By Kelly G. Richardson, Esq. CCAL Handling conflict is a regular part of governing, managing, or advising HOAs, which are corporations but also neighborhoods. Unlike clubs or churches, when things get unpleasant, a member cannot simply resign, because it is one’s home. Disagreement is normal but is a problem when it becomes destructive. So, it is important to learn how to “disagree without being disagreeable” and how to respond when someone else is behaving disagreeably. DISAGREEMENT IS OK Some boards feel that all votes must be unanimous, confusing unanimity with teamwork. A nay vote is not disloyal nor is it any reflection upon the motion-maker. Allow board colleagues the freedom to disagree, because every director’s view is valuable, even when in the minority. Teamwork takes over after the vote is done. After the board votes, the corporation has decided, and the directors move forward. While the dissenting voters are free to express their opinions without retribution, they must support the corporation’s completed decision under their fiduciary duty of loyalty to the corporation. FIND THE SEED Some puzzles involve objects hidden in a larger background, where the task is to find the object camouflaged amid the distraction, and the challenge in reducing conflict is identical. A member may be seething and spewing rude remarks, but there may be a legitimate concern hiding in all that upset. An unpleasant way of expression does not negate the factual complaint expressed - perhaps anyone might be upset by their situation. Find the seed within the upset and respond to that instead. Responding emotionally in like kind simply escalates conflict. FORGET HISTORY When dealing with a disagreeable fellow director or homeowner, leave the past alone. Reminders of past disagreements fan the confrontational flames. Deal with the present or the past may distract from the present issue.
LET THEM SPEAK Lend them an ear. Some situations can be defused simply by allowing persons to complete their comments without interruption. Most associations permit 2 or 3 minutes for open forum remarks. Allow neighbors their time to speak uninterrupted within their time limit. Sometimes just being heard is enough. DON’T TAKE IT PERSONALLY Did you make the roof leak? Then why get upset because someone complains. Avoid defensiveness. FOSTER A HEALTHY ENVIRONMENT Inappropriate meeting locations make business-like discussions difficult. Can attendees hear the board or is the room an uncomfortable or cramped environment? If the association has no suitable location to meet on-site, perhaps a location off site should be considered. EMBRACE MEETING RULES Associations should have reasonable rules for meeting conduct, which inform new members and others who do not regularly attend. Set clear standards of behavior and explain the meeting process. NO MORAL JUDGMENTS A normal bad habit is to conclude the person on the other side of the issue is stupid, dishonest, or even evil. This is unfair and wrong, and almost guarantees destructive conflict. Give them a chance — and give peace a chance by doing so. PLEDGE CIVILITY Embrace the Community Associations Institute’s Civility Pledge, inaugurated in 2020, consisting of six points of commitment toward more peaceful communities. It can be found at caionline.org/homeownerleaders/civilitypledge. After years of uncivil behavior in our state and national capitols, consider if HOAs led a resurgence of civil behavior. Perhaps civility starts at the home(owner association)!

