Does Your HOA Have ALL It Needs?
Fire on the Mountain
By Kelly G. Richardson, Esq. CCAL The previous column discussed considerations regarding property insurance, but that is only one of many insurance types which most HOAs should have in place. First and foremost is liability insurance. This is the insurance which covers claims of negligent damage or injury affecting persons (owners, tenants, or visitors) on the property. Civil Code Section 5805 protects the individual members of the HOA from being sued personally just because they are HOA members, so long as the HOA has at least $2,000,000 (100 or less members) or $3,000,000 (over 100 members) in liability coverage. HOAs should discuss with their insurance broker and legal counsel what amount of liability insurance is appropriate, since an allegedly injured party could seek damages beyond the limits of the insurance, and that financial impact on the HOA could still later be passed along to all the members in the form of a special assessment. Directors and Officers Insurance adds a layer of protection for the unpaid volunteer directors who are making important decisions each year, and who are exposed to lawsuits from unhappy homeowners. Civil Code Section 5800 provides for immunity for HOA directors so long as the HOA carries at least $500,000 (100 or less residences) or $1,000,000 (over 100 residences). This should really be a non-negotiable item for every HOA director in California — make sure the HOA has that insurance in place before joining the board. Just like with general liability insurance, discuss with the broker and legal counsel the recommended coverage levels, as many HOAs may find larger limits of coverage more desirable. Individual owners should have their own homeowner insurance policies, insuring their lot or unit from liability and from property damage incidents. Many condominium associations have little or
no responsibility to restore a unit beyond bare walls ready for fixtures and finishes, and the condominium owner without an “HO6” insurance policy may find themselves in dire circumstances if the HOA property insurance does not cover finishes, fixtures, or belongings inside the unit. Fidelity insurance insures against losses from dishonesty by persons handling HOA funds. In 2018 Civil Code Section 5806 was enacted, requiring all HOAs to have such insurance covering directors, officers, employees, and the management. The insurance amount must match or exceed the total of the HOA’s combined reserves account balance and three months of HOA assessments. Earthquake insurance is often a subject of discussion in HOAs due to the potential high damage from major seismic events and the insurance’s high cost and high deductible. Some HOA CC&Rs require such insurance, but most do not. Even if the final decision on such insurance is within the board’s authority, consider taking time to first disclose to the members the pros and cons. Workers compensation insurance is a good idea for HOAs, even those which apparently have no employees. The definition of “employee” was substantially broadened in 2020, so someone who might have been an independent contractor in 2019 might be an employee in 2020. HOAs should check with their insurance broker about having a minimal workers compensation insurance in place. Injured employees are mostly limited to the workers compensation insurance benefits if that insurance is in place. California Fire Season is Upon Us It was May of 2009 and the Jesusita Fire was quickly spreading through the hills above San Roque and threatening to cross Foothill Road in several areas, potentially turning catastrophic. We raced to evacuate the area and headed to Los Angeles to stay with friends. In what felt like a sign of sympathy to our situation, the Grateful Dead played “Fire on the Mountain” at their May 9 show at the Forum. That fire ended up burning almost 9,000 acres and destroyed or damaged 80+ homes. It does not even come close to the impact from the Thomas Fire or other historic fires but it was the first one that caused us to evacuate so it will always stand out in my mind. Summer is almost here and that means fire season is here as well. New laws are going into effect this summer that will affect homes sold in the high or very high fire severity zones. A good bit of Santa Barbara falls into those zones and that means that homes being sold will have to provide documentation that they are in compliance with maintaining a defensible space or “buffer zone” between the home and flammable materials such as grass, trees or wildland areas around the property. There are a few ways to comply with this law. There will be some areas without a local ordinance requiring an owner to obtain documentation of compliance with the defensible space laws. In this case, the buyer must agree to obtain documentation of compliance within one year after closing escrow. Alternatively, if the seller has obtained documentation of compliance within 6 months prior to entering into contract, the seller must provide that documentation to the buyer and provide information on the local agency from which a copy of that documentation may be obtained. For areas that have a local ordinance requiring an owner to obtain documentation that the property complies with defensible space laws then one of two things can happen. The buyer can agree to comply with the requirements of the local ordinance, if the ordinance allows the buyer to do so. Alternatively, the seller shall provide the buyer with a copy of the documentation that complies with the requirements of that local ordinance and information on the local agency from which a copy of that documentation may be obtained. It is critical to remember these requirements when purchasing your home. Discuss the requirements with your agent and your insurance carrier. Vigilance is a small price to pay to live among such beauty.

