The National Association of Realtors® has announced its five 2020 Good Neighbor Awards winners. For 21 consecutive years, NAR has honored Realtors® who make an extraordinary impact on the world through volunteering. Fair Housing Violations? Restrictions on Hard Floors and Outside Play By Kelly G. Richardson, Esq. CCAL
Mr. Richardson: I enjoy reading your column. I recently bought a condo and was in the process of replacing the carpet with laminate flooring because of allergies. The HOA informed me that there is a rule prohibiting hard flooring to be installed in condominiums above another condominium. I asked the management company for the definition of “hard flooring” but have been ignored. Is there a legal definition? Would vinyl flooring or linoleum be considered “hard flooring” or is carpet my only option? This is a health issue. I am hoping you can provide some direction. — Thanks, R.N. Dear R.N.: California Fair Housing laws and regulations require that the HOA make “reasonable” accommodations upon request to deal with your allergy issue (a disability). Have you provided the HOA with documentation that your allergies do not permit you to have carpeted floors? However, if you have documented the health necessity of the hard floor, that does not end the discussion. The purpose of a restriction against hard floors above the ground floor is to protect the lower neighbor from noise nuisance. The accommodation of a non-carpeted floor could be unreasonable if it creates a disturbance for the lower neighbor. So, your HOA and you should dialogue in what the regulations call “interactive process” to agree upon reasonable measures to buffer the floor. That may require the advice of an acoustic expert to specify an installation providing a reasonable amount of buffering. Since the cost of accommodation is normally paid by the requestor, you may be asked to pay for the consultation. The HOA may also ask you to promise to restore the carpeting after you move out. However, even if the HOA approves the buffered new floor, your lower neighbor
still could find the noise objectionable, so you may want to include them in the discussion. — Thanks, Kelly Hello Kelly: Since COVID-19, more kids have been playing outside of our condos (including mine). It’s very peaceful and quiet even with the kids riding bikes, and they usually ride with their parents. Now the HOA announced that per the HOA governing documents recreational and sports activities of any kind are not allowed in common areas, including no baseball, scooter or bike riding, motorized toy cars, skateboarding or skating. Can they do this? I know it doesn’t mention children but that’s who the HOA is targeting. What do you think? — Thanks, A.O. Dear A.O.: Rules mentioning or targeting children may violate state and federal Fair Housing laws. Such rules are considered “familial status” discrimination, which is illegal except in age-restricted communities. However, if the rules discuss prohibited activities, and not the age of the person pursuing the activity, the HOA may be within the law. HOAs often restrict recreation in common area streets, walkways, and landscaped areas to protect residents from nuisance, property from damage, and, most importantly, the participants from being injured by pursuing recreational activities in areas not intended for recreation. So, the HOA might not actually be targeting children, but instead trying to prevent potentially dangerous activities in common area. With schools mostly closed at present, there is an understandable pressure on families with children, but safety cannot be overlooked. — Best, Kelly

Too Much Wattage Question: We recently remodeling our kitchen which turned out beautifully, but we have a problem with the ceiling lights. We have open beamed cathedral ceilings in the kitchen and dining area with track lights on the ceiling and pendant lights over the countertop peninsula, all with 10 small halogen spotlights. The lights all work wonderfully except when we turn on the microwave oven, the circuit breaker trips, and we have to turn the breaker back on before we can have our lights working again. The lights and microwave oven are brand new so we think that the circuit breaker may be bad. What can we do? Your Handyman: Circuit breakers are designed to both prevent a shock in the event of an accidental short to ground which can happen if a person touches an energized wire, and also to prevent the electrical wires in your walls from over heating and possibly causing a fire when too much power is being demanded from a circuit. Electricity is a bit of a mystery to many people, but the basic concepts are actually pretty easy to understand. The electrical service in your home is divided up into circuits each having its own circuit breaker located in your circuit breaker box which is usually found on the outside wall of your home where the cables from the power lines on the street attaches to the house. A newer home will have separate 110-volt circuits for your wall outlets, ceiling lights, large appliances like your refrigerator and dishwasher, and a few 220-volt circuits for an electric water heater or clothes dryer. Each circuit is designed to safely provide adequate electrical service to run the lights and appliances that may be connected to or plugged into that circuit. Amperage or amps is another common electrical term that can be understood as the strength or amount of current that is available to your home. Most new homes will typically have 200 total amps of available power while older homes may only have as little as 100 total amps. Each circuit breaker is rated for a certain level of amperage with the most common being 15 or 20 amps for most household usage and 40 or 50 amps for an electric oven, water heater or air conditioner. If the amperage needs of a circuit exceed the rating of the circuit breaker, then the circuit breaker will trip or open, which basically turns off the circuit. The third common electrical term that helps to understand basic home electrical service is Wattage which is simply the amount of power that a light bulb or an appliance requires to work efficiently. You probably have noticed that light bulbs are always rated for wattage with a large incandescent flood light requiring as much as 150 watts or a new LED recessed can light only needing 6 watts. An electrical appliance like a large flat screen TV or a microwave oven may be rated for as high as 1200 – 1500 watts. The last factoid of electrical information for this discussion is the simple formula: Wattage = Voltage x Amperage. The basic application of this formula for the layman home owner is that the amount of available wattage on any circuit is determined by the voltage which is 110V in this case, and the amperage rating of the circuit breaker which is likely 15 amps in this case. Multiplying 110 volts by 15 amps gives us a maximum available wattage of 1650 watts on this kitchen circuit. Each halogen light bulb is probably rated at 50 watts, with 10 bulbs having a total of 500 watts, plus the likely wattage of the microwave over at 1200 watts gives a total wattage of 1700 watts. The combined wattage of the lights and microwave oven exceed the rating of the 15-amp circuit breaker and the breaker trips. All that being said, what is your solution? I would suggest replacing the halogen lighting with LED lighting which uses far less electricity, produces very little heat versus the halogen, which is very hot, and produces a very comfortable light. Another possible option is to plug the microwave oven into a nearby outlet on a different circuit using a heavy-duty appliance extension cord with 12-gauge wiring.

