Who Handles Those Termites? By Kelly G. Richardson, Esq. CCAL

Dear Kelly: I live in a townhouse. My neighbor had termites and my other neighbor on the other side suspects them as do I. We were told by the association that it is our responsibility to take care of them. It just seems to me that termites come from the outside in and should be the responsibility of the association. Could you shed some light on this for me. M.N. Dear Mr. Richardson: Does the association have any responsibility to handle a termite problem originating from trestles (wood patio overhangs) that were originally installed by the builder and are part of the architectural design of the townhouses? Termites are entering the home due to infestation of dry rot and termites in these structures. R.M. Dear M.N. and R.M.: Termite infestations in attached housing affect not only those living in affected buildings but potentially affect all assessment-paying members if the damage requires expensive repairs to common area framing.Allocation of responsibility is provided by Civil Code Section 4780(a) which states that in condominium, stock cooperative, or community apartment associations, the association is responsible for repair and maintenance of common area termite issues, unless the CC&Rs say otherwise. You each describe your homes as “townhouses,” but that describes the homes’ architectural configuration, not the type of property ownership you have. A townhouse could be a planned development, condominium, stock cooperative or community apartment property. If the CC&Rs are silent and your association is a condominium (you own a “unit”), stock cooperative (you own a share of stock) or community apartment (you own an undivided equal fractional interest of the entire project) then under this statute common

area termite treatment and repair is HOA responsibility. Many associations are built in the townhouse style which are planned developments and owners’ deeds recite that they own a “lot.” In such associations under Civil Code Section 4780(b)the owners are responsible to handle their own termite prevention and repair issues, (again, unless the CC&Rs state otherwise).Attached planned developments such as townhouse buildings present a problem for the individual owners, because they cannot tent their entire building without permissionof each of the owners in that building. This can make it difficult for anything other than spot treatment to occur. Per Civil Code Section 4780(b), a majority of all the members can vote to allocate this responsibility to the association, or the association members may well vote to amend their CC&Rs to accomplish the same thing. Best regards, Kelly Dear Kelly: My HOA is not very diligent about termite prevention. I had subterranean termites come in through a crack in the slab foundation and ruin my wood floor. The HOA declines any responsibility for my floor because it is on the other side of the slab.They drilled holes in the slab and filled the cracks with epoxy.Do I have any recourse for the amount spent to repair my floor?Thanks, T.M. Dear T.M.: Your association may not recognize the fact that the termites entered through a crack in the slab, which crack the HOA has apparently agreed is HOA responsibility. Remind them that the problem originated from a common area issue and hopefully you all can work things out. Best, Kelly

Your Handyman By Mark Baird

Expensive Bird Food Question: Several years back my wife insisted on having a small waterfall and a shallow koi pond built in our backyard and I have since spent a small fortune feeding Koi to the local egrets, herons, and raccoons. My wife loves watching the Koi, but they don’t last more than a few weeks. I stopped replacing the Koi several months ago, my wife really misses them, and she is not happy at all with me over this issue. Is there any way to keep the Koi from getting eaten by our local wildlife population? Your Handyman: Koi can make for very expensive bird & raccoon food and even the most alert backyard dog will be hard pressed to provide constant 24/7 surveillance on your pond. Herons, egrets and raccoons have a lot of free time on their hands and if your pond is not constructed correctly, they will eventually can dine on your fish. I have known of several cases where homeowners have spent considerable time and money designing and installing water features in their yards, stocking their ponds with Koi, only to have the fish eaten in the first weeks by our crafty local wildlife. The solution is to consult with a Koi expert during the design process and my understanding as a non-Koi expert, is that the pond needs to be at a minimum 3 feet deep to allow adequate depth for the fish to escape the long saber like beaks of the herons and egrets. Less than 3 feet deep and the fish get shish-ka-bobbed by the bird beaks or snatched up by the nimble opposing thumbed paws of the raccoons. As far as a solution for your pond, we have built in the past a lightweight shallow framed box made from redwood covered with chicken wire that is staked to the ground over a shallow pond keeping the Koi in and the wildlife out. This may sound a little unsightly, but it works, and as the perimeter plants fill in through the wire mesh it will become a little less noticeable, your Koi will peacefully swim about and your wife will be happy again; and as a wise man once told me: “a happy wife makes for a happy life”. Question: We have an old spa on our back patio that we do not use because my husband has vertigo and I’m afraid he will slip and fall climbing in and out. We do not know how to get it out of the yard because it so big and heavy, and we had a new fence built a few years back that blocks the side yard through which it was originally delivered. This old thing has really become an eyesore that gets no use at all, but we don’t know how to get rid of it! Your Handyman: Many homes have older portable spa’s that are no longer used or have stopped working but remain in place because they can be exceedingly difficult to move, or a fence or gazebo was later built that makes it impossible to remove the spa intact. The solution is to cut the spa up into four or more pieces that can be lifted by two or three strong young workers and then removed from the yard. We have done this numerous times and it is accomplished using a Sawzall which is a reciprocating saw with a long blade that cuts through the plastic shell, interior insulation and hoses, and the exterior wood box. The electrical service connections need to first be disconnected and capped and the circuit breakers for the spa need to be turned off or removed from the circuit breaker box, all done by an electrician. The spa pieces are of course too big to be put out for trash collection but need to be loaded into a pickup truck and hauled to the dump, eventually to be buried in the landfill since unfortunately they have no recycle value.

