the State separately from filing the CC&Rs with the county Registrar-Recorder. The Articles document the creation of a new legal entity, a corporation, to be the HOA. An attorney should review your HOA documents. The CC&Rs contain a legal description of the property contained in the association project and apply to all properties contained in that description. Also, a lawyer or paralegal can retrieve your association’s subdivision map or condominium plan (a public document filed with the Registrar-Recorder) to confirm which lots are within the subdivision and then which lots are owned by the HOA. Hopefully the ownership of common lots will reflect the HOA name as listed in the Articles of Incorporation. Since your HOA is small, it should be easier to amend the CC&Rs to identify the name of the association. That requires a vote of all your members, which is usually easier in smaller associations. Maybe hundreds of millions of dollars are spent each year by Insurance companies and homeowners repairing damage caused from leaking water lines and appliances. Your home can be protected from water damage to a great extent by some basic plumbing safeguards and a little routine maintenance. Every home should have a plumbing shut off valve that can be easily used in an emergency to shut off the interior water supply for the home. Ideally the shut off valve should be a single ball style valve that shuts off the interior water supply and also an additional ball valve that shuts off the exterior or irrigation water supply. A ball valve is a simple plumbing valve that is easily operated and is opened and closed by a quick 90 degree rotation. The older style gate valves have a round handle that raises and lowers a gate of sorts in a vertical track, but this type of valve is quickly fouled by mineral build up and won’t shut completely. Plumbing shut off valves are usually found near the front entry of a home and often are located along with a hose bid that supplies water for a garden hose. It’s a good habit to shut off your interior water supply when out of town or especially if you have a vacation or second home that is vacant for extended periods. I shut off the interior water supply to my house when we leave for just the weekend after experiencing a flooded kitchen from a leaking ice maker line after just going out for dinner. We occasionally work at homes that don’t have a shut off valve and then the only way to turn off the water is at the meter valve which is not designed for frequent use and is frowned upon by the water company. Repeatedly turning water off
and on at the meter may eventually damage the meter which may get you a nasty note and a big bill from the water company. If you don’t have water shut off valves that can easily be operated in an emergency you should put it on your home improvement list to get done sooner rather than later after a water leak episode. High water pressure can often be the cause of frequent leaks and every home should have a pressure regulator installed in the main water line that controls the pressure in your water lines, appliances, and sprinklers. The interior water pressure of a home should be between 55 & 60 PSI (pounds per square inch) and a water pressure gauge can be purchased at most any hardware or plumbing store for about $10 for an easy pressure check. The water pressure valve threads onto either your hose bid (the valve for your garden hose) on the outside of your home or onto the water supply valves for your clothes washer. Water pressure should be checked periodically and if your pressure exceeds 65-75 PSI then your home is at an increased risk for a leak. We received a call a few years back from a retired gentleman who had dealt with frequent water leaks in his sprinkler system over 20+ years he lived in this particular house and he had called us to repair the most recent leak. When we checked the pressure on his front yard hose bib it pegged our gauge at 110 PSI and the interior pressure in the home was just as high. His leak problem was solved by the installation of a pressure regulator on the main line of the house and he no longer needed to worry about leaking sprinkler lines and huge water bills. Water leaks inside the home often occur in the flexible water supply lines that supply hot and cold water to sinks, toilets, dishwashers, clothes washers and ice makers. These are the hose like water lines you see in the cabinets under your sinks and hanging down the wall behind your clothes washer. Over time these lines can become brittle with age or can be damaged by mice or rats and even the smallest leak gone unnoticed can quickly create a flood damaging expensive flooring, base trim, walls and downstairs ceilings. It’s not uncommon for us to go on a service call to replace a sink or toilet in a 40 - 50 year old home and to find what appear to be the original water supply lines still in use. Always install new flexible water supply lines made from braided stainless steel when putting in a new faucet or sink, and it’s really a smart investment to replace any flexible supply lines in your home that are much older than 15 years. In just about all cases a new hose will cost less than $10 and it’s a cost effective way to protect your home. Most refrigerators have an ice maker or chilled water dispenser that is usually connected to a reverse osmosis water filter under the kitchen sink via a small water line that can be concealed in the kitchen cabinets, attic or the crawlspace under the floor. Usually these water lines are a ¼” copper or plastic line and care needs to be taken not to damage then when moving the refrigerator. If the line is plastic and runs through a wall, floor or ceiling it should be protected by a blue flexible conduit often called a Smurf tube after the little blue characters in children’s TV shows. Lint clogged clothes dryer vents can be a cause of a house fire if not regularly cleaned. The gas flame or electrical heating element in your dryer can overheat if the vent is not clear and most every Boy Scout knows that lint is great tinder for starting a camp fire. The air blowing out of your clothes dryer is hot and moist and lint accumulates quickly on the damp inside