Running Toilet Question: The toilet in our guest bathroom runs intermittently without any rhyme or reason and I cannot seem to get it to stop. My wife and I are light sleepers and this toilet wakes us up several times a week. What can be done to quiet this commode down or should it just be replaced? Your HandYman: A toilet is a simple device that we all take for granted and is typically easy to fix when not working properly. The problem that you are describing usually is caused by one of two different issues. The first issue is when the rubber flapper valve is not seating properly onto the drain hole in the tank due to deterioration of the flapper or from mineral buildup, water is leaking slowly from the tank into the bowl via the compromised seal, and the tank valve is then periodically turning on to refill the tank. Turn off the water valve on the wall behind the toilet, lift the flapper valve to drain the tank, and the flapper valve should easily remove to be taken to the hardware or plumbing store to buy a replacement. The second possible scenario is that
the little valve that fills the tank with water is not always closing completely with each flush, it continues to run water into the tank which then spills into the overflow tube and flows down into the bowl. This water valve assembly in most toilets is usually a single piece item that is easily removed after turning off the water supply, by unscrewing a large plastic nut on the bottom of the tank, then lifting the valve assembly out, and taking to the hardware or plumbing store to find a matching replacement. By Mary Carol Garrity If there is anyone who can share some wisdom on the art of downsizing, it’s my friend Marsee. In the 41 years she and Mike have been married, they have moved a whopping 18 times. A few years ago, they decided it was time to downsize. So they sold their lovely 100-year-old Tudor home (featured in my book “Rooms We Love”) and bought a

townhome just off of Kansas City’s historic Country Club Plaza. Marsee is thrilled with so many facets of their smaller home. With no yard to care for and a lot less house to keep up with, they have more time to explore all the city has to offer, from art exhibits to entertainment. Their neighborhood is in the center of it all, and they can walk to shopping, the gym, the library and area parks.
Marsee decided to spread the party to the home’s third level office, coaxing guests up there by setting up food and drinks. While the outcome is usually satisfying, the process of downsizing can be painful. I asked Marsee to share some of her secrets. Here’s her advice: LOVE IT OR LEAVE IT When you have a lot less space to live in, you have to make some tough decisions about what will follow you to your new home. Marsee didn’t want the rooms in her new home to be packed full, so she made some tough choices early on, determined to only keep the furniture, artwork and accents she absolutely could not live without. GIVE YOUR EXTRA TREASURES TO THOSE YOU LOVE When Marsee and Mike started out as newlyweds, she remembers how family members helped them outfit their first homes, giving them furniture and other pieces that had been passed down through the generations. She wanted to do the same for her son and daughter-in-law, and other family members. Once Todd and Brooke picked the family pieces they wanted for their own home, Marsee and Mike loaded them up in a 17foot Penske truck they nicknamed Big Al and drove the furniture to Arizona. As Marsee shared the story of each piece, Brooke recorded it in a notebook. Now, Marsee says, the couple can start creating their own stories with the heirlooms. RETHINK WHERE YOUR FURNISHINGS GO So often, we get in a rut with our decorating. For example, if a piece of art hung over your fireplace mantel for years, you can’t imagine it anywhere else. Marsee moved a lot of furnishing and accents to new places. The chairs and table that once filled her kitchen’s breakfast nook are now library furniture in their home office. LIVE IN THE SPACE FOR A WHILE BEFORE YOU MAKE FINAL DECORATING DECISIONS When Marsee first moved into the townhome, she thought she wanted a keep her decor very edited. This would be a change for this talented decorator, who has taught me so much about designing layered displays. Interestingly enough, after she lived in the townhome for a few months, she missed many of her old treasures, and the feel of more complex tableaus on her tables. She pulled some of her favorites out of storage and bought a few new pieces and got busy layering. DISCOVER HOW TO LIVE IN YOUR SMALLER SPACE Marsee and Mike love to entertain. But they were not going to be able to accommodate the same number of guests, in the same way, in their smaller townhome. So Marsee began to rethink how they entertained. Instead of having guests congregate in the kitchen or living room, Marsee decided to spread the party to the home’s third level office, coaxing guests up there by setting up food and drinks. What Do I Need to Know About Mailboxes? By Paul F. P. Pogue The mailbox is one of the most enduring icons of the American home. Even in an age of email and streaming video, nearly every home in the nation maintains some kind of mailbox, a reminder that some things can only be delivered by the reliable old U.S. Postal Service. You may not give much thought to your mailbox, but it’s an essential tool for your home, and it’s often one of the first things a visitor sees — the most literal form of curb appeal! Keep this in mind when installing or replacing a mailbox. FOLLOW THE RULES The U.S. Postal Service regulates mailbox design specifications — for instance, door slots must be at least 30 inches above the floor, and roadside mailboxes are generally required to be placed at a height of 41 to 45 inches. You should contact the local post office and consult any applicable homeowner association rules before installing a custom mailbox. All mailboxes bought off-the-shelf should bear the Postmaster General’s seal of approval. MAILBOX MATERIALS Metal mailboxes provide a solid, reliable service. Aluminum mailboxes are the most popular products on the market. They’re very durable and highly resistant to rust. An aluminum mailbox is most likely to survive many years, especially if weather and moisture are serious considerations where you live. Steel and copper provide a unique and highly durable look. They require more maintenance than aluminum but can last decades if properly maintained. No matter what mailbox style you use, consider pressure-treated wood for the mounting post. Insects and woodpeckers can do plenty of damage to untreated wood.
