Mary Arnoult Mary Arnoult is now the 2021-2022 Chairman of the Las Aletas Auxiliary of the Assistance League® of Santa Barbara. She has been a member of Las Aletas for 3 years, and previously held the position of Vice Chairman of Membership and Chairman of the Nominating Committee. Ms Arnoult is retired from SBCC where she was in the Human Resources Department as the head of Student Employment. As Chairman of Las Aletas, Ms. Arnoult will head a membership of 60 women, be the liaison to the Assistance League® of Santa Barbara and oversee the continued development of its’ three philanthropies: Operation School Bell®, Kids on the Block, and Operation Bookshelf, which support children and the elderly in Santa Barbara. Las Aletas also supports the Assistance League® of Santa Barbara in their Thrift Shop and their 16 philanthropies. HOA Insurance Is The HOA’s Coverage Sufficient? By Kelly G. Richardson, Esq. CCAL
Breaking Down the Types of Commercial Leases So you have found the perfect place for your business and it is time to negotiate the lease. Aside from the basics such as term and rent, what should a tenant (Lessee) be looking at in their commercial lease? There are three main types of commercial leases and depending on which one the property owner (Lessor) wants to use will determine what your responsibilities are as the Lessee. Who is paying the real estate taxes? Who maintains the air conditioning? Who is responsible for utilities? These are not small expenses and depending on the lease used it can make the difference in making your business successful. There are three main types of commercial leases; triple net (NNN), modified gross (MG) and full service gross (FSG). A triple net lease (NNN) means that in addition to paying your base rent you are also responsible for your proportionate share of property taxes, insurance and common area expenses for the property. The charges are not limited to those three items but they are the big ones and thus why they call it a triple net lease. There is very little that is not passed on to the Lessee by the Lessor and these types of leases are preferred by Lessors and usually used for investment properties. A Full Service Gross (FSG) lease is one where the rent that the Lessee pays is inclusive of everything, including utilities. These leases are the simplest in terms of a Lessee understanding their responsibilities. They pay a single amount and the Lessor covers the costs for everything. Often times these types of leases will have an expense stop or cap where a Lessee may be responsible if the expenses exceed a certain level. This type of lease is most popular for Lessees for obvious reasons. Modified Gross (MG) leases are a middle ground between NNN leases and full service gross leases. In a modified gross lease, the Lessee is responsible for paying the rent and utilities and, depending on how the lease reads, a portion of the common area expenses. In some leases, the Lessee is responsible for any increases in the expenses after the first year. This type of lease is very flexible in handling expense responsibility and so they can be a good compromise for Lessors and Lessees.
Insurance brokers are one of an HOA’s most important vendors, yet they are often ignored until claims arise. This mistake can be costly. Insurance is a contract in which the insurer accepts a fee (“premium”) and in return agrees to pay for certain incidents of damage (property insurance) or claims of liability (casualty insurance). Because insurance is a contract, it is critical to understand the contract’s limitations. Here are six questions to carefully consider. 1. Is there a deductible, and how much is it? The deductible must be paid by the insured HOA before the insurance company pays the first dollar of damage reimbursement. Also, what are the limits of the insurance? Is there enough insurance to cover the amount of the damage? 2. What are the exclusions in the insurance contract, where the insurer states that it will not pay on certain kinds of damage incidents? Mold, mildew, or dry rot damage are commonly excluded. It is important to understand the exclusions, as there is contractually no insurance for the items excluded from the insurance policy. 3. How much of the HOA property is covered by the insurance for damage to the property? Does it cover all the buildings and improvements? One HOA discovered to its shock during the wildfires two years ago that its asphalt streets, heavily damaged by the conflagration, were not included in the definition of “covered property.” Pay close attention to which elements of the property are covered by the insurance. 4. How much insurance does the HOA have? Particularly with a condominium association, in which the HOA is normally responsible to rebuild the structures, it is important to review the valuation of the property. If the HOA has a stated value of the structures at $5 million but the actual repair cost is $10 million, where will the HOA find the additional millions to re-
store the property? Talk to your insurance broker annually to review the valuation of the insured elements of the HOA complex, and make sure there is enough insurance to cover a catastrophic loss. 5. Does the property damage insurance include guaranteed replacement cost or building upgrades required by more recent building code updates? These factors can prove to be vital issues especially in older buildings. 6. Does the insurance policy match the association CC&Rs? Often boards are upset because the insurer pays on a property damage claim where the HOA has no liability. However, with property damage insurance, the insurer insures any damage occurring to “covered property.” The insurer responsibility to pay a property damage claim has nothing to do with the CC&Rs but everything to do with what the insurance policy covers. In condominium, stock cooperative, or attached planned development properties, the CC&Rs do not always match the insurance regarding what is covered within residences. Some HOAs have CC&Rs requiring the HOA only to restore walls, floors, and ceilings to a condition ready for finishes and fixtures (a “bare walls” approach) but its insurance covers all the common area and the units (“walls-in”). Conversely, if due to insurance costs the HOA prefers a “bare walls” insurance approach, make sure the CC&Rs do not require a “walls-in” responsibility for the HOA. Talk to the HOA insurance broker annually to keep on top of the property insurance coverage. [Next week- Liability and specialized insurance]
These descriptions are not absolutes and often times Lessors and Lessees can negotiate terms that will alter these in order to work in a specific situation. That is why it is important to have an experienced commercial real estate agent working for you in your negotiations. They see dozens of leases every year and will be able to assist you in negotiating the best terms for your agreement.