walls of the vent and the dryer. Not only is a clogged vent a potential fire hazard but it is a big waster of energy by reducing the efficiency of the clothes dryer. We clean the vent using a specialized brush that is designed for cleaning dryer vents which can be purchased at the hardware store for about $25 and when used along with a powerful shop vacuum it’s not unusual to fill a 5 gal bucket with lint removed from even a short run of vent. The flexible accordion style vent hose that you can see on the floor behind your clothes dryer should be made of a flexible metallic material and not made of plastic. Plastic dryer exhaust vent hoses used to be very common but are considered to be a fire hazard and should be replaced with a metallic hose vent. Avoid storing combustibles like paper bags or cardboard boxes around the sides of a water heater or clothes dryer. Possibly the best investment for the protection of your home is the simple fire alarm. Can there be any adult who has not heard dozens of public service ads over the years for smoke detectors? Surprisingly we occasionally do work in a home that either has no smoke alarms, not enough smoke alarms, smoke alarms with dead or removed batteries, or smoke alarms that have been disabled. Smoke alarms can be purchased at any hardware store and are a simple life and property saving device that will cost you about $15 and should be properly placed throughout the house and one in the garage. At a minimum every bedroom in your home should have a smoke alarm mounted on the ceiling and also one in every hallway leading to bedrooms. But even the most expensive and best placed smoke alarm won’t protect anyone without a good 9 volt battery. Make it your habit to replace smoke alarm batteries annually on a day that you can easily remember like your birthday, New Years Day, Daylight Savings day, or any date that will jog your memory. Use a Sharpie pen to write the date on the new battery that was installed so that there is no confusion as to its age.

Cottagecore vs. Cluttercore By Katie Laughridge New Traditional design is always adapting and growing to include inspiration from likeminded design movements to remain a stimulating and timeless style choice, and I for one love to look at all the new visions coming into the spotlight. Gen Z and millennials are taking to their social platforms with new image combinations that create a visual feast and a surprisingly specific design viewpoint. The aesthetics tend to be more than just a design choice, sometimes also embodying a fantastical-seeming lifestyle. This last month I stumbled across two aesthetics I found to be both fun and encouraging to my own design tastes. These two genres have been branded as cottagecore and cluttercore. Cottagecore is an escapist aesthetic. It takes you to a place where there are no phones ringing, no errands to run, and the pie on the natural wood countertop is always baked from scratch. Think of an English countryside where all you have on the schedule for the day is baking bread, picking wildflowers and finishing up your tiresome tasks with an afternoon-long picnic (and perhaps some slow stitching before bed). It is the beginning of the fairy tale before the villain shows up. Cottagecore is romantic and soft, based around natural elements. The liberal use of white and cream and lack of artificial colors provides a stunning backdrop for fresh florals, intricate embroidery and woven grass accents (plus it hides all the flour you have no doubt spilled from all the baking). Feminine, fresh and airy textiles add softness to the look that is complemented by purposeful, delicate accessories like vintage teacups, dried flowers and mossy hued knickknacks. It is the perfect visual masterpiece to reduce anxiety and
to help you re-center on the simple things in life. If cottagecore is sunbeams peeking through fluffy clouds and a lazy afternoon, then cluttercore is sitting by a warm hearth after a quick walk in a fall rainstorm. The art of achieving a cluttercore aesthetic is to create an organized mess that feels like a big hug. This movement takes to heart what I have always believed: Less might be more, but more is certainly better! I find comfort in (organized) clutter and think filling your home with beloved sentimental objects is both creatively stimulating and creates a “homey” atmosphere. While this look does require some self-discipline — it is a fine line from cluttercore to hoardercore — when done correctly it shows off design skills and an eye for balance. When practicing this visual approach, try to use your free space by filling your surfaces with curated vignettes and stack your books and baskets up to create height. Sometimes this loud and unapologetic movement leans toward the bohemian, but I prefer the antique approach where the collections are reminiscent of walking into your favorite hole-in-the-wall antique shop. By using picture frames for bold and beautiful gallery walls and upping your #shelfie game with plenty of books and knickknacks, this look is easy to edge into. Plus, think of all the storage room you can free up when you actually put all of your belongings to good use!