A brick mailbox surround provides the ultimate distinctive mailbox design. Brick mailboxes create an elegant but understated aesthetic, and they’re also the most durable in the face of vandals or thieves. Take care to check this out first with your local post office; some postmasters don’t like them because they can pose a damage threat to delivery vehicles. If you do install one, make sure it’s far enough away from the curb to minimize risk. A mason can design a brick mailbox for you. Instead of buying a pre-manufactured mailbox, you can hire a pro to create an unforgettable impression on those driving up to your home. Carpenters and handymen are excellent choices for building a custom mailbox. NEXT-GENERATION MAILBOXES Design aside, mailboxes still serve an essentially utilitarian purpose: to hold your mail safely until you can retrieve it. Africans named this native shrub after the tassel of a lion’s tail. Inspired by orange flowers held on tall stalks, the regularly spaced whorls inspired the tribal name. The association was later continued in the botanical name, Leonotis leonurus. This member of the mint family called wild dagga survives in the wild due to potent alkaloids in the foliage. The primary constituent, leonurine, is a pharmacologically active guanidine alkaloid that can effect the cardiovascular system. Alkaloids are protection against plant-eating wildlife, which are legion and browse heavily during the dry season. This may keep your plants free of rabbits or deer, so it might be worth a test. This big perennial is native to a large range in South Africa, where it is called wild dagga. They are found along the eastern coast from Cape Province to Natal, where the Zulu and other groups have used it as an age-old medicinal plant. Tribal healers treat with lion’s tail, but it’s also a popular tobacco substitute. These plant chemicals interact with contemporary medications such as over-the-counter pain relievers and antidepressants. It can cure or kill depending strictly on how they’re administered. Lion’s tail grows so quickly it can reach 6 feet tall in the first season. It’s a quick fix to fill ugly corners and block views of sprinkler valves and pool equipment. It prefers rather rough elevated conditions, which is great for foothill home sites and those in rocky wash ground. The plant loves porous sandy or gravelly soils where other plants struggle due to lack of fertility. The bright orange blossoms evolved to feed the African sunbird, but local hummingbirds find them just as attractive. Plants will self-sow if whorled flower spikes are allowed to go to seed. After seed is released from very attractive structures, the tall spikes are exceptional cut for dried arrangements. Another key to drought resistance is oily aromatic foliage. When crushed, the leaves emit a distinctive odor, which helps to keep it free of pests and diseases. It can be nipped back by light frost, but will return with the heat. Leonotis leonurus will survive cold to 20 degrees Fahrenheit and desert heat to 120!

Yellow flowering Jerusalem sage, Phlomis fruticosa, with its light gray foliage makes fine contrast, as do the drooping blooms of Mexican bush sage, Salvia leucantha. At the end of each growing season, trim off all the old seed heads. By this time, the birds will have taken the seed or it’s dispersed to selfsow volunteers next year. If it’s happy, you may have lots of these little fellows to transplant around your garden for even hotter zone color. As these fast growing sub-shrubs or perennials age they may lose vigor. A careful pruning back at winter’s end stimulates a smaller,
less rangy fellow for the growing season. If you cut the seed heads late, you get to make wreaths and dried winter bouquets from these attractive remnants. Shaping renews the foliage and twigs for much more vigorous stems and plentiful blooms. Lion’s tail is exceptional for larger suburban yards. In hot climates they thrive on east- and south-facing exposures. Use them as fast screens, as wildlife lures and as fillers in new landscapes that need a quick color fix. Then relax and enjoy the yard guilt-free as your lions draw hummingbirds, butterflies and beneficial insects to feed and pollinate all summer long.
Lions are large shrubs that make great drought-resistant color at focal points in the garden.
Seed pods that follow flower whorls are attractive to finches and many other small songbirds.
Flower spikes of wild dagga are segmented by whorls of bright orange flowers pollinated by African sunbirds.

The act of tree topping, defined as the excessive and arbitrary removal of parts of a tree with no regard for its structure or growth pattern, is a contentious one in the tree service industry. But most professionals agree that they should not remove too many branches and leaves. And when they do cut trees back, they should take great care to maintain the tree’s structural integrity. Responsible pruning targets dead branches, those that cross and rub against each other, and unsafe branches that pose a threat to the house.
