AROUND TOWN Teacher’s Fund Accepting Applications to Help Educators Provide Online Instruction During COVID-19 School Closures As schools across Santa Barbara County switch to remote learning due to the coronavirus pandemic, the Teacher’s Fund is offering support to teachers in need of digital instruction tools and materials to help their students learn. The Teacher’s Fund recognizes this is a challenging time for teachers, who must quickly adapt their curriculums and lesson plans to online platforms so their students can keep learning and stay connected during this difficult time. While the doors of Santa Barbara schools are physically closed to maintain “social distancing” and slow the spread of the coronavirus, teachers are serving as an academic and social lifeline for students isolated in their homes. “We want teachers to know we see them and they are not alone. We’re here to make this transition easier for them,” said Renee Grubb, owner of Village Properties Realtors and founder of the Teacher’s Fund. “We also invite community members and businesses to show their support for our Santa Barbara teachers and students by donating to the fund.”

Termites Question: Our roof is about 35 years old, is in bad condition and we have put off replacing it probably for longer than we should have. We have funds budgeted for a new roof to be installed next year but my husband just discovered that we have active termites in several places on the eves and there are fresh termite droppings throughout the attic. Should we have the house fumigated before the new roof goes on? Your Handyman: One of the very few downsides to living in the beautiful temperate climate of Santa Barbara is that termites are most everywhere. To some degree they are in every wood fence, every tree stump, every mailbox post and every house in the neighborhood. It sounds like your house has an active infestation that probably started in the eves and rafter tails and then the hungry bugs steadily chewed their way into the attic area. You are wise to not put fumigation off because getting rid of the termites is just as important for the protection and preservation of your home as the new roof. It does make the best sense to have the new roof installed first and then have your house tented for termites, because there could be termites in the new wood that your roofing contractor will be installing. Fumigating your house with the new roof in place will get you a clean start with a termite free house.

Established in 2002, the Teacher’s Fund is a non-profit organization that assists local teachers with the purchase of supplies, materials and equipment not covered by school funds. To date, the fund has donated more than $1.7 million to Santa Barbara County elementary, middle and high-school teachers in public and private schools. Village Properties and their real estate agents provide major support to the fund, along with several other businesses, individuals and foundations. Teachers can apply to the fund online for a grant of up to $1,000 (although the average grant amount is between $200 and $500). Grants will be awarded for online learning and teaching tools including digital books, educational software, math and science apps, and audiovisual equipment. To receive a grant award in May, applications must be submitted by April 20. Many talented successful people find themselves continually frustrated with volunteer service on their HOA board, and often are surprised to find themselves in conflict regarding their HOA service. This can be rooted in the failure to understand that HOAs run very differently than businesses, and some of the practices which bring career success are not what the HOA needs. Governing the HOA is very different than running a business. One such difference is the “chain of command.” In one’s career, whether in business, government service, or elsewhere, the hierarchy is vertical – someone supervises you and you supervise others, and you are expected to personally exercise authority quickly and efficiently. In the normal business setting, officers are expected to act, and the decisionmaker is typically a single person. However, in the HOA, the decisionmaker is not one person, it is a group – the HOA’s board of directors. The HOA president has only one vote and needs to obtain the agreement of other directors before a decision is made. The association acts by vote of its board – corporate action is BOARD action. Another major difference is the president’s role. The business corporate president is empowered and expected to make important decisions about all major operational issues. On the other hand, the typical HOA president controls very little. The HOA president normally sets the agenda and chairs the meeting but is only one of the decisionmakers. So, HOA presidents are coalition builders working to lead the board to a consensus. Some presidents misunderstand their lack of power by misinterpreting HOA bylaws, which often recite the president is to use the powers normally accorded to a chief executive officer - but that must be interpreted in the context of