Lantana Gives Hummingbird and Butterfly-Attracting Perpetual Color for Hot and Dry By Maureen Gilmer Tribune News Service
To see lantana in all its glory, visit Palm Springs on an average 110-degree summer’s day. Mounds of them in public landscaping are still intense when the mercury nudges 120. This tells you that no matter how hot it is where you live, lantana can take it and keeps on blooming. In fact, it does even better in blast furnace conditions. There’s been a lot of lantana breeding, particularly in Texas where they are essential plants for that buggy climate. It’s because lantana is so soil-rich in pungent oils that virtually nothing will eat it. That’s a big benefit for those with rabbits and deer too. Their chief enemy is frost, so they are considered annuals in temperate climates. Where frost is minimal, they become long-lived perennials. Here are some basics before you buy a bunch of them to brighten up your dry garden for the summer: EXPLORE AVAILABLE FLOWER COLOR Bush lantana produces flower clusters that are unique. If you’ve never studied them closely, perhaps it’s time to get out
the glasses and take a look. This is one of the few plants on earth that produces flowers of vastly different colors on the same stem. As a result, breeding has produced some really amazing combinations. Bright reds and rich oranges are the original hot colors of old bush lantanas. While intense and floriferous, hot hues aren’t for every garden. Lots of hot color isn’t always beloved in the heat of summer. It also doesn’t fit into every garden’s palette. Varieties that feature hot or soft pinks are among the loveliest up close. They blend into a cottage garden scheme better than the common red/orange group. These pastel hues are at home with drought-resistant perennials without overwhelming them both literally and visually. Solid flower color lantanas are subtler, which matters a lot when you’re seeking a certain look. A good example is yellow lantana. Some are bright lemon yellow while others are creamier looking, and still more a much darker gold hue. Although all yellows may appear identical to the untrained eye, when blended with other colors they are distinctly different. The yellow-flowered variety you choose
can make or break that planting composition. GET THE RIGHT HABIT A big old lantana, usually the upright bush type, can take over much space and seed itself into an invader. These are all too often shorn down to size because they get so huge without frost. Creeping lantana tends to produce solid color flowers. The most well known are a canary yellow. A spreading lavender with smaller foliage offers the flattest habit of all. They work beautifully when combined because yellow and purple are nearly complementary colors, which together produce a vivid dynamic. SEEK STERILE HYBRIDS The latest innovation in lantana breeding is sterile flowers. It’s well known that seedlings often pop up around mature plants wherever black fruits form after flowers fade. These future volunteers are highly variable in color and habit, with some of them quite weedy-looking. This is why sterile flowers are important to gardens in mild climates where every seed will sprout and flourish. The best way to peruse all the varieties available is to go online where breeders show off their most important new in-
troductions. These plants are available in small containers through most local garden centers. Purchase in quart-sized containers or one gallon for quicker color. Choose in bloom to know exactly what you are getting. Plants with a detailed tag or pots from a branded grower are sure to be reliable. In a hot, dry year, reconsider lantanas and all their new forms and colors to fill gaps where drought has taken older plants. Use them to fill in between succulents and cacti until they reach larger sizes. Plant them in pots on your patio, porch or balcony. Then sit back and watch butterflies and hummingbirds pollinate up close and personal all summer long.

It Only Leaks When it Rains By Mark Baird Question: Water drips inside our living room from the top of the sliding glass door frame whenever we have rain for a day or two. There are quite a few cracks in the stucco wall above the sliding glass door but the window above it on the second floor doesn’t leak at all. I have tried spraying the wall with the hose to try to pinpoint the leak but I can’t get it to leak with the hose. Our condo is about 7 years old and the roof is in good shape. Why does just this one window leak and how can we get it fixed? Your HandYman: It sounds like there was a problem with the water sealing of your sliding glass door when the condominium complex was being built. Water sealing doors and windows is a very important step in the construction of any building that must be done correctly or moisture can enter the walls to eventually cause dry rot and mold, or can create a leak like the one you are trying to solve. During the later phases of construction the plywood exterior of your condominium building was wrapped in a water proof membrane most likely made of tyvek, all the window and door openings were wrapped in a similar membrane, and then the plastering contractor installed the stucco exterior over this membrane. Cracking in stucco is not unusual and moisture can seep through these cracks after prolonged exposure to rain or heavy misting. After passing through the stucco, the moisture then slowly drains down the exterior side of the waterproof membrane and ultimately exits the wall at the metal weep screed flashing that is located at the base of the exterior wall where the stucco coating overlaps the cement foundation.

The metal frame that encloses your sliding glass door has a continuous flange or fin which is an integral part of the frame, it extends out away from the perimeter door opening for an inch or more, and this fin is nailed to the exterior face of the plywood surrounding the opening for the window. The water proof membrane if installed correctly laps over this metal fin, any descending moisture is prevented from entering inside the wall by either draining out at the exterior top of the sliding glass door frame or flowing laterally to the side of the frame and then eventually down and out to the weep screed. If the membrane was cut short and does not overlap the fin adequately, or if the membrane was nailed behind the fin, then this could possibly be the cause of your leak. A solution is to break away 10� or so of the stucco along the top of the door frame, lap in a new continuous section of a waterproof membrane over the fin and under the existing tyvek membrane, and then apply stucco over this exposed area. You need a contractor who is experienced in water sealing doors and windows to come to your home to make an evaluation of your leak before you start chipping away at the stucco.
