Old CC&Rs – Expired Documents, and Who Owns the Yards? By Kelly G. Richardson, Esq. CCAL
Kelly, I wanted to know if you have any information in regard to the expiration of California CC&Rs. I’ve heard 20 years from the time of the recorded filing of the CC&Rs. I ask because I live in a subdivision development of homes that has no common areas but does have an HOA in which the developer transferred the CC&Rs to the HOA and homeowners. The CC&Rs don’t show up in the San Mateo county recorder system and I can only find a single change in the CC&Rs back in 1986. I need to confirm whether the HOA should have renewed and recorded the revitalization of the CC&Rs as they are over 30 years old. Any information would be appreciated. – O.M., Dear O.M.: In past years, real estate attorneys included expiration dates in CC&Rs because of the “rule against perpetuities,” an old legal rule which required a termination date. Although the passage of the Davis-Stirling Act in 1985 may have eliminated that concern, lawyers these days typically write CC&Rs with periodic automatic renewal so the HOA is covered in case a future court rules that CC&Rs still must have termination dates. If CC&Rs expire, the association no longer falls under the Davis-Stirling Act, which could be a horrible problem particularly for a condominium property. To reimpose expired CC&Rs, one would need 100% written consent not only of all the owners but also all the mortgage lenders – a very difficult task indeed. Older HOAs (‘80s and earlier) should check their CC&Rs and ask members to vote to amend and include automatic renewal, to avoid the possible disaster of expired CC&Rs. – Best, Kelly
Kelly, Thank you for your articles. I have a question regarding property ownership. Our small complex is a condominium, and we have free-standing houses each with a yard. Our condominium plan has a tract map with boundaries that include the unit with the front yards/ patios along with a description that a unit consists of the dwelling, garage and private yard areas encompassed by the unit boundary line shown on the plan. This might be in conflict with other language in the CCR’s. One owner is of the opinion that based on the tract map that this is his own private yard and he owns it. It is my opinion that this is a condominium and that he doesn’t own the land. However, it is exclusive use common area with input on the project by the HOA. Thank you for any direction you can provide. – R.A. Dear R.A.: Some subdividers create condominiums in which the unit is not the typical airspace block “surrounded by the unfinished surfaces of floors, walls, and ceilings,” but in which the unit appears to be a piece of land. I call those “lot line condos,” which can provide subdividers a way around zoning setback and minimum lot size requirements. Have an HOA attorney look at the CC&Rs and condominium plan to provide guidance on this. Also, just because the yard possibly is part of the unit does not mean the HOA has no say in how it is used or maintained – the CC&Rs normally would apply to the units and common area. – Appreciative of your question, Kelly

What should we do to force tenant to leave home we sold? By Gary M. Singer
Questions We have a monthly tenant in a house we decided to sell. We have her first chance, but she could not qualify for financing. We found a new buyer and gave our tenant 30 days’ notice to move out because the buyers want to move in. We are a few days from closing, and our tenant is not packing and does not seem to have any intention to leave. What can we do? – Violet

Since your tenant is on a month to month lease, you provided more than the required 15-day notice you are not renewing the lease for another month. This terminates the monthly lease allowing you to file an eviction lawsuit to have the tenant removed. Be careful not to accept more rent after termination because doing so will start a new lease, and you will have to begin the cycle again. While filing an eviction suit eventually will get your tenant out, it may not occur for several weeks. A landlord may not force their tenant out by, for example, cutting power or changing the locks, and must wait for the lawsuit to take its course. While this will eventually work, your buyer will be upset and may even have trouble with their mortgage financing if the eviction drags out. You can take a more pragmatic approach. Start by talking with your tenant to see the issue. She may not have the money to move or be having trouble finding a new apartment. I have found that many people jump right to a dispute and skip over potentially easier solutions. Once you discover what your tenant’s hold-up is, try to address it. If the problem is not finding a new rental, help her look. If she needs help with moving expenses or the extra expense of starting a new lease, writing your tenant a check may be quicker and less expensive than writing one to your attorney or paying the mortgage while finding a new buyer. Just be sure to get the arrangement signed and not give her all the funds until she is out of the house. Gary M. Reinforce Existing Fence Question: We live on the Mesa and our wood fence is as old as the house and is precariously leaning downhill towards our neighbor’s home. The fence is built on the top of a small cement block retaining wall in our neighbor’s yard, and it is also in bad condition and should be rebuilt. The problem is that our neighbor is not interested in replacing either the retaining wall or fence even if we pay the entire bill. In the meantime my husband and I are worried that our fence is going to completely fall down and then we will have no privacy at all in our backyard. Any suggestions?
Your HandYMan: You have probably heard the old adage that “Good Fences Make Good Neighbors�. Being on a friendly basis with your neighbors is important but having the private use of your backyard is just as important. Many of the homes on the Mesa were built in the 1960’s and 50 years is a long time for your wood fence to survive the effects of weather, termites and dry rot, and it’s probably past due for replacement. However if the fence is supported by a crumbling retaining wall that your neighbor will not
allow you to rebuild, then it makes no sense to spend the money to build a new fence that may collapse when the retaining wall finally gives way. It sounds like the only realistic option is to install several metal support posts on your side of the fence that are set in concrete and then attach them to the fence with metal deck screws. This should support the old fence for at least a few more years or maybe even more. The expense of installing or maintaining a fence that sits on a property line is usually shared by both neighbors but often one party either can’t afford the expense or just doesn’t want to cooper-
ate. Hopefully, your neighbor will come around sometime in the near future, be more cooperative, and maybe even agree to share the expense of both a new retaining wall and a new fence. By Cathy Hobbs When you think of traditional color combinations, what typically comes to mind? Perhaps neutral colors such as black and white or tan paired with brown. Pairing the right colors together can add interest while also creating an inviting space. Afraid to experiment with different color combinations? Here are some top tips. DO Pair strong foundation colors together such as white, black and gray. Incorporate a pop of color with your color scheme. Consider unexpected, versatile base colors such as indigo or chocolate brown. Use contrast elements and pair light and dark colors. Use citrus colors such as orange, yellow and green in spaces in which you are looking to capture the eye and add interest.