the HOA, not a business. The HOA president normally serves at the pleasure of the board. Unlike corporate presidents, they have no contract, and the HOA officer can be replaced without reason at any time by a board majority. There is no doubt that HOA governance is less efficient than the management of a business. However, in the business the officer is paid and in return is also held accountable for the officer’s decisions and actions. In the HOA, the officer is not compensated, and if following proper board process (as opposed to individual actions) is not held personally accountable (i.e. liable) for board decisions. Business executives often are applauded for being action-oriented and quick to make decisions. However, the association president who “takes things into their own hands” may find that such decisions are much quicker and more efficient. However, that president may be exposed to avoidable liability, since the non-profit corporation acts through its board of directors, not one officer. Sometimes the board needs an individual director to act, and so grants specific authority to act. That always should be documented in the minutes. When circumstances do not permit a board decision before the officer acts, that officer should seek board ratification of that decision as soon as possible, to document the decision was authorized. Another important difference is that the business executive controls – while the HOA officer serves. The HOA president is the lead servant, not the boss. Understand how volunteer service is different, and it just might become smoother.

By Jenny Dickelman The house I grew up in was “Home Sweet Home” for seventeen years, and our family was moving. It was a rental and had never been sold. I sat in the upstairs hall looking out upon the creek at the end of our back yard rippling over rocks strewn with fallen blossoms. As a tomboy, I had climbed the fruit trees in the orchard beyond, where I sat on a gnarled branch to watch my father hoe his garden. With the same energy, he now was packing dishes — the ones with chips I’d carelessly dried in a hurry to get outdoors and play. Turning to the noise in the garage, I saw the movers load the bunny hutch on the back of their van. “Inky” and “Pinky” huddled close together. Most of our furnishings were already on. My mother called to me, and I scrambled down to the kitchen to help empty the old ice box the ice man had routinely stocked with blocks of ice. A warm morning in May soon began melting the butter quickly. I insulated the crock with chipped ice and newspapers. My grandma on the farm had sent the handmade churned butter to us, as usual, along with bacon, eggs, and cottage cheese. It was a prized spread. “Toast crumbs!”, I exclaimed. “The butter has toast crumbs?” I could hear my mother’s questioning voice, but my thoughts were still wandering. I was thinking that was all we had, everything was taken from us. All we had were crumbs of the past. We were leaving a life as we knew it; the refreshing breezes off Lake Michigan, the closeness to the “Windy City”, Chicago, everything I’d grown to love and cherish — going to live in a river town far away. Arms encircled me; Mother’s soothing whisper, “We’ll miss it, all of us will. We’ll meet lots of new friends, you’ll see.” From early days, we had hard winters, deep drifts of snow. My father carried me on his back to school. Weekends, at suppertime, we’d hear jingling bells as sleighs glided by with lanterns swinging. Songs of youths piercing through the frosty night air. In the spring, we’d drive out to the country to gather asparagus growing wild along the roadside. Elderberries were picked in the woods across from our house. The mail came to the Post Office downtown. The milk delivered by horse and wagon. Happy memories are treasures given, not taken from the heart.

In the world of COVID-19 everything is constantly changing. In the

real estate industry, major changes have occurred and which may likely have changed again by the time this article is published. Initially the federal government published a list of essential services during this time of restricted activity. It did not include real estate as an essential service. Since then real estate has been added to the essential list. Governor Newsom’s stay-at-home order issued March 19, as updated by the “Advisory Memorandum on Identification of Essential Critical Infrastructure Workers During COVID-19 Response” from March 28, 2020, expressly includes residential and commercial real estate, including settlement services, as essential services recognized by the Department of Homeland Security as being necessary for the maintenance of America’s Critical Infrastructure. This comes at a time when numbers of confirmed COVID-19 cases are rising, exponentially, not plateauing or decreasing. It comes at a time during which we have been told it is critical to stay home to “flatten the curve,” when healthcare workers are begging us to stay home as each new infected person puts their own lives (and those of their family) and our whole healthcare system at risk. This may seem confusing. The California Association of REALTORS® has issued statewide guidelines for doing real estate business, however, there are counties that have more restrictive Shelter In Place orders. Santa Barbara County is not one of them. So, it is up to REALTORS® and the public to practice discernment in deciding what is truly essential during these harrowing times. Here are some of the highlights of the guidelines, along with some of my comments and concerns: Showings should be done virtually, if at all possible. All activities should be completed electronically, if at all possible. Only a single agent and no more than two other individuals are to be in a dwelling at the same time during a

