Tankless Water Heaters By Mark Baird Question: The water heater in our Goleta home is at least 15 years old and just this last weekend I noticed that it has sprung a small leak and water is collecting in the round pan that it stands on. My wife and I have read articles about how much less energy a tankless water heater uses versus the old tank style of water heater that we now have. Our home is a typical California Ranch style home that was built in the 1960’s with 4 bedrooms and 2 bathrooms. Can you give us some information on the pros and cons of installing a tankless water heater in our home? Your HandYman: There has been much written in the past few years about the energy efficiency of tankless water heaters, however things often are not as simple as advertised and you are wise to do your homework before making a purchase. The two basic types of residential water heaters can be classified as storage and tankless. The storage water heater is usually an insulated metal tank holding anywhere from 5 to 120 gallons of water, a typical residential tank is 40-50 gallons, and is heated by either a gas burner or an electric heating element. Cold water enters the tank at the bottom, hot water is drawn off the top and the “first hour” rating of the tank tells how much hot water can be provided in an hour. A storage water heater is constantly losing some heat through the walls of the tank even though it is insulated and a gas burning water heater loses heat additionally via the vertical flue that runs up the tank that heats the water when the burner is on. This loss of heat is referred to as “standby heat loss” and is one of the reasons that tankless water heaters were developed. However, new storage water heaters are so well insulated that no heat can be felt when you put your hand on the outside of the tank even though the water inside is quite hot. Since tankless heaters heat water on demand there is not any standby heat loss, however there is heat loss through the hot water supply pipes which increases with the distance the hot water has to flow to get to the point of use, which is the case also for the storage tank heater. In new construction, tankless water heaters are often installed at the “point of use” at a bathroom or kitchen, especially smaller tankless units in the bathrooms and breakrooms in office buildings, but in an older home they are usually installed in a central location when replacing the original storage water heater. Along with energy efficiency a big selling point for the tankless units is that they never run out of hot water if the right sized unit is installed for the number of bathrooms in your home. Another plus is that the size of the tankless heater is considerably smaller than

the storage tank unit freeing up room for other uses, and it can be mounted onto an exterior wall of your house or garage provided it is away from doors and windows so to avoid carbon monoxide venting into the home. Depending on which report you read, tankless water heaters are credited with energy savings of from 22% to 36% when compared to a properly sized storage unit in the same home. So far so good, however before you pick up the phone and start calling your plumber to schedule the installation of your new tankless water heater, there are a few especially important considerations that somehow are not so prominently explained in the manufacturer’s advertisements: Purchase & installation Costs: The tankless unit is considerably more expensive to purchase and to install than the storage unit. According to Consumer Reports, tankless model purchase costs range from $800 to $1,150 plus about $1,200 for installation, compared to $300 - $480 for storage tank heaters plus $300 for installation. These upfront cost differences in many cases pencil out to a 20-40 year payback period for the tankless heaters which is much longer than the expected life of the unit. utility service: The heating elements in both the gas and electric storage tank units are relatively small and usually do not require a very large flow of gas or electricity to keep your home flush with hot water. The burners in most gas storage tank water heaters range from 30,000 to 50,000 Btu (British Thermal Units) per hour which is not that much bigger than a large burner on your gas stove, and the gas supply can be adequately provided with a 1/2” diameter gas pipe. A gas fired wholehouse tankless unit sized for the typical Santa Barbara or Goleta home will have a gas burner producing as much as 180,000 Btu/hour and the largest units may have burners working at over 300,000 Btu/ hour, and a minimum ¾” gas supply line will be required which can be an expensive consideration if a new gas line needs to be plumbed. If the gas supply line is undersized, the burner will be starved for fuel, it will not operate efficiently, and other gas burning appliances in the home may also be affected. maintenance: The heating element in a tankless unit is a sophisticated copper heat exchanger that can be quickly damaged by the extremely hard water in Santa Barbara. In many cases the manufacturer warranty on the heat exchanger is voided if your home does not have a water softener and often a particle or scale filter is required in addition to the softener. Many tankless units require that the heat exchanger be flushed annually with a vinegar solution to remove scale and freezing may

also be a concern if the unit is installed on an exterior wall. In many cases this type of maintenance is more than the typical homeowner is able or willing to do and a service call from a plumber is needed or the maintenance is just ignored. A storage tank heater ideally should be drained and flushed annually, and its life will also be extended by a water softener. Flow rates: All tankless water heaters have a minimum flow or activation rate that must be reached before the unit will turn on and start heating water. In some units the minimum flow rate is as high as 0.5 or 0.6 gallons per minute which may be significantly more than a person will use when washing hands, brushing their teeth, or shaving. What this means is that in some situations you will need to use more water than you have used in the past in order for the tankless heater to start heating water. I have seen many installations where a 5-gallon electric tank water heater with a hot water recirculation pump is installed in tandem with the tank less heater(s) so that hot water is

