The California Real Estate Snapshot A survey of California REALTORS® taken over the weekend and data on the pandemic itself showed positive signs for recovery where the housing market remains a relative bright spot. However, there are several factors which show that the effects of the recession continue to weigh heavily on the pace of the recovery, even in a brisk housing market. Buyer demand, particularly here in California, remains very vigorous. Mortgage applications nationwide are more than 20% above 2019 levels. Requests for showings in California are more than 90% higher than they were at this time last year, despite COVID constraints. Buyers have adapted to the virtual process and are more comfortable moving forward to purchase even from afar. And yet, even as California’s housing market and economy see signs of life, the challenges we face remain very much ongoing. Recently released data on the second quarter shows that the economy contracted by 32.9% — the largest quarterly decline in recorded history. In contrast, the U.S. economy shrank by less than 18% during the Great Recession of 2009. Housing inventory will remain an obstacle for California’s recovery— especially amidst such robust demand. New listings were down 6.8% last week and were essentially flat for the preceding 3 weeks. And, with the number of COVID-related deaths in California still rising and the real estate market facing ongoing restrictions that make it challenging to list and sell homes, inventory is likely to remain depressed for the near term. Thus, even as California continues to make progress, it is critical that we temper our optimism with realism. Many Californians want to buy: their home is more important now than ever before given that people are spending so much time there; they have more flexibility with their housing decision because many can now work from home; rates are low and have provided a significant boost to affordability. The data suggests that inventory is near record lows, homes are selling very quickly, and there is minimal evidence of discounting on the typical home. Higher demand on top of existing low housing inventory is likely to result in a recovery that is much slower than we would have hoped for and one where not as many buyers will be able to get into home ownership as desired. If you are thinking of selling, now is a good time to take action with the assistance of your REALTOR®, who can walk you through the safety guidelines and the latest virtual technologies for marketing and completing a sale.

In our culture, disagreement is mishandled more than ever before. However, disagreement is to be expected between directors of common interest developments (aka “HOAs”), and the way it is understood and handled can either enhance or harm the association community and its governance. Voting “no” is not disloyal. Volunteer directors are expected to think independently and use their best judgment on board decisions and not just rubber stamp their colleague’s opinions. With varying backgrounds and viewpoints, different votes can be expected, as everyone tries their best for the HOA. Unanimity is NOT required. Majority votes are as binding as unanimous votes. There are some decisions on which unanimity is important because of the importance of the decision, in which the membership needs to see a united board. However, trying to attain unanimity on everything creates the impression that disagreement is bad and discourages directors from voting their personal views. Disagreement is not a rejection of you. Don’t take disagreement personally. Contrary to our current political and social climate, prove that you can take disagreement gracefully and without offense. Instead of declaring, ask. The moment one hears disagreement, the first impulse is to declare one’s rejection of that disagreement. However, consider asking one to explain their position further. It’s just possible you may learn something that causes you to question your position. Asking instead of declaring shows respect to your board colleague. To paraphrase John Lennon, give agreement a chance. Knowing when to say “when”. Once everyone has said their opinion on a motion and explained why, call for the question. When the majority speaks, move on to the next agenda item. The board decided wrongly, now what? After arguing your position, and a board majority voted against you, what is the next step? Your responsibility as a director is to support and carry out the corporation’s decision – it’s now your decision also. The board decides as a team. Think of a canoe being paddled by the board. Before launching off across the lake the paddlers discuss the landmark they will all paddle toward. If you prefer a different landmark, can you paddle off in the direction you prefer instead? Your attempt to do so will frustrate your teammates and probably also turn the boat over. Support the team or get ready to swim. The board is making a big mistake. Don’t I have a duty to take this to the homeowners and seek a reversal of the decision? In short, no, your duty is quite the opposite. Directors frequently confuse their personal views with their fiduciary duty, passionately defending their attempts to sabotage or overturn board decisions, invoking “fiduciary duty”. Your loyalty is to the corporation and to its decision. Your fiduciary duty is not to force the other directors to see it your way. Fiduciary duty is not what you think it is, it is what the law says. What if I cannot support the board’s decision? If the board is so wrongly headed that you cannot abide by its decision, then resign and leave the board. If you are no longer a director, you are no longer bound by the duty to support the decision, and then can say what you wish, so long as you do not disclose executive session information.

Three Santa Barbara art experts explain how to achieve tranquility and energy through our visual environment. Sheri Mize at her Design Studios helps situate fine art in her clients’ homes. She notes that original art elevates a home, and enhances real estate emotionally as well as its investment value by giving it roots and a soul. “Original art grounds a home in ways that even expensive reproductions do not. Home owners in Santa Barbara discover how important it is to support local artists and that this is a way for them to become part of the community.” Sheri will help clients hang art in their homes, finding what shapes work on what wall, coordinating the art with room designs and furnishings. Leanne Baker at Davis & Taft Antiques and 20th century modern design provides exquisite art and furnishings. She believes that “because of what’s going on in a world of fear, anxiety and isolation, one of the ways to keep us in touch with our humanity is through our senses. Art lightens the spirit and keeps us balanced in the face of world events.” In a photo from her showroom, Leanne shows how a very dramatic, black and white visually Op art like painting with a hard edge quality by Dorothy Churchill-Johnson can work as a focal point in an intimate setting. One can engage in the painting, even getting sucked into its mesmerizing folds. Soft edge surrounding furnishings could create an interesting contrast. In another photo we can see Dorothy’s beachscape detail working perfectly with the simple, clean and rustic décor of the clients’ dining room. Dorothy explains that in her work she tries to “synthesize realism with other contemporary influences such as pattern, abstraction, and surrealism. “I like to find small details of ordinary things and blow them up to visual extremes in order to call attention to the beauty all around us that we overlook in going about our busy lives. Beauty is its own excuse for being, and owning beautiful things is more than an indulgence, it’s a necessity. A home enhanced by fine art is a gift not only to its owners but to everyone who enters it and enjoys its hospitality.”