For almost 50 years, the California Association of REALTORS® have participated in an annual Legislative Day in Sacramento. This event gives our REALTOR® members the ability to meet firsthand with their elected officials to discuss real estate issues. In recent years, we have had between 2,000 and 2,500 REALTORS® descending on the Capitol to make sure our legislators understood the importance of housing and home ownership. Due to COVID19, those meetings were largely cancelled last year. However, this year, we have our first virtual event ever planned. Legislative Day is important because legislators hear from REALTORS® about how policies impact real estate in their hometowns. In addition, it demonstrates the strength of the REALTOR® community by showing them how many of us are committed to spending time advocating for our industry and homeownership. Which is Best for Fast-Growing Privacy? Dear Jessica: Part of my 150-foot-wide property has been cleared for an inground pool. Next to my home are two-story homes that overlook my property from their second floor, so I’m looking to plant privacy shrubs that could grow up to 10 feet taller than my 6foot stockade fence. The area gets full sun from 11 a.m. to 6 p.m. I did some research on Green Giants, Leyland cypresses and arborvitae, and I’ve become overwhelmed. I understand that Leyland cypress grow 10-feet wide and deep. I don’t mind the width, but I’d prefer not to sacrifice yard space for their depth. I’m told that some shrubs have to be wrapped over winter, and I’d prefer not to have to do that. – Kelly Ann Russo

Dear Kelly Ann: I certainly understand your desire for privacy, and I’d imagine you’d like it sooner than later. You really can’t go wrong with either Leyland cypress (Cuprocyparis x leylandii) or Green Giant arborvitae (Thuja standishii x plicata, Green Giant). Green Giant can grow to about 60 feet tall with a width of 14 feet. It is denser than Leyland cypress, so it may provide better adjacent privacy, but that likely isn’t a major concern for you since they will be planted in front of a fence. Leyland cypress is a bit larger, with the potential to max out at 70 feet tall and 15 feet wide. Both have a growth rate of roughly 3 to 5 feet in height per year, but both will also grow into your yard space beyond your stated comfort zone. Other notable differences include color: Green Giant is pure green, whereas Leyland cypress leaves have a gray-green hue. Green Giant can handle cold temperatures a bit better, but Leyland cypress does better in heat, which could come in handy if your fence is made of a synthetic material such as PVC, which traps heat. Leyland cypress also can tolerate drought better. Green Giant has fewer pest and disease concerns. Both trees can be regularly sheared to manage their depth. It’s important to begin pruning as soon as the trees become established. You’ll know when that is by the first appearance of new growth. Water trees deeply a day or two before pruning, then start by trimming a couple of inches from all of the longer branches on each tree, cutting at the point where stems intersect with lateral branches. That will encourage new, denser growth. Repeat this in late spring and once more in midsummer during the next two growing seasons, also trimming the top terminal leaders (the vertical stems at the top of the tree) by no more than one-third their length each time. As the trees mature, you will be able to begin sheering their fronts, but take care not to prune or sheer into the deeper parts of branches that are bare and brown; new growth will not emerge from those areas.