available for hand washing and such. It would seem that this type of dual installation would create a net energy use increase for the home. So, it may be that after taking a careful look at all the considerations, a tankless water heater is not the best option for your home, and avoid the temptation to save money by purchasing a tankless unit that is undersized for your home’s hot water needs. Who is Responsible for Accidents at a Condo’s Social Club? By Gary M. Singer QUESTION: If a member of a social club (dance, tennis, karate, etc.) within our Condo Association gets hurt or does something that causes an injury to one of its members or guests, can the Condo be held responsible? – Bob ANSWER: Your association can be held responsible for the injuries to the extent that it was negligent in reasonably keeping the area and equipment safe for use. The person who caused the injury may also be on the hook. The law regarding this is not much different than any other facility negligence law. If your association manages the area when the club meets, or manages the club’s operations, then it has the responsibility to use reasonable care in making sure that both the facilities and operations are safe. The fact that it happens to be a community association that is hosting the social club means that the association will be held to similar standards to any other organization involved in the same activity. Besides making sure that the facilities are maintained and safe, your community should make sure it has proper insurance for the types of activities that are being offered, and that any instructors or assistants that are hired or approved by the association are properly trained and vetted. Like any other business would, your association should make regular inspections and timely correct any issues of concern. To be clear, the law does not require your community to be everywhere doing everything to make sure that no accidents happen — that is simply not realistic. Nor does the law make every injury someone’s fault because sometimes accidents just happen, despite every effort to the contrary. Under the law, the association has the duty to use reasonable care in making sure that no avoidable injuries occur. Gary M. The American Lung Association says that dust accumulation in carpets and rugs can impact allergies. And according to the Environmental Protection agency, carpets retain numerous sources of indoor air pollutants, including pet dander, insect allergens, particle pollution and everyday dirt and dust. Microscopic dust mites or mold can also take up residence in your carpets without being visible. All of these can be stirred up and released by walking across the carpet or using a standard vacuum. But a professional carpet cleaning service can use steam cleanings, special shampoo formulas, and high-powered vacuums that remove these deeply trapped pollutants safely. HIRING A CARPET CLEANER The frequency of carpet cleanings depends on the amount of traffic your carpet receives, as well as the household environment. Low-traffic carpets may only need to be cleaned yearly. Households with pets, smokers, children or large amounts of foot traffic should be professionally cleaned two to four times per year. Carpeting is one of your home’s most valuable and visible assets, so you want to select your cleaner carefully. When you hire a carpet cleaning service, ask exactly what is included in the quoted price. Will they move furniture for you? Will they clean hightraffic areas? Does it cost extra to clean stairs? You also want to be sure they screen their employees and conduct criminal background checks. Ask what certifications they hold from reputable cleaning organizations, such as the Institute of Inspection, Cleaning and Restoration Certification. Homeowners have several options when it comes to choosing the type of carpet cleaning method. Some cleaning services use a wet cleaning method, or steam cleaning, that has a significant drying time, while others are considered “dry” treatments, which you can walk on as soon as the cleaning is finished. Some treatments use powerful cleaning chemicals, while others rely on the power of steam or environmentally friendly cleaning products. You want to choose a company that offers the treatment method that works best for your home and family. Take care when listening to promotional carpet cleaning rates. Insist on an in-home estimate to get the best estimate possible. Be very skeptical of carpet cleaners who keep piling on extra services and costs after they’ve given an initial price. Some companies offer a low price simply to get a foot in the door, then identify many other issues to upsell costly services. Double-check your carpet manufacturer’s documentation for cleaning details. Some methods will void a carpet’s warranty.

Amending CC&Rs is not easy. Here are some tips to avoid making it harder. 1. Check with the members. Amending CC&Rs usually takes a supermajority (i.e., more than simply a majority of the quorum), so a good idea isn’t enough – it still needs widespread support. A great proposed amendment is meaningless if the homeowners will not vote for it. 2. Avoid controversial amendments. Be aware of subjects which could be very upsetting to some members. Avoid issues on which a widespread consensus cannot be achieved, such as changing assessment allocations or unpopular use restrictions. 3. The board can pass some amendments. Certain amendments can be approved in an open meeting by the board such as amendments deleting developer marketing provisions (Civil Section 4230), removing illegal discriminatory restrictions (Section 4235), or changing the old Civil Code references to the current (Section 4235). 4. Get out the vote. Many members think abstaining is OK if they don’t have time to read everything, but that hurts the amendment’s chances. Divide the community into sectors and assign each sector to volunteers. Apathy is usually the greatest frustration to amendments. 5. Didn’t meet the number? Don’t give up. Civil Code 4275 allows HOAs to file a court petition seeking judicial approval so long as over 50% of all members voted in favor. These petitions really should be viewed as a last resort, due to the legal, mailing, and copying cost involved. 6. The EXACT text of the amendment must be sent out with the ballots, per Civil 5115(e) - even if it was already previously distributed. Help members by sending TWO versions - one “redlined” showing what is being removed and what is being added, and another “final” version

