HOAs Can Meet Purely Virtually During Emergency By Kelly G. Richardson, Esq. CCAL
Kelly: With the Governor’s executive orders on Covid rescinded in June, is there anything preventing boards from conducting in-person meetings again? The members want an open annual meeting,but the board president wants to only do Zoom. I appreciate your help! – M.R. Dear M.R.: Once the Governor rescinded all the various state health orders in mid-June 2021, that rescinded any state bans on in-person meetings. Individual counties have their separate health orders that can be stricter than the state, but I am unaware of any county presently banning HOAs from holding indoor meetings. A game changer occurred on September 23, 2021, when Governor Newsome signed into law Senate Bill 391, which adds a new Civil Code Section 5450(a). That section immediately took effect as an urgency statute, so it is now state law. It allows HOAs during a time of declared emergency to hold meetings which are purely virtual. California remains in the state of emergency, which the Governor declared on March 4, 2020. Now, so long as the state of emergency continues, HOAs may meet completely virtually, subject to some conditions. The notice of the first virtual meeting must be individually mailed to each member, including all the technical information for someone to join the meeting and a telephone number and email address of a person who can help with log in problems. All votes incompletely virtual meetings must be by roll call vote. Lastly, if the meeting is a meeting at which member votes are to be counted, a camera must be placed so that attendees can watch the vote counting. While it would have been great to have this law passed early in the pandemic, it still helps HOAs. Since March
2020, HOAs which met completely virtually had been violating the Civil Code Section 4090(b) requirement that there be a physical location where members could choose to attend. Lastly, as to the form of the HOA meeting, that is a board matter, not the president’s decision. – Best regards, Kelly Dear Kelly, Can our HOA require vaccinations and masks in the pool area and/or clubhouse? There are signs posted requiring both, but proof of vaccination has not yet been asked for. Do they have the authority to mandate them? – Thank you, M.P. Dear M.P.: HOA boards normally can pass regulations regarding use of common area. However, how will the HOA police these issues? Will staff be placed in the clubhouse controlling all entry points? HOA lawyers have been debating the legal enforceability of such requirements, but I think the larger question is whether such requirements are practically enforceable. I still believe the best approach is to take reasonable precautions while reminding all members that the HOA cannot guarantee the health status of others and that residents should make their own decisions regarding their personal risk.Furthermore, we are finding that “breakthrough” infections of vaccinated persons are still possible, so vaccination status is no guarantee. HOA boards are in uncharted waters, with one group of homeowners demanding access to amenities, while another group of owners demands shutdowns or strict controls for health safety reasons. As with most HOA governance questions, the answer is probably somewhere in the middle. – Thanks and stay healthy, Kelly

Guest Bathroom Facelift Question: Our 30-year-old guest bathroom is looking pretty worn and we would like to give it a quick face lift this spring by putting in a tile floor, new vanity and new toilet. We are do-it-yourselfers, but our budget is pretty tight, and we would appreciate any tips on how to keep the cost down.
Your Handyman: With a little planning and shopping your bathroom can easily be spruced up without breaking the bank. When shopping for tile keep in mind that the larger the tile the less labor will be needed for the installation and larger floor tiles are very popular. The big box hardware store seems to always have 12” and 18” square tiles on sale for about $3 or less per square foot and it doesn’t take a lot of them to cover the floor of a smaller bathroom. If your bathroom is on a raised foundation with a wood subfloor that makes squeaks or flexes at all when walked on, then you will probably need a layer of cement backer board glued and screwed down first before the tile is set. A new brand name toilet like Kohler, American Standard or Delta can be found on sale for $300 or less and we have installed some beautiful vanities purchased with countertop, sink and faucet included for under $750. While you are at it you will need new baseboard trim for the floor and casement trim for around the door and try to buy them pre-primed which will make the painting go that much quicker. Some floor tiles are available with matching base trim if you prefer a tile base trim instead of wood. Remove the existing toilet and vanity first and then install the large new tiles wall to wall rather than tiling around the vanity. Be sure that the toilet flange on the floor is raised to the height of the new tile floor surface or the new toilet’s wax ring may not seal correctly. You can purchase a book on how to install tile or do a YouTube search for tile installation videos. A simple bathroom tile floor can successfully be installed by a beginner if you take time to read up before hand and very patiently follow the installation guides. Mirrors that are framed and hung on the wall like a picture are very popular and you should be able to find a new light fixture for about $100. If the old exhaust fan is old and noisy then look for a replacement fan with the same size metal box and it can probably be installed without having to modify the opening in the ceiling. Do not attempt to do any electrical work unless you have a solid understanding of how your home wiring works; otherwise call a contractor to do the wiring. The last tip is to have all the materials sitting in the garage before starting the demo of the old bathroom, so you won’t have any interruptions in your work schedule.

Tribune News Service Long or short, chaise or sectional‚ what are the best options when it comes to a sofa? One general rule of thumb is to pick your larger pieces first such as your sofa before making smaller selections such as chairs and accents. A sofa is really the foundation for the room and can make or break a room when it comes to floor plan and layout. When selecting a sofa for your space, here are some general rules of thumb.

