California continues to face an unprecedented housing crisis. The biggest factor is a lack in the supply of new housing. Policies related to the supply of new housing are created at a local level and local governments often create those policies based on voter interests and do not consider our local and regional housing needs. NIMBYs (Not in My Backyard) and municipalities using exclusionary housing policies are a major driver of the housing crisis. These policies are used across the state to restrict or deny new housing projects, including housing projects that would increase access to affordable housing. While the state of California continues to pass laws designed to limit these practices and to make it easier for property owners to build there is not a lot they can do to monitor implementation at the local level. Without a strong organization to stand up for individuals’ property rights there is often little that property owners can do to force these cities to change their practices. Californians for Homeownership is a non-profit organization that was founded to work on behalf of the citizens of California against these policies. Californians for Homeownership monitors compliance with the laws and when necessary they will file suits to make sure they are enforced. This can come in the form of lawsuits aimed at making sure cities review and approve projects in a timely manner, do not overcharge for development fees or to make sure that cities do not discriminate with regards to the approval of projects. After several recent victories across the state, Californians for Homeownership has filed suit against the City of Coronado over practices meant to discourage the building of Accessory Dwelling Units (ADUs) in the community. ADUs are secondary housing structures built on single-family properties. Often referred to as “granny flats”, these are an innovative way to increase the supply of housing throughout the state. The suit states that City staff denies ADUs when homeowners file for permits for the construction of a new home and an ADU at the same time. This violates the City’s written ADU policies and state ADU law. The housing crisis cannot be solved by cities and communities working against their own residents in denying or restricting the creation of new housing. Only through cooperation and collaboration will we be able to solve our housing crisis. Organizations like Californians for Homeownership work to help protect the rights of property owners and to further the supply of new housing across the state. It just takes knowing which colors to use in which room — and which colors to avoid. BEDROOMS For the bedroom, it’s best to choose peaceful, relaxing colors that will help you get a good night’s sleep. BEST: BLUE AND GREEN The color blue evokes a sense of calm. In fact, all shades of blue are said to bring down a person’s blood pressure, respiration rate and anxiety levels. And light greens are said to make people feel serene, comforted and refreshed. Interestingly, the color green is also said to stimulate fertility. WORST: DARK PURPLE, ORANGE AND YELLOW Dark purple is said to stimulate vivid dreams and nightmares. This is especially true for deep, dark mauve and eggplant shades. If purple is your color of choice, consider a soft lavender. This will bring the bedroom a sense of calm, the same way blue does. Bold orange is said to make people feel excited or energized — making it a better match for an exercise room than the bedroom. And yellows can make people feel hungry, which is undesirable in the one room dedicated to sleep. KITCHEN The kitchen is a place for happiness and community. Choose a color that will inspire you to cook for and spend quality time with loved ones. BEST: YELLOW, EARTH TONES, WHITE Yellow kitchens tend to make people feel happy, optimistic and inspired. What’s more, yellow is said to activate the metabolism and make people feel hungry. Rich browns emulate the color of the earth, which can be associated with the fresh food we eat. And crisp whites will help give your kitchen a clean, airy feel.

WORST: BRIGHT ORANGE AND RED Experts warn: Stay away from bright orange and red if you’re watching your weight. These colors are said to stimulate appetite. BATHROOMS Your bathroom is a place for self-care and self-love. Go with colors that make you feel relaxed, refreshed and confident. BEST: LIGHT GREEN, LIGHT BLUE AND BLUSH The calming effect of light green and blue make them great choices for the bedroom as well as the bathroom. And blush pinks are not only flattering to all skins tones, but they are also said to make people feel warmer after stepping out of the tub. WORST: NEON, DARK PURPLES, BLUES AND REDS Neon colors, such as hot pink and lime green, are too bold for the bathroom; they won’t stand the test of time. And dark purples, blues and reds are considered oppressive colors. They will make a small bathroom feel even smaller. OFFICE The office is meant to make you feel productive and undistracted. Here, you want to choose colors that put you in the zone. BEST: GRAY AND GREEN Gray tones are detached and steady, which may help you feel less distracted and more organized. And green is considered to be a color of concentration, as well as one of the best colors to look at over a long period of time. As a bonus, green represent tranquility — something you want to feel when your work becomes frustrating. WORST: RED Red is said to be physically stimulating and anger-enhancing. For most of us, that’s the opposite of how we want to feel when we’re trying to get some work done.

