A note from the SBAOR President By Staci Caplan President of the Santa Barbara Association of REALTORS®
Honoring the Legacy of Toby Bradley This week the real estate community lost a great leader and friend when Toby Bradley passed away on November 15. Toby served as President of our local Santa Barbara Association of REALTORS in 1992, and then went on to become the second female Treasurer for the California Association of REALTORS (CAR) in 2000 and 2001. When she served as CAR President in 2003, her mission was to create cultural diversity and inclusivity within the organization. Most notably, Toby was the founder of CAR’s Housing Affordability Fund (HAF), a legacy which has grown and helped many into home ownership. Every year since its inception, REALTORS have donated to the fund, and this year the CAR Board of Directors contributed an additional $1,000,000 to further the HAF mission. Toby served extensively as a CAR and NAR Director, serving on many committees over the years, most notably on Taxation and Government Finance. I remember being inspired by her as a newer CAR Director when observing Toby speak so passionately and eloquently at the microphone. She was so persuasive and influenced many positive outcomes. In fact, according to Bob Hart, our local SBAOR CEO, Toby was a proponent of tax portability long before the recent passage of Proposition 19 on this year’s ballot. According to Diana Bull, another SBAOR and CAR past President/ Treasurer, “Toby was highly respected at the National Association of REALTORS for her keen knowledge of real estate tax and finance legislation. We often debated strongly with each other on many issues, and then went out to dinner to laugh and share champagne!” Toby became a REALTOR in 1979 and created many friendships with clients and colleagues alike. Her Broker, Renee Grubb of Village Properties states, “She was so smart and such an asset to our real estate profession. If you did not know Toby you really missed out. She was such a caring person.” She was highly respected throughout our nation by many REALTORS and will be missed.
Who Decides on the HOA Colors? And, A Neighbor Hates Mine. By Kelly G. Richardson, Esq. CCAL
Mr. Richardson: Help! During a monthly meeting, I presented a petition signed by many homeowners concerning the color that they were going to paint the complex — we wanted a newer look. They wouldn’t consider the petition, saying that the subject had already been decided. Shouldn’t the board take into consideration what a goodly number of owners want? T.W. Dear Kelly: In my complex, we’ve had the same color of exterior paint for all the years the complex has existed. Our board is proposing/attempting to change the color. Can the board to do that without input from the homeowners? M.S. Dear T.W. and M.S.: On the question of whether a board must seek member input on keeping or changing the color scheme there is a “yes and no” answer. Normally, decisions about maintaining the association property are made by the HOA board of directors. Those decisions can occasionally be limited by the HOA governing documents, such as if a rule specifies the approved exterior building colors. Without some other specific restriction in the governing documents limiting board discretion regarding colors, technically, yes, the board could make the decision without seeking member input. However, even if a board is not required to present the issue to the community for member input, it should do so. If the board abruptly decides to completely change the HOA’s color scheme, it could be very upsetting to the membership and result in bad feelings against the board and even association upheaval. There are times when a board should pause and take time to present

its plans to the community before forging ahead, and this is certainly one of them. The board’s most basic duties are to protect, preserve, and maintain the HOA property. However, boards are not required to improve the property. Making a major change to the colors could be controversial — and that will be learned through presenting the idea to the members and listening. So, “must,” no, but “should,” yes. Best, Kelly Kelly: My HOA approved a certain trim color on my house approximately 20 years ago. In the meantime the color faded and I recently repainted the house and the trim came out a little brighter. Although some neighbors complimented me on the paint, one person mentioned his distaste in an insulting and hostile anonymous letter to me. I have unsuccessfully asked the HOA for copies of any complaints for the sake of verifying that these people are actual members. Should I be bullied by some unidentified coward? M.G. Dear M.G.: Since the HOA approved your trim color change, this means the HOA approved your paint color, and so long as you stay within the scope of that approval you are complying with your association architectural standards. Some HOAs have rules requiring disclosure to neighbors in advance of esthetic changes to a residence, but your’s does not. A neighbor’s complaint letter is not a document that you have a right to see. In my experience, you probably don’t want to see it — it will just be upsetting. The neighbor has a right to their opinion, but so long as you stay within the HOA’s approval, it is just that — an opinion. Sincerely, Kelly

Question: A friend of mine used to work as a handyman in the town that I grew up in and would tell me stories about all the unusual and varied jobs that he would do. What is the most unusual job that your handyman company has done? Your Handyman: I think one of the most attractive aspects of the handyman business is the many different types of jobs that you do in a typical month. Many trade’s people who have worked as or for a general contractor much prefer handyman work versus spending often as long as 18 months or more working on a custom home where different personalities in the crew can start to create friction. We have done all sorts of unusual jobs involving installing many types of artwork and sculptures into difficult locations, slogging around in waist deep mud to repair water lines, and performing all types of finish carpentry in the many beautiful homes of Santa Barbara. But the job that stands out as the one that we probably won’t repeat was helping a senior lady with the interment of her beloved pet dog. The lady lived alone, was quite frail, her canine companion of many years had died, and she wanted the pet buried in her backyard. One of our technicians carefully laid the dog to rest, and then said a few words about the dog at the lady’s request.

Depending on its usage, how a sofa is made, may be a key factor in how long it lasts. In general, nothing beats all hardwood construction. A sofa constructed of low-grade wood or particle board simply will not last as long as one made from solid hardwood. Another key component is ensuring that springs or coils are well made and the frame is well cushioned and wrapped prior to upholstery. Need a durable fabric? A popular designer choice is commercial or hospitality grade fabrics that repel liquids and stains while remaining attractive and aesthetically pleasing.
