Adaptive Reuse in Commercial Real Estate Adaptive reuse is not a new concept in commercial real estate. It is the practice of taking an existing building and repurposing it for a new use. This means renovating an existing building rather than demolishing it and building something new. In the past, we have seen single property assets in urban areas utilize this approach of neighborhood renewal. There are rules that we have to abide by in order to consider something as an adaptive reuse. The first is that you reuse all or a substantial portion of an existing structure. Tearing down a building and putting up a new one is not an adaptive reuse. Secondly, the existing structure has to have had some kind of functional or economic obsolescence. We see this with structures such as abandoned mills, factories, malls and other structures that have outlived their usefulness. Finally, there has to be a change of use. You cannot just put like for like in a renovated structure. We see examples of this with residential housing going into old industrial lofts or retail and experiential uses going into old manufacturing areas. Santa Barbara has experienced adaptive reuse over the years. The Funk Zone is probably the best example of adaptive reuse. An entire neighborhood has sprung up out of older industrial properties. A series of properties and buildings were repurposed for wineries, breweries, restaurants, artist enclaves and soft goods retailers. This kind of adaptive reuse is the future. This 2.0 version of adaptive reuse will seek to transform entire neighborhoods and not just single buildings or assets. It is a re-examination of our communities to reposition them for change. It is this kind of scenario that we could also see play out for an increased amount of housing in our downtown or core areas. For property owners and developers willing to take the risk and with support from local governments who see the benefit of an evolving landscape versus the continued decline of an area there will be possibilities for new ideas and solutions. We are in the midst of a sea change in our concept of cities. With new technologies pushing driverless vehicles, the increased need for affordable housing in our urban areas and the still developing changes in our lives from a pandemic now is the perfect time to explore the concepts of adaptive reuse throughout our communities.

New Laws Approved for 2022 Part III - Major Housing Reforms — Dismantling HOAs? By Kelly G. Richardson, Esq. CCAL In recent years, the Governor and Legislature have made increasing California’s housing supply a high priority. This year saw several major bills signed into law, easing the creation of further housing density. Two bills in particular, Senate Bills (SB) 9 and SB 10, seek to increase infill density by encouraging more residences on properties that presently are used as single-family lots. If such bills are attached to HOAs, it could literally destroy the foundation of such communities. SB 9adds two new sections to the Government Code: Sections 65852.21 and 66411.7. These sections will start in 2022 requiring cities and counties to allow lots of 2,400 square feet (or more in size) to be split into two lots and allow two dwellings on each lot. Such lot splits are to be handled “ministerially,” meaning without hearings. The new units must be at least 800 square feet in size and one parking space per unit may be required unless the property is within one half mile of a “high quality transit corridor” or a major transit station. A “high quality transit corridor” means an area in which during peak hours a bus stops at least every 15 minutes. SB10 creates a new Government Code Section 65913.5, permitting local governments to adopt zoning ordinances allowing construction of up to 10 residential units on parcels located in “transit-rich areas” or “urban infill sites.” A “transit-rich area” is defined by the statute as a parcel that is within a half mile of a major transit stop (bus station, rail station or ferry terminal, or the intersection of two high quality bus corridors), or is a parcel located directly on a high-quality bus corridor. If the local government adopts such an ordinance, it must issue a map so that property owners can clearly know if their property is within this ten-unit zoning area. Could SB 9 and SB10 result in your next-door neighbor splitting their lot and adding three more residences, or creating a ten-unit apartment or condominium building next door to your home? Under

these statutes, the answer is yes. A policy decision has clearly been made in Sacramento that housing supply is more important than preserving the quality of life in residential neighborhoods. Do these changes affect all neighborhoods? What about HOAs, which normally require that properties be used for “single-family residential” purposes? Senator Toni Atkins, the author of SB 9, issued a public letter on August 30, 2021, stating her belief that the lot split and “two-on-alot” provisions of SB 9 would not override HOA governing documents. That letter is not legally binding but does give some comfort to planned developments with lots of at least 2,400 square feet. SB 10 eases zoning for mini-developments, but unlike SB 9 is not mandatory. Common interest communities (aka “HOAs”) are attractive to homebuyers because of quality standards, architectural conformity, higher maintenance standards and other restrictions preserving a certain quality of life for owners within the community. At the same time, legislation increasingly limits the ability of communities to make their own decisions about their community (such as last year’s enactment of Civil Code 4741 regarding rentals). Planned development associations should check with their legal counsel to confirm their CC&Rs contain “singlefamily residential” requirements.

