Regarding your recent article, does the section 4741 approval of rental caps as low as 25% of the HOA mean an HOA such as ours can disallow rentals above that percentage? We are a small community with surging rentals, creating automobile congestion on our streets. thank you for your time, — P.W. Dear P.W.: Civil Code Section 4741, new in 2021, allows HOAs to set rental caps as low as 25%. that is a minimum, so HOAs with current caps above 25% are unaffected by that aspect of the new law. HOAs adopting a rental cap should remember that Civil Code 4740(a) still applies so that the new cap, which is a partial prohibition, would apply only to owners acquiring title after the date the cap was voted into place. — Sincerely, Kelly Dear Kelly: A group of us would like to put out to a member vote to have our CC&R’s changed to have a 25% limit for rentals that is within the new Assembly Bill 3182 law in California. the board says their decision is to not have any limit and our current CC&R’s do not have any restriction on the number of renters. What can we do to get this out to a vote of all homeowners? — E.P. Dear E.P.: Over the years, my experience has been that the subject of rentals is the most common source of controversy when associations are discussing updating their CC&Rs. Some association communities prefer wide open rentals while others prefer a cap or other limitations. Before you put the HOA to the expense of a mem-
bership vote, consider informally polling your neighbors to make sure you have strong support for the idea. Amending CC&Rs usually requires a majority vote of all members and sometimes even requires 75% approval vote to succeed. If you have enough support and the board still will not set a vote, you could petition for a special meeting of the membership. However, who is going to draft the proposed amendment? Normally that would be the HOA’s attorney, and the amendment must be properly drafted to prevent possible legal challenge. If you have a large amount of support for the idea, hopefully the board will listen to the community. thanks for your question, — Kelly Dear Kelly: Civil Code 4740 has a paragraph grandfathering existing owners so that rental prohibitions would not apply, but now I see the new 4741 does not have that same paragraph. Despite that, it is obvious that the purpose of both 4740 and 4741 is to limit the rent restrictions allowed by an HOA. — T.Z. Dear T.Z.: Yes, the new section 4741 does not contain a grandfathering provision, although that is not really its point. When Civil Code Section 4740 became law in 2012, its main point was have newly-adopted full or partial rental prohibitions only apply to future owners. the new Civil Code Section 4741 goes much farther, banning all “unreasonable” restrictions by HOAs on rental of homes. to a certain degree, Section 4741 overshadows Section 4740 since it is difficult to conceive of a prohibition that could possibly be adopted without running afoul of Section 4741(a). — Best regards, Kelly

Wood Treatments: Gray

Santa Barbara’s Multifamily Housing Market Returning to Normal The multifamily housing market for Santa Barbara continues to adjust in order to deal with the ongoing pandemic. Strong demand for apartments has helped keep vacancy numbers compressed but we have seen some easing of that with the delivery of several new development projects and there are still more that are under construction. Currently, according to CoStar apartment vacancy stands at 4.4% while rent growth has actually declined by .5% over the last twelve months. We attribute this to property owners and tenants working out rent reductions to cope with COVID and fewer tenants looking to make moves during COVID. While larger projects from the Towbes Group and John Price in Goleta are in the pipeline we have many smaller projects under way in Santa Barbara that are being built under the Average Unit Density (AUD) program. We could see that vacancy level rise slightly, closer to a healthier level for a market our size. However, demand remains high for housing in our area as the sales market for homes continues its hot run and it is only hampered by a lack of inventory. On a broader scale, we continue to see large cities like San Francisco, San Jose and Los Angeles experience compressed rents over the last twelve months. Over the same period, interior markets such as Sacramento and the Inland Empire have seen positive rent growth between 6%-7%. However, based on the economic recovery this could be the last month of flat rent growth for the larger gateway cities. The month-to-month comparisons continue to flatten and should see growth by the summer. Returning to our local market, when looking at investment properties of five units or more there have been five sales along the South Coast of Santa Barbara County so far this year with two more in escrow. Compare this to the first quarter of 2020, which had only three sales. The first quarter of 2020 did not see the immediate impacts of COVID-19 as the number lines up the number of sales on average during the first quarter of the last several years. Truly, the largest impact on sales is inventory. Buyers remain active and interested, even during COVID-19.
I told you how and why grayed wood should be cleaned and brightened to its natural color prior to various treatments. Cleaned wood will give any wood treatment a longer life, and any colored treatment will not have the gray color asserting itself through the new color. Q: What if I like the grayed, weathered look? Why not just leave the wood alone and let nature take its course? A: You can, but in most cases, your wood will have to be replaced much sooner. It’s true that some wood species will outlast others, especially, teak, redwood, and cedar, however, all woods will last longer with preservatives, oils, stains, and paints applied. Using these various treatments also keep paint store owners in business. Q: But what if I really like the grayed, weathered look AND I want the wood to last a long time? A: Did you know there are treatments designed to give new or cleaned woods that “driftwood gray look?” Look for words like on the label like “bleaching” or “weathering.” They look very natural over time but there may be no choices of shading. To pick your shade of gray, there are hundreds of various gray shades of semi-transparent, semi-solid, and solid stains, as well. Bleaching and weathering Stains are available from various manufacturers. They are pigmented gray stains that give you the grayed look as soon as they are applied. Re-application cycles may be from two to ten years. The difference: Orientation to light. The sunny exposures require additional coats more frequently. In some cases, like beach houses, they may require yearly coats. The Eco Wood Treatment is a Canadian product used extensively throughout their park system. This is a powdery material added to water. Once applied, the wood begins to turn gray. The good news about this product: NO REAPPLICATION. EVER. The bad news, you have no control over what shade of gray the wood will turn, so test first. When I first started carrying Eco Wood Treatment, I was waiting for the other shoe to drop: When would I get my first complaint? When would someone say it didn’t work? It hasn’t happened, yet. (Fingers crossed!) There’s another method of graying wood. Toss a steel wool pad into a mixture of vinegar and water (equal parts). Let sit overnight. In the morning--voila!! Brush it on for a grayed look. I can’t vouch for the longevity of this mixture, but some folks really like it.