Renting to Criminals, Move in Fees, and What is “Single Family”?

By Kelly G. Richardson, Esq. CCAL Dear Kelly: My HOA made a change in the CC&Rs. Renters must be approved by the board and nobody with a criminal record shall be approved. Can they make these demands for just rental units and not units being sold? Wouldn’t criminal records be just as important about potential buyers? – J.S. Dear J.S.: The state Fair Housing regulations which took effect in 2020 do not permit a blanket housing discrimination against persons based upon criminal history. Under Title 2 Section 12266, there must be some connection between the criminal history and the HOA’s safety concerns. So, for example, someone who had been convicted of arson or a violent crime might be a reasonable concern, unlike someone who had committed loan fraud. Hopefully your HOA had the benefit of legal advice when the members amended the CC&Rs to require prospective tenants to be approved by the board. Ask counsel to review the criminal history issue and make sure the HOA’s policy does not violate the regulations. – Best, Kelly Hi Kelly, Our association requires that owners notify management before moving occupants in or out of their unit, and management arranges for a representative to observe the moving of belongings and to document the impact upon any common areas. Deposits and the observer cost also must be paid. Furniture or appliances or other large items cannot be moved in or out of a unit except when purchasing new furniture. Owners who ignore this rule may be fined. I would like your opinion on this policy. – Thank you. C.R. Dear C.R.: The association is responsible to protect the common areas and can take rea-
sonable steps to protect hallways, elevators, and other common elements against damage from moving activities. Associations with more rentals may have greater incidence of resident changes and therefore a higher probability of damage. Association charges related to moving must be reasonable per the 2015 appellate decision in Watts v. Oak Shores, meaning they can be supported by a good faith explanation approximating the HOA’s actual incurred costs from move-ins/outs. – Sincerely, Kelly Mr. Richardson, our HOA says military renters cannot live together in their community if they are not a “family” and they define family as an “integrated economic unit.” However, the CC&Rs define family as “natural individuals, related or unrelated, who live as a single household.” Is requiring an “integrated economic unit” discriminating based upon source of income? Do the HOA’s guidelines discriminate against military personnel? – Sincerely, R.Z. Dear R.Z.: Many cities do not have a clear definition of “family,” but the California Supreme Court in its 1980 opinion in City of Santa Barbara vs. Adamson endorsed a broader definition of the term. In that opinion, the Court stated that members of a “family” need not necessarily be related or have a head of household. Some cities have adopted the definition of “family” to be a group of persons sharing a residence’s common facilities. Renters, military or not, need not be a “family” in the traditional sense of the word to be considered “single family” occupancy. Also, treating residents differently because of their military service may violate Fair Housing laws, since veteran or military status is now a protected class in California. – Thanks, Kelly.

What Not to Miss in The Final Walk-Through Of Your New Home By Pat Setter It’s an exciting moment, walking into your brand-new home after it’s finally completed. But don’t let the excitement distract you from the importance of this final walk-through with the builder a few days before closing on a home. This is your chance to inspect the home, learn about the mechanics and systems, and note any areas of concern or defect. The day of your walk-through inspection, arrive on time and in comfortable shoes — and make sure your calendar is cleared so you are free of distractions and obligations during your appointment. Be sure to bring a notebook to make a checklist, and have your smartphone handy to take photos of the items that need to be repaired, as you and your builder representative create the “punch list” of items that need attention. Point out anything you find that needs to be addressed, because after you move in you won’t be able to prove that that scratch on the kitchen countertop wasn’t caused during the move-in. Once you have a list of repairs, your builder representative (usually a customer service professional) will go over the list and have you approve it, making sure that all your items of concern are noted. Then he or she will go about alerting the correct trade contractor to come back in and correct the work. If that’s after you have moved in, you will be contacted with the day and time the work will be attended to. Once the repairs or corrections are completed, you will need to sign off that the work was done satisfactorily. Here are some things to look for during your walk-through: • Examine all surfaces, including cabinets, counters, fixtures, floors, windows, ceilings, and walls, inside and out. Paint touchups are among the most frequently noted items. • Turn all the faucets on and off and flush the toilets to inspect for leaks.

