erhaps the biggest decision we have to make as we grow old is what to do with the house. In many cases, it’s the biggest asset we own and is counted on to provide ourselves with a decent retirement. We usually build a lot of equity in the house particularly if we have owned it for many years. But the decision to sell the house has so many ramifications. In many cases, the principal problem can be capital gains particularly in high valued areas such as Santa Barbara. (Capital gains in this case represent the difference between the amount the house is sold for minus the house’s purchase price and, if eligible, credit.) Capital gains, assuming a high bracket, can be particularly onerous in California for several reasons. You could pay an additional tax of 9.3 % on gains here. Second, under the recent changes to federal tax law, California taxes in any large amount are essentially non deductible on our federal tax return. “But I need the money and what I pay in taxes may be irrelevant” is what I hear you say. But in this situation, why not get a mortgage in this very low interest rate environment. The money borrowed may be enough to carry you to the end of your life. The interest paid is also deductible on your tax return. And if you can’t qualify, you might consider a reverse mortgage. It’s more expensive but you don’t have any out of pocket costs until they are paid at the end of any specific term. There is another consideration when you decide to sell. If you purchased your house many years ago, thanks to Proposition 13, your current property taxes may be relatively low. You may have a very low property tax due to Proposition 13. Here is an example of what I mean. Consider two people that each own a house near the beach. The first person bought the house 30 years ago and, based on the original purchase price, might owe $2,000 a year in property tax. The second person, may have just purchased a similar house next door and might have a property tax obligation of $20,000 per year. In the case of the first person, the fixed property taxes add about $400,000 to the value of the house provided the tax benefit can be retained. The benefits of Proposition 13, which give people predictability about their taxes and have allowed seniors on a fixed income to stay in their homes, is probably the only tax benefit in our high tax state of California. The last point, applicable to those who took advantage of a mortgage, you might give up a good, low interest loan. Renting your house is another option that should be considered by seniors. You can consider either short-term rentals through companies such as Airbnb or long term rentals through a local realtor. What are the benefits of renting? First, you save on the onerous taxes on both the state and federal level. Second, you preserve a very low Proposition 13 property tax rate. Third, if your house mortgage is paid off or has a low mortgage, the rent you receive for a house that has appreciated significantly over the years, could provide some important income. Fourth, there are some significant tax advantages when you rent out your house. Property taxes can be written off as a rental expense as well as many other expenses of maintaining the property – expenses that you previously had to cover completely. Lastly, and potentially most importantly, by renting your house you retain the opportunity to keep the appreciation on the house. It would not be unreasonable to see homes in Santa Barbara appreciate in value by 25 percent over the next ten years if historical trend continue. So that is why I rent my house. It may be the surge in virus related issues, but it’s always booked and it the easiest money I have ever made. Your home is your castle. Carefully consider all your options before you give too much of it away to the marauding knights from the IRS.

Around Town Village Properties Offers Resources for Homeowners Struggling to pay Mortgage during Pandemic Millions of Californians have lost work due to the COVID-19 pandemic, and that’s left many homeowners struggling to make their mortgage payments. In light of this unprecedented job loss, Village Properties, a locally owned real estate agency based in Montecito, has launched a resource page for distressed homeowners with information on types of assistance available to help them stay in their homes. The website page is www.villagesite.com/we-care. Located on the company’s website, the We Care resource center provides comprehensive fact sheets and forms related to mortgage forbearance, mortgage assistance, loans for veterans, and the Coronavirus Aid, Relief, and Economic Security or CARES Act passed by Congress in March. Homeowners in need of help or with questions can also contact Village Properties directly at 805-969-8900. “At Village Properties it is our desire that those who wish to stay in their homes may do so,” said Renee Grubb, owner of Village Properties. “We felt it was vital to make these resources accessible to our community during these uncertain times.” Possible options available to distressed homeowners include mortgage payment forbearance, which involves coming to an agreement with the home servicer or lender to temporarily pause or reduce mortgage payments. The CARES Act allows this option for all borrowers who, either directly or indirectly, experience financial hardship due to the COVID-19 pandemic. U.S. veterans may also be able to obtain mortgage assistance through the Department of Veterans Affairs, including help making up the financial shortfall from the sale of a home that is underwater. Forms on the resource page can be downloaded and used to determine eligibility for assistance programs. Village Properties’ expert agents are readily available to talk with homeowners about their specific real estate needs during these uncertain times.

