and How Does it Work?

Competition in this current housing market is stiff. Low supply and high demand are just two factors complicating the home search for many prospective buyers. Not only that, but qualifying for a traditional loan can be difficult, especially with the current rise in interest rates. One option outside the norm is seller financing. With seller financing, the owner of the home offers the buyer a loan. Thus, you can avoid the pitfalls and challenges of the traditional mortgage experience. Seller financing offers several benefits, such as lower closing costs. But they come with their own challenges as well. Here’s how this lending process works and whether it’s right for you.

to make payments to the seller per their agreement. Or, two, the seller keeps the house title until the buyer fully repays the loan. Only after do they receive the title. In either case, the seller often requires the buyer to complete an application, go through a credit check and offer a down payment. The seller may also demand certain requirements, such as an appraisal of the home. Or, they may insist on retaining the right to foreclose the property if the buyer defaults. If both parties agree, they must sign a promissory note that contains that loan’s terms. Then they file a mortgage (or deed of trust in some states) with the local public records authorities.

What Is Seller Financing? Seller financing is an alternative way for a buyer to purchase their home. Essentially, the seller becomes the lender and extends credit to the buyer so that they can cover the purchase price of the home (excluding the down payment). So, you effectively cut out the middleman i.e., a traditional lender. The seller oversees the debt instead.

Is Seller Financing Right for Me? Today’s housing market is highly competitive. So, you may find the home of your dreams, but it’s out of your price range. Or, perhaps, you struggle with qualifying for a traditional loan. Either way, seller financing can open up the opportunity of homeownership to you. And you would have potentially advantageous terms, too, such as a low-interest rate, low minimum down payment and fewer closing costs. But there are risks to seller financing. Contracts can include unfavorable terms, like a higher interest rate or a too-short repayment period. If you struggle with meeting the criteria for a conventional loan, consider all your options. Seller financing isn’t the only router. There are other loan types that come with relatively lenient requirements.

How Does Seller Financing Work? When you enter a seller financing agreement, the seller acts as the lender. So you, the buyer, purchase a home from the seller with no involvement from a bank, credit union or other traditional lenders. The seller only extends credit to the buyer, though, not cash. Once they do, the buyer makes regular installment payments to the seller. They do this until they completely pay off the balance owed. Although this agreement doesn’t involve lending institutions, the buyer and seller often use other professional help. Many times, they rely on attorn eys and Realtors® to facilitate the purchase. Professionals in these fields also take the lead in generating the terms of the agreement. However, the buyer and seller may negotiate factors such as the loan’s length or interest rate. Seller financing generally functions in two ways. One, the buyer receives the house title after pledging to pay the seller’s offered loan. The buyer can then refinance or sell the property but continue

The Bottom Line While it can be hard to find a perfect loan, you shouldn’t rush into any lending agreement. Seller financing may be right for some buyers. But it heavily depends on the seller and the terms they offer. Before you explore this option, consider hiring an attorney. They can ensure that your rights as a buyer are upheld. Or, they can help you walk away if negotiation is impossible. Remember to explore all your options before you choose, though. There are other loans out there that come with lower credit requirements which may make more sense for you.

CCAL California has experienced many drought periods, but in January 2014 the drought situation became sufficiently severe that then-Governor Brown declared a state of drought emergency. Soon thereafter, several laws added to the DavisStirling Act, Civil Code Sections 4735 and 4736. Civil Code Section 4735 does not allow governing documents to directly or indirectly prohibit low water-using plants or artificial turf. During a time of declared drought emergency, under subpart “c” of that statute the HOA may not penalize homeowners for letting their yards “go brown.” Section 4736 bars HOAs from requiring pressure washing the exterior of homes during a declared drought emergency. The drought eased, and in April 2017 Governor Brown terminated the declaration of drought emergency, also ending the application of Sections 4735(c) and 4736… at least for a while. However, Civil Code Section 4735(a) and (b) continued to be in force, as they were not temporary — homeowners have since 2015 had the right to install xeriscapes or artificial turf. That right is not unlimited — the HOA may still set reasonable standards of appearance and maintenance and may ban plants which could create a nuisance for neighbors. Artificial turf must be kept clean, must resemble grass (sorry, you can’t honor your local sports team’s colors with your artificial lawn), and must be maintained. On October 19, 2021, Governor Newsome declared a new state of drought emergency, consequently reviving Sections 4735(c) and 4736. Most HOAs may have missed this fact, given the Covid-19 health emergency and other challenges. So, since October 19, 2021, HOA members, if they choose to cut back on watering their yards, may let the

yard landscape die, and pressure-washing again cannot be compelled. Homeowners — If you suspend watering your yard in your HOA, be a responsible AND good neighbor — keep your yard clean and neat if it’s dry. This is a very good time for associations to re-evaluate their landscaping to determine if long-term savings can be had through cutting back on lawn areas, upgrading the sophistication of irrigation systems, and finding other ways of reducing water usage. Condominium associations sometimes are established without individual water meters, with the HOA paying the water bill. This can be a recipe for water waste, since individual residents may not be as concerned about a sink or toilet left running — they aren’t (directly) paying the bill. If the installation of separate water meters is possible and feasible, it may be a great long-term step to get each residence separately metered. If separate metering is not possible, perhaps sub-metering is available. If there is a single water intake pipe to a single residence, the flow of that water can be measured electronically with a sub-meter. There are companies which install, maintain, and monitor submeters, thereby allowing HOAs to bill their members for their water usage. This might require an amendment to the governing documents, to create the right of the HOA to bill members for their water usage. Submetering allows a water wasting homeowner to be held financially accountable for their excessive usage of water. Nobody can guarantee how long the current drought crisis will last, but one thing is certain — it is here now, and California HOAs should step up their game and step down their water usage.