This space demands a unique and unexpected aroma that both stands out and blends effortlessly just as this perfect pattern does.
Fall is in the air, and with it the crisp and spicy scents I crave this time of year. I am candle-obsessed year-round, but I do consider autumn the official beginning of candle season. The comforting ambiance brought to a room by the soft glow of a candle is hard to beat (and especially needed this year). I truly believe that after a stressful day, a candle’s soothing aroma and soft glow can help you relax and re-center. While I love spring scents full of fruit and sweet freshness, I find myself dreaming of wrapping myself in a warm embrace of delightful fall and winter notes like oak, amber, peppermint and ginger. These scents smell good enough to eat and make my mouth water just thinking about them. Take a journey with me as I pair some of my favorite scents with the coziest fall corners. Molasses room The molasses room is one of my favorite spaces year-round. With warm brown walls the color of New Hampshire’s finest maple syrup, there is an inherit comfort to the room however it has been styled. We tend to put more of our earthy, masculine and cabin-inspired furniture and accessories in this area to enhance the rich and slightly rustic atmosphere. A room like this is the perfect space for an abundance of textures and patterns that provide intrigue and complexity. There is not a better candle pairing than the intricate blend of flavors that is Pickwick’s British Oak. With notes of cardamom, galbanum, lime and mandarin mixing with jasmine, basil and base notes of sandalwood and tree moss, it is a scent with many intriguing layers.

Hedge apple room This space is full of natural light and has no shortage of personality. Plus, what better place for some fall foliage than a room the color of freshly dropped hedge apples? With no shortage of punchy and bright colors, this is a fall look full of sunshine and crisp lines. Enter one of my go-to scents, Black Pepper. This scent is interesting because it smells almost completely different when it is burning and when it is unlit. When it is lit, the sharp notes of black pepper soften to blend beautifully with the fresh floral scents of lemon, jasmine and violet leaf, creating the perfect top notes to a long-lasting base of oakmoss, amber and patchouli. Plaid bedroom As a plaid-obsessed person, this bedding design speaks to my heart and soul and deserves a special fragrance to enhance it. It demands a unique and unexpected aroma that both stands out and blends effortlessly just as this perfect pattern does. In my search there was only one candle that could do it justice and that is Masala Chai. This scent snuck up on me unexpectedly and now burns in my bedroom almost every night. Both warm and uplifting, it contains soothing bedtime oils like peppermint, green tea (yes please!) and lemon along with spicy touches of green cardamom, clove, pepper, ginger and white amber. Real Estate During the Pandemic
Third Quarter Home Sales Soar By Sue Irwin What a surprising year in real estate markets across the country, and especially in the Santa Barbara area! Our local market went from a roller coaster ride this spring to something more like a rocket launch this summer, and the trajectory appears to be continuing as we settle into autumn. Here are highlights of the year so far, and a recap of how the business of real estate has changed in 2020. Home sales were more robust than normal in January and February, in large part due to low interest rates, but then sales slowed drastically by mid-March when the pandemic caused the country to take a break from almost everything, including a break from buying property. In a very short time, however, real estate was deemed by the State of California to be an essential industry. People working in the real estate industry—brokers, sales agents, lenders, escrow companies, home inspectors and more—adjusted their business activities by adopting protocols that allowed real estate business to be conducted in a safe manner. Like most other businesses, going digital for meetings has become the norm, and any inperson property visits now require signed Property Entry Advisories, mask wearing, and hand cleaning stations. Vacant homes have been easier to show since no occupant is in danger of being exposed to Covid-19, but even so, Realtors must clean surfaces between showings. In addition, many sellers are requiring proof of financial ability to purchase their home before allowing showings to occur, particularly if they live in the home. Summer Was a Wild Ride for Sales Activity! In these restrictive and uncertain circumstances, most people were surprised by the surge of real estate activity that started in May and has continued full speed ahead ever since. When we compare the Santa Barbara Multiple Listing Service data for April
2019 and April 2020—April being the heart of the “spring buying season”—the newness of the pandemic brought the market to its knees, and roughly half the number of homes sold in April than we would generally expect. But starting in May, an increase in buying activity kicked into gear, with more sales and pending transactions each month from late spring through summer. In September alone, 177 homes closed escrow— about 75% more homes than last September. Despite the pull-back in early spring, by the end of September the South Coast surpassed the number of year-to-date home sales compared to last year—which was a relatively busy year. Home Prices Are Now at an All-Time High Along with higher demand for homes and more sales, starting in July the median price of homes has increased more than anyone would have guessed. A year ago, the overall median price of homes along the South Coast was $1,288,250, just above the top median price before the Recession. By June this year, after a dip in early spring, the median was back at that level - $1,288,500. Then it took off, rising rapidly to $1,490,800 year-to-date by the end of September—a 15% increase in the South Coast median home price just over the summer. One factor driving the median home price increase for the South Coast has been a record-breaking number of luxury home sales in Montecito, where the year-to-date median of $3,668,298 is 24.6% higher than last year’s $2,943,325. In Montecito, we normally have a large number of highend properties that are on the market for a very long time, but the usual over-supply of homes has been virtually exhausted by a pandemic-driven demand in the high-end market. For you homeowners out there, please note that the South Coast median increase of 15% doesn’t necessarily mean that your own home has increased that much this