• Open and close windows and doors to make sure they lock and seal properly. • Check to see whether all appliances operate, that they are the correct model and that the appliance handbook is available. • Don’t forget to inspect the entire property. Make sure the ground slopes away from the home, so as to avoid foundation problems and flooding. If the landscaping is already in place, look for dead plants and check for areas where water could pool. The inspection, which can last an hour or two, is also your chance to ask questions about how things work. Be sure to ask where the shut-off valves are for gas, electricity and water in case of an emergency. Although your new home comes with a stack of instruction and warranty manuals, it’s helpful having someone demonstrate the appliances, the heating and air conditioning and the smarthome features that come with many new houses. During this time, the builder’s representative will also go over the homeowner’s maintenance responsibilities, which are often required to keep warranties in place. Often, builders will schedule a follow-up inspection soon after you’ve moved in and another toward the end of your first year in the home, which marks the end of the warranty for workmanship and material. Small problems, such as a popped nail in the drywall, often arise as the home settles. During this first walk-through, ask lots of questions. You may choose to have a home inspector professional perform their own inspection of the property. If so, you will need to schedule it with the builder ahead of time before your walkthrough. Then, bring along your inspection report to discuss anything of note. By being diligent upfront, you can ensure that you will be able to enjoy your new home for years to come. Tribune News Service When it comes to color combinations, you may ask yourself, what’s in and what’s out? Which colors can I put together? And which ones may be taboo or clash? Here are some general guidelines you can follow that can help improve the likelihood of color combination success. COOL VS. WARM COLORS A traditional color wheel can be a wonderful guide and tool if you are confused about which potential colors could blend well when placed near each other. As a general rule of thumb, colors next to each other on the wheel work well together, as do colors that are opposite each other on the wheel. Don’t be afraid to blend colors together, either by pairing warm colors with other warm colors, or by pairing cool and warm colors. Have a special outfit or garment pairing you simply love? Consider trying

that same color combination in your home. Often, colors that work in fashion can easily translate into fabrics and wall colors that will work well together in the realm of home decor.
Mustard yellow is a gender-neutral accent color that works very well with neutral tones.
TURQUOISE AND ORANGE Turquoise and orange may sound like an odd pairing, but the color combination can be quite inviting, especially for those looking for a modern, if not hip decor. Around Town Santa Barbara Botanical Garden is Open! Spring in the Meadow
Many of you are familiar with the Santa Barbara Botanic Garden or “The Garden” as it is called. But, to those newcomers to our seaside city who would like to drink in the beauty of The Garden let us introduce you to it. The Garden’s mission is to conserve California native plants and habitats for the health and well-being of people and the planet. In fact, it was the very first botanic garden
in the nation to focus solely on native plants. The Garden, set in Santa Barbara’s beautiful Mission Canyon, has provided the community with seasonal Californian splendor since 1926. Visitors can travel the state over just a few miles of trails —stopping to enjoy a Coast Redwood grove, explore the unique flora of California’s Channel Islands (complete with panoramic Island views!), or sit leisurely by a cool Canyon stream. A conservation institution first and foremost, the Garden houses an impressive scientific research and restoration program working to preserve plant biodiversity across the State. Visitors can help the cause by planting native plants at home. The Garden’s nursery boasts the widest selection of native plants in Central California and their Home Demo Garden provides all the inspiration needed to get planting! COVID-19 precautions are in place, including
limited admissions and required face masks throughout the Garden. “A visit to the Garden is the perfect low-risk outdoor activity for families, and Spring is a beautiful season to visit!” says Assistant Director of Development and Communications, Becky Curtis. “And if a visit isn’t in the cards just yet. you can still experience the Garden’s beauty online at sbbg.org/athome” The Garden is open to guests every day from 10 a.m. - 6 p.m with COVID-19 related precautions.