showing. If other persons are necessary for a showing, they should wait outside or in their vehicles to observe the social distance guidelines. Sellers are to be advised that they should not be present within a dwelling at the same time as other individuals. If a seller insists on remaining on the property, that seller is to agree to the terms and sign a declaration (see below) that is required for persons entering the property. Agents should read and understand the recommendations from the Centers for Disease Control and Prevention (CDC) on how to protect yourself, where it reads “The best way to prevent illness is to avoid being exposed to this virus….It is unknown how long the air inside a room occupied by someone with confirmed COVID-19 remains potentially infectious.” Any persons on the property must agree to adhere strictly to the social distancing guidelines at all times by remaining at least six feet apart per the recommendations established by the CDC. Any person entering a property shall provide by declaration that to the best of their knowledge, they are not currently ill with a cold or flu; do not have a fever, persistent cough, shortness of breath, or exhibit other COVID-19 symptoms; have not been in contact with a person with COVID-19. Has anyone else heard in the news that many people are ASYPMTOMATIC? All persons visiting a property will agree to wash their hands with soap and water or use hand sanitizer prior to entry, and to wear disposable rubber gloves and a protective face mask, if one is made available. Is anyone else having difficulty obtaining these items? Are we to assume that those visiting the property have just washed their hands prior to entry, after exiting their vehicles where they have touched the steering wheel, gear shift, door handles inside and out, after possibly viewing other properties? In addition, sellers must disclose to all persons who enter the property if the seller is currently ill with a cold, flu or COVID-19 itself, or has a fever, persistent cough, shortness of breath or other COVID-19 symptoms, or has been in contact with a person with COVID-19. Further, if anyone who enters the property is later diagnosed

with COVID-19, the person who is diagnosed must immediately inform the listing agent, who will then make best efforts to inform everyone who entered the property after the person diagnosed, of that fact. This is more than disturbing. Sellers and buyers must be expressly made aware of the risks of showing and visiting properties: that it may be dangerous or unsafe and could expose them or others to coronavirus (COVID-19). Sellers and buyers must be advised of their responsibilities pertaining to COVID-19 protocols regarding social distancing and other CDC guidelines. To the extent possible, the use of various third-party services providers for non-essential services must be avoided and, where unavoidable, the providers must agree to sign an agreement to follow CDC guidelines. Unless absolutely necessary, communications with clients should be done via electronic means or by telephone. In person conversations should be minimized unless absolutely necessary. Listing agents should not leave brochures and flyers in the property but instead upload them to the Multiple Listing Service. Discourage anyone who does not need to view the property from attending a showing. Agents conducting the showing should meet clients at the property and not drive the client to the property, so as to minimize risk. Information relevant for the showing should be provided in advance to the clients electronically. If using a lockbox, be sure to disinfect the key, the box, and the doorknob prior to utilizing. When using disposable gloves, be sure to put them on prior to entry and to dispose of them after leaving each property. Refrain from touching any surface during a showing. As indicated above and following the CDC guidelines, maintain a safe distance from anyone in the property by staying a minimum of six feet apart. If the size of the residential unit makes it difficult to maintain the sixfoot distance for all parties attending the showing, individuals may need to

wait outside and come in the property one at a time, at all times maintaining proper social distance. Bring your own sanitizers, and gloves — don’t rely on others to bring them. If hand sanitizers are unavailable, liquid hand soap for hand washing should be made available. The public would then be touching the kitchen and bathroom sinks and handles, which contradicts the guideline above to “refrain from touching.” Follow suggestions in the CDC’s Cleaning & Disinfecting Guide and provide this information to sellers, advising them to disinfect the property according to those guidelines after the showing is complete. For vacant properties, previously considered the safer option for showings, one should then assume the property has not been cleaned in between showings. Most buyers visit multiple properties before purchasing. Real estate professionals know during a single transaction, the services of inspectors, pest control companies, and workers performing repairs, to name a few, are required to complete a typical transaction, which could mean multiple people entering a property. Multiply this out by many properties, many buyers, and the ensuing transactions, and you have a web of potential contact which should at the very least should give one pause. I now know someone who has lost a family member to the virus. I suspect that by the time this is published, many of you will also know someone who has also suffered the effects of the virus.
