Question
I Haven’t Paid my Rent for two Months. Can I be Sued for Eviction?
I rent an apartment and have been out of work due to the pandemic. I am behind two months on the rent. The world is starting to open up, and I am worried every day about being sued for eviction. What should I do? – Lisa
Answer
In the upcoming weeks, the temporary ban on evictions will lift, and landlords who need to make their mortgage payments will flood in for assistance. While I expect a bit of backlog, the courts have been preparing for this and should get caught up quickly. Now is the time for you to speak with your landlord and try to work things out. If your financial picture is improving, try to see if you can start paying some rent, even if you are not able to get caught up. Your landlord will be less likely to evict you if they see you are trying, and you will not owe as much in back rent when things return to normal. If you are not able to do this, or if your landlord is not willing, you should start looking for a new place to live now. Some landlords have been sitting on empty apartments due to coronavirus and would be happy to get a tenant. It also will be much harder to rent a new home after an eviction lawsuit has been filed against you. Even if you do move out, you are still on the hook for the back rent. However, most landlords are less likely to sue you just for the back rent if you voluntarily move out and leave the property in decent condition.

Short Term Rentals

Moving The Furnace Into The Attic Question: My husband and I just recently purchased a tract home in the north Paterson area in Goleta that doesn’t have many cabinets or closets for storage. The houses in our neighborhood were all built in the 1960’s and for some reason the builder put the forced air furnace inside a closet in the hallway backed up to the bathroom. I would like to move the furnace into the attic and then build shelving in the closet for some desperately needed storage space. Can you tell us what would be involved with this project? Your Handyman: Many homes that were built in the same time period as your home did for some unknown reason have the furnace unit and sometimes also the water heater originally installed in a closet inside the home. This used up a potentially great space for storage and also created the potential for an interior water leak problem in the case of an inside water heater. It always seemed to me to be a poor use of space and many homeowners with a similar arrangement have moved the furnace into the attic and the water heater into the garage. Moving your furnace into the attic will require some planning, a good HVAC (Heating, Ventilation, and Air Conditioning) contractor, and a building permit. One of the first issues for you to investigate is the condition of your ducting which is probably located in the attic. If the ducting is in poor condition then it would make sense to remove and replace it at the same time as the furnace and more than likely your existing ducting will have much less insulation value than modern ducting, so there will be significant energy savings realized with new ducting. There is the possibility that asbestos was used to insulate your old ducting in which case a contractor who is certified in asbestos removal will be needed for any work that disturbs the asbestos matting that was commonly used to insulate ducting and furnaces when your house was built. Asbestos removal if done correctly creates no health or safety issues but if attempted by a homeowner or untrained contractor can contaminate a home with asbestos fibers and create an expensive cleanup. Correct placement of the return air register is an important factor in the energy efficiency and proper operation of your new heating system. The return air register is the vent opening in the wall or floor where cold air is drawn in to be returned to the furnace for heating and then blown back out into your home via the register vents located in the various rooms. A return air register for a
furnace needs to be located at or near floor level in order to recover the colder air that has been pushed downward by the heated air blowing out of the registers. Conversely the return air register for an air conditioning system needs to be located on or near the ceiling to recover warm air being pushed up by the colder air from the a/c unit. Once your furnace has been moved to the attic, probably the only way to install the return air register on the floor will be by running a metal rectangular duct down the side or back of the closet where the old furnace was housed. This duct will take up some valuable storage space but if the return air register is situated on the ceiling, your overall heating system will not be able to operate at maximum efficiency. Any type of appliance that has a gas flame like a furnace, water heater, or fireplace needs to have an adequate source of combustion air supplied from outside the home in order for the appliance to operate efficiently. If not enough combustion air is available, the gas flame will not burn cleanly, it will not heat efficiently and may also produce excessive amounts of carbon monoxide gas. Depending on the style of your roof, your attic probably has either gable vents at the peak of the gables, eve vents at the eves where the rafters end or possibly metal dormer vents installed at some time with a new roof. Your HVAC contractor will be able to determine if there is an adequate supply of combustion air in the attic and if not, then vents will need to be installed prior to the new furnace going in. Two other issues that will need to be addressed with this project is the availability of a gas supply line and an electrical outlet for the new furnace location. There probably is not a gas line already in your attic so a new gas line will need to be extended from where the old gas line terminated in the closet. This extension should be made with a steel pipe that is concealed inside the wall and not with any type of flexible line exposed in the closet. A new power outlet should not be a big problem and a wire can easily be run up into the attic via the closet if needed. The gas and electricity supply both will be handled by your HVAC contractor or by a plumber or electrician that he will hire as a subcontractor. After the new furnace is installed and running, then you can finish off any wall openings in the closet with new drywall, install your shelving and enjoy both your new storage space and your new efficient heating system!

