Some Bad Pending HOA Legislation

Last week’s column recapped five bills proposing to help HOAs. This week addresses the other side of the coin, as four legislative proposals are pending, which would not help California’s 50,000+ HOAs. AB 1410 (author Rodriguez) This year’s worst HOA bill is Assembly Bill (AB) 1410, by Member Freddie Rodriguez. The bill states that it responds to the pandemic emergency, yet most of the bill is not temporary. The bill would eliminate any ban on leasing portions of residences. This means that HOAs could not stop someone from renting each bedroom to a different tenant or subdividing the residence into multiple rented parts. This would effectively destroy the longstanding rule that HOA homes must be single “family” residences and allow them to become mini boarding houses. AB1410 would also add a new Civil Code Section 4754, banning anything in governing documents restricting “critical discussion” of the HOA. That sounds like a nice idea; however, I have not seen such a provision in any HOA CC&Rs or rules during 32 years of advising HOAs. Several years ago, the Community Associations Institute sponsored a bill proposing lowcost training for HOA directors, but it did not become law. AB 1410 would add a Civil Code Section 5101 requiring all of California’s 200,000 or more volunteer directors and every HOA employee (including everybody from managers to maintenance personnel) to take a course on “ethics and harassment prevention.” No information on course content, legitimacy, length, or cost is provided. AB 1410 would also create a new Civil Code Section 5870, prohibiting HOAs from pursuing enforcement actions of any kind during declared emergencies or quarantines, and would create a new Section 5880 permanently requiring HOAs to give photographs or any other evidence to members accused of violations. During emergencies or quarantines, apparently scofflaw members can behave without consequence if this bill is passed and can demand to inspect any “evidence” against them. AB 1466 (authors McCarty, Bonta, and Chiu) AB1466 addresses the problem of old CC&Rs containing illegal discriminatory restrictions (most commonly racial or against children). The bill would allow HOA members, brokers, escrows or “other persons” to submit to County Recorders a proposed CC&R amendment. There are no proposed protections to ensure that County Recorders can confirm that only discriminatory portions are affected, and County Recorders are given only 90 days to record the amendments demanded. Under this bill, anybody inside or outside the HOA could modify its CC&Rs. The “Safe At Home” program protects victims of domestic violence, and AB 611, from Member Quirk-Silva, would add a new Civil Code Section 5216 requiring HOAs use a designated state address instead of the member’s actual address for those in the Safe At Home program. However, this is unnecessary, since HOA members under Civil Code Section 4040(a)(2) can already designate an email address instead of postal mail for notifications.
Question: My wife and I have decided that the timing is right for us to sell our family home and the move into a local senior living community. We have raised 4 children in this house, but the kitchen, bathrooms and interior walls have not been remodeled in over 30 years. I think we should remodel the kitchen and bathrooms while my wife thinks we should just paint all the walls and get new carpeting. What work should we do to update the house prior to listing it for sale in order to get the best-selling price? Your Handyman: Great question! Many seniors find themselves in this situation after the kids are finally up and out on their own (thank goodness) and the warm family home that used to resonate with the activity and sounds of growing children, now seems cavernous and a little lonely. You are wise to consider carefully what work to have done to help make the house more marketable and it is easy to quickly spend piles of money on contractors and designers without necessarily adding significantly to the final sales price of the house. It is not uncommon when an escrow closes for the first thing to show up in the driveway is a Marborg roll off dumpster and much or all of the new cabinets, doors, and fixtures installed by the seller get torn out, loaded into the dumpster and head off for the landfill. I recommend that before you spend time or money on fixing up the house that you first find a realtor who has many years of experience representing buyers and sellers in your neighborhood. An experienced realtor can advise you based on their experience as to what type of work should be done to increase the selling price and may even advise you to just have the house professionally cleaned, painted and leave it at that. Talk with your neighbors and friends to get referrals for realtors who work in your neighborhood, interview 2 or 3 to get a feel for their style and personality, and then rely on his or her advice on how to maximize your selling price.

AB 1584 (author Housing and Community Development Committee) AB 1584 would declare “unreasonable” restrictions on accessory dwelling units (“ADUs”) or junior ADUs to be void. This would make the third major change in the law regarding ADUs in HOAs in three years, while HOAs are still figuring out 2019’s AB 670 and 2020’s AB 3182. Tribune News Service Typically dark, drab and cavelike, windowless rooms tend to pose a challenge. In many instances they cannot be counted as bedrooms or rooms in a home and often become the space that is most difficult to determine proper function and of course, how to add light. Here are some tips on ways to shed light on windowless spaces.
A light-colored area rug and light-colored furniture make a windowless lower level feel bright and welcoming.

