Proper Seismic Bracing of a Water Heater

They Aren’t Enforcing The Rules! By Kelly G. Richardson, Esq. CCAL Kelly: Residents in our HOA are encouraged to report rule violations. I and others have reported violations directly to the manager, primarily because the phone numbers and email addresses for any of the board members are not public for the residents. How do we follow up on reports of violations and/or obtain statuses? Some of these reported violations have not been taken care of in over a year. When I asked our manager and our president, they each said they could not divulge this information. What can we do? – E.R. Dear Kelly: I live in a small HOA and each homeowner is responsible for home exterior maintenance. The current board will not enforce any of the community rules because they do not want to offend any of the residents with violation letters. What are my options since our neighborhood is beginning to look shabby? – Thank you, J.M. Dear Mr. Richardson: Our board members do not adhere, follow, or enforce any of the HOA policies. What can we do about them not fulfilling their obligation? – J.D. Dear E.R., J.M., and J.D.: Enforcement of association operating rules is a basic function of the board. Per Civil Code Section 5975(b), only the association can enforce rules. Homeowners can enforce CC&Rs against their neighbors, but not rules. It can be frustrating when it appears the association is not acting against violators. Associations should keep their disciplinary actions confidential. So, once a complaint is received of a CC&R or rule violation, the complaining party needs to trust that the HOA is handling it appropriately.

Typically, if there is a disciplinary hearing, the complaining owner would not be notified of the hearing or its outcome. So, the fact that the board or manager does not provide updates does not mean the rule is being ignored. Boards have reasonable discretion as to which violations they enforce and which they don’t. Appellate cases including Behan v. Lido (1977) and Eith v. Ketelhut (2018) illustrate that the HOA can reasonably decide how to interpret its documents and determine whether rule enforcement in a particular situation is in the HOA’s best interests. However, that discretion must be exercised reasonably and not arbitrarily. A board cannot take a position contrary to the clear language of the document (such as in the 2008 ruling in Ekstrom v. Marquesa case) or contrary to law (as in another 2008 case, Ritter v. Churchill). Some rules are very difficult to enforce, due to practicalities and available management or volunteer resources. Before adopting a rule, a board should consider it is practically enforceable, and is the issue sufficiently widespread that the HOA needs to have a written rule? Some associations have so many rules that it is hard for residents to know and comply with all of them, and others adopt rules to deal with a single situation. Both approaches do not help positive community living. At the end of the day, rules should protect the property and ensure a reasonable level of neighborly behavior. If a board and manager are unable or unwilling to enforce reasonable rules, the majority of the homeowners will be affected, and may decide that a changed board would approach the matter better. – Best, Kelly

Question: I recently read an article about preparing your home for an earthquake and it mentioned that improperly braced water heaters are a leading cause of house fires that start as a result of a major earthquake. Our water heater is in a closet inside our house and it does not have any sort of bracing at all. Can you explain what I can do to make our water heater more earthquake safe? Your Handyman: The article that you read is correct and an un-braced or incorrectly braced water heater does pose a threat to your home in the event of a moderate to severe earthquake. Correctly bracing a water heater is a fairly simple thing to do but I regularly see water heaters that have been installed by both plumbers and homeowners that are not correctly braced. If a water heater is knocked over during an earthquake, the natural gas supply line or the 220 volt electrical wiring could be ripped out of the wall by the weight of the falling tank, and a fire could possibly start if the gas or electrical service is not quickly shut off. If the gas and electrical connection lines are rigid and not flexible connections, then they may be cracked or damaged during an earthquake and even if the tank doesn’t tip over a fire hazard can occur from a gas leak. Seismic bracing straps for a water heater can be purchased at most any hardware or plumbing store and detailed instructions will be included for a correct installation. The kit will have 2 thin metal adjustable straps, and one strap needs to be located at the top 1/3 of the tank and the second strap needs to be at the bottom 1/3 of the tank. Each strap needs to have both ends lag screwed into the wall studs and then connected across the front of the tank with brackets that can be tightened together by turning a threaded bolt with a wrench. On a flat wall the water heater needs to be pressed firmly against the wall by tightening the straps and likewise if the water heater is situated in a corner it needs to be pressed into the corner by the straps. If there is some obstruction like plumbing preventing the tank from being in full contact with the wall, then