Reopening HOA Amenities in the COVID-19 World By Kelly G. Richardson, Esq.
As the seesaw battle of the COVID-19 pandemic continues, HOA boards and managers are torn between the fear of reopening amenities and the desire of residents to enjoy their use. Pools, gyms, and tennis courts are hot issues now as HOAs try to return toward normalcy. Most County Health Departments have specific guidance regarding reopening amenities such as pools, gyms, or tennis courts. In addition, the Center for Disease Control (CDC.gov) and the California Department of Public Health have helpful on-line information. The Community Associations Institute published a comprehensive tenpage document titled “Healthy Communities,” addressing HOAs and the COVID-19 pandemic. It can be found by visiting www. caionline.org or by an internet search for “CAI Healthy Communities.” Liability concerns regarding reopening involve at least two areas — alleged carelessness regarding reopening the amenity or guaranteeing the users’ safety. Most counties have established minimum guidelines of operation regarding reopening of amenities, and HOAs should meet those standards. That can be powerful evidence that can help the HOA in the event a user tried to cast blame for contracting the virus. Another problem is appearing to make a promise the HOA cannot keep. If the user follows all the usage rules, does that guarantee that the user will be safe from the virus? Of course not, so avoid making statements that promise that the rules are to keep the users safe from the virus. It is better to warn users that there is no guarantee the guidelines will prevent any virus transmission, that there is always a risk of other users failing to follow safe practices, and that users should decide upon the level of risk they are willing to accept.
Many HOAs are rushing to have all users sign blanket waiver documents purporting to release the HOA, its board and management from any liability. Consult with HOA legal counsel about the enforceability of blanket releases and consider if the HOA has sufficient staffing to ensure that each user signs the release. California law allows boards to adopt emergency rules, and rules to reopen amenities during the pandemic would fit that description. Those rules should be adopted by the board in open session, and legally only have a maximum duration of 120 days. Consider posting the emergency rules at each amenity entrance, along with a disclaimer reminding users that the rules are no guarantee of safety. Be careful to avoid creating unenforceable rules. Some of the guidelines are not mandatory. Also avoid creating rules the HOA is unable to enforce. One method of enforcement is to have a staff person monitoring compliance, but many HOAs are unable to dedicate a staff member to monitor each amenity. Consider the option of having residents report violations by users. The rules are connected to serious health safety considerations regarding a virus which has killed over 120,000 Americans. This might merit a larger than normal fine. Remember that fines should not be punitive but should be a deterrent. Finally, remember that while reopening of HOA amenities is not mandatory, the emotional health of community residents may benefit greatly from a thoughtful and carefully phased reopening of amenities as permitted by local government. This is a tough time, but we will all get through it. Stay safe and stay healthy.

