Pandemic Questions Continue By Kelly G. Richardson, Esq. CCAL

Kelly, I am on the board and we are having our first HOA virtual meeting next week because of Covid-19. Do we need to have a quorum for that meeting? I appreciate your help and enjoy your HOA Homefront each week. – R.S. Dear R.S.: The declared state of emergency in California does not mean the Open Meeting Act or your bylaws have been suspended. Many HOA boards are mistakenly thinking that everything now is an emergency, and thereby dispense with the required transparency under the law. Quorum, notice to members, and openness are still the requirements, even during this emergency. Civil Code Section 4923 defines “emergency” as “circumstances that could not have been reasonably foreseen” requiring immediate action. There are few topics which cannot wait four days for proper notice to members. Also, meetings can still be in the open. Telephonic or electronic meetings are permitted by Civil Code 4090(b) and 4925(a) – so there is no reason to hold improper closed or emergency meetings. Even in times such as these, proper association governance is not suspended – there is no “HOA martial law” in effect. – Best regards, Kelly Dear Mr. Richardson: Our residents are concerned about cases of Covid-19 in our HOA. Our manager told us that legal counsel said because of HIPAA rules they are not obligated to report if there are or have been any active Covid-19 cases. We are not asking for names, just a knowledge of whether there are or have been Covid-19 cases. What is our HOA responsibility in this matter? E.K., Oceanside

Dear. E.K.: I have had many association clients with rumors circulating about illness and even COVID-19 fatalities, but associations have no greater right to know residents’ medical information than anyone else. Some of my client boards have been in the same situation, with homeowners wanting to know what the HOA also does not know and cannot share if it did know who was ill. Most California homeowners associations have been doing a wonderful job to reduce the risk of contagion by closing recreational facilities and otherwise thinking of ways to reduce the risk of transmission of the virus. However, sharing medical information (even if the HOA had it) is probably outside the HOA’s role, even during a pandemic. Best regards (and looking forward to reducing “Safer At Home” soon), Kelly. Dear Kelly: I received a letter from my HOA notifying me of a large (over 10%) increase in my monthly dues. This is an outrage to subject people to this type of nonsense during the health and financial crisis in the world. I was unable to find anything in current legislation covering HOA payment increases similar to the rent increase cap. Is there anything that can be done to prevent this increase? Is there anything you can do to help shine a light on this? – Thank you, D.C. Dear. D.C.: Per Civil Code Section 5600, associations may only assess for actual expenses. If your association is having a shortfall in its ability to meet expenses, those expenses are yours as much as anyone else in your HOA. It would be wonderful if HOAs could have all vendors hold off on billings, but HOAs must meet their bills, pandemic or not.

Ice Maker Stopped Freezing Question: The ice maker in our kitchen freezer all of a sudden has stopped working. The freezer is only a few years old and was working fine up until last week. Is there an easy fix for this problem or do we need a new ice maker? Your HandYman: The first thing you want to check is to make sure that the water supply to the ice maker has not been turned off. Usually the water to the ice maker is supplied via a small plastic or copper tube from a water filter or reverse osmosis system under the kitchen sink, or from a small angle valve located on the wall behind the refrigerator. Also

check to make sure the small moving bar in the ice maker is in the correct position and is not jammed up on a piece of ice. If your water supply is on and the ice maker arm is not jammed, then it is most likely that the little water supply spout inside the ice maker has frozen over and is not allowing water to flow into the ice tray. Simply turn off the freezer, thaw out the ice maker using a hair dryer for about 10 minutes or so and the ice maker should start back in producing ice. If this doesn’t work then it is time to call an appliance repair service.

Door and Windows Need Weather Stripping Question: My husband and I recently purchased a home in Montecito that has beautiful custom wood doors and windows, but they are very drafty and daylight can be seen at many places when they are closed. There is a little grove or slot cut into the inside edge of the door and window frames but there is no weather stripping of any type. What can be done to seal up these beautiful doors and windows? Your HandYman: Many better quality doors and windows often have a brand of weather stripping called Q-LON that comes in long strips that with a barbed plastic fastener that inserts into a cut in the door or window frame that is referred to as a kerf. A kerf is simply a groove in the wood frame that is the width of a single cut of a saw blade. Your doors and windows had Q-LON or a similar weather stripping product in place originally but they may have been removed by painters who didn’t

come back after the paint dried to reinstall them. Q-LON can be purchased at most hardware and window stores and is made from urethane foam wrapped in a polyethylene coating, it is weather and UV resistant, does not stick to paint and stains, and most importantly it retains its original shape over many years of being compressed when the door or window is shut, thus providing an excellent weather seal. Try to purchase the new Q-LON in strips of sufficient length so they can be installed in continuous pieces rather than use multiple pieces in one run. A common way to insert the Q-LON barbed fastening strip into the kerf is by using a small piece of wood trim or a paint mixing stick rather than using a metal tool like a screw driver and risking a scrape or gouge in the window or door frame. Once the Q-LON strips are all fitted back in place your doors and window should be weather tight and sealed.

