Mr. Richardson: Hello. Is there a formula for the reserve funds that are necessary, or at least advisable, for a HOA? Also, can an assessment be collected from each homeowner and put in reserve and then returned to them after a reasonable time if it’s not needed? – Respectfully, B.K. Dear B.K.: HOAs in California are required by Civil Code Section 5550 to obtain a reserve study every three years and to review it annually. That reserve study informs the HOA as to how much money needs to be set aside each year to offset the ongoing deterioration of the common area elements included in the reserve study. There are many fine companies specializing in preparing reserve studies for HOAs. Without a good reserve study, the HOA has no roadmap for its financial security. As to assessing for money beyond that prescribed by the budget and reserve study, Civil Code Section 6600 requires that associations only assess for actual anticipated expenses. Assessing for a “rainy day fund” is not allowed. – Best regards, Kelly Dear Kelly, Our board has not raised assessments for four years. The reserve budget is less than 7%. If the board raised assessments as recommended by the reserve study and the management company, it ought to be higher this year. Can I pursue the board for failing in their fiduciary capacity? – E.Y. Dear E.Y.: Budgets should follow the HOA’s projected actual expenses and the reserve fund contribution prescribed by the HOA’s reserve study. Budgets should reflect reality, not wishes. Some boards err by refusing to adopt realistic budgets which allow for the normal increases in expenses and set aside

money to offset the ongoing deterioration of key HOA common area elements. However, suing the board is expensive and may not change anything. The ballot box in the HOA is usually far more powerful than the courts. So, elect a new board. – Sincerely, Kelly Dear Mr. Richardson: Our HOA has a reserve line item for repair and replacement of the exterior surfaces of our condominiums. The original exterior has been replaced on approximately 50% of the units, but the reserves have been collected to pay for all of the units. Must all the units with the original exterior surfaces be updated since the useful life of this component has ended and the reserves have been collected for this component? – Thanks. D.B. Dear D.B.: Before the board began the wholesale replacement of the building exterior, hopefully it obtained expert inspection and advice about the condition of the exterior walls and the need to replace the exterior wallcovering material. It is certainly possible that the material is performing far better than predicted, but it is also possible that it is not, and that the laypersonís eye could be misled. The Business Judgment Rule requires, among other things, that the board of directors obtain the appropriate expert advice for each decision. A construction expert should be consulted prior to making major construction expenditures, to make sure the HOA is not repairing too much or too little. If the appropriate expert says that, despite the reserve study predictions, a building component does not yet need replacement, the board may rely on that advice to defer replacement. –Thanks, Kelly

Question: Hi Ed: I remember you did a past column on bathroom lighting fixtures. Since we plan to remodel our bathroom, I was looking for some lighting ideas. Do you have any new favorites for a bathroom lighting style that’s easy to match? – Paula Answer: As a master plumber, I do get to see a lot of bathrooms and do get a lot of trendy decorating ideas that I can share. However, I’m not a bathroom designer or pretend to be one. So when I attend trade shows and hear professionals buzzing about new bathroom styles that I have seen, I pay attention. One new bathroom lighting style I like is called modern farmhouse. A big reason I like this versatile design style is because it’s so easy to match. Fixtures are available for bathroom area lighting, vanity and mirror lighting and wallaccent lighting. Basically, modern farmhouse lights give a neutral, clean look that brings in hints of reclaimed materials with iron workings that may look like handmade accents. Bottom line: Modern farmhouse-style bathroom lighting can give you a look that’s honestly simple and simple to match.

