New Laws Approved for 2022

Holiday Plumbing Problems Question: We have an embarrassing problem that happens every holiday season and I am already feeling anxious in anticipation. Our toilets are older low flow models that were installed about 25 years ago to help reduce our water usage and they work just fine for my husband and me. However, we have a large house where our extended family gathers for Thanksgiving and like clockwork every year, the plumbing gets all backed up creating an embarrassing situation for our guests and a very expensive visit from the plumber. What can we do? Your Handyman: The holidays are a time for families to gather and enjoy the company of one another but are also one of the busiest times of the year for the local plumber. A very common holiday plumbing scenario involves a home with sewer lines that are partially blocked with tree roots, they drain just fine all year for grandma & grandpa but get completely backed up when the house suddenly is full of festive holiday visitors washing, showering and flushing. If your home has a history of root intrusion in the sewer lines, then it would make sense to have a plumber rooter out your sewer lines prior to your guests arriving. The plumber can insert a small video camera with a light down the main line to see if the pipe has partially collapsed or has extensive damage from roots. If the pipe has substantial damage, it will eventually need to be replaced before it becomes permanently blocked and sooner is better than later. You may have seen advertising for “trenchless” sewer lines where the plumbing contractor digs a fox hole at the location where your sewer line enters the house and then a second hole where it connects to the sewer main in the street. They then feed a steel cable through the pipe to pull a funnel shaped mandrel through the old pipe which bursts the old pipe open, pulling behind it a new polyethylene pipe, giving you a brand-new root proof pipe without having to dig up your yard, driveway, walkways or planters. It sounds like your home has the first generation of low flow toilets that came out in the early 1980’s as a well-intentioned way to save water but many of these toilets just simply had a smaller tank with no effective redesign of the trap in the base of the toilet. These earlier designs really didn’t work very well, were prone to clogging, and often required multiple flushes instead of one, effectively defeating the water saving intentions. The good news is that new toilets today have both a smaller tank and the trap has been redesigned so that clogging is now no longer the problem it used to be. But back to your issue; you can check your toilets to see if the water level is adjusted to the maximum height or you may want to consider buying new toilets and just be done with the problem. If you do decide to keep the old toilets it would probably be a good idea to purchase a new baffled style toilet plunger that can be found at any hardware store, keep it in the garage with a pair of rubber gloves in a 5-gallon bucket as your emergency clog response kit and hope for the best.
Part II- Good Changes Coming By Kelly G. Richardson, Esq. CCAL 2021 was the most positive legislative year for California HOAs in a very long time. Today’s column summarizes four helpful changes to California law, one which is already in effect. Senate Bill (“SB”) 391 took effect as an urgency statute immediately once the Governor approved it on September 23, 2021. It allows HOAs during times of declared emergency to hold purely virtual meetings (without the normal requirement of a physical location where members can choose to observe). Notice of the first virtual meeting must be announced to all members by mail, including the contact information of someone who can help with log-in difficulties, and all votes in purely virtual meetings must be by roll call. Assembly Bill (“AB”) 1101 was sponsored by the Community Associations Institute. It makes several changes regarding the safekeeping of HOA funds.The current Civil Code Section 5380(b)(6) requirement of board approval for fund transfers (including payments) now varies based upon the HOA’s size. HOAs of 50 or less members must have board approval for transfers of either $5,000 or 5% of the HOA estimated annual income (whichever is less), and HOAs of over 50 members must have board approval increases starting at the lesser of $10,000 or 5% of the HOA estimated annual income. Several prior exceptions to the rule against commingling HOA funds have been deleted, and the requirement of dishonesty insurance has been clarified to be more consistent with insurance terminology. SB 392 was sponsored by the California Association of Realtors and continues to move toward electronic communication. Starting in 2023, owners may choose whether they wish to receive individual notifications from the HOA by postal and/or electronic mail. If they do not choose, the default method of communication is still postal mail.The remainder of the bill is effective in 2022. A new 4045(a)(5) is creat-