wood blocking can be lag screwed horizontally to the wall studs and the tank can then be pressed against the wood blocking. A water heater with seismic straps placed correctly on the tank and fastened correctly to the wall studs, is still not correctly braced until the tank is firmly in contact with the wall. This is a very common oversight probably simply due to the installer not taking the time to read the installation instructions, but if the tank is not in firm contact with the wall then the straps will provide less protection during an earthquake. Damage to furniture and structures during an earthquake often occurs when the house starts to move out of synch with the contents and instead of moving together as a unit they strike together or collide as they move, and unsecured objects simply get knocked over after being hit by either the wall or by another object of greater mass. Your water heater or a large bookcase that has a large mass will have greater momentum while moving and will hit other objects with much greater force. A water heater or large piece of furniture that is securely braced will in theory shake and sway with the house rather than slamming against the walls and toppling over. If the water heater is not held firmly against the wall by the straps, then it will strike against the wall and the straps as the house shakes, and the shear weight of the tank may tear the straps off the walls and the tank may still fall. The final step in preventing your water heater from starting a fire during an earthquake is being able to quickly shut off the gas supply to your house after a major earthquake. Know where your gas meter is located, make sure it is easily accessible and leave a wrench at the meter for emergency use in case you can not get access to your tools in an emergency. Even better is to have your plumber install a seismic shut off valve that automatically turns off the gas supply when shaken by an earthquake.

Sea of Dreams Pebble Mosaic Walkway

By Betsy Gallery Helen and Eben Mishkin wanted a very special walkway for their beautifully designed new home. Helen showed an inspirational photo of a pebble mosaic to her landscape designer and contractor Bonnie Barabas, who encouraged Helen to sketch out her own design. Helen and Eben wanted the pebble mosaic to incorporate some of their ancient (160 million years old) ammonites. They see ammonites as windows to the past so distant it may as well be another world. With their infinite spirals and prismatic shine, they are beautiful in and of themselves. But what I really love about them is how mind bogglingly old they are — so old we can’t really wrap our minds around it with only our small span of years for reference. The ammonites are part of the homeowners’ large collection of polished and natural fossils. Three polished ammonites have an eye-catching electric red glow in the sunlight. The unpolished fossils add a primitive vibe. Bonnie Barabas at her design/build firm, Family Tree & Garden, created a dreamy landscape to work with the mosaic art. Bonnie loves to work collaboratively, sometimes with her clients, and sometimes with other artists & craftspeople, to create a landscape that’s truly unique. In this case, she struck gold. Bonnie put Helen and Eben together with local mosaic artist, Betsy Gallery, to fabricate the 11 foot long by 3.5 feet wide pebble mosaic front walkway from a design created by Helen. The Sea of Dreams theme of the walkway evokes the creative vision of the couple who partner in publishing Eben’s fantasy fiction with illustrations by Helen. Standing white Timor pebbles form gentle waves ending in the ammonites. Mandalas echo the shape of the waves. Flat black Sumatra pebbles fill the waves and Borneo mix pebbles create a background. The fabrication process involved a lot of planning and logistics to bring three different heights of materials to the same surface level. The mosaic was created on mesh in Betsy Gallery’s Ortega Street art studio, cut into manageable sections and transported to the installation site. Alfred Ramirez, fine artist and tile contractor, and Adrian Gonzales, master craftsman, who have worked with Betsy on her major public installations, had a real challenge with the installation. The original concrete pad was not ideal, but they leveled it for the first layout to make sure everything fit. Then they installed the flat pebbles in thinset, organizing the many flat sections before routing out the shapes of the waves wherever there were standing pebbles and ammonites, in order to lower them to the level of the flat pebbles. Alf and Adrian resolved a number of problems as the installation developed in order to maintain the correct angles and curves for the waves. The Sea of Dreams Pebble Mosaic Walkway enhances the home and the neighborhood. Neighbors who commented on the work in progress will be pleased with this addition to their Santa Barbara West Side landscape at 1416 Robbins Street.
