Is THIS a Conflict of Interest?

By Kelly G. Richardson, Esq. CCAL Question: I live in a beautiful home in San Roque that was built in the late 1920’s and it still has the old original Knob & Tube style of electrical wiring. The original fuse box was removed and replaced with a circuit breaker box years ago, and I have not had problems with any of the wiring. I want to add several new electrical outlets and a light fixture, and I have heard and read different takes on the safety of adding any additional load to the old wiring. Do you think this is a good idea? Your HandYman: Prior to around the mid 1930’s the electrical service in homes was provided by the style of wiring referred to as Knob and Tube (K & T) where single insulated copper wires ran through framing studs via porcelain insulating tubes and were supported in runs by nailed down porcelain insulating knobs. When the wire entered an appliance or passed through a wall board to a switch box it was insulated with a flexible cloth sleeving called Loom. This early insulation was typically an asphalt saturated cotton cloth which would eventually be replaced with rubber insulation in later years. Wire splices were simply made by mechanically twisting the wires together and then wrapping the splice with asphalt saturated cloth tape. Knob & Tube wiring had only a black hot wire and a white neutral wire and sometimes fuses were placed on both the hot and neutral line of a circuit which created the dangerous situation of a neutral fuse burning out while the hot leg of the circuit remaining energized. The principles of

effective grounding were not fully understood at that time and the now standard green or bare grounding wire was not part of K & T. Many homes in Santa Barbara still have their original K & T wiring but most all have replaced the old fuses with modern circuit breakers. I personally would not recommend adding any additional load to your older wiring by installing new outlets or fixtures, however there are electricians who might disagree with me on this point. You do want to avoid or minimize the use of any high wattage appliances like space heaters, home theater hardware, or a large flat screen TV. The electrical demands of a modern house are much greater than what was required by homes in the 1920’s, many appliances need a ground wire for safe operation, and thus the demands on your wiring are substantially increased. If you decide to go ahead with your electrical project, be sure to have the work done by a licensed electrician who has experience with K & T wiring. In my opinion it would be a very worthwhile investment for you to have your house rewired with modern wiring and just be done with your old but still functioning K & T. As with any home you want to be sure that you have adequate smoke detectors throughout the house and be careful not to overload the safe capacity of your wiring. I wouldn’t lay awake at night worrying about the safety of your old wiring but rewiring the house should be something that you place high on the “To Do” list, and would certainly be a sound investment.

Hello Kelly! Is it considered a conflict of interest if a board member is also an HOA employee? Our board is voting on matters which would affect the job duties of the board member/employee. Would this be considered a conflict of interest? The director acts as property manager. – Thank you! E.L. Dear E.L.: A homeowner who is also an employee, let alone the manager, is burdened with major conflicts of interest. Is the manager making their home a higher priority? Does the manager issue violation notices against their friends? Managing HOAs under the Davis-Stirling Act is complicated, particularly under the growing body of technical requirements. Don’t hire a neighbor; hire a professional manager. They cost more, and there are reasons for that – professional managers have training, experience, and resources behind them which more than offset the cost. – Best regards, Kelly Mr. Richardson, How ethical is it for an active member of our HOA board to be dating one of the vendors presently working on our property? Other homeowners are aware of this situation and I have been elected to ask you if it is ethical. We feel as though one or the other should step down from their position. Kind of a conflict of interest. Maybe you have a better perspective on the situation and can share with me. – C.C. Dear C.C.: A director’s personal relationship with a vendor creates a conflict of interests for that director. I am assuming that the director has the good judgment not to discuss that vendor openly (or privately) with any other directors, and to abstain from votes affecting that vendor. Otherwise, it could

