Everything else — from listing, advertising, virtual walk - throughs and open houses, and all document signing — are being done virtually.

If you are a seller needing to sell during the stay in place order, be prepared for additional COVID - 19 disclosures (to be signed by buyers as well), and for possible requests from your agent for you to participate in a Zoom showing, or to provide your wifi and password for a Facetime showing. If any visits to the property are absolutely necessary, be prepared to follow the guidelines your agent provides, such as limiting the number of people allowed at a time (two) and additional sanitary measures.

Installing a New Ceiling Fan

Kelly: Is the HOA required to supply the state a current list of the board members? Is the list available for public view? I am not a member of the HOA. — G.O. Dear G.O.: If you are not a member of the HOA, the only public information available is on the Secretary of State’s website – www. businesssearch.sos.ca.gov. This site will give you the correct legal name of the corporation (if the HOA is a corporation) and is updated at least every 2 years. It will also provide you the names and contact information for the CEO/President, Secretary and CFO/Treasurer (but often the management company lists its own address for each of the officers). Thanks for your question, Kelly. Mr. Richardson: I read your column each week in the [paper] and have learned many great tips. I have a question about board members talking to each other about issues outside of the meeting sessions. I prefer to make sure the association is always protected and indemnified with all contracts and work orders. In order to do so, I want to develop an agreement that would protect the association but would like to get input from my other board members. Does the Davis-Stirling act preclude any conversation, or interaction prior to a meeting to develop documents and reviews that would be brought to the open session board meeting for discussion and or approvals? — Thanks, D.G. Dear D.G.: If a quorum of the board is discussing an HOA topic at the same time or in email, it violates the Open Meeting Act. Civil Code 4090 says if a quorum of

the board discusses any item pertaining to the HOA, that is a “board meeting.” Civil Code 4910(b)(1) prohibits deliberations via email. Therefore, if you choose to discuss this issue with the board, it must be in open session, unless you are receiving attorney advice in a closed session. Your HOA attorney is the person who can help you all with your contract protections — that is their area of expertise and what they are licensed to do. Best regards, Kelly Dear Kelly: I am on our HOA board. Our homeowners are mostly apathetic to the HOA and never attend meetings. We have two open board positions out of three seats with only one person applying. Does the HOA still have to mail out costly ballots for our 2020 Annual Meeting when there is only one person running for the two open positions? It seems like a highly unnecessary cost to the HOA to pay for an election/ballots when there is no competition. Can the board simply notify the homeowners that due to lack of candidates no ballots will be sent? —Thank you, C.B. Dear C.B.: Unfortunately, California’s current HOA election laws are a “one size fits all.” There is no exception to the requirement of written secret ballots, no matter how small the HOA, or if the election is uncontested. A new law took effect this year allowing the election to be canceled if the number of applicants matched the open seats, except it only applies to HOAs of 6,000+ members! Our HOA election laws are impractical and need a reasonable legislator to take a look at them. Best, Kelly

Question: I want to install a ceiling fan in my daughter’s bedroom but there is not a fan or light on the ceiling currently. Can this be done easily or is it a big expensive project? Your Handyman: With all the hot weather that we had in recent summers, many Santa Barbara homeowners have been installing ceiling fans as a way to help keep a bedroom feel cooler during the night. A ceiling fan can be installed in a new location without a whole lot of work provided there is easy attic access above the bedroom and some of your homes electrical wiring is exposed in the attic. A ceiling fan does not require a large amount of power and in most cases be safely wired into an existing circuit for other lights in the house. Usually a ceiling fan is mounted in the center of the room but may have to be moved slightly from center depending on where the wood framing joists are located that support your ceiling. The weight and movement of a fan requires that it has strong support for the metal electrical box that it is attached to and the box, in turn, needs to be screwed to a piece of wood blocking that is nailed between the ceiling joists in the attic over where the fan will be located. In the case of no attic access, a fan box is available with expanding support brackets that connect into the joists by rotating a threaded steel sleeve while working on a ladder below the opening. The electrical connection is made using romex cable that is wired into a metal electrical box that is designed to support a ceiling fan, which then supplies power to the fan. Most ceiling fans now are available with a remote control so that a dedicated wall switch is not needed but if a wall switch is needed, then the job becomes a little bigger and a wire must be brought down from the attic to the new switch location which more than likely will require a little drywall repair and painting. This project is past the abilities of most do-ityourselfers and you should consider calling an electrician to make sure the job is done correctly and safely.

Question: We just recently purchased an older home in the downtown area of Santa Barbara and for some unknown reason the flow of water in our kitchen faucet has dropped by well over half while all the other faucets are still going strong. The house doesn’t have copper pipes, but the old steel pipes look like they are in good condition. Is our problem with our old pipes or do we need a new faucet? Your Handyman: It sounds like your home may have its original galvanized threaded steel pipes which are probably the culprit with your faucet issue. Steel pipes rust over time on the inside and a small piece of rust or mineral deposit may have come loose in the pipes and traveled to your faucet where it is now blocking the water flow. The first place to look for a blockage is in the aerator which is the little round ring covered with a screen that is on the very end of the faucet where the water comes out. The aerator should unscrew counterclockwise and you may find an accumulation of rust and mineral particles on the inside of the screen blocking water flow. If the aerator is clear, then you need to turn off the water supply valves under the sink and remove the center mixer handle on the faucet. There should be a little opening on the mixer handle that may be capped with a plastic plug that conceals the head of a hex screw that holds the handle in place. Once the handle is removed you then carefully unscrew the top cover of the valve which will expose the inside of the valve and the little rubber washers. This may be another spot where a piece of rust or mineral is causing a blockage. Always remember to take carefully notice of how plumbing parts are arranged before disassembling them or take a picture with your phone, so it is easy to put them back correctly, and be sure to cover the drain openings in case a tiny part is accidentally dropped into the sink. If the faucet still is not flowing well then it is probably time to call a plumber for an estimate on replacing your old pipes with new copper pipes.