DO: 1. Add plenty of mirrors. Mirrors in a windowless space instantly act as “windows” and will make a small space feel larger. 2. Consider size and scale. Proper scale is key in these spaces, so they don’t feel stuffed or closed in. 3. Add plenty of extra light. Light sources — ideally three to four different types — will help prevent a windowless room from feeling overly dark. 4. Consider adding an interior window or clerestory. Adding an interior window will help as far as emitting some light. 5. Go light and bright. Light colors such as white, taupe and beige will help make a windowless space feel brighter.

DON’T: 1. Overdo it with dark colors. Dark or darker shades of warm colors will cause walls to visually recede and will close in a space. 2. Discard windowless rooms. These spaces can still be functional and purposeful. Common uses can be home offices and even nurseries. 3. Overlook artwork. Artwork plays a key role in adding interest to a windowless space. 4. Forget greenery, accents and accessories. These spaces should shine and be presented just like any other room in your home. 5. Introduce too many colors into a windowless space. A palette of two to three colors will help the space maintain a clean, fresh look.

Tribune News Service Question: Dear Ed: We are buying a new home and the builder is letting us pick out the bathroom fixtures within a budget. Since a whirlpool tub is not possible, what extra soaking comforts can we add to a standard bathtub? — Pat Answer: When choosing your standard size bathtub, I suggest looking for a tub that has a slotted overflow drain. Most tubs have a circular overflow cutout to fit the round overflow drain assembly. A slotted bathtub has a special long and narrow overflow cutout that looks like a coin slot. With this thinner cutout opening, the water level in the tub can be a little higher for some extra soaking comfort. Two notes: A slotted overflow drain assembly is needed to fit this type of tub. Houseplants Add Natural Beauty to Your Home By Mary Carol Garrity

I have a dark history with houseplants. I adore them, but I kill them. My list of offenses against my poor houseplants is long and tragic. I have been known to forget to water them, and also to drown them. I have mistakenly put those that need lots of light back in dark corners, and the shade lovers in southern windows with all-day sun. But now, I’m turning over a new leaf. I no longer want to treat houseplants like fresh cut flowers, with an estimated life expectancy of about a week. I not only want them to stay alive, I want them to be healthy and grow. My renewed determination to keep my plants alive occurred last fall. I had sunk way too much money into our outdoor planters to let the plants die when the weather turned cold. So Dan and I drug the huge pots of mother-in-law tongues, which normally live on our porch, over to my mom’s cottage next door. I just wanted them to stay alive until we could drag them back outside in the spring. Then, something absolutely crazy happened. I didn’t kill them! In fact, they thrived. One day when Dan was working at Mom’s cottage, he told me, “Those plants make the room. You should keep them there.” I don’t know what shocked me more: Dan’s commenting on decorating, or the realization that I had helped a plant flourish. It was decided: The plants will stay put, and we will be back at the nursery, getting new outdoor plants this spring. In the world of interior decorating, houseplants are trending. Fig trees are particularly hot right now. Which, I am proud to tell you, I have also not killed. One is living at Mom’s cottage, too, happy as a clam. The simple living room is washed in neutrals, so the bright green leaves give a great kick of color. When I’m at the grocery store, I like to pick up plants that catch my fancy, like miniature rose bushes. The old me placed them in a pretty cachepot and hoped for the best. The new me will find out the amount of light and water the plant needs, and actually take care of it. It feels incredibly hypocritical for me to share tips on how to care for houseplants, given my checkered past. But after I did a quick search online for easy-to-follow tips on helping houseplants thrive, I wanted to pass on my findings, in case you have dubious plant skills, too. The experts say: Find the right level of light. Check the plant’s tag, or do some quick research, for the kind of light your plant needs. Then, place them accordingly. Dust them. This one surprised me. But, plants get dusty, too, just like everything else in your house. The accumulated dust on their leaves not only looks bad, it blocks their sunlight. Water correctly. Not all plants need the same amount of water and humidity. Watch out for drafts. Keep your plants from cold drafty doors and windows, and from heat vents. Add fertilizer. Plants need to eat, too. Watch for insects or disease. Check for early signs, so the critters don’t spread to other plants in your house. Repot when necessary. If your plants grow, they are going to need bigger houses.
