Bridge Loans: Everything You Need to Know Thinking about selling your home while planning your next move? Doing both of these steps at once can be a delicate balance and may cause financial strain— especially if you, like many homebuyers, are planning on using the profit from selling your current home to buy your new one. Thankfully, a bridge loan can help ease you’re home buying journey. What is a bridge loan? A bridge loan is a short-term loan used to bridge the gap between buying a home and selling your previous one. Sometimes you want to buy before you sell, meaning you don’t have the profit from the sale to apply to your new home’s down payment. This can be a challenge if you were depending on that money to buy your new home. In the meantime, you can apply for a bridge loan to help finance a home purchase. How does a bridge loan work? A bridge loan will help provide funds for your new home purchase if you do not have it readily available. The most common way to use a bridge loan is for closing costs. You can apply for a bridge loan with a lender. Although terms may vary, it’s standard to borrow a maximum 80 percent of both your home’s value and the value of the home you wish to buy. How to get a bridge loan to buy a house To qualify for a bridge loan your lender will look at standard credentials like your-deb-to-income ratio, how much home equity you have, your credit card score and possibly your household income. It helps if you’ve been a good mortgage candidate with your first home. If you do not have a decent amount of equity in your current home, it may be hard to qualify. If your lender determines that you are an ideal candidate, you may experience a faster approval process for a bridge loan than you did for a traditional mortgage. How to repay a bridge loan The loan typically lasts about a year until you begin making repayments. It’s beneficial to structure it so you can use the money from the sale of your home to repay your bridge loan. There’s usually a

final due date for when the loan needs to be paid back in its entirety. It’s important to work out the terms of repayment with your lender and make sure you’re clear on the steps going forward. Pros of bridge loans • Beneficial in a seller’s market. If the market is hot and you’re competing with many other buyers, your application could be seen as more competitive with a bridge loan. A bridge loan can take away any financial contingencies in your offer. This is desirable to a seller because it’s a better guarantee on whether the deal will go through. • You can avoid private mortgage insurance (PMI) by putting down 20 percent or more of your down payment. If you do not put down 20 percent, PMI is required and raises your mortgage payments. • Quick financing. It can be faster to qualify for a bridge loan so you don’t have to worry about selling your current home before buying your next nest. Cons of bridge loans • Higher interest rates. Since bridge loans are short-term solutions, the lender needs to charge higher rates. The higher rates make lending the money worthwhile for the lender. • Ultimately a bridge loan is more money out of your pocket as a homeowner. The bridge loan is a financial resource that may be worthwhile or necessary in the moment, but remember the interest and various fees you pay is money out of pocket that you won’t be getting back. • Two mortgage fees. Once the bridge loan closes, you’ll start paying it back in addition to your actual mortgage. • Can be hard to qualify for if your finances don’t meet lender requirements. Applying for a bridge loan may be beneficial depending on your financial situation and where you are in the buying and selling process. Make sure to weigh your options, consider alternatives and talk with your local trusted Realtor® for referral options.

CCAL Dear Mr. Richardson: I am looking into purchasing a property with 3 freestanding units and a small amount of common space used as a walking area to get from the street to units. The selling agent provided the CC&Rs, but the HOA doesn’t exist and has never met for as long as the current owners have been there. There are no members, no minutes, and no fees. What does this mean for the rules in the CC&R? Are they enforceable? Does the HOA need to be reinstated? What are the implications of this current situation? – R.K. Dear R.K.: Smaller associations are governed by exactly the same laws in the Davis-Stirling Common Interest Development Act as large ones. It is very difficult to operate a very small association fully in compliance with the law, because that normally requires a professional manager and periodic input from qualified legal counsel. I find that many if not most very small associations completely ignore their governing documents and operate more as a partnership than an HOA — meaning that things are done by consensus and little if any records are kept. There is most likely a homeowners association in the property, which is unfortunately being ignored. Ignoring the law and governing documents can work for a while, until the first disagreement or other problem arises. The governing documents and statutes provide a framework to guide the owners in that property. Rather than completely avoiding the requirements of the law and governing documents, it may be advisable to consult legal counsel to see if the documents can be streamlined to make operation simpler. For example, all of the maintenance and repair responsibilities may be reallocated on the three homes to their