Put Bee-Friendly Flowers Anywhere with Portable Pollinator Gardens

By Debbie Arrington To bees, size doesn’t matter. They don’t care how much space a landscape may cover. These pollinators prefer to focus on flowers. And they will find them. On patios or decks, in window boxes or wine barrels, bees will come buzzing if they discover something they like in bloom. “When we talk about pollinators, we (garden experts) make it all really complicated,” said Ellen Zagory, director of public horticulture for the UC Davis Arboretum. “We stress to plant for a long season of bloom and offer lots of (plant) suggestions, but that’s mostly for people with a big garden and a lot of space. “But you can still have pollinators in a smaller space, like a deck or a patio,” she added. “Anywhere the flowers can get sun.” The key: Create a portable pollinator garden. “It’s small and easy,” Zagory said. “Then, you can relax and enjoy it. You can move it around to find the right spot. The bees will like it, too.” The plight of honeybees, threatened by Colony Collapse Disorder, continues to concern gardeners as well as environmental and agricultural experts.

“It’s not just the honeybees,” Zagory said. “All the bees need help.” By adding pots of nectar- or pollenfilled flowers, gardeners can help bees in spots that are usually barren. “People just want to do the right thing, but they don’t know what to do,” Zagory said. “So, we’ve tried to simplify (recommendations) to make it easier.” For starters, try a trio. Choose three different flowering plants for the same large pot. “Think of it like a flower arrangement: One tall, one medium, one lowgrowing,” she said. “Thrill, fill, spill; a tall plant provides the thrill, the medium fills the middle while trailing plants spill over the edge.” Anything in the daisy and mint families are candidates for bee-friendly containers. Zagory recommends blanket flowers (Gaillardia) with their “thrilling” red, orange and yellow petals. For spill, little seaside daisies (Erigeron) attract little native bees while cascading over a container’s rim. As fill, colorful catmint (Nepeta) pumps flowers into any gaps. Zagory has become a devoted proponent of pollinators, adding flowers that will attract bees, birds and butterflies wherever she can. In the arboretum’s Terrace Gardens, a broad concrete walkway became a bee

oasis with the addition of 45 large containers, planted mostly with low-water blooming perennials. “The pots ranged from 10 inches to 3 feet across,” Zagory said. “I experimented with lots of different combinations.” Artichokes and wallflowers, geraniums and salvias, oreganos and succulents; they provided portable color as well as minibee havens. “Some plants work better in pots than others,” she added. “Succulents will last a long time (grown) in a container. They can go five years (without replanting or dividing), they’re so adapted to that space.” Among her favorites in her container experiment: Sedums. Also known as stonecrops, these plants can take a lot of abuse and adapt well to life in pots. Bright yellow Palmer’s sedum blooms throughout winter and early spring while Autumn Joy puts on its flower show in fall. “California natives, on the other hand, outgrew their pots right away. One goldenrod can fill a whole large pot on its own. The plants grow so fast, you can’t water them enough.” The asset that allows native plants to adapt so well to drought works against them in a container. “It’s their roots,” Zagory explained.

“California natives have such strong roots. They grow out and down, in search of water. Their root systems quickly fill the whole pot.” Only the smaller native perennials such as the seaside daisy coped well with multi-season confinement in a container garden. Annuals such as dwarf sunflowers and California poppies produce flowers quickly and can grow in deeper containers, Zagory noted. “There are a lot of really good annuals that you can try. Remember: They need sun.” When planting a portable pollinator garden, start with good commercial potting soil, Zagory instructed. “Don’t use garden soil. We have too much clay. In the container, it shrinks and pulls away from the sides. (When irrigated), all the water goes down the sides and doesn’t hit the roots. where it’s needed.” Also, keep in mind that you want those plants to grow. Start small and let those transplants mature. They’ll be happier and bloom more. That makes the bees happy, too. “Plants need room to grow,” Zagory said, “even in a container.” Distributed by Tribune Content Agency, LLC.