ed, permitting HOAs to make general notices on the HOA’s web site. New subparts (c) and (d) are added to Civil Code Section 5230, barring the HOA or its managementfrom selling member information to a third party without member consent (some management companies have been doing this under their contracts, without full disclosure to the membership). Associations and their management firms should encourage members to accept communications electronically. The cost, material, and time expended in sending postal mail can be substantial for larger HOAs. These days, where everyone not only has email but accesses it on their smartphones, email should become the primary mode of HOA communication. AB 1584 helps correct a problem regarding the correction of illegal rental restrictions. Last year’s SB 3182 added Civil Code Section 4741, barring “unreasonable” restrictions against HOA rentals and requiring HOAs to amend their governing documents before 2022 to correct any unreasonable restrictions. Many lawyers incorrectly told their clients that the law required HOAs to amend their CC&Rs although rules are also “governing documents.” This is expensive and often impossible due to member disinterest.AB 1584 opens a six-month window starting January 1, 2023 and concluding July 1, 2023,in which HOA boards can amend CC&Rs without a membership vote solely to remove provisions violating Section 4741. This should not be attempted without competent legal advice. Dear Legislators:Thanks for the help this year. Now, how about letting HOAs vote electronically???

We plan to install an alcove-type shower or tub/shower unit. We also want a glass shower door in place of a shower curtain. What glass door choices can work for us? – Beth Answer: Upgrading to a glass door for a tub and/or shower setup can make a huge decorative difference in any bathroom, along with the convenience of using a glass door in place of a shower curtain. The door itself can also add value to the bathroom as well. Basic glass door choices for an alcove shower or tub/shower can include: Sliding tub/shower door: Two sliding glass panels for a bathtub unit that are also used for showering. Sliding shower doors: Same concept as the tub/shower door except designed for larger shower only units. Pivot shower door: Swinging or hinged door for smaller shower-only units. Finally, there is a new style concept called “bath screens.” This is again for tub/shower units. It’s basically a half-size glass tub door to partially enclose the shower area of the tub. Bottom line: Even when you add up the extra costs, upgrading to a glass shower door can be a clear choice to make.

Here are some top tips: Do’s 1. Do be very thoughtful and careful with your selections, as opposed to choosing items randomly. 2. Do look for similar colors, finishes and tones. 3. Do incorporate elements such as greenery and blooms to help add interest and texture. 4. Do use bins and baskets when looking to fill larger areas on shelves. 5. Do use books to help act as filler. A popular design technique is to pair books of similar colors together, wrap books or turn books spine side in. Don’ts 1. Don’t be afraid to use contrasting colors, dark items on a light-colored shelf for example can really help provide an inviting accent. 2. Don’t overdo it. Less is more. 3. Don’t forget that shelving can also bean opportunity to highlight a curated selection of collectibles. 4. Don’t be afraid to leave shelves empty. Instead intentionally leave certain shelves bare when looking to create a visual sense of rhythm. 5. Don’t overlook interesting ways to create shelving, such as using skateboards or reclaimed wood placed on brackets. 1031 Tax deferred exchange safe for now For the past year the real estate investment community has feared that, among other things, the 1031 Tax Deferred Exchange could be on the chopping block under a Democrat administration. First, a quick primer on 1031 Exchanges. The tax-deferred exchange, as defined in Section 1031 of the Internal Revenue Code allows a property owner to sell their investment property and defer the taxes that would normally be due upon that sale. In order to fully qualify an owner must; (a) acquire “like kind” Replacement Property that will be held for investment or used productively in a trade or business,(b) purchase Replacement Property of equal or greater value,(c) reinvest all of the equity into the Replacement Property, and(d) obtain the same or greater debt on the Replacement Property. Debt may be replaced with additional cash, but cash equity cannot be replaced with additional debt. Additionally, the Exchanger may not receive cash or other benefits from the sale proceeds during the exchange. When the Biden administration took office, there was a lot of talk about doing away with the 1031 Exchange system in an effort to raise additional taxes. This would affect a large number of small “mom and pop” investors who bought investment properties as a way to build wealth for their families. If the exchange option were eliminated then any appreciation in the value of the investment property would have been taxed upon a sale. There would be no way of further deferring those taxes through reinvestment. This would cause the number of sales each year to plummet and the value of properties to drop as demand for investment properties would have dried up overnight. Throughout the summer and into the fall negotiations were being held that would decide the final form of the multi-trillion dollar economic plan. Politicians spent weeks moving things on and off the table and only over the past week or so did the final framework come together. Members of the House Ways and Means committee sent out letters recently to their constituents letting them know that Section 1031 of the Tax Code was safe. While the bill has yet to be finalized and voted on, we can be assured that the Tax Deferred Exchange is safe, for now at least.