Can’t Move Mattress Upstairs Question: I am a SBCC student and have just moved into a new condo which has a very narrow stairway to the upstairs master bedroom and despite the efforts of my movers there is no way that my box springs mattress will go up the stairs! The movers even measured the upstairs windows hoping they could lift in through an upstairs window which are not large enough either. I don’t sleep well on a small bed and I’m desperate to get settled into my new place. How can I get the box springs upstairs so I can finally get a good night’s sleep? Answer: This is a fairly common problem that comes up on moving day every month and there is a last resort solution if all others fail, which is cutting and folding the box springs. This may sound a little extreme, but the box spring mattress is essentially what the name implies; a wood framed box that is filled with springs, upholstered on the top and sides and usually covered on the bottom with a light fabric liner. The first step is to remove the fabric bottom liner to reveal the wood box framing, carefully cut the wood box in the middle of the bed, and then fold the box springs in half like a book to carry up the stairs. Unfold it in the bedroom and then by using small lengths of boards as splints, screw these boards across where you cut the frame and your box springs will be fine when set back in its metal base frame. However, you will have an unsightly cut in the side upholstery of the mattress which can be hidden with bedding.

New Clothes Dryer? Question: My mom’s clothes dryer seems to be running fine, but it takes forever for a load of laundry to get dry. It isn’t all that old and she says it was working fine up until recently. Is it time for a new dryer? Your Handyman: It sounds like your mom’s clothes dryer is due for a lint cleaning. Even for a household with just one person doing laundry, lint will build up in both the dryer and in the dryer vent causing the dryer to work much less efficiently and sometimes creating a fire hazard. Clothes dryers clogged up with lint are a major cause of house fires in the United States and are easily prevented by a periodic thorough cleaning of the inside of the dryer around the motor and heat exchanger, and of the exhaust vent done with a long brush. The exhaust vent should be a flexible metallic tube not plastic and should not have any kinks or large dents that will restrict the flow of hot air away from the dryer. We clean dryer vents on a regular basis and people are often amazed at the amount of lint that has accumulated. After a good lint cleaning your mom’s dryer should work just fine and she should put the next cleaning on her calendar about 18-24 months out if she tends to do a large amount of laundry.

Hydrangeas a harmony of colors await you in 2022

By Norman Winter A new look at Hydrangea Harmony of Colors may be just what you need as you plan your garden for 2022. You’ll see that it not only adds beauty to the landscape, it energizes and excites you and suddenly everything you do in the garden seems fun. You probably have heard about basic colors schemes like monochromaticism, blends of similar colors, complementary colors, and the old adage of opposites attract, or one selection from the hot side of the color wheel paired with its opposite from cool side of the color wheel. When it comes to the new riotous colors of today’s hydrangeas, you can open up that color scheme door to include triadic and even quadratic harmony, three or four colors equal distance apart on the color wheel. This is all about knowing your hydrangeas and picking out partners. My fun started almost three years ago with the arrival of Let’s Dance Rave hydrangeas that were bred for extra cold resistance up north but were like an electrical charge of color for those of us in the South. Electric blue and purple mauves you didn’t know existed suddenly became available for garden partnerships. I asked my color design guru son if his clients thought about combinations with their blue or purple hydrangeas, and the answer was

only a couple. The old-fashioned way is simply to plant them as stand-alone shrubs. Here you find the impetus for this column. At the beginning I referenced knowing your hydrangeas as to their color. In reality, this is also like knowing your soil pH and how it varies across the landscape. In my backyard, a hydrangea can be electric blue, telling me the soil is very acidic. The same variety in purple 10 feet away is less acidic. Up the hill in the left corner are some Wee Bit Giddy hydrangeas, new this year from Proven Winners with shocking red pink blooms. I expect it to change over the years, but who knows about this old hill. Wee Bit Giddy provided me with my most outlandish monochromatic partnership of 2021. The Garden Guy interplanted Heart to Heart Tickle Me Pink caladiums. Since I had never grown either, the result was beyond all expectations. Blue violet colors or flowers with blue and violet mixed together have always stirred me. It’s like this is a magical blend maybe only fit for royalty. Sometimes I even think this marriage only occurs by accident, but I am sure the great designers intentionally make it happen. So when a Let’s Dance Rave hydrangea, Rockin Deep Purple salvia and Superbells Double Blue calibrachoas came together in my garden in a monochromatic blend, I had

a state of euphoria. An intermingling of Goldilocks Creeping Jenny gave a finishing touch of chartreuse. Proven Winners is debuting Soprano impatiens in 2022, which, by the way, are still dazzling now in November. These little orange and violet shades workhorses allowed me to create a triadic blend of color with the lime green foliage of Rockin Golden Delicious salvia and blue hydrangea blossoms. This filtered light garden has held its interest since June. One of my favorite combinations of 2021 mimicked a wildflower meadow against the blue hydrangeas. Obviously, the hydrangeas were in the shadiest part of the grouping, while Uptick Coreopsis and Evergold Carex grass grew in the sunnier front. Superbells Tangerine Punch calibrachoas and Soprano Orange impatiens were at the left flank. If you just don’t know where to start in your hydrangea partnerships, consider some of the Shadowland series of hostas. These are guaranteed to make dazzling partners. The Garden Guy in pursuit of hydrangeas and azaleas blooms together just planted the new Perfecto Mundo Orange azaleas in front of Tuff Stuff Ah-Ha, mountain hydrangeas that always have long-lasting huge blue blooms. Wonderful hydrangea partnerships await you for 2022. The Garden Guy hopes you will jump on the bandwagon and let your imagination flow.