showing the section as it will read after amendment. If your association is pursuing a complete rewrite of your CC&Rs, a redlined version may not be helpful because the new document may be organized differently. Instead, consider distributing a summary of “highlights” of what will be new or different in the proposed CC&Rs. 7. While trying to amend CC&Rs, consider whether bylaw amendments are also needed. More may be accomplished with the same vote (and effort). Bylaw amendments usually require less votes to approve, and if apathy strikes, a court can still order them approved under Corporations Code Section 7515. 8. Normally, boards explain to members why the proposed amendment should be passed. If some members strongly oppose the amendment, the Wittenberg v. Beachwalk case reminds us that a board cannot prevent others from expressing opposition. If there is a significant amount of disagreement, the HOA should slow down and work toward building a consensus. 9. Have attorneys prepare proposed amendments. CC&Rs are a legal document. I occasionally learn of clients recording amendments which unknowingly violate the law or contradict another part of the CC&Rs. The association attorney should be involved throughout the amendment process. 10. Along with the desired amendment, add an amendment reducing the supermajority. If the HOA is putting in the huge effort to achieve 75% or 67% approval, include an amendment reducing that to 51% so future amendments are more achievable. 11. Record the amendment. Once the amendment is filed with the County Recorder it automatically binds all present and future owners. Good luck with your update!

How Should I Baby-Proof or Child-Proof My Home?

By Paul F. P. Pogue If you have a little one on the way, one of the most important steps to take is baby-proofing and child-proofing your home. You can hire a professional childproofing company to examine your home and provide a full list of recommendations. Most of the time, they can install the products at the same time. But you can also take steps on your own to make your home safe for the little ones. WHAT SHOULD I BE LOOKING FOR WHEN CHILD-PROOFING? You’ve probably already thought about some of the basics: baby gates on stairs, child-proof locks on doors and cabinets, bumpers on table corners and other potentially dangerous furniture. In addition to that, go through your house and look for potential danger zones. Kitchens and bathrooms hold particularly high danger levels. Take special care to make sure knives and cleaning chemicals are well out of reach and secured behind child-locked doors and drawers. Knob covers on stoves prevent your child from accidentally starting up a heat source. Keep an eye out for choking hazards. Cords from blinds can easily entangle a child. Replace your blinds with cordless blinds if possible, or use a cord safety device. In addition to baby gates on stairs, consider other areas of your home that would benefit from a safety barrier, such as fireplaces. This is good advice in any situation, but always worth remembering for your family’s safety: Install smoke detectors and regularly check them.

WHAT ’S THE BEST WAY TO BABY-PROOF FURNITURE? Babies and small children can get into places and climb things you’d never expect. First off, install straps and anchors to large and unwieldy furniture, such as dressers and bookcases, to prevent them from falling over. Cabinet latches and locks are a must as well. Carefully read the instructions on any safety equipment you install yourself. A poorly installed safety feature can be worse than none at all. HOW SHOULD I BABY-PROOF THE ELECTRICAL OUTLETS IN MY HOME? If your home was built after 2008, your outlets are already babyproofed to a certain degree. That’s when the National Electrical Code started calling for tamper-resistant receptacles, which block off access unless both slots are pushed in simultaneously. If you have older outlets, an electrician can easily replace them. (The cost will depend on the number of outlets.) Of course, it’s always a good idea to add another layer of protection. Outlet caps remain a longtime standard, but they’re also a choking hazard. Instead, place sliding outlet covers on the plates. You can buy these for a few dollars per cover and install them yourself. HOW CAN I PROTECT MY SMALL CHILD AGAINST POISONING? The most important step in poison prevention is keeping dangerous materials away from kids. Medication and household cleaning chemicals should be locked in cabinets, high up and out of reach. Keep your state or local poison control center’s phone number close at hand, so you can find it easily in the event of an emergency. And when you have household cleaners or medications out for use, keep a sharp eye on them — it only takes a second for a child to get into them.