South Coast Real Estate Market Update Second Quarter 2020 As one might imagine, with the unfolding impacts of Covid-19, real estate sales activity for the Santa Barbara South Coast for the first two quarters of 2020 has seen some dramatic shifts. The Santa Barbara Board of Realtors is here to support our community during these unprecedented and challenging times. Our hearts go out to local families and businesses directly impacted by the pandemic. For those who wish to buy or sell real estate, our members are ready to help under safe and carefully crafted protocols in order to best protect all involved in the real estate sales process.
Market Summary Year-To-Date The year began with strong sales activity fueled by a strong economy and ongoing low interest rates. When the country, and our local community, began to grapple with the ramifications of dealing with the virus, sales activity went from bewilderment and paralysis in March and April to, astonishingly, a robust sellers’ market by May and June. Pending sales for homes and PUDs for the month of June 2020 were up three times the number for April 2020; 149 versus 50. By comparison, we saw 103 pending sales for the month of June 2019, showing a significant jump in demand year-over-year. As you can see, the local real estate market is one sector of our local economy where a “V-shaped” recovery has taken hold. Since the Stay at Home Order was eased, we have seen a surge in out-of-town buyers coming to the Santa Barbara area seeking a smaller community environment for their families. There has been increased appeal for compound-type properties and “extended-family” floor plans. Privacy, space and rural settings are also in high demand. Looking closely at the data, you will see how this rollercoaster of a market has now settled in at a somewhat astonishing pace. The chart gives a breakdown of activity per neighborhood as well as the year-to-date median price and months of inventory. The current low month of inventory numbers will almost certainly result in a higher median price as the year unfolds.
Median Sales Price For houses and PUDs market-wide, all communities from Carpinteria to Goleta, the median sales price is flat from one year ago; $1,288,500 as of the end of June versus $1,290,00 one year ago. Look for that number to creep up as the year unfolds. The big winner in the median price category is Montecito. As of the end of June, Montecito’s median price was $3,250,000, up 14% from one year ago. What we are calling the “Montecito surge” is a result of a large number of higher-end Los Angeles and Bay Area buyers deciding to not delay their dream of a home here. There have been many cases of buyers coming to town, viewing a handful of homes, picking one and closing with cash in less than 30 days. Their strong preference is for turn-key homes, to allow for their move to happen sooner rather than later. The median price for the city of Santa Barbara, at $1,236,000, is actually down very slightly from one year ago, but we do expect that number to move upward as

the months unfold. Going back many years, the Goleta market has been “the canary in the coal mine” for South Coast market trends. (That market was the first to signal distress and foreclosures coming out of the 2008 financial crisis.) The Goleta median price at the end of June at Houses/PUDs $1,055,000 is up 7% from a year ago, indicating marCarp/Summerland ket strength in a mostly Montecito entry-level housing comSanta Barbara munity, which in turn, will Hope Ranch impact the higher price Goleta ranges across the South Condos Coast. The smaller comTotals munities of Carpinteria and Summerland show a decrease in their median price and higher-end Hope Ranch is showing a slight increase.

Months of Inventory The months of inventory statistic provides an excellent snapshot of current buyer confidence and today’s pulse of the market. It compares the number of pending sales to the available inventory, whereas sold data will reflect market activity from up to two months previously. To define this statistic further, months of inventory represents the absorption of the available properties. A lower number shows properties are selling as fast or faster than new listings coming on the market. Looking at the chart, you will see today’s strong activity is clearly reflected. Again, across our market, the winner is Montecito, for the most dramatic change in that statistic, year-over-year. At the end of June this year, Montecito had only 3.1 months of inventory, as compared to 8.9 a year ago. I personally do not recall, going back many years, that low of a month of inventory number for Montecito. To illustrate further, at Montecito’s three months of inventory, there are approximately three sellers for every one buyer, (this of course will vary according to price range) — as compared to a year ago where on average, each seller was competing with eight other sellers for that one buyer. Months of inventory for Santa Barbara and Goleta are 1.5 and 1.0 respectively. This is solid sellers’ market territory. Priced at market value, a seller can expect their home to sell within the first four to six weeks. Along with this swift market a buyer will often be facing multiple offer situations, which is never a fun place to be. Consult your Realtor for strategies in having your offer stand out from the rest under those circumstances. Current days on market, for the entire market is 65. This number varies greatly, depending, of course, on location and price range. For properties priced at under $1 million, days on market is well under one month. As far as list price to sales price percentage, again, heavily determined by location and price, this currently stands at 95%, this is the list price at the time of sale, after any price reductions.