How to handle emergency tree service By Paul F. P. Pogue When storms roll in, damage trees and drop heavy branches in your lawn, you need to address the problem as quickly as possible. This is even more important if a stormdamaged tree poses an imminent threat to your home or property (or someone else’s!) Experts recommend you follow three steps when storms cause tree damage: 1. Make sure everyone in the house and around it is safe. 2. Contact your insurance company for guidance. Your agent can explain how your policy covers tree damage and if they have specific steps you must take to be covered. 3. Contact a tree service company to do the work as quickly as possible. Even if you don’t have a fallen tree, you could have a dangerous situation when a storm hits. Once high winds have died down, take a walk around your property and inspect the trees for telltale signs of damage. Check carefully for dead wood, deep splits in the bark, signs of decay and weakened branches. If you see something that concerns you, contact a professional. Fortunately, many tree service companies offer emergency service and 24-hour phone lines, so you should be able to reach someone quickly. Different states and cities have their own regulations regarding who can work on trees, and some areas have no regulations at all. Make sure whoever you hire holds all the licensing needed to do this work. In an emergency, it can be tempting to hire the first person who returns your call. But with trees and branches, a poorly

executed job can be more dangerous than no job at all. In addition, accreditation with the International Society of Arboriculture or the Tree Care Industry Association demonstrates a company or individual who takes their work seriously. Most tree removal jobs cost between $400 and $1,200. Larger and more complicated jobs might come closer to $2,000. Several factors will impact this cost. Tree size is the most important, followed by how much space your pro has to work. If they have to work around nearby power lines or close to the home, it will take longer to complete the job. This cost doesn’t always include stump removal, which can run between $100 and $400 on its own. Of course, depending on the problem, you might not need to remove the tree entirely. If a tree has been seriously damaged but remains standing, a tree professional can reinforce it with bracing or carefully trim damage to preserve the tree’s main body. One more thing: Insurance and legal liability can get extremely fuzzy when a tree or branch falls from one property into a neighbor’s yard. In many cases, the property owner where the tree actually landed might be liable for damages and removal unless the tree fell due to negligence on the part of the property owner. By Cathy Hobbs There’s lemon and lime as well as orange. So-called citrus colors can add warmth and energy to nearly any space. Often, they will help instantly brighten and lighten, and can even help to mimic sunshine in dark spaces. Not sure how to introduce citrus colors into your home? Here are some top tips. 1. Use yellow and yellow-based tones in spaces that receive little to no light. These colors can help mimic sunshine. 2. Do mix citrus colors in the same space. Lemon and lime for example can be a fresh, clean color combination. 3. Pair citrus colors with colors with deep undertones such as black and charcoal to create an element of luxury. 4. Use citrus as accent colors such as pillows, throws and accessories. 5. Consider using citrus colors in spaces where you want to create a sense of warmth and coziness. 6. Use tints, tones and shades of citrus if looking to create a more monochromatic color scheme. 7. Use pops of citrus colors to add energy and interest to neutral spaces. 8. Bring citrus colors in unexpected ways such as artwork and textiles. 9. Blend citrus colors together in spaces where you want to create a sense of whimsy such as a children’s bedroom or family-friendly space. 10. Don’t be afraid to incorporate citrus colors in various parts of your home from kid spaces to living rooms.

Perfecto Mundo Double Purple and the lime green of the anise form a perfect fall partnership at The Garden Guy’s house.