three owners, and the governance can also be streamlined. – Best regards, Kelly Dear Kelly: When I got my property, I was not told I had an association or what it entailed. They didn’t even want to give me the CC&Rs. Eventually I got the CC&Rs from a neighbor, and someone made me notice the date it was recorded — 45 years ago. I heard that this CC&Rs could be expired? Is there such a thing? Do they automatically renew? What are the implications of this document being so old? – Respectfully, P.M. Dear P.M.: Very old CC&Rs sometimes do have expiration dates and they should not be allowed to expire. If the CC&Rs document expires without being renewed by the HOA, that group of homeowners no longer is a “common interest development” and is outside the Davis-Stirling Act. Without CC&Rs and the law’s guidance, how can the HOA pay its expenses? Require termite treatment? Keep insurance in force? Modern CC&Rs avoid the problem by automatically renewing. The Davis-Stirling Act became law in 1986 and in its earlier years was fairly minimal. So, governing documents dating before the 1990’s often are substantially out of step with current law and sometimes even have illegal discriminations against children or minorities. If you had trouble getting the CC&Rs, that is a troubling indication, because your CC&Rs document is the foundation of the HOA’s operation of the property. Your board should consult experienced HOA legal counsel to evaluate the association’s current governing documents and consider bringing the HOA into the 21st century. – Thanks, Kelly

How can I prevent water leaks?

Who is responsible for water-damaged ceiling in condo?

By Paul F. P. Pogue Water leaks may seem harmless, but they can quickly escalate into one of the biggest problems around your home. Not only do leaks waste water, but they can also send utility bills sky-high, invite mold growth, and cause expensive damage to your house.

It is often hard to determine the cause of a leak. Sometimes it is as easy as pointing to a burst water heater, but other times the reason is not as apparent.

As you review your home’s efficiency, take these simple steps to get rid of water leaks. Update your appliances Older toilets can be some of the biggest water wasters in your house. Toilets installed before 1992 can use as many as seven gallons of water with every flush. However, all toilets sold since 1992 must use no more than 1.6 gallons per flush. And toilets that have earned the WaterSense label from the Environmental Protection Agency use 1.28 gallons per flush or less and provide the same performance as lessefficient toilets. To avoid flushing your hard-earned money down the toilet, consider upgrading older toilets to new, high-efficient models like WaterSense toilets. The EPA says these water-saving latrines can save 13,000 gallons of water per year for an average annual savings of $140. While toilets account for the most water usage, you shouldn’t overlook other appliances. For instance, washing machines account for nearly a quarter of your water use. High-efficiency washing machines use less water, and many models let you adjust for the size of the laundry load. Similarly, newer dishwashers that carry the Energy Star logo use less water and consume less energy than older models. Look out for leaks Check indoor fixtures for the telltale signs of a leak. Low pressure from faucets, musty smells, ceiling stains, and water discoloration can mean you need to take a closer look. For outdoor fixtures, pay attention to unexpected muddy spots and spongy grass. Turn faucets on and off again, then look for dripping or signs of leaks around the wall or faucet base. If you find soggy points away from the main water line, there’s a good chance they involve the sprinkler system. If you think you might have a leak but can’t find it on your own, call a plumber for help. Modern tools and miniature camera lines allow them to accurately pinpoint where water is coming from — and where it’s going. Find the valves Most plumbing fixtures have a shut-off valve that should be easily accessible near the floor or under cabinets. This offers a temporary solution if a fixture is leaking significant amounts of water. And if you have a significant leak on an internal line, you might need to shut off your home’s primary water supply to stop rushing water. A house built on a slab usually has the valve near the water heater tank. If you have a basement, that’s where you’ll likely find the valve. Your plumber can show you exactly where your valve is if you can’t find it on your own.