summer—it’s a reflection of all home sales on the South Coast. As you can see in the callouts below, different areas have seen different amounts of median price change this year! Certainly, most sectors of the South Coast have higher median prices compared to this time last year, but not 15%. Compared to the end of September last year: • Hope Ranch’s 2020 median was $3,485,000, up 12.4% • Santa Barbara’s 2020 median home price was $1,375,000, up 8.3% • Goleta’s 2020 median price was $1,077,500, up 8.6% • Carpinteria/ Summerland is the only sector that has a lower median price now than last year-to-date. The 2020 median home price of $1,129,500 is 6.7% below last years median. The condominium market has been robust this year. The median sales price of condos year-to-date is $712,500, an 8.3% increase over last year. The number of condos sold in the month of September alone was about twice as many as last September, and year-to-date the number of condo sales is just a hair below last year, but likely to surpass 2019 levels in October. Higher Prices Fueled by Low Interest Rates and High Demand for Homes What’s fueling this upsurge in number of sales and prices? Low interest rates have definitely continued to help entice buyers into the market, and they are a godsend for people looking to buy an entry level home. It’s understandable that the low rates are enticing—who knows how long we will have 30-year fixed rates at 3% or less? But mainly, the pandemic has changed people’s needs, and having a home that works well for those needs has become a top priority: People want a beautiful living space since they are spending more time at home, and they want the conveniences of a home office and space for home schooling, plus outdoor areas for play, entertaining guests or enjoying quiet moments outside. Besides locals resettling, Santa Barbara and Montecito have become a refuge for people moving from larger urban centers, predominantly from Northern and Southern California but also from the East Coast, Texas, the Northwest and elsewhere. A smaller urban area and the natural beauty and climate of the South Coast are big attractions. Sellers’ Market Conditions Prevailed All Summer Without a doubt, the real estate market had sellers’ market conditions across the board throughout July, August and September. Homes are selling quickly and multiple offers are common, and the data for “Months of Inventory” confirms that it’s a sellers’ market. Measuring how many months it would take for all listings to sell if nothing new

came on the market, the value of months of inventory (MOI) reflects the demand for properties compared to the supply available. A value of 3.0 or less is considered a pretty hot market, and at values above 5.0 the scale starts tipping in favor of buyers having more clout than sellers in negotiations, generally speaking. This year, with such high demand for homes, months of inventory has been dropping steadily, meaning available homes are selling at a much faster rate than new listings are coming on the market. The Goleta and Santa Barbara sectors weighed in at 0.9 MOI for September—less than one month of inventory available. Looking back to our last hot sellers’ market—as the recovery took hold after the recession—Goleta did have an MOI this low at least one month in 2014, but Santa Barbara never did, and the overall MOI rarely dipped under 3.0 for the South Coast as a whole. This September, the South Coast MOI stood at 1.4—something I don’t think we have ever seen. The unusually high number of sales in Montecito is a major reason why the overall number is so low. Unlike its usual 7.0 or higher MOI, this September Montecito recorded a historically low 2.9 MOI. It’s Hard to Predict Where We Go from Here The election, the pandemic, a rapid increase in home prices over the last few months, interest rates remaining low, winter weather, holidays—there are a lot of factors that can influence the real estate market in the coming months. Is there any reason I should be concerned? — Grace Answer: Yes, there are several issues you should consider. When entering into any agreement, especially one with a family member, you should have a written contract. Not only will this help resolve problems that may arise, but it