How to keep your Home cool wHen it’s Hot outside

By Nancy Ngo A recently released summer outlook predicts temps will be higher than average. It’s going to be a hot summer. The National Oceanic and Atmospheric Administration (NOAA) just released its latest outlook predicting that temperatures will be higher than average this summer in most of the country. When it comes to keeping your home cool, it’s about keeping humidity at bay.

Heating and cooling experts offer these tips for when a hot spell rolls through town: Clean seasonal debris This time of the year, cottonwood fluff and grass clippings can created blockages on central air conditioning units. “It suffocates your unit and it can’t function properly,” said Jon Ryan, CEO of Genz-Ryan, a Burnsvillebased heating and cooling company. To clean, run a garden hose from inside the system. But be careful that the water pressure isn’t pushing more debris into the system. “You want to make sure you’re not spraying directly on the unit because there are electronics in it, so make sure you’re directly spraying that heat exchanger,” Ryan said. “Only spray that or hire a professional as part of your tune-up.” Tim Adams, service manager at Standard Heating and Air Conditioning, said another option is to spray the exterior of the unit one coil section at a time with low water pressure. “You don’t want to spray directly down on it. Spray on the sides in a sweeping motion from left to right and work your way down,” he said.

Keep the air on Sure, instinct might be to turn off the air conditioner and crank open windows while away, but not during a heat wave. “People think ‘If I’ve got a nice cross breeze it will keep the house cool.’ It’s not about temperature, it’s about humidity. Opening a window is one of the worst things that you can do because you’re bringing in humidity,” Ryan said. “If you want to change the temperature when you’re gone, then fine. But don’t [change it] more than 3 to 5 degrees.” Clean air filter regularly A dirty air filter will reduce airflow, making your system run harder and your house cool less efficiently. “The good rule of thumb is every time you pay your mortgage or credit card bill, change your air filter,” Ryan said, adding that some types of air filters can last longer. “But 99% of the time the ones people have in their homes require them to be changed once a month, 12 months out of the year.”

Schedule a yearly tune-up Being proactive by giving your cooling system a tuneup at the beginning of the season is key. Like a car, neglecting it can cause more damage in the future. “The problem is if you don’t fix something, it will fail at an inopportune time,” Ryan said. “If it’s failing and not working optimally, it will stress out other components of your systems. If it runs optimally it will use less energy, which will cost you less and it will last longer.” Staying cool without air conditioning Not everyone has an air conditioner. During a heat wave, try to head to a place that has air conditioning. If that’s not possible, hang out in the basement, which will provide the coldest air in your house. Use fans and, if there’s a breeze, open the windows. “Cook outside as much as you can and look to grill or make salads,” said Ryan. “Any excess heat that you add to your house is going to make you feel more uncomfortable.” Distributed by Tribune Content Agency, LLC.

o longer will trays of flower transplants create a mess, a sore back from picking them up and clutter in the garden shed with thoughts of future use. Thanks to the Eco+ Grande Pots that caught most of us by surprise at the garden center this year, we can now simply pull four tabs and plant them in the hole — a true ecological wonder. Son James alerted me that racks of beautiful bedding plants were showing up for sale and on display at major garden centers, and what did I know about the new plantable Eco+ Grande containers? My first thought was, “Why doesn’t The Garden Guy already know about this?”

It was several hours before I could get to the garden center to check them out. When I arrived, every plant had been sold. How could this be? Did the customers know they were buying the latest in science, technology and environmentally friendly containers, or was it the beautiful flowers? Unbelievably, the scenario repeated twice before we both got our hands on some bedding plants in the new pots. You are probably wondering what all the fuss is about. Well first, you would swear these pots are plastic, but they are not. They are plant-based, developed from corn, sugar beets and switchgrass. Without getting too scientific, a biopolymer is made that resembles plastic. The Proven Winners Eco+ Grande containers have nutrients built in to the walls of the containers. The organic nutrients are rich in phosphorus, calcium and nitrogen. As the containers — which are planted directly into the soil — break down, nutrients are released to the roots all season long. The process is simple: You peel off four tabs on the bottom of the pot before placing them in the planting hole. Removing the tabs is essential for roots to be properly exposed to the soil and begin growth. The containers and removed tabs can be planted in landscape beds or your favorite mixed containers. Water your plants well after planting. The Eco+ Grande containers will gradually disintegrate over time, helping to feed the plant’s roots. By planting the entire container into the soil, you minimize root disturbance, you don’t have to fret about weekly feeding or worry about fertilizer runoff. Since climates and environmental conditions differ over a long growing season and across the country, the size of pieces left in the soil may vary and can simply be tilled in for the next growing season. Son James planted a couple of flats of Blue My Mind evolvulus grown in the Eco+ Grande containers. He used a Proven Winners Twist n’ Plant Original Gardening Auger with a cordless drill. This made the project rapid as the container slipped perfectly in the hole. The Garden Guy was relegated to planting with a shovel or trowel. One way to look at Eco+ Grande is like power in a package. We have all planted trays of flowers and then moaned with the effort it takes to go pick up the little plastic pots. Then we think, maybe we save and use them, maybe we will recycle. The next thing we know we have crossed over the line to the cluttered garden shed. If for some reason you elect not to plant your Eco+ Grande in the ground, know they are environmentally friendly and compostable, whether it is the city compost system or on your own. Proven Winners was involved in years of research on the new Eco+ Grande, and as they say, they didn’t have to drill for oil to produce them. You have to admit it, with award-winning flowers grown in an Eco+ Grande it is a great time to be a gardener. If you see them for sale, I hope you will give them a try.