reflect very poorly on the board’s credibility with the association membership. – Thanks, Kelly Kelly, We are beginning to do a major phased landscaping remodel. We have just about completed the first phase - it was awarded to the same company that does our weekly gardening. Now the man who owns this company purchased a home in our community. Our landscape board feels this is a conflict of interest. Our board president disagrees and wants to award him the next phase of landscape redo. Your thoughts, please? – Thanks, P.S. Dear P.S.: I generally discourage hiring homeowners. It is harder to fire or criticize a neighbor who is also a vendor, and if there is a major problem it is harder still to discussing suing that neighbor. Sometimes an owner or the owner’s close relative will bid on HOA work and even offer a substantial discount, but it is not worth it. There will always be someone claiming nepotism. Further, if that vendor needs to be taken to task, is the HOA willing to do so if it is a neighbor or a neighbor’s close relative? – Sincerely, Kelly READERS: Civil Code Section 5350 was added to the Davis-Stirling Act in 2014 and recites very short list of official conflicts of interest. It declares a conflict if voting on one’s own discipline, reimbursement assessment, assessment delinquency, architectural modification request, or grant of exclusive use common area rights. However, there are many other circumstances which are a conflict, such as the situations recited by readers E.L., C.C., and P.S. Protect your board’s legitimacy and avoid conflict or appearances of conflict.

Milkweed Feasting

By Norman Winter As we all strive to get our hands on every native milkweed for our states and to the ultimate benefit of the Monarch butterfly I thought I might plug its use for the other guys. Your first thought might be I’m talking about the Queen or Soldier butterflies that are related to the Monarch and also must have milkweeds as larval host plants. That’s important too, but I am speaking for the ability of the milkweed this time to be a nectar source for butterflies and hummingbirds. In other words, we love milkweeds because they are extraordinarily beautiful and intricate in their design making them great plants for the landscape or the backyard wildlife habitat. Of course, Monarchs, Queens, and Soldiers butterflies could not survive without them. If you stop and pay attention, however, you’ll notice milkweeds are like the ‘pollinator luncheon junction’ for an assortment of butterflies. Currently in the hill country of

Texas not too far from San Marcos, Wimberly and Dripping Springs you’ll find the Antelope Horn milkweeds (Asclepias asperula) blooming everywhere. My brother, scouting for monarch and queen caterpillars like everyone else, was stunned to find thirteen or more hairstreak butterflies and bees, too, hitting on the blossoms. I’m a hairstreak lover from way back so this excites me about as much as monarchs. There were gray hairstreaks and numerous Juniper hairstreaks. If you have never seen this green and rusty orange Juniper hairstreak with white bands you are missing a real treat. Speaking of hair streaks, I have been treated once in Texas and once in Georgia to what I consider the most beautiful of all, the Great Purple Hairstreak, appreciating the milkweed nectar. At the National Butterfly Center in Mission, Texas, I photographed the Red-bordered Pixie feeding on milkweed. Many enthusiasts have this butterfly at the top of their so-called must-see bucket list.

When you consider that hummingbirds and bees also frequent milkweeds then there is surely the impetus for the nursery industry to maximize production of milkweeds and the gardening public to open the pocketbook and purchase. Grow several of these, and your family will experience the whole lifecycle of the butterfly. The landscape itself will also become a picture of the color. Plant them in full sun with fertile well-drained soil, and you will find them to be virtually maintenance free. Once you have yours planted, then the fun begins. Unbeknown to you, unless you are watching, eggs will be laid, we call this ovipositing. These eggs will soon hatch into caterpillars that are as exotic looking as the butterflies. Unless you live in the South, you only see the Monarch caterpillar on your milkweed. This is a cause for family celebration. These caterpillars will eat, and they do so with a voracious appetite lasting for around two weeks. You might think this stripping of the foliage would prove to be the demise of the plant but in no-time, you will have more leaves and flowers. The caterpillars will seem to disappear. They will be attaching themselves head downward and shedding their skin. Now it is time to go on the hunt for what is known as a chrysalis. Chrysalis is another name for pupa. You will find these hanging almost unnoticed on the underside of the leaf, or a branch. I have also found them hanging from the wire of a nearby fence and even the eave of the house. The chrysalis looks green but in reality, it is clear, and colors become apparent as the Monarch gets closer to emergence. This is the kind of fun that the kids or grandkids will enjoy, and the experience will make lasting memories. Adding to the memories will not just be watching the lifecycle of Monarch butterflies but the graceful flight and nectaring of an assortment of butterflies and hummingbirds too!