Question If a condo apartment in a multi-floor condominium has its ceiling damaged from a leak in the unit on top of it, who is responsible for repairing the ceiling damage? – Dick

Answer

The law holds people responsible for their negligence. If someone does not maintain their mechanical systems appropriately and harms their neighbors, the offending unit owner will be accountable. That said, like most legal issues, more analysis needs to be done. First, the condo’s documents will need to be reviewed to determine where the owner’s responsibilities end and the association’s begin. Usually, this transition occurs at the unit’s walls. The owner is responsible for everything inside their apartment, and the association takes care of maintaining what is inside the walls and the building exterior. However, not every condominium is set up like this. It is often hard to determine the cause of a leak. Sometimes it is as easy as pointing to a burst water heater, but other times the reason is not as apparent. Most people assume that their upstairs neighbor must be the cause of a leaking ceiling because of the laws of gravity. But water has a funny way of running along the inside of walls, and what was assumed to be their neighbor’s fault was caused by a leaky drainpipe several units over. This issue highlights the importance of individual owners getting hazard insurance. Most people assume that the association’s insurance policy will cover this situation, but it usually does not. And even if it does, the insurance company will look to the negligent unit owner for reimbursement. Without a separate policy, an unsuspecting homeowner could be left with a hefty bill to repair their, or their neighbor’s apartment. Gary M. Can I swap homes with a relative in another town?

1. Look to incorporate large pieces that are solid as opposed to patterned. This provides for the most amount of versatility. 2. Infuse gray and cool tones in spaces that have an abundance of light and you desire to cool down. 3. Blend soft neutrals together such as tan, gray and muted pastels. 4. Incorporate tans and brown tones in spaces you wish to feel warm and cozy. 5. Use neutrals as a springboard to either a predominately neutral color palette or one in which you wish to infuse pops of color. 6. Blend metallics and florals into your neutral color palette. 7. Use rugs and artwork as an opportunity to bring in neutrals on a large scale. 8. Consider tactile materials as a way of softening a space. 9. Create a sense of contrast by pairing light neutrals such as taupe and gray with dark neutrals such as brown and black. 10. Consider pastels and pastel tones as a way to blend soft color into a neutral color palette.

Questions I moved away from my hometown about a decade ago and want to move back home. My cousin wants to move to where I live now, and we think it would be good to swap our homes. Can we do this? – Miriam

Yes, but there are plenty of details that will need to be dealt with. While it is rare, house swapping, done correctly, can take much of the worry out of the process out of selling your home and buying a new one. You can avoid streams of potential buyers visiting your home and avoid having to spend many weekends looking for your new dream home. The process is much like a traditional home purchase. You will need to prepare two purchase contracts, one for each property, making sure to have each contract contingent on the other and set the closings for the same day. Even though, or perhaps especially because you are family, it is essential to do your due diligence on your new home. It would be best to have the homes appraised to ensure it is an even swap. If the properties are worth different amounts, the owner with the more expensive home can be paid the difference at closing. If both houses are owned free and clear of a mortgage, no money has to change hands other than to pay for transfer taxes and closing costs. Any mortgages on each property will need to be paid off, and you might need to get a new mortgage to do so. Some lenders can work with this uncommon type of transaction, but you may need to shop around to find one that can. Treat this deal like you would a more traditional one. Have a thorough property inspection performed, get a title search, and arrange for title insurance just like any other closing.

By Norman Winter A display at the recent Young’s Plant Farm Annual Garden Tour caused quite a stir — not only within the industry that day, but on my Facebook page as well. I would like to take credit and say it was my beautiful photography, but to be honest, when you look at a planting and say something like “holy wow!,” it is always the plants. The display was really a trifecta of award winners that just happened to come together. And the crème de la crème was Blue Mohawk rush, or Juncus.