Here are five effective ways to boost your home’s curb appeal this spring. 1. CLEAN THE EXTERIOR The first step to achieving great curb appeal is to start with a clean hose. Power washing the exterior is a great way to remove accumulated dirt, grime and moss. Clean the windows and make sure they’re all clear and sparkling. If you can’t reach them all, consider hiring a pro to help. Get into the gutters and the roofline to remove all dirt, leaves and branches. 2. REPAIR MASONRY If your home’s masonry is showing signs of age, it may be time to call out an expert to repair or restore it to its original pristine glory. Shasta Daisies Sizzle in the Landscape and Containers Too! By Norman Winter A recent visit to The Landings shopping center in Columbus Georgia taught me a little lesson. I have been too restricted in my thinking when it comes to selecting plants for mixed containers, Shasta daisies to be exact. I love Shastas, and always have, but thought they were for cottage gardens, wildflower patches, and picturesque perennial plots. I just never thought about the joy shoppers would receive by their beauty as they passed mixed containers going from their cars to their favorite restaurants or boutiques. However, while I have treasured varieties like Becky the Perennial Plant of the Year and best allaround Shasta ever, and the delectable looking Ice Star, I had never tried Banana Cream. That sounds edible too! Banana Cream has been out a few years and is the first Shasta with creamy yellow overtones. The 4- to 5-inch flowers are produced over an extended time. Yes, gardening friends, Shastas are for mixed containers and wherever else you want them in the garden too! This is the flower that little girls and young ladies alike find most enchanting with dreams of them having a prominent place in their wedding someday. The pristine, glistening white flowers that light up the spring and early summer like no other plant, now comes with a dash of creamy yellow. The Shasta daisy whether you choose Banana Cream, Becky or the famous Mt. Hood, in more northern areas, can last in the garden for a number of years with proper bed preparation. Choose a site with six hours of sun and a little afternoon shade protection. The soil must be fertile, organic-rich, moist, and very well drained. If plagued by tight heavy soil that doesn’t drain, then amend with 3 to 4 inches of organic matter and till to a depth of 6 to 8 inches. This regimen gives clear indication why they have the ability to work so well in mixed
containers as potting soil certainly drains freely. Space plants 12 to 15 inches apart. Plant at the same depth they are growing in the container. Apply a layer of mulch after planting. Of course, in mixed, designer type containers you’ll be using the Shasta most likely as a pocket or filler type plant complementing all of the other companions. Maintain moisture through the long, hot summer and feed with a light application of fertilizer every 4 to 6 weeks. Keep the flowers deadheaded for both a tidy look and increased flower production. Vigorous varieties like Banana Cream and Becky will repeat. Divide in the fall, spacing as recommended. This will be a yearly event if you want the best blooms and healthiest plants. They combine wonderfully with blue salvias, purple coneflowers, and the old-fashioned cut-flower type zinnias. Shasta daisies are native to Portugal and the Pyrenees and yet they look as if they were born for Grandma’s cottage garden and yes, mixed containers too. There is nothing that will put a spring in your step and a joy in your mood quite like a Shasta.