We have recently found several (web-based short-term) rentals in our complex that are just day to day rentals. I wrote to the internet company and they replied that they would not take any action. How can they not take some responsibility for making sure the owners of the places they rent out are not illegal? R.F. Dear R.F.: Your HOA should enforce its CC&Rs. The internet company is happy to make money on short-term rentals, regardless of whether they are allowed. Many cities have zoning limiting short-term rentals, which are considered a nonresidential commercial use, so the city might take enforcement action. Most likely, your CC&Rs also declare the property to be dedicated to residential use. Your association may want to consider adopting a written rule banning such rentals or advertising short term rentals and including a fine for advertising or renting in an amount which outweighs much of the financial benefit of the rental. Best regards, Kelly Dear Mr. Richardson: Almost half of the units in my building are short-term vacation rentals. This results in increased wear and tear on the building. Can we impose a modest “facilities fee” on such rentals to help us maintain the building? If not, is there some other legal way to collect fees from rentals to compensate for the additional expense of maintaining the building? J.S. Dear J.S.: If the association can create a reasonable but rough calculation of the cost imposed
upon the association by a short-term tenant, the 2015 appellate case of Watts v. Oak Shores supports the notion that the HOA can impose a fee for short term rentals, so long as it can show a good faith estimate of the costs which are being covered by the fee. The calculation does not have to be exact but should be supported by some reasonable information. Ask the manager and perhaps the HOA CPA to see if a rough estimate can be made of that cost, and then impose a fee based upon that cost. Thanks for your question, Kelly Hello Kelly: During my many years in my HOA, the CCRs have always required 30-day minimum rentals. Now the HOA wants to raise it to one year. Can they do that? Thanks, J.B. Dear J.B.: If the members of your HOA vote to amend the CC&Rs to establish a longer minimum initial rental term (one year instead of 30 days), then that would be the new minimum. The CC&Rs are a covenant and a form of contract binding all the owners in the association. By amending the CC&Rs, your HOA community HOA has agreed to tighten up its rental limitations. If Assembly Bill 3182, authored by Assemblyman Phil Ting of San Francisco, were to become law, the ability of HOAs to make decisions about rentals will be reduced (more on that next week). One would think that HOA communities could make their own decisions about how to operate their properties, but the Legislature repeatedly intervenes. Since most legislators are not active (or even resident) in HOAs, it is perplexing that they think they know what you all want and need. Best regards, Kelly

You probably don’t think about asbestos exposure very often. The EPA banned its use in 1989, and after all the news articles about how asbestos causes cancer and mesothelioma, who would want to use it at all? But the ban was removed a few years later, and while contractors virtually never use asbestos in residential applications anymore, it remains in millions of homes, especially those built before the 1970s. Although asbestos in the home usually doesn’t pose a day-to-day danger, homeAsbestos can be found in a wide array of residential owners need to know the applications from the 1960s and earlier, including dangers involved in disturbflooring, pipe insulation and roofing. Hiring an asbestos removal contractor Some asbestos materials, such as flooring, are best left undisturbed. If you plan on doing work that involves breaking up, removing or drilling through those materials, though, call an asbestos professional. Asbestos removal is not federally regulated, but most states require licensing. Deteriorating materials such as tape and pipe insulation should be replaced. A qualified professional will use specialized techniques to seal off the area and prevent any amount of asbestos from escaping. A typical project takes two people eight hours to complete. Popcorn ceiling installed prior to 1990 is likely to have asbestos in it. Asbestos popcorn ceiling removal costs between $3 and $10 per square foot — two to three times as much as standard popcorn ceiling removal. Most asbestos removal jobs will cost between $1,000 and $3,000. More extensive jobs, such as a whole-house remediation, will be much more expensive, averaging between $15,000 and $30,000. Preparing the area and sealing it off from the outside makes up two-thirds of asbestos abatement cost. Expect to pay between $75 and $200 per hour for labor. Hiring asbestos removal contractors should be done carefully. Asbestos licensing and training regulations vary by state and locality. However, you can’t take them with you if you move, so keep that in mind when making your decisions. The cost of built-ins can be as little as $500 to as much as $7,350. It all depends on how personalized you want them to be. Labor typically runs $30 to $130 per hour. If you choose to install built-in shelving yourself, the cost can range anywhere between $200 and $500, depending on the material, size and type of shelves. Built-in materials Built-in bookshelves can be made out of a variety of materials, such as veneer plywood, birch or Douglas fir.