I have always been a big fan of botanicals in the home, starting as a young girl who wanted flowers on her wallpaper to an adult ... who still wants flowers on her wallpaper. However, my husband and two sons don’t seem so keen on the idea, so we must meet in the middle by mixing together my favorite florals with more masculine flower-free botanicals to keep our spaces in perfect harmony. I love having blooms in my home, and greenery is a big part of that. Plus, in a bit of good news, you don’t have to be a skilled floral arranger to decorate with them. You can create a fun, simple display with just a few items. Just cluster a group of small glass vases on a pretty tray and insert your favorite stems. If arranging just isn’t your thing, try using topiaries. They make for another simple but dramatic display perfect for your table, kitchen island, bookcases or mantel. Since they come in different shapes and sizes, you can mix several together for an impactful look. Cluster three or five at the center of your kitchen island or dining table or bookend your mantel with a triad of different boxwoods. Floral fabrics are more popular than ever, and I can’t get enough! You can find gorgeous florals that span the spectrum from soft and romantic, to stylized and electric. These prints add year-round freshness to your spaces, from your bedroom to your living room and every room in between. I have also found myself drawn to botanical pairings as well. They come in so many different textures and colors that you can mix and match with your festive florals for lovely layered looks. When in doubt on how to start celebrating botanicals in your home, look to your art. Whether you prefer realistic renderings or something a bit more painterly, there are endless artistic representations of botanical wonders. Botanical art comes in all sizes, and I just admit I’m most often drawn to oversized pieces that make a big statement and varied sizes grouped together in a gallery wall. You really can’t go wrong though, when it comes to featuring botanical art. Having these wonderful items in my home makes me dream of clear skies and fresh stems year-round, whether the weather is cooperating or not!

continued from page 20 I would like to take you down memory lane to about 15 years ago. I was coordinator for the Mississippi Medallion Award program for Mississippi State University. In our trials, we were looking at several Juncus species, but mainly Juncus inflexus, the native J. effusus and other varieties. They all did exceptionally well. We did something a little odd in that we chose “Juncus species” as the Mississippi Medallion Award winner for 2008, along with Diamond Frost euphorbia and All Around Purple gomphrena. At that time, there was a new trend in Southern landscapes called the dry creek. This was the perfect remedy for areas where you needed to move water away from the house. All decked out with river rock and plants, the dry creek not only solved a problem, but became a real eye-catching aspect of the landscape. As you might guess, the rush, or Juncus species, became choice plants. A couple years later, Proven Winners started entering Blue Mohawk, a variety of Juncus inflexus in trials. This variety won Top Performer 42 times; if your state had a trial, Blue Mohawk was the likely winner. But Proven Winners showed us how elegant the plant was as a thriller in mixed containers. A dozen years later, new recipes are still taking the world by storm. This was the case June 7, when Blue Mohawk was standing so picturesque, surrounded by Heart to Fast Flash caladiums and Sweet Caroline Medusa Green sweet potato. Sure, you are still invited to let Blue Mohawk solve landscape issues wherever they

are needed, but now Blue Mohawk has moved into the category of fine art. Consider the fairly new recipe called Misty Seas, which was also seen at Young’s Plant Farm. It features Supertunia Mini Vista Indigo, Supertunia Mini Vista Violet Star and Supertunia Mini Vista White — all award winners, and as you might guess, surrounding the Blue Mohawk. This could be the perfect choice for your porch, patio or deck. The Blue Mohawk rush is considered a warm season grass. It can be perennial from zones 5a through 9b, or treated as an annual, which is what many mixed container designers do. In the landscape you may wish to let it perennialize. They will reach 24 to 36 inches tall with a 12-inch spread. As a perennial it has the possibility of doing a slow spread by underground rhizomes. Once frost has induced a winter rest, you can leave the stalks to add winter interest. Once spring arrives and growth is eminent, cut the stalks back to ground level. The rush is on for the long growing season ahead, and I promise you could not find a more picturesque thriller for your mixed containers than Proven Winners Graceful Grasses Blue Mohawk. Just know you will make your gardening friends jealous!