Mountain Laurels Make Spring Even More Incredible By Norman Winter The mountain laurels that bloom in the South add to what has been an incredible spring. No doubt under Mother Nature’s watch full eye the mountain laurel bloom will progress northward in amazing fashion. Stunning is a word I often use to describe a particular plant but today that word is reserved today for the apparent lack of utilization of the wonderful large shrub or small tree that is native from Louisiana to Indiana eastward to Maine and then down to Florida. With that huge geographical range, we hopefully have answered your first question, no you don’t have to have a mountain to grow it. Yet you’ll find them along mountainous roads, and a wide variety of habitats. In fact, if you grow azaleas, rhododendrons or blueberries you are a prime candidate for a mountain laurel, and I say let it happen. Botanically speaking the mountain laurel is known as Kalmia latifolia. When you first see it in full bloom you start to think could they possibly be some kind of rhododendron. They indeed are in the Ericaceae family so they are related. You’ll find them in some of the most spectacular scenery in our country. My wide Jan and I were doing a little mountain laurel hunting with the camera and found breathing taking old specimen hanging over the gentle rapids of Palmetto Creek in Harris County, GA.

MOUNTAIN LAURELS

Trout fishermen in the Blue Ridge mountains tell of seeing them hanging over the Toccoa, Chattooga and Nantahala rivers. You’ll find them in residential areas too so you do not have to have a river either. Morning sun and afternoon shade is the common joke around my house. While that would be perfect know that you’ll find them in more shade and more sun too. They can reach 15 feet in height and look dazzling at less than six feet. That can be their spread as well. What you’ll notice on older specimen is gnarling, curving trunk with branches that look as though they have a story to tell of times past and things they have experienced. This stout wood was once used for handles of tools. If you ever have the chance to stand in front of an old timer in bloom you’ll leave feeling as though you have just experienced something grand in the world of plants and that perhaps you have just been taught a lesson on beauty, patience and perhaps a persevering spirit. So, in the home landscape we recommend the mountain laurel to be planted in fertile, humus rich acidic soil that drains with fervor. If you have tight heavy soil don’t fret plant in raised beds. In one of my favorite spots along a smaller moving creek I can see rose pink, light pink and white native ones all growing with mere feet of each other. A search on line shows you the rich colors that are available. The flowers are so exotic in their design. They are borne in terminal clusters, each measuring up to an inch and giving the distinct look of being a five-sided cup. As I mentioned ours are blooming now in late April but in your area your bloom could be June. Wouldn’t it be fun to just follow the mountain laurel bloom across the county finishing in Maine? It would probably be even more rewarding to plant some at your home that your children and grandchildren would experience over the years. Then someday whether your descendants, or someone else’s, they would look with amazement and learn a lesson of perseverance with the gnarly branches and beautiful flowers. If you’re using it for little more than a trash bin storage and the occasional home project, now’s a good time to take the plunge and convert your garage into the hobby space, home gym or guest apartment you’ve always wanted. els are currently one of the hottest trends in home improvement. And the sky’s the limit when it comes to your options. Here are a few important considerations to get you started. THINK THROUGH YOUR PLANS A garage conversion is a major remodel, so it’s important to take the planning process seriously. Will you be converting the space for an everyday-living purpose, such as a new

bedroom for a family member? Or will you use it for hobby or entertainment purposes? If you turn your garage into a motorcycle repair zone or the ultimate billiards room, will you still be able to get your car inside? These decisions are entirely up to you, but be sure you understand and prioritize your needs and wants up front. BE REALISTIC Improving garage organization with custom cabinets and hangers may require an investment of a few thousand dollars. But converting a garage to a living space, adding a car lift or installing significant hobbyist upgrades could escalate into an investment requiring tens of thousands of dollars. It’s important to know what you’re getting into up front. And it’s also important to understand that converting your garage for other uses may make your home less desirable to potential homebuyers in the future. CONSIDER THE LOGISTICS AND SAFETY If your garage isn’t already insulated, you may want to install insulation to create a comfortable living area. You’ll also want to talk to an HVAC company about routing heating and air conditioning to the garage if it isn’t already equipped. Of course, depending on the purpose of your conversion, you’ll probably want to keep lighting, electricity and running water in mind as well. Garages are constructed with different safety rules and considerations than living areas. If you still have a standard garage door, you’ll need to ensure proper clearance for its safe operation and see to it that the electronic sensor eyes aren’t blocked. Garages have different ventilation requirements as well, particularly if you run any kind of flame source

or gas heater on a regular basis. An expert can help you determine how to safely consider these problems. GET THE RIGHT PERMITS Talk to your local building inspector and be sure to obtain any necessary permits for your garage project. General improvement, storage upgrades and similar projects rarely require municipal compliance. But major additions, living space conversions and the addition of mechanical structures such as car lifts may require the involvement of your state and local governments. If you skip this step, you could run into trouble if and when the time comes to sell your home. Additionally, keep in mind any historic district rules or neighborhood association covenants that apply to your property. You don’t want to spend $10,000 only to find out the association committee disapproves. And of course, be sure to hire a licensed, bonded and insured professional to do the work. One more thing: If you’re modifying your garage in a way that will keep you from storing your car, be sure to inform your insurance company. This could affect your premiums.