Photos courtesy Norman Winter/TNS Mid-October and 44 degrees sent me out into the landscape to scout for camellia blossoms, but instead I was mesmerized by the azalea flowers. My front yard is about a halfacre, requiring an adventure with a slope, so I am often failing to do due diligence not only with maintenance but photography, too. I don’t know what surprised me the most — was it the huge carnation-like blossoms of Bloom-A-Thon Double Pink, or the pure exquisite nature of Perfecto Mundo Double Pink and Perfecto Mundo Double Purple? Both Perfecto Mundo varieties looked as though they were made of pure porcelain. I planted really small plants two years ago, and this year was like their coming out party. The blossoms are smaller than the Bloom-AThon, but azalea lovers everywhere will have to have these reblooming varieties, too. They will literally offer months of bloom. I am delighted with my combinations, though I have to confess one was sort of an accident. I planted the Perfecto Mundo Double Purple with a lime green anise shrub. The lime green foliage and purple touching in marriage is ever-so striking. My accidental
These azalea are Perfecto Mundo in your landscape combination occurred with Perfecto Mundo Double Pink and Rockin Deep Purple salvia. I just never considered the blooming sequence, especially since the azalea was small at planting. Right now I love it, but it is possible the salvia will have to be moved later. The Perfecto Mundo series has now grown to six with the addition of Perfecto Mundo Double Dark Pink, Double White, Red and the ever-so exciting Orange. We are talking about a flaming orange, too! In addition to being a little more compact at 3-by-3 feet the Perfecto Mundo series has another trait that will put these on your must-have list, that being a resistance to lace bugs. In the backyard it is the Bloom-a-Thon Red that has been stealing the show. It bloomed in the spring, rested and then started again in the summer. I took my first summer photo July 9 of them blooming with Autumn Frost hosta. They have been blooming every day as we now head into late October. The Bloom-A-Thon series also from Proven Winners comes in five colors, Purple, White, Red, Hot Pink and carnation-like Double Pink I mentioned earlier. Bloom-A-Thon azaleas are recommended in zone 7a-9a, while the Perfecto Mundo series exhibits a little more cold-hardiness and is recommended for zone 6b-9. Both should
be planted in fertile well-drained acid soil. The Garden Guy makes it a practice to incorporate organic matter into all azalea shrub beds. Add a layer of mulch after planting and again each year. The azalea keeps the roots near the soil surface, and this annual decomposition of mulch and organic matter will maintain a good environment for new roots and help in moisture retention. I have mine in a part sun area that is shifting throughout the day. They do have the ability to tolerate quite a bit of sun. These azaleas really do best in a filtered light to part sun area particularly in the south. I like them planted in curvy informal sweeps or clusters with odd numbers versus the formal toy soldier look. In the backyard, in addition to variegated hostas, The Garden Guy has a dream of having both Bloom-A-Thon and Perfecto Mundo partnered with hydrangeas. My goal is to one day see azaleas bloom alongside the iridescent blue mophead shaped hydrangea blooms. It could happen! So yes, you can have a glorious spring azalea bloom and follow it up with an extralong, late summer to fall bloom too, when you grow Bloom-A-Thon and the new expanded Perfecto Mundo series of reblooming azaleas. Fall is a great time to plant!

Is a fire pit a good idea for my backyard? By Paul F. P. Pogue A fire pit is a perfect addition to your backyard for gatherings after dark. After all, the bright glow and the warm crackling of the fire is the ideal backdrop for a lovely evening’s entertainment. They’ll bring beauty to your outdoor space and perhaps make your home more attractive when it comes time to sell. You can build the pit yourself or hire a professional to do the work. A DIY fire pit kit usually costs between $200 and $400. This will include stones or pavers to build the structure, a steel ring the frames the interior, and lava rocks to line the floor. A prefab fire pit is usually the least expensive option, and it’s easier and faster to assemble. However, they don’t tend to last as long as custom-built fire pits, and you don’t have a lot of options to customize. If you hire a landscaping professional to construct a fire pit, the cost will average around $700, although high-end pits will set you back more than $1,000. The biggest advantage of hiring a pro is that you can customize it exactly to your style and needs. You might install a classic circular stone pit with red rocks for an earthy look, or a rectangular gas-fueled pit with glass crystals for a modern, sophisticated look. Take care that whatever materials you use are capable of handling the high temperatures. Some kinds of concrete and glass could crack or explode under the heat.

Most fire pits use firewood or charcoal as fuel. However, you can also install a gas line or electric flames for a customizable, turnkey fire source. Since these involve running extra electrical or gas lines, the cost will go up accordingly. You can also use propane tanks. When installing a pit, consider adding other fixtures to enhance its use. For example, a permanent sitting wall around the pit provides more ideal seating than folding chairs in many cases. Stay safe for the holiday (and the rest of the year!) While we’re thinking about fire pits as Independence Day nears, it’s an excellent time to take stock of fire safety measures. Whenever you have an active fire going in a pit or fireplace, or if you’re lighting fireworks, make sure you have a fire extinguisher nearby. An extinguisher is an essential tool of home safety and can be purchased for a reasonable price. It’s a good idea to have one fire extinguisher for every floor of your home, in an easily accessible place. The kitchen should always have a fire extinguisher nearby. Fire extinguishers are rated by class. In most cases, the best extinguisher for a home is an ABC model, which works on ordinary combustibles, flammable liquids, and electrical equipment. Make sure everyone in the household knows where the extinguisher is and how to use it.