When I entered horticulture 40 years ago, making a vegetable garden was free and easy. We simply grew plants we could eat in the yard just like our grandparents did. But as the years passed, I watched this simple age-old process turn into a complex and expensive alternative to store-bought produce. While I made my mistakes and learned from them, I didn’t have the financial investment there is today. We just planted in the ground because we could, and it was easy. Today, planting in ground has been left behind as raised beds take over in backyards. They must be constructed with store-bought materials, filled with store bought-soils. And they are not conducive to certain crops like corn. This turns your first garden from a love affair with shovel and spading fork into a shopping experience. That makes it expensive if you fail. That’s why most folks are too discouraged to try again because they don’t know any other way.
Save money, get a good workout and make your garden the old fashioned way: hand digging. So many of our American communities were built upon really good valley bottomland where soils are fertile and deep. Bringing in all that storebought stuff to grow things is not using natural resources around and under your house. It is not sustainable to grow vegetables in wholly manufactured raised beds when they can be easily grown inground naturally. Most residential vegetable gardens can be made in a weekend with nothing more than a strong back and hand tools. Start by removing all the grass and weeds in the area you’ve designated where it gets full sun much of the day. Next, use a fork or shovel to turn over the soil one shovelfull at a time. It’s slow and tedious, but fun if there are two of you working from opposite ends. While the ground is open, add some nutrition. Composted steer manure is the cheapest soil conditioner out there, and one of the best. You can’t use too much. It will bring in microbes and mi-
cronutrients that may be lacking, as well as organic matter. Plus, there’s something different about manures that offers more immediate fertility, which is why it’s used to cover newly sown lawn seed. Work the manure in as you use the iron rake to pulverize clods, remove sticks and roots and rocks. Your goal is a smooth, soft surface to accept seeds and seedlings. This method takes much of the guesswork out of a first garden. It’s hand-watered, as folks have done for a century here, and it will produce like gangbusters. Without beds to restrain you, the space can be fortified and tilled year after year for a large family garden. Maybe its size grows unhindered by boundaries. Above all, you can rearrange your garden each year for crop rotation, which is vital to maintaining soil fertility overall. Is this an organic garden? That’s up to you. It’s OK to be a hybrid gardener. That means we are aware of the all-organic ideal, but not consumed by it. We prefer organic products when we have the choice. This frees you of the fear of mak-

ing a mistake that irreparably harms the soil or the garden with the wrong thing. Truth is, it’s not that critical. Your garden comes from nature. In nature, very little is absolute. It’s more important for you to enjoy the food than to get overwhelmed with the nuances of organic gardening in potting soils in relatively tiny boxes. Learn the basics and the rest takes care of itself, said an old mentor. Before you can understand the science of true organic gardening, you must learn to garden first. Trying to do both at the same time leads to failure and discouragement. Let’s bust out of labels and get back to the basics so everyone can find success the first time without taking a course.