DON’T Be afraid to use jewel or metallic tones to add color and interest. Pair the same tint, tone and shade of a color in the same room when looking to achieve a vibrant sense of color. Using contrasting colors will have more impact. Forget to incorporate color through the use of artwork and accessories. Use overly dark colors as a wall color. White or light base colors will help make other colors pop. Forget classic color combinations such as red, white and black. Some color combinations can stand the test of time. Whether you have a long wall you wish to highlight, a ceiling you want to elevate or bold design statement you’d like to make, placing artwork or mirrors in a series or with the use of symmetry may do the trick. Here are a list of do’s and don’ts. Do: Use identical pieces of art to create a diptych (two pieces of art in a series) or a triptych (three pieces of art in a series). Use mirrors in a series or grid in spaces that may not have a lot of windows. Be aware of mirror placement, especially what objects may be reflected. Look for opportunities for drama, especially opportunities to elevate or highlight ceiling heights. Consider neutral color in modern environments such as black and white. Don’t: Mix too many materials, sizes and shapes.
Identical pieces tend to work well for a minimal look. Ignore the power of white. White framed artwork and mirrors may be desirable if you’re looking for items that feel integrated and blended. Hang artwork too high or too low. A rule of thumb is artwork and mirrors should be hung at average eye level height (5 feet above the finished floor to the center of the artwork). Overlook the opportunity to make a statement with finishes such as brass. Forget the power of symmetry. Lantanas lead fall garden fest celebration By Norman Winter If the plant world celebrated Oktoberfest, lantanas would be front and center leading the party. As far as The Garden Guy is concerned, it could be a fall lantana fest. Now don’t get me wrong they were among the toughest, perseverant performers of the long hot summer. But come September and October, the relief from torrid temperatures brings the lantanas even more blooms, richer colors and lusher foliage. They too seem to be in celebration mode. I know many of you are already seeing snow and freezing temperatures. If you are happy I am happy for you. If you are lamenting this sudden change in climate then head south, we would welcome you with open arms. Here in Columbus, Ga., the last week in October, the butterflies are abundant and the hummers are feeding on lantanas getting fat for the long trip to the tropics. The landscape floral show is mesmerizing; could these lantanas really be so beautiful? I say that while thinking of Luscious Grape. Not the fruit, but the purple flowered Luscious Grape lantana part of an award-winning series. Luscious Grape is different from the others in the series, in that it is a Lantana montevidensis selection, native to South America. Luscious Grape is a multi-award winner in university trials. My son James has been using the variety for a number of years so I have grown accustomed to seeing them blooming from May until the first really hard frost. In baskets and containers, they are incredible. But the eye opener to me this year was his application where it tumbled over a wall, with cascades of purple blooms. Seeing a rare Zebra longwing butterfly feeding on it in my yard in October was my gold medal moment. It is not just Luscious Grape having a fall fest, but Luscious Marmalade with the fiery orange colors of a sugar maple and the new Luscious Golden Gate lighting up the fall landscape in dramatic fashion while bringing in a host of butterflies and bees. This helps with not only drainage but ideal root expansion with young plants. Plan on spacing your plants 2 to 3 feet apart depending on your variety selection. Every September, garden centers load up with mums that we enjoy for a few weeks. I would tell the industry don’t be afraid to offer us some blooming lantanas to partner with these mums. More than likely they will bloom longer and feed remaining pollinators too.