will also cause you both to think of issues now that you would not have otherwise. You need to address what happens if your bother stops paying you, if he lets the hazard insurance lapse, or fails to pay the property taxes. You should also consider what would happen if he passes away unexpectedly before paying you off, files for bankruptcy or gets a divorce. Because allowing your brother to pay you off over time for the house is essentially a mortgage loan, you will need to check state and federal law and do it by the book. Also, every person has a unique financial
position, and this sale may have tax consequences, so speak with your tax professional before moving forward. This information will help you structure the transfer appropriately. This transaction is more complicated than it may seem and should be set up to fit your family’s unique needs. The three of you should consult with an experienced attorney to help you structure this properly. Most of the time, everything will work out fine on its own. But having dealt with family disputes like this in my law practice, this is a situation where an ounce of prevention is worth five pounds of cure.

Mums The Word for Fall By Calla Jones Corner In early October I bought 3 chrysanthemum plants to brighten up my front doorstep during the gloomy days. Seeing the outdoor plant stand at Trader Joe’s overflowing with a panoply of colored mums reminded me that for decades I’ve loved seeing how French flair flourishes when decorating with these seasonal blossoms. If one is lucky to enough to be in France during October and November, one’s eye is constantly enchanted by how the French are able to decorate store windows, window boxes and dining tables with their innate savoir faire, using mums. France sells more than 23 million of the plants from 9,000 cultivators during the two months. For Americans, chrysanthemums signal the beginning of Autumn and the pumpkin harvest. This seemingly boring flower that one picks up cheaply at grocery markets before Halloween lasts ’til Christmas, filling vases at Thanksgiving to focus the eye on Fall’s subtle, yet lusciously striking colors. In fact, mums are anything but boring. Normally I am in France in October to visit our family in Burgundy where mums are celebrated for Toussaint, the French equivalent of “All Saints’ Day”, at the end of October and for Armistice Day, on the 11th day of the 11th month, at the 11th hour, to celebrate the ending of World War 1. On that day in 1919, George Clemenceau called upon the French to decorate with mums the tombs of fallen soldiers. The flower was chosen because it was one of the rare plants flowering at that time of the year. So, too, for Toussaint, which falls on November 2. It is not a biblical holiday, as one might think, but rather a day of catholic tradition celebrating all the dead. French cemeteries in November burst with colored mums as the nation mourns its deceased family members and heroes. Apart from its role in national fêtes, different colored mums are offered as symbols—yellow for perfection, red for intense love, white for pure love, pink for infatuation that could turn into real love. It is said in France that if one dreams of
mums, one is waiting for love and marriage. The origin of mums is not known. But it is thought that it dates back to the 15th century, B.C. in China, where the flower symbolized nobility and hardiness and was given to families who had a newborn. Its boiled roots make a calming tea or a treatment for headaches. Its petals are added to salads. As a ritual, nectar from the petals is served on the 9th day of the 9th moon during an autumn festival known as “the Double Nine”. Only the Japanese outdo the French in their historical adherence and affection for the flower. In Japan, mums have been cultivated since the 8th century A.D., when it was chosen as the imperial symbol, representing the sun. It adorns the country’s flag and all pertaining to the empire. Japan’s Emperor sits on “The Chrysanthemum Throne.” Kamikaze pilots, during World War II, used the mum as their symbol. The Order of the Chrysanthemum is the highest medal awarded for bravery. Ikebana, the Japanese art of flower arranging, often uses mums. In November, in Bunkyô, a suburb of Tokyo, the annual Chrysanthemum Festival exhibits mums from over 2,000 varieties. There is even an ancient recipe for chrysanthemum cheesecake, which today’s gourmets claim has an undefinable taste and aroma. Japan claims to have 350 of the approximately 20,000 known varieties.

DECORATING TIPS: • Densely packing mums with other flowers, like asters, plays up their texture. • Yellow mums placed in blue vases are a mood booster. • Put in white vases a mixture of white spider and pompom mums with baby’s breath, carnations and silver dusty miller, to create a wintry feel. • Arrange loosely clusters of white and chartreuse daisy and pompom mums into farmhouse pitchers for a casual look. • For a lush look, combine delicate red roses with pink anenomes and similarly colored large and pompom mums.