T

here is a “see-through” phenomenon going on in the world of flowers and it is nothing short of thrilling. This is happening thanks in large part to the mass production of Meteor Showers verbena and to some extent Truffula Pink gomphrena. Some of us have dabbled in the “see-through” world with giant alliums and reveled in the possibilities with agapanthus if we lived in a zone that could grow them. But now with these two plants from Proven Winners we can design gardens with the thought of a thrilling season long performance. You may be thinking what is “see through”? Meteor Showers generically speaking has often been called verbena on a stick. Some say, it bears the flowers on stilts while other say it naked. It is precisely this 30-inch plus habit that provides you the ability to create a cloud of blooms that seem to be floating in air above your other flowers. For instance, right now in Columbus, Ga., I can take you to beds where these lilac blue blooms are floating above fiery orange Luscious Marmalade lantanas. In another bed, they are magically blooming above Calliope Red geraniums bordered with Diamond Snow euphorbias. The look is red, white and blue all the way. There are similar beds with SunPatiens and if you could only see the Meteor Shower blossoms floating above the blazing hot new Viking begonias. Son James has been creating these beds in commercial properties across our area. Sometimes he will line the Meteor Shower plants up formally like toy soldiers but his joy is to plant the beds where the verbenas have a random look as if Mother Nature was doing a roadside or meadow type planting. Meteor Showers is known botanically as Verbena bonariensis and is a stunning fairly-new cultivar. Before Meteor Showers the generic form was really a pass-along kind of plant with a love-hate relationship. We loved it for its beauty and unique stature which often was quite tall, but held our breath when it came to re-seeding. Then a

couple of dwarf varieties hit the market and are still somewhat available but have never reached a widespread popularity or availability. Meteor Showers is different, it has little reseeding and is now massed produced. Proven Winners calls it lilac in color which is certainly appropriate but it is not hard to see blue shades throughout the day as I mentioned above. It is treasured by bees, butterflies and hummingbirds and blooms all summer and has the ability to be perennial in zones 7 and warmer. It has award winner written all over it. Truffula Pink gomphrena is known botanically as Gomphrena pulchella it also gives an incredible see-though look with its hot pink blossoms. The plant gets wider than Meteor Showers with more lower leaves. It can work however in the same type application but will require a little more planning and thought in the design versus the almost carefree randomness allowed by Meteor Showers. It too will reach almost 30 inches with a spread to 26 inches. It has won 41 awards across the country and is a pollinator magnet too. Both of these plants will make you look like a garden pro if you provide fertile well drain soil with plenty of sun. The fun part will be designing your bed of color in layers the bottom flowers and then your magical cloud floating above whether they be the lilac blue of Meteor Showers verbena or the hot pink of Truffula Pink gomphrena. No one says you can’t do both! By Angie’s List Warm weather, fresh air, al fresco dining — an outdoor deck is one of the best places to gather the family and enjoy all that summer has to offer. But even the most well-constructed deck needs regular inspection and maintenance. While a wood deck requires the most attention, composite decks also need care and upkeep. Here’s a look at how you can prep your deck for the season and keep it in tip-top shape for years to come. Perform A seLf-insPection Experts recommend inspecting your deck for any issues at least once every year — keeping an eye out for loose boards and hardware, as well as signs of splintering and decay. • Completely clear and clean the surface of your deck before inspection, taking care to sweep away any dirt and debris and remove any furniture and toys from the area. • Carefully check all the nails, screws and other fasteners in your deck. You’ll need to repair or tighten any fastener that is loose, corroded or rusted. • Check the railings, banisters and stairs for stability. Are there any tripping hazards, like loose boards? Does the rail or banister move when you push against it? If so, you may want to have a pro to come out to repair it and perform a through safety inspection. • Examine the boards for weakness or decay. Small holes in wood boards can indicate an insect infestation, while leaves and debris left for a long time can harbor mold. If you can push a screwdriver into the wood, that’s a good sign it’s too weak, and a good sign it’s time to replace it.

For a smaller deck, you can get the job done with a long-handled scrub brush. Larger decks may require periodic pressure washing. Second, check whether your deck needs resealing. Test it by sprinkling some water on the surface. If the water beads up, your sealant is still effective. If the water seeps into the wood, you know it’s time to reseal. For the best results, it’s a good idea to hire a professional once every few years to clean and seal your wood deck. A professional should use the correct power washing settings to avoid splintering the wood. And, they should also use the cleaning chemicals recommended by the manufacturer for your particular wood material. Wear and tear, and sun and rain, can take their toll on any deck surface. Regular upkeep will help you get ahead of any issues and extend the life of your deck, saving you more time and money in the long run.