DO’S 1. Choose your sofa once you have a chance to understand how you wish a space to function. 2. Choose a neutral-colored sofa if you are looking for a pieces that are timeless and can be used in different parts of the home and move with you from home to home. 3. Consider a sectional, especially for corner spaces. 4. Use longer sofas along long walls to help fill a space. 5. Look for style, feel, function and comfort.
DON’TS 1. Don’t purchase a sofa without measuring the space where the sofa will go in advance. Be sure to allocate room on either side of where the sofa will sit for circulation and flow. 2. Don’t overlook hospitality-grade fabrics. Many designers solely choose hospitality-grade fabrics because of durability. 3. Don’t forget to consider using lower-profile sections of a sofa to form a single unit such as pairing two chaises, a left and a right side together. 4. Don’t dismiss the beauty of leather and faux leather. Once considered outdated, these materials are still considered to be modern and on trend. 5. Don’t purchase sofas in fabrics or colors that are considered trendy or won’t last the test of time. Perennials to add dazzle to your cool season containers By Norman Winter Perennials for cool season containers may seem like the proverbial horticultural oxymoron, but that is exactly what I have been planting the last few days in my zone 8a landscape. My favorite pansy pals are Goldilocks lysimachia, Lemon Coral sedum, Ogon Japanese sweet flag and Burgundy Glow ajuga. The kicker is I’m not planting pansies yet, but fresh crops of Supertunia petunias and Superbells calibrachoas. Last fall, planted petunias and calibrachoas lasted until midsummer floods (I’m exaggerating somewhat, but we had more rain than I ever remember). You have to admit nine-plus months of blooms is incredible. Believe me, though, I’ll add pansies and violas in a couple of weeks. Goldilocks Creeping Jenny Goldilocks lysimachia, or Creeping Jenny, is simply amazing with its yearlong Lemon Coral tenacity and dazzling color in the garden. sedum gently I love how it plummets over the rims of tumbles over containers, stopping only when it hits the the edge of this ground, then still keeps growing. What I mixed container may treasure most about it in the West Georgia area is the with pansies, tall colorful transformation from summer into winter. The kiss of dianthus and cold is like magic. Evergold carex In the summer it provides chartreuse or lime green whergrass. ever you want it. But in winter it gives the closest color to a 24-karat gold bar you can find in a plant. Put that in boxes or baskets with blue violet-colored pansies and it will remind you of sapphires and gold. This award-winning plant gets taken for granted, but it shouldn’t, as it is perennial in zones 3-10.
Red begonias. Oddly I am also in year three with these begonias. Ogon Japanese sweet flag This variety of Japanese sweet flag gives an unbeatable fine grassy element or texture to the garden and mixed containers. This is the plant that acts as the finishing touch to mixed containers. As beautiful as your mixed container design may be, it is this little filler plant that says “ta-da!” The Japanese sweet flag spreads from the tip of rhizomes similar to that of an iris. They can reach about 10 to14 inches tall, which gives you the opportunity to use it as a ground cover. It is perennial from zones 5-11. Never underestimate the power of just one small grass to a mixed container. Burgundy Glow ajuga Lastly, I find most gardeners simply don’t think of ajuga as a container filler or soft spiller. It’s funny we call it bugleweed. We plant it in tough places in the landscape where nothing else grows. We love it when it blooms, but we just don’t think about it in the cool season mixed container. Burgundy Glow is an award-winning cold hardy variety recommended for zones 4-11 and offers multicolored foliage, usually showing a healthy dose of pink. The foliage is the perfect foil for the fine-textured Ogon sweet flag and even Goldilocks lysimachia. All these perennials offer some of the easiest opportunities to propagate and use elsewhere in the landscape. The cool season planting calendar is just now getting underway, and I urge you to incorporate these four perennials into your designs. Lemon Coral sedum Lemon Coral sedum is a succulent that is perennial from zones 7-10 and gives a soft, needlelike texture. At least once or twice a year I look at its beauty and simply can’t believe it is a perennial, thrilling not only with its foliage but later with a billowy cloud of bright yellow blooms. While many students learned remotely last year, school districts have begun welcoming students back to the classroom. Although home and school may not be as closely intertwined anymore, you can still foster a fun home environment and one
that lets children focus on homework. One way to make children’s bedrooms conducive for the school year is organization. “To help your kids stay organized, keep things at their height. Closet storage, benches and coat racks will all be used more often if kids can get to them easily. Try adding a few bins to conceal their toys and other items,” HGTV said. Desks are also important. Not only do they provide a dedicated homework space,
but it’s also good for creativity. “Whether for homework, crafting, art projects or computer work, having a designated space where kids can work builds healthy routines, fosters independence and encourages creativity,” Popular Science said. Apartment Therapy notes that younger children should have desks suited to their proportions. Older children can work with regular-sized desks. “The ideal situation is a desk that’s on
